  • AFGHANISTAN: ‘Our fight for accountability has become a thousand times harder under the Taliban’

    CIVICUS speaks with Horia Mosadiq, an Afghan women human rights defender (HRD) and founder of Safety and Risk Mitigation Organization (SRMO). SRMO aims to empower, support and protect Afghan civil society activists and organisations, including those working in remote and insecure areas, and to advocate for greater state protection and accountability for any abuses they suffer as result of their work.

    Horia has extensive experience in assisting HRDs at risk and providing human rights and safety training. She previously worked as the Afghanistan researcher for Amnesty International.

    Since the Taliban takeover in August 2021, Afghanistan has experienced a human rights and humanitarian crisis. Protests,especially by women, have been dispersed with excessive force, gunfire and beatings, leading to deaths and injuries of peaceful protesters. Journalists and HRDs have been threatened, intimidated and attacked and had their homes raided.

    Why did you establish your organisation?

    Along with two other dedicated activists, I established SRMO in 2013 with a mandate to protect HRDs and civil society in Afghanistan. We founded it because there was no mechanism inside the country to respond to growing threats against activists. I was an HRD at risk for many years and was totally reliant on international civil society organisations (CSOs) such as Freedom House, Front Line Defenders and Urgent Action Fund.

    But we wanted to set up something led and run by Afghans, by people who understood the situation on the ground and could respond to the needs of Afghan HRDs who don’t speak English and don’t have access to international platforms and organisations. The whole idea behind SRMO is to reach out and protect grassroots activists, especially those in volatile areas and without international access or funding.

    What does your research reveal about the current situation of Afghan HRDs?

    We recently published a report that contains two distinct sections. The first covers the situation in 2021 until 15 August, a time when the previous government was in control and there was an elected president in charge. A clear law enforcement system, a judiciary and other accountability mechanisms were in place. They were not anywhere near perfect or even responsive, but at least they existed.

    The second section covers the events following the Taliban takeover on 15 August 2021. The whole security situation in the country changed significantly and the republic of Afghanistan was gone. The Taliban operate on the basis of Islamic ideology and renamed the country ‘Islamic Emirates of Afghanistan’. There is no law-and-order system anymore. The whole system is run by a group of mullahs with no clear accountability. Nobody knows which laws they are implementing. There is a lack of clarity and a definite legal gap. In many instances they refer to Sharia law, although we don’t have a codification of Sharia, so it is all open to interpretation. This is the situation on the ground today.

    Following the Taliban takeover, attacks against HRDs have continued and nobody has been held accountable. Many HRDs have been killed, abducted, tortured and disappeared. Between January and March 2022 alone, SRMO documented 120 violations against activists, journalists and critics, including killings and kidnappings. Even medical doctors have been abducted by the Taliban.

    Many CSOs have had to shut down and media workers and journalists have faced numerous restrictions. We documented the case of a TV journalist who interviewed a critic of the Taliban, and right afterward he and his crew were arrested and tortured, and were only released after signing statements pledging not to reveal their treatment to the international community. Many activists who protested had their passports and IDs taken away so they couldn’t leave the country and expose the truth. Activism is still happening, but civic space is increasingly shutting down.

    Contrary to the general belief among the diplomatic community, the security situation has not improved under the Taliban. Although you may not hear about many bombings or active fighting in various parts of the country, the general security situation has deteriorated. Dozens of HRDs, journalists and others have been abducted, tortured, disappeared and detained unlawfully and without any explanation. The de facto authorities are part of an abusive system. The limited accountability mechanisms that existed under the previous regime are all gone. Now no one is accountable to anyone. Our fight for accountability has become a thousand times harder under the Taliban.

    How have you conducted your work following the Taliban takeover?

    Since August 2021, our focus shifted to reactive work to provide safety and protection to HRDs at risk and evacuate them from the country. The evacuations have since slowed down, but we also support the internal relocation of those at risk. We also provide humanitarian assistance to women HRDs, as many have lost their jobs and livelihoods. So as well as facing security threats, many have lost their means of surviving, paying for food and essentials required for their family. We have tried to support some minimal living costs where possible.

    What has happened to the activists who were evacuated?

    Those who were part of an organised effort undertaken by some countries and CSOs are being looked after while they resettle. But those who fled the country to Central Asia, Pakistan or Turkey experience an extremely bad situation as they run out of funds, their visas expire and there are no programmes for their resettlement. Many are pushed back by embassies or told they need to register with the United Nations (UN) Refugee Agency and that it can take years before they are resettled.

    Some with expired visas are even being deported back to Afghanistan. I just heard that Greece has deported 500 Afghans to Turkey, which sent them back to Afghanistan. In Central Asian countries people cannot get their expired visas renewed while in the country; they must leave to get a new one, which many HRDs are unable to do. This is making it difficult for them to survive. Many activists and journalists are facing ever-growing economic difficulties. They can’t pay for rent or food. Things are particularly difficult for those with small children. Many funders don’t provide resources for HRDs outside their country.

    What can the international community do to support HRDs in Afghanistan?

    I am disappointed with the international community. The way they have responded to the Ukraine crisis is very different from how they have responded to the situation in Afghanistan. They were open to receive millions of Ukrainian refugees, whose cases were processed within weeks. In contrast, only a few countries – including Canada, Germany and the USA – have been willing to issue visas to Afghans. This is not nearly enough, as thousands are currently stranded in neighbouring countries and in need of immediate help. If they can do it for Ukraine, why not for Afghanistan? Is it because of our skin colour or because they don’t view the Taliban as the enemy? There may be politics involved but I think there is also systematic racial discrimination. 

    More positively, the appointment of the UN Special Rapporteur on the situation of human rights in Afghanistan is an excellent step. At the moment there is a vacuum of human rights monitoring mechanisms. CSOs can only do so much and having someone working with a UN mandate and the support of the international community is key. The international community should provide the UN Special Rapporteur all the necessary financial and diplomatic support and his recommendations must be taken seriously and implemented.

    Our recent report includes a series of recommendations for the international community to put pressure on the Taliban to ensure accountability for crimes committed against HRDs and to provide financial, diplomatic and political support to Afghan HRDs at risk, including by issuing humanitarian visas and funding resettlement programmes. The international community should use its leverage to pressure the Taliban to create a safer space for HRDs and journalists in Afghanistan. This issue is currently not being addressed adequately at the international and diplomatic level.

  • ARMENIA: ‘As people leave their homes in search of safety, humanitarian organisations must support their basic needs’

    ShushanikNersesyanCIVICUS speaks about the civil society humanitarian response to the Azerbaijani blockade and military offensive against Nagorno-Karabakh – the disputed territory within Azerbaijan that until recently was governed by ethnic Armenians – withShushanik Nersesyan,Media and Communication Manager at People in Need (PIN) Armenia.

    Founded in 1992 bya group of journalists involved in the 1989 Czechoslovak ‘Velvet Revolution’, PIN is a civil society organisation (CSO) working in the fields of humanitarian aid, human rights, education and social work. Since it was established in 2003, its permanent office in Armenia has worked to strengthen Armenian people’s abilities to improve their lives and the communities they live in.

    How did the Azerbaijani blockade affect people in Nagorno-Karabakh?

    It all started in December 2022, when Azerbaijani civilians identifying themselves as environmental activists began obstructing the Lachin corridor, which links Armenia and Nagorno-Karabakh. In April 2023 Azerbaijan set up an official checkpoint that largely cut off the passage of people and goods between Armenia and Nagorno-Karabakh. Once it was under Azeri control, it was possible to use the corridor only in exceptionally urgent cases, through the intermediation of the International Committee of the Red Cross (ICRC) or Russian peacekeepers.

    On 29 July Azerbaijani authorities abducted V Khachatryan, a 68-year-old Nagorno-Karabakh resident who was being evacuated by the ICRC for urgent medical treatment through the Lachin corridor. Khachatryan remains in captivity. Another incident occurred in late August when three Nagorno-Karabakh students were captured by Azerbaijani border guards while travelling to Armenia via the corridor. They were only released 10 days later. Free movement of people to Armenia became impossible.

    The prolonged blockade led to a humanitarian crisis due to shortages of essential goods – including electricity, fuel and water – and the closure of basic services. People in Need, along with Action Against Hunger and Médecins du Monde France, condemned it but, regrettably, our efforts to open to road for the trucks with food to Nagorno-Karabakh were thwarted.

    The situation changed with the shelling that caused the deaths of hundreds of innocent people on 19 and 20 September. Since 24 September, over 100,000 people have fled Nagorno-Karabakh to Armenian regions, where they are also facing an emergency situation due to food and hygiene needs, plus longer-term issues of housing, education and jobs.

    How has Armenian civil society responded to the humanitarian crisis?

    CSOs including PIN deployed humanitarian projects to help blockade-affected people. CSOs conducted visits and issued statements. In Kornidzor, on the border, representatives from dozens of Armenian CSOs gathered during the blockade, urging the international community to uphold human rights and ensure the passage of humanitarian aid for civilians in Nagorno-Karabakh. The unimpeded delivery of essential goods, including food, hygiene items, medicine and fuel, as well as the unrestricted movement of people, including critically ill patients, are fundamental tenets of international humanitarian law.

    What work is PIN doing in this context?

    Since 1992, as a newly established organisation, PIN has been there to help people affected by the First Nagorno-Karabakh War, which lasted from February 1988 to May 1994. We have actively contributed to the growth of Armenian civil society, which has remained resilient throughout this crisis. We coordinate our efforts with the government and local authorities to closely monitor the situation on the ground and carry out numerous humanitarian projects.

    We continue assisting the most vulnerable populations. Since September 2020, we have provided essential humanitarian aid and long-term efforts for the social and economic integration of thousands of people.

    As a humanitarian organisation, we advocate for rights and a peaceful resolution of conflicts in adherence with international law. Along with our partners, we have expressed our concerns, called for measures to prevent the unfolding humanitarian catastrophe and continuously raised internal and donor funds to help people in need.

    When people started fleeing Nagorno-Karabakh, we immediately mobilised PIN funds to support the first recipient centre in the Syunik border region to deliver aid such as food, clothes and blankets to forcibly displaced people and create a special space for children’s activities while their parents dealt with registration and searching for accommodation. Additionally, we launched the SOS Armenia appeal and new humanitarian assistance projects funded by the Czech Ministry of Foreign Affairs, the European Union, the Netherlands Refugee Foundation, Start Network and USAID.

    As people continue to leave their homes in search of safety without being able to take their belongings, humanitarian organisations must continue providing assistance to support their basic needs.

  • ARMENIA: ‘Lack of compelling international action allowed the attack on Nagorno-Karabakh to occur’

    Founded in 2022, the CEECCNA Collaborative Fund is a feminist fund that mobilises sustainable resources for social justice movements across the CEECCNA region.

    What is the current security and human rights situation in Nagorno-Karabakh?

    The ethnic Armenian population of Nagorno-Karabakh was forcibly displaced within days of the Azerbaijani government launching a full-scale attack on 19 September. A week later, 100,632 people had arrived in Armenia, having left behind their homes, their belongings and the lives they had built.

    Several actions deliberately targeted against civilians occurred before the start of the ethnic cleansing of the Armenian population from Nagorno-Karabakh. In December 2022, Azerbaijan blocked the Lachin corridor, the only road connecting Nagorno-Karabakh with Armenia, leaving the 120,000 Armenians who lived there completely isolated. People endured nine months of severe food insecurity, fuel shortages, electricity outages, communications breakdowns and medical supply shortages. This resulted in a humanitarian crisis that put people, particularly those with vulnerabilities, at risk. Many pregnant women had miscarriages and stillbirths, people with chronic illnesses couldn’t receive their medication and treatment, and risk of infection increased due to the lack of hygiene products. These were just a few of the severe challenges people faced during the blockade.

    The Lachin road was reopened several days after the Azerbaijani offensive, when people, already traumatised and starving, experienced a direct threat to their lives. They had no choice but to leave their homes in search of safety in Armenia.

    Why did Azerbaijan initiate the blockade and military offensive?

    The nine-month blockade and the offensive were meant to achieve the ethnic cleansing of the Armenian population of Nagorno-Karabakh. The intentional deprivation of essential resources for survival followed by the direct attack to take over Nagorno-Karabakh, along with the creation of conditions for the Armenian population to leave, indicate that Azerbaijan is not contemplating any peaceful end to the conflict or human rights guarantees for Armenian people to feel safe in their homes and continue living in Nagorno-Karabakh.

    By leveraging additional threats against Armenians and Armenian sovereign territories, demonstrating its military power, and consistently introducing new conditions in the negotiation process with Armenia, Azerbaijan intends to assert its dominance. This approach reinforces a policy of hatred towards Armenians spanning decades and undermines the peacebuilding process between Armenia and Azerbaijan.

    How has Armenian civil society responded to the humanitarian crisis?

    Displaced people endured a journey of over 20 hours to reach Armenia, during which they had no access to food, water or sanitation facilities. As a result, most of them arrived thirsty, hungry and in need of medical attention. When they began arriving, local organisations, activists and volunteers were among the first to give them food, hygiene products and assistance to register for the state support system.

    Local civil society organisations engage in continuous needs assessments of displaced people, using dynamic data collection approaches, as the situation is changing rapidly. In addition to the immediate provision of goods, there are medium and long-term needs to address. Displaced people need psychological assistance to overcome trauma, sustainable medical support, permanent housing, access to education and employment and services to prevent and address gender-based violence.

    As part of the CEECCNA Collaborative Fund, we provide timely updates about the situation to our international partners and mobilise and direct resources to local organisations. Due to limited resources, Armenian civil society activists worked under a lot of pressure because they had to initiate fundraising efforts while simultaneously providing emergency response.

    The Armenian government has provided displaced people with one-time financial support, essential products and access to temporary accommodation. For all its good intentions, however, the government also lacks resources and capacity to provide adequate long-term assistance to displaced people.

    Has the international community’s response been adequate?

    The response has been slow and inadequate. A few months into the blockade, the international community refused to call the situation a humanitarian crisis and many turned a blind eye to the deteriorating conditions of Nagorno-Karabakh’s Armenian population.

    After numerous appeals and demands from civil society, some international agencies began releasing statements urging the Azerbaijani government to open the Lachin corridor. They mainly referred to the International Court of Justice’s orders of 22 February and 6 July 2023, which unequivocally mandated Azerbaijan to ensure unrestricted movement of people, vehicles and cargo along the corridor in both directions.

    Despite these decisions, the road remained blocked. A group of four United Nations experts also expressed their concern about the continued closure of the Lachin corridor and called on the Azerbaijani authorities to promptly reinstate unimpeded and safe movement along the road, as stipulated by the November 2020 ceasefire agreement.

    The lack of more compelling action by the international community created an unhindered environment for the attack to occur. Many organisations are currently responding by issuing new alerts and appeals, along with providing much-needed humanitarian support. However, the people of Nagorno-Karabakh and Armenia require sustainable peace and human security, which will only be achievable through a negotiation that is inclusive of the voices of those most profoundly affected by the conflict. We advocate specifically for the inclusion of women in formal negotiations, in order to pave the way to sustainable peace.

    The international community’s crisis-response support is highly appreciated, but it should be complemented by long-term funding for dialogue, peacebuilding and the reestablishment of human security. Armenian civil society working to alert about potential risks of conflict escalation on the borders of Armenia could also benefit from their support.

  • ASEAN: ‘Laos’s leadership raises serious human rights concerns’

    Mary Aileen Diaz BacalsoCIVICUS speaks about the implications of Laos chairing the Association of Southeast Asian Nations (ASEAN) with Mary Aileen Diaz Bacalso, Executive Director of the Asian Forum for Human Rights and Development (FORUM-ASIA).

    Founded in 1991, FORUM-ASIA is a network of 85 organisations across 23 countries, mainly in Asia. It works to strengthen movements for human rights and sustainable development through research, advocacy, capacity development and solidarity actions in Asia and beyond. It has consultative status with the United Nations and maintains a consultative relationship with the ASEAN Intergovernmental Commission on Human Rights.

    What are the main challenges ASEAN will likely face in 2024?

    ASEAN is a regional alliance comprising of 10 Southeast Asian countries, plus Timor-Leste, which is on track to join. It was established in 1967 to preserve peace and stability in the Cold War era. Nowadays it oversees collaborative efforts on its three pillars of economic, socio-cultural and political and security matters. It is also meant to promote and safeguard human rights through a regional mechanism within the political-security pillar.

    With Laos as chair, ASEAN will face three significant challenges in 2024. The first is related to its reliance on consensus politics and non-interference, which means that progress depends on each member state’s unique circumstances. Political events such as elections in Indonesia, attempted coups in Myanmar and regressions in human rights and democracy in countries across the region, including in Cambodia, Laos, the Philippines, Singapore and Thailand, obstruct advances in the protection and promotion of human rights and put the ability to achieve consensus to the test.

    The second challenge is the result of a notable lack of optimism and growing scepticism by human rights organisations about Laos’s role as chair. Laos’s reputation for human rights abuses and violations of fundamental freedoms raises doubts about its ability to lead ASEAN effectively in improving human rights protections.

    The third challenge is linked to external factors, particularly geopolitical tensions between China and the west, which will influence the regional bloc. These pressures may impact on economic, socio-cultural and political-security cooperation within ASEAN, adding another layer of complexity to the challenges the organisation will face in 2024.

    What does the fact that Laos is chairing ASEAN in 2024 mean for China’s standing and role in the region and globally?

    Laos continues to have the same voting power as other ASEAN members, but as chair, it has greater influence in shaping the organisation’s agenda. For instance, it has chosen ‘Enhancing Connectivity and Resilience’ as the theme for 2024 and has shown commitment to fostering connections with the East Asia bloc, including China. An official statement issued by the 2024 ASEAN Foreign Ministers Retreat emphasised the importance of enhancing ties between ASEAN and East Asian countries. It highlighted mechanisms such as the East Asia-ASEAN Summit, which includes the 10 ASEAN states plus China, Japan and South Korea.

    Two key concerns arise under Laos’s leadership, particularly regarding human rights. First, it’s uncertain how it will approach the Myanmar crisis, particularly due to the continued reliance on ASEAN’s Five-Point Consensus as the primary reference, despite calls from civil society to move beyond this plan.

    Laos has designated a seasoned diplomat as the ASEAN Special Envoy, tasked with meeting junta leader Min Aung Hlaing in Myanmar. However, the lack of a clear agenda for engaging with supporters of democracy such as the National Unity Government, the National Unity Consultative Council and the Ethnic Revolutionary Organizations raises doubts that ASEAN is playing a progressive role. Given historical and political ties between the military junta and the government of Laos, concerns linger about ASEAN’s alignment with the interests of people in Myanmar.

    Second, the future of the human rights agenda is uncertain given Laos’s dubious human rights track record, which includes cases like the 2012 enforced disappearance of a prominent member of Laotian civil society, Sombath Somphone, and the deportation of the Chinese human rights lawyer Lu Siwei in October 2023. Plans have already been outlined for the 2024 ASEAN Human Rights Dialogue, but it is unclear whether civil society will be included or whether Laos will ensure a secure environment for it to take part.

    Another pending topic on the human rights agenda is the revision of the terms of reference of the ASEAN Intergovernmental Commission on Human Rights, which are supposed to be revised every five years but haven’t experienced any improvement in one and a half decades.

    Does Laos’s role as chair create any significant opportunity for Laotian civil society?

    We are quite sceptical about the potential impact of these changes in regional institutions on the domestic civil society landscape of a country with closed civic space.

    Laos systematically represses civil society activists and dissenters through a variety of legal and extra-legal measures, including surveillance, threats and violence. The decision to choose Timor-Leste over Laos as the host for the ASEAN Civil Society Conference/ASEAN Peoples’ Forum despite Laos holding the ASEAN chair underscores the apprehensions of civil society regarding safety within Laos.

    Given the principle of non-interference on which ASEAN is based, it remains an unresolved question whether other ASEAN countries will scrutinise Laos’s human rights track record.

    Nonetheless, from a civil society standpoint, this situation presents an opportunity to amplify efforts in advocating for justice and accountability for victims of human rights violations in Laos.

    FORUM-ASIA is steadfast in its commitment to monitor the human rights situation, document violations and hold the Laotian government, as well as all ASEAN governments, accountable for upholding their commitment to protect and promote human rights in accordance with international human rights standards.

    It is key to strengthen solidarity with Laos and leverage the momentum of Laos’s chairing of ASEAN. We urge the international community to participate in campaigns and advocacy initiatives. We must join forces to amplify the voices of the oppressed, shine the spotlight on Laos and the region and undertake collective action to address human rights concerns.

  • ASEAN: ‘There is a lack of a consistent approach and political will to address the Myanmar crisis’

    MaryAileenDiez BacalsoCIVICUS speaks with Mary Aileen Diez-Bacalso, a globally recognised human rights advocate and the new Executive Director of the Asian Forum for Human Rights and Development (FORUM-ASIA), on the state of civic space in the member countries of the Association of Southeast Asian Nations (ASEAN) and the regional body’s response to the human rights situation in Myanmar.

    In March 2023, Myanmar’s civic space was downgraded by theCIVICUS Monitor to the worst category, closed, in response to developments including the detention of thousands of activists and protesters, many of them convicted by secret military tribunals in unfair trials and given harsh sentences including thedeath penalty. Some have been tortured or killed. The ruling military junta has also systematically targeted journalists andforced civil society organisations (CSOs) to shut down and their leaders to go into hiding or flee the country. The junta has committed war crimes and possible crimes against humanity, including unlawful attacks, killing and injuring civilians through the use of extrajudicial executions, artillery shelling and banned landmines and cluster munitions.

    What is the state of civic freedoms in ASEAN member states?

    In recent years, there has been a discernible trend in ASEAN toward democratic regression and shrinking civic space.

    In Cambodia, as an election draws near, there is an ongoing assault on civic space and an increasingly violent campaign of repression and harassment against union activists, environmental campaigners, opposition politicians and media workers.

    In Myanmar, the path toward democracy, which began in 2011, was dismantled and civic space has closed. The junta’s nationwide crackdown has spread beyond cities into rural and ethnic minority areas, where resistance has grown. There is a climate of fear and insecurity, characterised by extrajudicial killings, arbitrary arrests, torture, enforced disappearances, sexual violence and other atrocities amounting to crimes against humanity. But ASEAN leaders have been unable to respond uniformly, and the Five-Point Consensus (5PC) they reached in April 2021 has miserably failed to address Myanmar’s crisis.

    In Singapore, civil liberties are curbed through the prosecution of journalists, protesters and harassment of activists. Civil space has been further limited by repressive laws such as the 2019 Protection from Online Falsehoods and Manipulation Act and the 2021 Foreign Interference (Countermeasures) Act, which include vague provisions that allow for executive discretion in interpretation and implementation.

    Overall, civic space in ASEAN countries has deteriorated. But in the midst of this darkness, the results of recent elections have cast a ray of hope that could have an impact at the regional level. Election results in Malaysia in November 2022 and Thailand in May 2023 have brought hope and a breath of fresh air after years of regression of fundamental freedoms. ASEAN’s youngest member state, Timor-Leste, is unique in that it has committed to consolidating democracy and held a free, fair and transparent election on 21 May 2023, allowing voters to cast their ballots peacefully, thus making their voices heard.

    As the current ASEAN chair, has Indonesia made any efforts to engage with civil society and protect human rights?

    Indonesia became ASEAN chair amid a lot of expectations regarding its potentials to address the Myanmar crisis, following the lack of progress under its two predecessors, Brunei Darussalam and Cambodia – and possibly on the assumption that no further progress will happen under its successor, Laos.

    Led by Indonesia, ASEAN managed to adopt several Leaders’ Declarations related to human rights, including one on combating trafficking in persons caused by the abuse of technology and one on the protection of migrant workers and family members in crisis situations, adopted at the 42nd ASEAN Summit in May 2023. These represented a crucial step toward protecting rights. However, questions of implementation and domestication have long plagued the ASEAN region.

    Progress made at the regional level is not necessarily reflected by domestic developments. For example, ahead of the 2023 ASEAN summit, held in Labuhan Bajo, the Indonesian police summoned two residents, Viktor Frumentius and Dominikus Safio, over a planned protest regarding compensation for houses and land clearing for a road project. The criminalisation attempt happened a few days after the police issued a warning letter for local people not to conduct actions that could ‘create incitement’ during the summit. This incident came on top of ongoing attacks on civil liberties in Indonesia.

    Regarding engagement with civil society, unfortunately the Indonesian government failed to respond to civil society’s request to conduct an interface meeting during the summit. Taken together, this and the attempted criminalisation of protesters reveal the government’s exclusionary approach to critical voices.

    Did the summit’s outcomes include any commitment on human rights?

    The summit’s outcome document highlighted the commitment to strengthen efforts to combat human trafficking and protect migrant workers. Human trafficking is indeed a serious and systemic violation of human rights in Southeast Asia, with the pandemic exacerbating the already precarious situation of marginalised people who might end up in hands of human traffickers.

    Regarding Myanmar, however, disappointment continues. On 11 May, despite expressing concerns over the continuing violence in Myanmar, specifically in light of the recent attack against a convoy carrying ASEAN diplomats in Myanmar on the eve of the summit, Indonesia released a statement that said that ‘the 5PC remains our main reference’. It basically ignored the calls from civil society groups and the wider international community to move beyond the 5PC.

    Unfortunately the issue of shrinking civic space was not discussed at the summit, which reveals continued neglect by ASEAN member states and a lack of consensus about the importance of the fact that civic space is deteriorating across the region.

    Has there been progress in strengthening the role of the ASEAN Intergovernmental Commission on Human Rights (AICHR)?

    Since its inception, the AICHR has been criticised as nothing more than a front for ASEAN member states to comply with their duty to put human rights on the regional agenda. It is not surprising that ASEAN finds it difficult to promote human rights at the regional level, given that its membership includes several authoritarian regimes and illiberal democracies.

    Civil society groups have done what we could to strengthen the AICHR, leading to incremental progress in its institutional strength and its relations with civil society. In 2019, FORUM-ASIA and its partners called for a review of the AICHR’s Terms of Reference to make it more independent and give it a protection mandate, among other things. ASEAN foreign ministers agreed to this, but the process hasn’t kicked off. Still, other positive changes happened, such as the inclusion of civil society in various AICHR activities and growing opportunities for the AICHR to meet with civil society in a variety of settings.

    For example, recently and for the first time ever, FORUM-ASIA and other CSOs with AICHR consultative status were invited to meet with AICHR representatives at the 37th AICHR Meeting. The question remains whether this practice can be sustained and institutionalised. The AICHR has also recently demonstrated increased engagement with national human rights institutions, its natural national partners. This also needs to be maintained and strengthened.

    Additionally, the current AICHR mechanism for handling human rights complaints needs to be assessed for it to become more transparent and responsive to rapidly deteriorating civic space conditions. But because the issue of shrinking civic space has not been met with consensus among AICHR member states, progress has been minimal. However, FORUM-ASIA keeps engaging with the AICHR in the knowledge that it will take years of effort to build a mechanism that lives up to our aspiration of holding states accountable for human rights violations. We are willing to engage in discussions with the AICHR about how to strengthen its complaint mechanism to contribute to enforcing states’ human rights obligations at the national level.

    Why hasn’t there been any progress in implementing the 5PC to address the situation in Myanmar?

    The 5PC has failed due to the fact that ASEAN has engaged with the military junta – the perpetrator of grave human rights violations with no commitment whatsoever to human rights – rather than with the legitimate representatives of Myanmar’s people, the civilian National Unity Government (NUG).

    As of today, the junta has not only failed to implement any of the plan’s provisions but has also increased its brutality against the civilian population. The deadly airstrike conducted in April was a glaring manifestation of the junta’s refusal to engage in meaningful dialogue and cooperation.

    Another issue is ASEAN members’ lack of a consistent approach and political will to address the Myanmar crisis. Only a few ASEAN countries openly condemned the junta’s human rights violations, while others, such as Cambodia, the ASEAN chair in 2022, even met with the junta chief and allowed the international community to interpret this approach to the crisis as recognition of the military regime.

    Finally, ASEAN’s principle of non-interference has been a major obstacle to effectively addressing the Myanmar crisis. ASEAN has moved away from this principle by becoming more assertive in certain cases, such as on economic and humanitarian cooperation, but this has not been mainstreamed. 

    How has civil society responded to ASEAN’s failure to address the situation in Myanmar?

    Despite numerous challenges, civil society has remained active. It is working to ensure that Myanmar does not fall off the radar or is forgotten as a result of conflicts and emergencies erupting in other parts of the world.

    Along with reputable Myanmar CSOs and other regional and international organisations, FORUM-ASIA recently released a position paper calling for a review and reframing of the 5PC. This paper provides five counterpoints of action that ASEAN leaders must immediately take to prove the bloc’s commitment and capability to resolve the Myanmar crisis effectively.

    The first point calls for the immediate adoption of an action plan for civilian protection and cessation of violence. The second emphasises the need to convene inclusive and meaningful consultations with legitimate Myanmar stakeholders, including the NUG, its advisory body the National Unity Consultative Council, the Committee Representing Pyidaungsu Hluttaw – a group of ousted parliamentarians – and ethnic resistance organisations. The third stresses the need to amend the mandate of the ASEAN Special Envoy’s term to three years with authority, independence and resources to take effective action. The fourth calls for the provision of direct support to frontline humanitarian responders in Myanmar and along ethnic borderlands, including Myanmar’s western borders. And the fifth point calls on the Special Envoy to immediately open formal communications and engage with civil society and other key stakeholders from Myanmar’s Spring Revolution.

    What should the international community do to push ASEAN to protect human rights and address the situation in Myanmar?

    International civil society and the international community must push ASEAN to immediately move away from the 5PC and embrace more robust and tangible actions to stop the military junta’s violence and atrocity crimes. They must refrain from legitimising the junta and must recognise the NUG as the democratically elected government and enter into dialogue with all relevant stakeholders, cut bilateral ties, including economic ties, and impose a full arms embargo on the Myanmar armed forces, and call for suspension of the export and transport of aviation fuel to Myanmar.

    They should also work closely with the United Nations, particularly the Security Council and Secretary-General, to resolve the crisis in Myanmar. They should set up a clear mandate for the Special Envoy, grounded in human rights principles, justice and accountability. The role must be full-time, lasting more than a year, and the appointed Special Envoy must engage with all relevant stakeholders, not just the military junta.

  • AUSTRALIA: ‘Indigenous Australians must be represented at the heart of policy-making’

    Paul WrightCIVICUS speaks about Indigenous peoples’ rights in Australia with Paul Wright, National Director of Australians for Native Title and Reconciliation (ANTaR), a civil society organisation (CSO) that works in solidarity with and advocates for the rights of Indigenous peoples in Australia, including by aiming to change the attitudes and behaviours of non-Indigenous Australians.

    What is the current situation of Indigenous peoples in Australia?

    As soon as colonisation began in 1788, Australia’s First Nations peoples, Aboriginal and Torres Strait Islander peoples, were systematically persecuted and marginalised. They were dispossessed of their lands and denied the rights afforded to settlers or colonisers.

    In 2022, more than 230 years since colonisation began and 120 years after the former colonies federated into the Commonwealth of Australia, Indigenous Australians continue fighting for their rights and to have their sovereignty recognised.

    Through the years, there have been big wins, frustrating disappointments and broken promises from governments. Human rights have been consistently denied or violated. Australia was one of the last nations to ratify the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), and following ratification it has done very little to honour or domesticate the articles of the declaration.

    More positively, the Australian Human Rights Commission includes an Indigenous Social Justice Commissioner whose role is to advocate for the rights of Indigenous peoples and keep Indigenous issues on the agenda of the Australian federal government. The position is currently filled by a Bunuba woman, Dr June Oscar, who is a great source of information on the human rights situation of Indigenous Australians.

    While things are slowly improving, Indigenous Australians continue to have a lower life expectancy, live in poorer health and have worse employment and education outcomes than non-Indigenous Australians.

    The wide health gap between Indigenous and non-Indigenous communities was highlighted by the Close the Gap Campaign, co-chaired by the Indigenous Social Justice Commissioner and the CEO of the National Association of Aboriginal and Torres Strait Islander Health Workers and Practitioners. In response, the Australian government entered into the National Agreement on Closing the Gap with the Coalition of Aboriginal and Torres Strait Islander Peak Organisations, committing to implementing tangible policy reforms. In July 2020 it issued its second Annual Data Compilation Report that tracks the implementation of the agreement.

    Do you think Australian Indigenous peoples are well represented in policy-making processes?

    They are not, so the current political battle in Australia is to make sure Indigenous Australians are represented at the heart of the policy-making that affects them. Aboriginal and Torres Strait Islander people have issued the Uluru Statement from the Heart, an invitation to ‘walk with us in a movement of the Australian people for a better future’. It calls for structural reforms, including constitutional change, to establish a First Nations’ ‘Voice to Parliament’ and kick off a national process of truth-telling and reconciliation. The current federal Labor government has committed to holding a referendum to decide this question. This is a major moment for Australia.

    Since the 1992 Mabo High Court decision, which recognised that a group of Torres Strait Islanders, led by Eddie Mabo, held ownership of Mer (Murray Island), native title has been recognised for all Indigenous people in Australia. In response to that seminal High Court ruling, the government introduced the Native Title Act, and over the next 30 years, 40 per cent of the Australian landmass has been returned to Aboriginal and Torres Strait Islander peoples that have made claims. Not all claims have been successful, however: native title rights are limited and do not entail self-determination at the level outlined in the UNDRIP and other international standards.

    How is ANTaR working to advance the rights of Indigenous Australians?

    ANTaR is a national advocacy organisation that promotes the rights of Aboriginal and Torres Strait Islander people that was founded 25 years ago. We began as a grassroots protest movement to resist government attempts to water down legislation on native title rights. We have subsequently worked alongside many Aboriginal and Torres Strait Islander leaders, organisations and communities to advocate for rights and justice. Our priorities have included health equality, justice, anti-racism, advocacy for a treaty, reconciliation and much more.

    As an ally organisation, we operate under the principle of not speaking for Aboriginal and Torres Strait Islander peoples and instead look to their leadership and direction to channel our resources and support. There are a growing number of solid connections between Indigenous peoples globally, which is encouraging. Australia has learned many lessons from Indigenous affairs in Canada, Norway, New Zealand and elsewhere.

  • AUSTRALIA: ‘There will be little change on First Nations people’s recognition, representation and rights’

    PeterLewisCIVICUS speaks with Peter Lewis, president of Australians for Native Title and Reconciliation (ANTaR), about the recent defeat in areferendum of a proposal to recognise Indigenous Australians in the constitution and create a permanent institution so they can speak directly to government and parliament on matters relating to Aboriginal and Torres Strait Islander peoples.

    ANTaR is a civil society organisation (CSO) that works in solidarity with and advocates for the rights of Indigenous peoples in Australia,conducting independent research and analysis and providing Australians with quality information on priorities concerning First Nations rights.

    What was the process leading to the referendum?

    In December 2010, an Expert Panel on Constitutional Recognition of Indigenous Australians was established and started discussing how to constitutionally recognise First Nations peoples. In January 2012, the panel suggested a new section be added to the Constitution – ‘Section 51A’ – to recognise First Peoples as the original inhabitants of the nation now known as Australia. The federal government later announced that a referendum on the matter would be delayed by two to three years due to an absence of widespread public support.

    In December 2015, a Referendum Council was established and began consultations on how best to establish constitutional recognition of First Nations peoples. A discussion paper was released in October 2016 and articulated the central suggestions for constitutional reform to include a declaration of recognition, a ban on racial discrimination and a First Nations Voice to Parliament, with the right to be consulted on legislation relevant to Aboriginal and Torres Strait Islander peoples.

    In May 2017, a convention at Uluru heard the outcomes from the First Nations Dialogues, with 250 First Nations leaders and representatives in attendance. Despite the generosity of spirit embodied by the Uluru statement, in October 2017 the government of then Prime Minister Malcolm Turnbull outrightly rejected its proposals, breaking is promise of ‘doing things with’ Aboriginal people instead of to them. Turnbull made this decision unilaterally, without any consultation with or regard for the National Congress of Australia’s First Peoples, a national representative body, or members of the Referendum Council.

    In March 2018 the government established another Joint Select Committee that was tasked to again inquire into and report on constitutional change. Its final report endorsed a constitutionally enshrined Voice to Parliament. By the end of 2018, the Labor opposition had promised to establish a Voice for First Nations people and vowed to take the issue of constitutional recognition to referendum if elected to government in 2019.

    On 29 September 2022, the inaugural meeting of the Referendum Working Group and the Referendum Engagement Group discussed the steps to a 2023 referendum on a First Nations Voice to Parliament. The Constitutional Alteration (Aboriginal and Torres Strait Islander Voice) 2023 Bill was introduced to parliament on 30 March 2023. On the same day, a Joint Select Committee was formed to analyse and report on the bill.

    The committee heard from witnesses and published submissions, and recommended that parliament pass the bill without amendment. The House of Representatives passed it on 31 May and the Senate did so on 19 June. This meant a referendum would be called within the next six months.

    A constitutionally enshrined First Nations Voice to Parliament would offer a first step toward structural and symbolic reform, ensuring that Aboriginal and Torres Strait Islanders peoples can have a say about the laws and policies that impact on their lives and communities.

    Who sided for and against?

    The federal leadership of conservative parties – the Liberal and National parties – did not support the referendum. However, there was some support for the Voice within the conservative parties federally and in some states and territories.

    There was also some opposition by a minority of First Nations leaders on the basis that the Voice did not represent an adequate transfer of power and that a treaty should come before any changes to the constitution. But a vast majority of First Nations leaders and organisations supported recognition and voice, as did most civil society organisations and some business organisations.

    ANTaR was active in the Yes campaign and worked with others to establish Allies for Uluru. In October 2022 we initiated a Yes to Voice, Truth and Treaty Campaign.

    The Yes campaign also received support from international CSOs such as Amnesty International and Oxfam, and its measures were supported by United Nations (UN) experts, and specifically by successive Special Rapporteurs on the rights of Indigenous Peoples.

    But the referendum was used by neo-Nazi and QAnon adherents to stoke fear about First Nations peoples’ aspirations.

    What kind of disinformation was circulated?

    The No side of the debate made a number of false claims ranging from the misleading to clear lies. There were claims that the Voice would be a third chamber of parliament and that it would delay all decision making. There were claims that Australians would lose their homes as a result, and that it would enable First Nations people to establish their own military, and even that it would allow the UN to take over Australia. There were claims that the move was legally risky and that it would divide the nation – although currently the federal government can legislate for First Nations people through the ‘race powers’, a constitutional clause that says the government can make special laws for people of any particular race. So the nation is clearly already divided.

    Why do you think the initiative failed, and what will the consequences be?

    In Australia referendums rarely succeed, and in fact have never succeeded without support from all major parties.

    The No case included much disinformation and fearmongering and a majority of the electorate responded negatively. It should however be noted that many inner-city and inner suburban areas, as well as First Nations-dominated remote areas, voted yes.

    Because of this result, there will be little change and First Nations people’s recognition, representation and rights will depend on whoever is in government at the time. First Nations organisations will renew their calls for justice and recognition of their sovereignty and press on issues such as treaty-making, truth-telling and reducing disadvantage by providing greater agency for First Nations communities.

  • BAHRAIN: ‘Had there been civic freedoms, the authorities would have known of the deep suffering at Jau Prison’

    JawadFairoozCIVICUS speaks about the situation of political prisoners on hunger strike in Bahrain withJawad Fairooz, founder and director of Salam for Democracy and Human Rights (Salam DHR).

    Founded in 2012, Salam DHR is a human rights civil society organisation (CSO) registered in France, Switzerland and the UK. It undertakes research and advocacy for the advancement of democracy and human rights, mainly in relation to Bahrain, but also in the wider Gulf and Middle East and North Africa regions.

    Maryam al-Khawaja, daughter of imprisoned human rights defender Abdulhadi al-Khawaja, intends to return to Bahrain imminently to ensure her father gets medical treatment and press for his immediate and unconditional release. Yet she, too, faces possible arrest. What’s your assessment of the situation?

    Abdulhadi al-Khawaja, 62, a dual Danish-Bahraini citizen, is the co-founder of the Bahrain Center for Human Rights and has a long history of activism. He was arrested by the government of Bahrain in 2004, 2007 and again amid mass unrest in April 2011. After this he faced a grossly unfair trial before a military court, including on charges of ‘seeking to overthrow the government’. He was tortured in pretrial custody and since his arbitrary imprisonment he has been repeatedly denied access to adequate healthcare.

    On 9 August he joined some 800 other hunger strikers. They called for an end to lockdown policies that require them to spend up to 23 hours of the day in their cells, the suspension of solitary confinement, the opportunity for collective or congregational prayer in Jau Prison’s mosque, face-to-face meeting rights with family members without a glass screen and access to healthcare commensurate with that available to the public, among other improvements in prison conditions.

    On 13 September the mass hunger strike ended with the authorities reportedly meeting many of these demands. This came as Bahrain’s Crown Prince visited Washington, DC, where he met with senior members of the Biden administration: the problem had to go away.

    Maryam nevertheless intends to travel and she has our full support. We continue to call for Abdulhadi’s immediate and unconditional release. The Danish and European Union (EU) authorities must do more.

    What is at the core of this problem is the absence of civic space in Bahrain. If there was space for independent civil society, then CSOs would have effectively alerted the authorities to prison conditions and they could have addressed the situation. An independent civic space makes it possible to find a balance in government conduct.

    What does this mean for Maryam al-Khawaja and our courageous colleagues travelling with her? It means they should be allowed to enter Bahrain and make their demands. The government should engage with them in a spirit of transparency. The absolute worst that could happen is for dissent to be tolerated just a little bit more. While this seems unlikely to happen, it is what the government should do. We wish them all Godspeed.

    How is it possible to conduct human rights activism in such a closed environment? How does Salam DHR do it?

    Bahrain has closed civic space. Government officials decide which CSOs can be registered and who can stand for their boards. They prevent people from engaging in public life who have no criminal records or public complaints but rather perhaps a past association with a political movement or party that was unfairly banned years ago.

    The Bahraini constitution provides for freedoms and safeguards similar to many other states, but the reality is that the government continues to carry out arbitrary arrests and stage unfair trials for acts that are not internationally recognised as crimes. The authorities torture detainees and use the death penalty, despite domestic opposition and international condemnation. They have stripped hundreds, including myself, of citizenship, depriving us of even the right to have rights in our homeland. They use the digital space to monitor and punish dissent and to foment religious and sectarian strife.

    Activists linked with Salam DHR cannot, in effect, exercise their right to peaceful assembly, let alone openly campaign for freedoms of association and expression, the release of prisoners unfairly tried and imprisoned or a moratorium on the death penalty. They would risk arrest if they did that.

    Yet engaging in civic activism is not totally impossible, only very challenging. Alongside CIVICUS and other partners, Salam DHR engages with allies and like-minded activists as well as the few CSOs that openly but cautiously raise human rights concerns so that the wider Bahraini society hears our message. We echo and amplify their appeals.

    We are a catalyst: we help Bahraini activists access platforms to reach domestic and international audiences and provide training and development opportunities such as internships. Alone and in partnership with others, we research, document and publicise developments, grounding our message in article 25 of the International Covenant on Civil and Political Rights, which states that every citizen shall have the right and the opportunity to take part in the conduct of public affairs.

    How useful for advocacy purposes was theglobal event held by the Inter-Parliamentary Union (IPU) in Bahrain’s capital, Manama, in March 2023?

    It was mixed: Danish parliamentarians and those from other countries addressed human rights issues and the absence of an independent civic space. The IPU’s human rights team raised concerns about freedom of expression and violations against Bahraini parliamentarians. But despite the IPU’s affiliated status with the United Nations (UN), the government still denied access to independent observers and human rights organisations, denying them either visas or access and turning at least one around at the airport. This was the authorities once again restricting civic space.

    A few days before the IPU meeting officially began, Bahraini lawyer and activist Ebrahim Al-Mannai called for parliamentary reforms on social media. He and three others who shared his post were arrested for publishing material that could ‘disturb public order’.

    At the event itself, the government appeared uninterested in seriously engaging with visiting parliamentarians on human rights issues, despite attempts from the Danish delegation and representatives from Finland, Iceland and Ireland. Our message is clear: open up civic space, free up CSOs and political parties and liberate discourse, otherwise the cycle of political unrest will continue.

    Reports indicate that the mass hunger strike in Jau Prison has ended. What’s your assessment of this episode?

    The painful August 2023 mass hunger strike was wholly avoidable. It happened mainly due to the government’s stubborn and short-sighted refusal to allow civic space to exist even to a minimum degree. Had there been freedoms of expression and peaceful assembly, they would have known of the deep suffering at Jau Prison. If you don’t let people say what they think, then public life can only lurch from crisis to crisis.

    The hunger strike was the expression of the accumulation of a number of factors that have been present in Bahraini prisons for years and it was based on grievances that have been repeatedly expressed: prison conditions and ill treatment of prisoners amounting to torture. The abuses worsened and conditions deteriorated during the COVID-19 pandemic. In 2021, medical neglect resulted in the deaths of two prisoners, Hussein Barakat and Abbas Mallalah.

    We appeal once more to the authorities to allow for the opening of civic space and provide a social vent to end the cycle of human rights crises we face.

    Is the international community doing all it can to support the struggle for democracy and human rights in Bahrain?

    International human rights organisations, UN treaty bodies and Special Procedures and partner states, for instance in the context of the UN Human Rights Council Universal Periodic Review process of Bahrain, have all joined us in calling on the government of Bahrain to abide by its international human rights obligations, starting with the basic step of letting people have a voice in public life.

    Today, 15 September, is International Day of Democracy, and we are joining the UN in calling on the government of Bahrain to empower the next generation by ensuring that their voices are included in the decisions that will have a profound impact on their world. In his address, UN Secretary-General António Guterres has warned that ‘walls are closing in on civic spaces’. Those walls are also the walls of Jau Prison, where it took 800 detainees’ unjust suffering for the government to even take notice.

    But the UN has also let neighbouring United Arab Emirates, which is as closed as Bahrain, host the forthcoming COP28 climate change summit. Lack of civic space means there can be no activism for climate justice in Bahrain – for instance, no public demands for accountability can be expressed over costly and environmentally damaging land reclamation in Bahrain’s northeast, which has already eroded the livelihood of fishing communities. We need to be able to address these challenges openly, with a rights-based approach, to avoid a future calamity.

    And powerful states that could be putting some pressure for change are avoiding the issue. Right now, Bahrain’s Crown Prince is wrapping up meetings with senior Biden administration officials, none of whom appear to have raised civic space concerns or addressed the needless suffering of 800 Bahraini prisoners. The UK has removed Bahrain from its list of ‘countries of concern’ at the same time as it trumpeted a billion-dollar Bahraini investment in the UK. In October the EU will recommence its cycle of so-called human rights dialogues.

    The international community’s inexplicable complacency over the festering human rights quagmire in Bahrain will further embolden the government in crushing civic space. Many leaders miss the point when it comes to Bahrain and its Gulf neighbours: they appear to accept the facade of what is presented as pragmatic autocracy and appear to accept regional rulers’ colonial-mindset contention that democracy will destabilise the region.

    Democracies have in fact produced the most stable, enduring and dynamic systems in the world. Human rights and democracy are essential for Bahrain and its neighbours because their deficits continue to be the primary cause of resentment and unrest. A security-based approach does not remedy these problems. Bahrain’s history has shown these methods to be a failure, as it has endured continuous waves of mass unrest followed by violent crackdowns.

    Authoritarianism and the forms of violence it fosters are the real destabilising forces, a cycle that can only be broken through the recognition and enactment of democratic rights. The first step towards this goal is simply letting civic space exist.

  • BAHRAIN: ‘The government uses public relations to mask human rights violations’

    DreweryDykeCIVICUS speaks withDrewery Dyke of Salam for Democracy and Human Rights (Salam DHR) about closed civic and democratic space in Bahrain as the state prepares to host the Assembly of the Inter-Parliamentary Union (IPU). The IPU Assembly takes place in the capital, Manama,from 11 to 15 March 2023.

    Salam DHR is a human rights civil society organisation (CSO) founded in 2012 to undertake research and advocacy for the advancement of democracy and human rights, mainly in relation to Bahrain, and also in the wider Gulf and Middle East and North Africa regions.

    We last spoke on the eve of the parliamentary election held in November 2022. How has civic space in Bahrain evolved since?

    The government of Bahrain held the November 2022 parliamentary election under the same, highly restrictive, 2018 Political Rights Law used in the 2018 elections. It banned scores of people from being able to vote or stand for election on spurious grounds such as affiliation to a banned political party or having a criminal record.

    Bahrain’s international partners, United Nations (UN) human rights bodies and civil society all decried the banning of political parties, as it flew in the face of international standards and simply deprived many people of having a voice. The court cases, too, dating from the 2011 unrest, were grossly unfair. In November 2018, the UN Human Rights Committee denounced both the Political Isolation Law and the Law on Associations

    And yet there seems to be a small opening for civil society and greater freedoms. The regional mood music appears to be changing, with the governments of Bahrain, Saudi Arabia and the United Arab Emirates normalising relations with Qatar, and the Bahraini government having set out a 2022-2026 National Human Rights Plan.

    Bahrain’s government appears to have signalled that it is minded to undertake some reform but civil society remains highly sceptical. Many of us are concerned that the government is once again using public relations initiatives to project an image of the country that masks longstanding, unresolved human rights violations for which there has been no accountability.

    Is change possible? Yes, to some degree, it appears so. But civil society needs to remain vigilant and sceptical. Action will speak louder than words. An amendment of existing laws on political and civil society organisations is now a must.

    How does Salam DHR manage to work in such a restrictive environment?

    Current legislation makes it impossible for our organisation to register and openly carry out any research or advocacy in Bahrain. That has been the case since 2013. And yet at least one woman human rights defender who is linked to Salam DHR and other human rights CSOs has remained active inside Bahrain. She walks a tightrope on a daily basis, taking action to support individuals, notably prisoners of conscience. Lawyers, political and civil society activists and others from all walks of life continue to contact us but we cannot discuss their identities to protect their safety. It is a challenge.

    In November 2022, however, the Bahrain Centre for Human Rights obtained accreditation to the UN’s Economic and Social Council, which means it can now formally participate in UN meetings and events. This important step could help prise open the space for civil society just that little bit more. We will see.

    Why do you think the Bahraini government offered to host the IPU Assembly?

    The Bahraini government invited the IPU to hold its 146th Assembly in order to project an image of a democratic country and boost its international standing. The IPU’s catchphrase on its website is ‘For democracy. For everyone’. The government seeks to own this message in a situation where democracy does not exist.

    The theme of the 146th Assembly is ‘Promoting peaceful coexistence and inclusive societies: Fighting intolerance’. Yet by limiting freedoms of association and assembly and the right to peaceful religious expression, Bahrain’s government promotes exclusion and intolerance.

    Possibly to foster its mission, the IPU accepted the Bahraini government’s offer to hold its meeting in Manama. Is that problematic? In some ways, yes. But it is upon us to promote – peacefully – democratic change that advances adherence to international human rights standards. And parliamentarians from around the world attending the IPU Assembly could help chip away at deeply rooted discrimination and the fact that so many in civil society are deprived of having a voice or are afraid to use it.

    Links between Bahraini parliamentarians and civil society are uneven. Some have few if any links while others have better connections and communication with their electorate, including civil society. Some seek to hold government action to account, albeit timidly.

    The IPU Assembly may be an opportunity for Bahraini members of parliament to learn how their counterparts in other parts of the world engage with their electors and effectively represent their concerns. Parliamentarians are a building block of a free civil society. We need them to step up during the Assembly to make that a reality in Bahrain.

    How could this whitewashing attempt become an advocacy opportunity?

    The IPU Assembly will be a pivotal opportunity for advocacy. Visiting parliamentarians must make it so. They must reject baseless hype and propaganda depicting Bahrain as a land of freedom and democracy.

    In a recently published brief, Salam DHR is urging attending parliamentarians to join with other parliamentarians from across the globe to call on the government of Bahrain to rescind all provisions that restrict parliamentary life and freedom of expression and association of Bahraini members of parliament. We want them to call for the government to resolve two outstanding cases the IPU’s Committee on the Human Rights of Parliamentarianshas lodged with the government of Bahrain, and examine the cases of 15 former parliamentarians targeted with arbitrary arrest and detention, unfair trial and imprisonment and arbitrary stripping of citizenship. We’re also asking parliamentarians to urge the government to implement all recommendations arising from human rights treaty obligations and as many as possible of those made by UN Special Procedures and arising from Bahrain’s 2022 UN Universal Periodic Review.

    We urge visiting parliamentarians to inform themselves of other widely shared human rights concerns in relation to Bahrain, including the denial of political rights and women’s rights, the use of the death penalty and the tactic of revoking citizenship as punishment, and to meet with human rights activists and others in civil society while in Bahrain.

    How can the international community better support Bahraini civil society and activism for democracy?

    Civil society in and engaged with Bahrain needs the international community to listen and speak with us, to hear our experiences and work with us. There is a narrative and experience that differs from the public relations whitewashing by the government.

    We are saying that there are longstanding problems that need to be addressed, in terms of law, practice and accountability. But we are also saying that we believe that Bahrain’s international partners – from varying states, including European Union member states, the UK and USA, and the UN and its human rights bodies – and now parliamentarians can all work together, in unison, to erode the climate of repression that denies respect for human dignity, in order to empower Bahraini civil society and gradually build a more open and rights-respecting country.

  • BANGLADESH: ‘Civil society made a lot of efforts to stop Japan financing the Matarbari project’

    SharifJamilCIVICUS speaks about the cancellation of the Matarbari 2 coal-fired power plant project in Bangladesh with Sharif Jamil, General Secretary of Bangladesh Paribesh Andolon (BAPA), a platform that organises civil society movements against environmental degradation. Since 2009 Sharif has been involved with the Waterkeeper Alliance, a global network aimed at ensuring every community’s right to clean water. He is currently the Coordinator of Waterkeepers Bangladesh and Council Member of Waterkeeper Alliance.

    What is the significance of the cancellation of the Matarbari 2 project in Bangladesh?

    The cancellation of the Matarbari 2 coal plant project is very significant because it shows global leaders living up to their commitment to fight climate change. Last year G7 countries reached an agreement to stop building coal plants and funding coal-related projects. If Japan continued to support this coal project, it would have undermined the global effort being made to tackle climate change.

    We were happy to see a few contractors also pulling out of the project. Sumitomo Corporation, one of the biggest ones, decided to back out of the project on the basis that it contradicts their new climate policy. The Japanese-owned company decided to stop building and supporting coal plants. We believe this was a major step towards the cancellation of the project.

    People living in the area where Matarbari 1 and 2 were implemented were affected by pollution caused by the projects. If it continued, people living near the coal plant would have been affected by air pollution. The coal plant also threatened to pollute water in surrounding areas, which would have also put people in danger.

    How has civil society been involved?

    Civil society made a lot of efforts to stop Japan financing the Matarbari coal project, and hard advocacy work finally paid off. We made sure to talk to community members in surrounding areas to get their views on the project. Because we listened to their concerns about the health issues the project might cause it was easier to carry out advocacy work in the communities. Environmental civil society organisations (CSOs) were able to put pressure on key stakeholders with the help of research institutions that studied and tracked global finance and investments.

    It is encouraging to see G7 countries living up to their commitments. Japan taking a position against coal financing is a huge step towards protecting the environment in Bangladesh and the rest of world. Coal-fired power plants are the biggest contributors of carbon emissions and therefore one of the biggest obstacles to climate change mitigation efforts. As civil society we are happy to see that it is possible to hold governments and multinational corporations accountable.

    However, while it is good news to see Japan backing away from coal plant projects in Bangladesh, it is also quite frustrating to see it headed towards liquefied natural gas, which is also a fossil fuel. It would be good if Japan could help Bangladesh move towards clean and renewable energies. They have the necessary technology to do so and sharing it with us would help us overcome the climate crisis we are all going through.

    What role did your organisation play?

    As an organisation we found it important to talk to scientists to understand the scientific impacts this project would have had on our environment. We also analysed the environmental impact assessment study provided by organisations that were monitoring the project. We communicated with the plant company and the government to understand their position on the fight against climate change and environmental issues in Bangladesh. Fortunately, they were willing to listen to our concerns and even invited us to their stakeholder meetings.

    The problem we noticed with this project is that the parties involved did not consider the data provided by environmental organisations. It was understood that power plants would boost industrial activity, but our argument was that these projects had to be sustainable. Doing an environmental impact assessment was therefore key. Any project that is implemented should be carried out comprehensively, inclusively and on the basis of science so that it does not harm our environment. It was frustrating that the environmental impact assessment of Matarbari 1 did not do any modelling for harmful pollutants such as fine particles (PM 2.5) or mercury, letting the plant continue functioning subjecting it to scientific scrutiny.

    In advocating against the Matarbari project we tried to let people be part of the development activities happening around them. It was important to make them understand that every development project happening in their communities had to be sustainable and promote their wellbeing, which was not the case with Matarbari 1 and 2.

    What other actions are needed to combat climate change and environmental degradation?

    Japan is a trusted partner of Bangladesh. Bangladesh has long received Japanese investment and development collaboration. We have worked for a long time with the Japanese International Cooperation Agency, which has done a lot of good. We would like to see collaboration for development continue, but it should be of the sustainable and green kind.

    The Matarbari plant project was detrimental to our environment and its activities would have polluted both our water and air. This caused unrest and protests. We want multinational corporations and governments to consider the environmental impacts of any project they intend to introduce. They should consider the long-term effects of every project as well as the country’s energy security.

    Did you receive any support from international CSOs and activists?

    Several environmental organisations in Japan and other countries helped us raise awareness about the negative impacts of the Matarbari project. Some of these organisations conducted studies and came up with recommendations on how projects could be made green and sustainable.

    But we still need support to ensure that upcoming projects aim to promote the use of clean energy and live up to environmental standards. Our country also needs resources to help it transition to clean energies. Therefore, there is further need for collaboration with governments that can help us move in that direction.

  • BOSNIA AND HERZEGOVINA: ‘Civil society has failed to spark people’s activist side’

    CIVICUS speaks about deteriorating civic space in Bosnia and Herzegovina (BiH) with

    Founded in 1996, CPCD is a civil society organisation (CSO) working to strengthen civil society and citizen participation in BiH and the Western Balkans through capacity development, advocacy and campaigning.

    What are civic space conditions like in BiH?

    In our nearly three decades working in civil society in BiH and the Western Balkans, we have never witnessed such a rapid deterioration of civic space. Our organisation, along with other CSOs, is deeply concerned about two new pieces of legislation introduced in Republika Srpska (RS), one of the two entities that make up BiH.

    The first bill, already adopted, reintroduced criminal defamation into the legal system. The second, currently under parliamentary debate, is a ‘foreign agents’ bill that would criminalise CSOs that receive foreign funding or assistance for ‘political activities’ and give state institutions the power to shut them down. This would be just another tool to further restrict civil society in the hands of government authorities, who already use the mechanisms in place to oversee the work of CSOs and exert pressure and threaten us. Over the past year there have been more inspections of CSOs than ever before, specifically targeting smaller and more vocal organisations.

    By silencing independent media and civil society, RS President Milorad Dodik seeks to eliminate public scrutiny and criticism in an entity marred by criminal activities and corruption and undergoing a difficult economic situation. The government is resisting democratic oversight and trying to eliminate all forms of critical thought among the public.

    Moreover, in April 2023 the Sarajevo local government proposed amendments to local public order laws that would penalise the spread of ‘fake news’ and criticism of state authorities. Although the draft bill was withdrawn in June due to the public outcry it caused, the authorities have expressed their commitment to reintroducing a modified version of the bill.

    These are all signals that the situation for civil society is rapidly worsening in RS and in BiH as a whole, with severe limitations being introduced on freedoms of association and expression.

    How has Bosnian civil society organised against the restrictive bills?

    A part of RS’s civil society is well organised and experienced in advocacy and campaigning. But overall, there are fewer than 10 CSOs that are strongly committed to their human rights mission and vision, while the rest maintain links with the government that make them less vocal against repressive laws. We provide support with expertise and funding to independent CSOs in RS, but we must be discreet because we are based in the Federation of Bosnia and Herzegovina, the other entity that composes BiH, and our help tends to be misunderstood by both politicians and the public in the RS.

    Unfortunately, many Bosnian CSOs remain silent due to fear. In RS in particular, people are afraid for their safety and that of their families. Unlike in Georgia, where people took to the streets to defend freedom of association, people in Bosnia aren’t motivated, partly due to media narratives portraying civil society as being paid by the international community to act against the government.

    We are using all available tools to raise awareness about repressive legislation within the country, at the European Union (EU) level and through communication with various civil society networks, including CIVICUS. The government argues that these laws are necessary to prevent the financing of terrorism and money laundering, but we view these as excuses.

    We have informed opposition members of parliament about the potential negative consequences of the ‘foreign agents’ law but have made no impact. Our outreach to the public has been hindered by lack of media support.

    However, we remain hopeful that this crisis may turn into an opportunity for Bosnian civil society to revive the sense of solidarity that we’ve lost over the past decade. These days, we constantly think in terms of projects and donors and tend to see each other as competitors when we most desperately need to be united.

    How would you describe the current political climate in BiH?

    Our region has historically bordered with empires, and this location has come at a price. The threat of RS’s secession has risen in recent years, posing a security problem for the entire region. Due to BiH’s location and rich natural resources and potential for energy production, many fear that its fate depends on the outcome of Russia’s war against Ukraine and the interests of major powers such as China, the EU, Russia, Turkey and the USA. The people of BiH are the ones with the least influence on the decisions that will affect them.

    While secession may not be imminent, the threat of it significantly impacts on people’s wellbeing. We experience a pervasive feeling of insecurity that contributes to an anxious atmosphere. This makes people easier to manipulate. Many people are considering leaving, mostly because of their sense of insecurity and the widespread corruption.

    Fear is our main currency. Past experiences of police surveillance leading to arrests of protesters have deterred people from participating in demonstrations. People are losing hope that things will improve. During the war we experienced between 1992 and 1995, we had a very strong feeling of hope that when the war ended we would recover a normal life and rebuild our country. Now we have peace but we don’t have hope anymore.

    How do you work to strengthen civil society in BiH, and what obstacles do you face?

    Our organisation was established right after the war, so it has existed for 27 years. We were the first ones to connect CSOs from different parts of the country and our network currently includes over 350 organisations.

    In 2004, we launched the first initiative of institutional cooperation between government and civil society. At that time, civil society was thriving. But over the past decade or so, the situation has steadily worsened. Civil society faces a shortage of human resources, and people hold rather negative views about civil society. We seek to change such perceptions by consistently communicating the purpose and results of our work to the public and beneficiaries of our services and activities.

    We also lack strong connections with the media, which should serve as a channel between us, the government, the international community and, most importantly, our society. To show what we’re doing and what we are trying to achieve, instead of just following donors’ visibility guidelines we have established our own portal in which we collect inspiring stories of civil society’s impact in improving people’s lives.

    But our biggest problem is lack of local ownership. For many years the international community did things for us, so we aren’t used to solving problems by ourselves. People aren’t used to activism; they complain and wait for others to resolve their problems. That’s one of the failures of civil society: we have implemented many projects, but never managed to spark people’s activist side.

    What challenges do you face in cooperating with international partners?

    International agencies implement large projects in BiH and many funds come from the international community, but we don’t see results. One of the reasons is that local civil society is pushed aside. When we inquire with donors about supporting local organisations or networks, they argue that small organisations lack the capacity to successfully implement large grants. It has become their mantra.

    This hampers the development of civil society as the true democratic force our country urgently needs. We must engage in dialogue with the government to devise solutions for the numerous problems we face. We need to move past the ‘projectisation’ of civil society and focus on the long term.

    This also applies to the government, which is also forced to work within the project framework, executing short-term tasks requested by the EU or other international institutions. For instance, the government, jointly with the European Commission, invested around €1 million (approx. US$1.06 million) to fulfil a request to establish a register for CSOs, but once international partners left the country, the register ceased to function. There was a failure to recognise that civil society could have created, managed and overseen the register, which could have been instrumental in developing a common civil society strategy.

    This year we established an informal group of donors who support local civil society in Bosnia. We hope the international community will consistently convey the message that they must prioritise local ownership and sustainability. We don’t want to see civil society becoming a mere service provider for larger international agencies. We need to organise around genuine shared interests rather than form networks to satisfy the criteria of calls for proposals. It is time for us to think strategically about who we are and what our role is.

  • BURUNDI: ‘Our right to be recognised and represented as an Indigenous community is being violated’

    Severin SindizeraCIVICUS speaks about Indigenous peoples’ rights in Burundi with Severin Sindizera, Global Coordinator of the Indigenous Peoples Global Forum for Sustainable Development (IPGFforSD).

    IPGFforSD is a civil society organisation (CSO) that advocates for the rights of Indigenous peoples in Burundi and monitors the implementation of the Sustainable Development Gaols (SDGs) in relation to Indigenous peoples at the national and international levels.

    What is the situation of Indigenous people in Burundi?

    The Batwa Indigenous people represent approximately two per cent of Burundi’s population. The context is disheartening because most of our rights are not recognised. Most Batwa people live in extreme poverty and are marginalised and discriminated against. They are often excluded from access to basic resources such as public services, education, land and healthcare. One common issue affecting Indigenous people across the globe is lack of access to land and decision-making bodies. 

    The Batwa people are not exempt from this, as our land rights are not recognised in Burundi. We need land to survive – to build our houses, grow our crops, graze our animals and preserve our culture.

    Batwa people are not well represented in decision-making processes, which explains why development strategies rarely cater to us and our needs. We have been excluded from the economic, social, political and cultural development of our country. It is quite unfair to have people make decisions on our behalf without consulting with our community. When projects are implemented, we are often sidelined. It would seem the government is trying to make people think it is helping Indigenous people while we are not really receiving the help we need.

    The SDGs aim to eradicate many problems affecting societies globally, but their implementation in Burundi has not been inclusive of Indigenous people. The government must understand that our place in society is already under threat, so it needs to approach the SDGs in an intersectional manner to serve all people of Burundi equally.

    The international community has also shown a lack of a solid plan to address the rights of Indigenous peoples during implementation of the SDGs. We want to know how international organisations aim to promote Indigenous peoples’ development through the SDGs. I had the privilege of attending the Forum on Financing for Development (FfD) in New York, but was disappointed I was the only member representing Indigenous peoples.

    What are the main rights violations experienced by Batwa people in Burundi?

    Batwa people in Burundi do not have access to education, healthcare and proper legal services. Many people have suffered and died due to being denied access to healthcare facilities in their communities. When we try to get legal help to hold accountable those responsible for negligence in healthcare centres, we do not qualify to receive it. We hope this will change one day and the Batwa people of Burundi will be inclusively integrated in their communities.

    But Batwa people currently face serious discrimination. We are often called names such as witches and made feel unwanted by the wider society. Our dignity is looked down upon and we are forced to take a lesser place in society. Without access to good jobs, Batwa people have a high prevalence of poverty.

    Batwa people are disproportionately affected by arbitrary arrests and rights violations, as well as by land grabbing from the government and international stakeholders. People take advantage of us because they know that the majority of us do not have identity cards, making it difficult for us to access justice. Whatever laws have been put in place to protect us are not really working.

    Our right to be recognised and represented as a community is being violated. We need members of our community to advocate for our rights independently, without being associated with any political party. The history of this country should inform policymakers about the importance of cultural recognition. No one should be left behind because of their identity. We have a right to participate fully in public life without facing rights violations.

    Has any progress been made in terms of representation in policymaking processes?

    The Burundian government has launched an initiative to include Indigenous people in some governmental positions. There are now a few Batwa people in parliament. However, the fact that participation in public affairs requires association with a political party makes us uncomfortable. This restricts many Indigenous people from speaking out about their rights because they are controlled by their political parties.

    Political representation is an opportunity for our needs to be heard but our people who are actively participating in public affairs do not necessarily speak on our behalf. Participation of ethnic minorities in Burundi still has a long way to go despite the efforts of the government. Batwa women are inadequately represented in political positions.

    Our government focuses on development but fails to promote it in an inclusive manner. It recently setup a national strategy for Indigenous people, highlighting issues we are dealing with and stating its plan to advance Indigenous people’s rights. We hope that they will consult with members of our community and Indigenous leaders about our needs so the strategy actually benefits us.

    How can Indigenous groups across the world work together to promote Indigenous people’s rights?

    Indigenous groups must have regional and international forums to collaborate towards the achievement of our human rights, economic and social development, as well as civil and political rights. We must partner with international organisations that have experience with working on Indigenous people’s rights so that they can help us with our advocacy work and share strategies to make our work more effective.

    Our organisation, IPGFforSD, works for Indigenous rights through international advocacy and innovative initiatives. We work in collaboration with Indigenous groups an encourage them to create and enhance their platforms in their respective countries from across the globe who face similar issues. We focus on monitoring SDG implementation because the rights and needs of Indigenous people are currently not well represented when SDGs are implemented. We have worked with the United Nations (UN) mechanisms, including the UN Economic and Social Council (ECOSOC), to raise awareness of the plight of Indigenous people and the need to recognise them in both national and international policies. We advocate for national governments and international organisations to implement the UN Declaration on the Rights of Indigenous Peoples.

    We also work to sensitise our leaders about Indigenous rights through workshops and seminars. Our aim is for them to be well informed so they can, we hope, help us in the battle of getting our rights recognised in Burundi.

  • BUSINESS AND HUMAN RIGHTS: ‘This treaty should not be negotiated behind closed doors’

    IvetteGonzalezCIVICUS speaks about the process to develop an international treaty on business and human rights and the role of civil society with Ivette Gonzalez, Director of Strategic Liaison, Advocacy and Public Relations at Project on Organising, Development, Education and Research (PODER).

    PODER is a regional civil society organisation (CSO) based in Mexico, dedicated to promoting corporate transparency and accountability in Latin America from a human rights perspective, and to strengthening civil society affected by business practices to act as guarantors of long-term accountability.

    Why is a treaty on business and human rights so important?

    We live in a world virtually ruled by capital. Since this hegemonic capitalist and patriarchal economic model has taken hold, it has become clear that whoever has the capital calls the shots.

    When companies directly influence the decisions of state powers, be it the executive, legislative or judicial branches of government, or others such as international organisations or banking institutions that should operate for the public benefit, and instead put them at the service of the private and exclusive benefit of a few people and prioritise the creation and accumulation of wealth over human rights, it results in a phenomenon we call ‘corporate capture’. Corporate capture is observed on all continents and results in the weakening of the state and its institutions. The strength of the state needs to be restored and the treaty on business and human rights could contribute to this.

    A legally binding international instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises seeks to curb violations committed by companies of multiple human rights such as the rights to health, freedom, privacy and access to information and the impunity with which they operate, which allows them to destroy the environment, territories, families and entire communities.

    All companies must operate with due diligence on human rights to identify, prevent, address and remedy abuses and violations, as a continuous cycle of management including project planning, investment, operations, mergers, value and supply chains, relationships with customers and suppliers, and any other activity that could cause negative impacts on rights and territories. The treaty serves as a means for states, as the primary duty bearers in charge of protecting human rights, to hold companies to their responsibilities and monitor compliance.

    An international treaty would also be a unique development in that it would cover the extraterritorial activities of companies, such as the activities of companies that may be headquartered in a country in the global north but have operations in the global south. At the moment, in many instances and jurisdictions, companies are only self-regulating and are not accountable for their human rights abuses and violations, and the destruction they cause to life and the planet. Some states are making progress on regulations and policies, but there are still gaps at the international level. We want this treaty to address the huge gap in international law that allows corporate crimes to go unpunished.

    What progress has been made in negotiating the treaty?

    Interesting developments took place at the eighth session of the Open-ended Intergovernmental Working Group on Transnational Corporations and Other Business Enterprises with Respect to Human Rights, held from 24 to 28 October 2022. While there is no strict timeline or deadline for producing the final version of the treaty, one of the experts convened by the Intergovernmental Working Group for the development of the instrument proposed 2025 for concluding the negotiations. This is the deadline that is expected to be met if states have the political will to build consensus. For the time being, some states that were reluctant to participate in the past are now showing a little more interest.

    For now, the draft has 24 articles, the first 13 of which were discussed in the last session. Discussions included central issues such as the definition of victims’ rights and their protection and the definition of the purpose and scope of the treaty: whether it should include only transnational corporations or other companies as well. The state of Mexico, for example, argues that this instrument should cover all activities that have a transnational character. There have also been discussions on the prevention of damages and access to reparations, as well as about legal liability, the jurisdiction that will deal with complaints, statutes of limitation and international judicial cooperation, among other issues.

    Some states have made contributions to improve the content under negotiation. In contrast, other states seek to minimise the scope of the treaty in certain regards, such as protections for Indigenous peoples and communities, environmental safeguards and women’s and children’s rights, among others.

    Some states support the most recent proposals of the chair rapporteur, the Ecuadorian ambassador, but a large part of civil society considers that, for the most part, they detract from what was achieved during the seven years up to 2021, and weaken the treaty. They promote power asymmetry between northern and southern states, as well as between companies and rights-holding individuals and communities. The third revised draft is the one we recognise as legitimate and the basis on which we believe negotiations should continue.

    How is civil society contributing to the treaty process?

    Dozens of CSOs are pushing for an effective treaty, including PODER, along with the International Network for Economic, Social and Cultural Rights (ESCR-Net), which brings together more than 280 CSOs, social movements and activists from 75 countries, and several other alliances, movements and coalitions such as the Treaty Alliance, Feminists for a Binding Treaty and the Global Campaign to Reclaim Peoples Sovereignty, Dismantle Corporate Power and Stop Impunity.

    Of course there is diversity of opinion within civil society on a number of issues, but we all agree on the need to regulate business activity with a human rights perspective. We have identified the elements this treaty should contain and the conditions required for its implementation. And we are trying to inject urgency into the process, which is going too slowly, while human rights violations and attacks against human rights defenders do not stop, but instead increase every year.

    Civil society has advocated with decision-makers to open up spaces for discussion with civil society. PODER, along with ESCR-Net, has in particular insisted on the constructive and proactive participation of states from the global south in the process, and specifically from Latin America. We also work to integrate a gender and intersectional perspective into both the process and the text. One example for this has been the proposal to use Mexico’s feminist foreign policy.

    Civil society’s point of departure is the conviction that it is not possible to develop a legitimate treaty without placing the participation of rights holders – affected rural people and communities, Indigenous peoples, independent trade unions, LGBTQI+ people and people in vulnerable situations, among others – at the centre of the whole process.

    What are the chances that the final version of the treaty will meet civil society’s expectations and fulfil its purpose?

    We hope the treaty will contribute to ending corporate impunity and states will assume their obligation to protect human rights in the face of corporate activity. It will prevent abuses and violations, redress grievances and ensure these situations do not recur.

    Although there are established processes for the development of international treaties, this is an unusual treaty and should be treated as such, and changes should be made to both process and content as necessary for it to be truly effective.

    For it to fully meet the expectations of civil society would require a paradigm shift based on the principle that business has a social function and that its operations should not exceed certain limits for a dignified life and a clean, healthy and sustainable environment. We know that our full aspirations will not materialise with a treaty, with National Action Plans and regulations and standards, even if they are properly implemented. But these are all important steps in trying to balance the scales by limiting the power that the global economic system has given to business corporations.

    While the treaty is unlikely to meet all our expectations, CSOs that are demanding the highest standards for this treaty will continue to do so until the end. We will continue to bring proposals from experts and affected communities and groups fighting for justice and redress for the harms they experience first-hand, opening up spaces for their voices to be heard and remain at the heart of the negotiations at all times, and including human rights and environmental defenders in consultations on the text.

    This treaty should not be negotiated behind closed doors or with the private sector alone, as this would allow for the repetition of the same cycle of opacity and privilege that has brought us this far, and would only contribute to maintaining an unsustainable status quo.

  • CAMBODIA: ‘No free and fair election can take place in the current political environment’

    Lee Chung LunCIVICUS speaks about Cambodia’s communal elections of June 2022 with Lee Chung Lun, Campaign and Advocacy Programme Officer of the Asian Network for Free Elections (ANFREL).

    Established in 1997, ANFREL is a regional civil society organisation (CSO) that promotes democratic, free and fair elections by conducting election monitoring, capacity building and civic engagement in member countries.

    How free and fair were the recent local elections in Cambodia, and what were their results?

    The official results of the elections for the commune and sangkat – an administrative subdivision – council held on 5 June 2022 gave the ruling Cambodian People’s Party (CPP) 9,376 (80.7 per cent) of the 11,622 council seats and 1,648 (99.8 per cent) of the 1,652 positions of commune chief. The recently reactivated Candlelight Party gained 2,198 (18.9 per cent) of council seats and four commune chief positions. The remaining 48 council seats went to other small parties.

    The CPP’s victory is no surprise given its tight control of politics and the pressures on the opposition, including the dissolution of the main opposition party, the Cambodia National Rescue Party. In such context, the CPP won over 3,000 more seats than it did in the 2017 elections, and its popular vote surged from 3.5 million to 5.3 million.

    However, it was unexpected that the Candlelight Party only managed to secure four commune chief positions despite winning one-fifth of the popular vote. The disproportionate vote-to-seat translation warrants further investigation.

    Overall, Cambodia still falls short of the benchmark for free, fair and inclusive elections, as assessed in ANFREL’s pre-election assessment mission. ANFREL’s member, the Committee for Free and Fair Elections in Cambodia (COMFREL), also noted various irregularities in the process.

    The undemocratic elements of the existing legal framework continue to allow room for abuse. In recent years, especially during the COVID-19 pandemic, crackdowns on the media, CSOs and the political opposition have increased. Numerous opposition candidates and members of opposition parties, most notably from the Candlelight Party, became the target of harassment and intimidation throughout the election period. As long as threats against the opposition and civil society continue to be prevalent, there can’t be a genuine and legitimate election.

    What role did civil society play in the election process? 

    In July 2021, a coalition of 64 Cambodian CSOs launched a list of recommendations that they named ‘minimum conditions for legitimate commune and sangkat council elections’. These included enabling a free political environment and active participation in political activities and allowing the main opposition to review and select members of the National Election Committee (NEC). They also called for greater political neutrality of military forces and independence of the courts, as well as freedom for the media and CSOs to function. Regrettably, no significant changes have been made since then.

    CSOs such as COMFREL recruited, trained and deployed citizen observers to monitor the election process. The NEC’s accreditation standards, however, are questionable, given that 93 per cent of the 74,885 accredited election observers came from organisations closely linked to the CPP. More than half of them came from the Union of Youth Federations of Cambodia and Cambodian Women for Peace and Development, led by Cambodian prime minister’s son Hun Manet and deputy prime minister Men Sam An, respectively.

    Cambodia is virtually a one-party state and now has a mostly closed civic space as a result of ongoing attacks on CSOs, independent media and the political opposition. Since 2017, the government has arrested, imprisoned, and harassed hundreds of activists, opposition figures and journalists. Some flee the country out of fear of retaliation.

    The draconian provisions outlined in the Law on Associations and Non-Governmental Organisations continue to be in effect. The law forbids unregistered organisations from carrying out any activity and grants sole authority over the registration process to the Ministry of the Interior, while registered organisations must adhere to a broadly defined ‘political neutrality’ requirement. CSOs are frequently required to go through informal approval processes with local authorities to carry out their work on the ground, even though the law does not require them to do so.

    Do you think the results of the communal elections will be replicated in the upcoming national elections?

    The results of the commune and sangkat council elections can be regarded as a predictor of the results of the next National Assembly elections, scheduled to take place in July 2023. They confirm once again that no free and fair election can take place in Cambodia’s current political environment. If attacks on the opposition and civil society continue, the CPP will retain its power in the next election.

    What support does Cambodian civil society need from international organisations?

    Cambodian civil society needs more attention from the international community on critical human rights violations and the dwindling state of democracy. International organisations should keep up their efforts to monitor developments in Cambodia closely and extend solidarity with Cambodian civil society, which frequently faces threats and harassment while carrying out their work. Local CSOs also need funding to continue their advocacy and campaigning on the ground.

  • CAMEROON: ‘Communities must benefit from what comes from their land’

    EstelleEwouleLobeCIVICUS discusses the aspirations and roles of civil society at the forthcoming COP28 climate summit with Estelle Ewoule Lobé,co-founder of the Cameroonian civil society organisation (CSO) Action for the protection of environmental refugees and internally displaced people in Africa (APADIME).

    What environmental issues do you work on?

    Our organisation, APADIME, works on several interconnected human rights and environmental issues. We work on the protection of the rights of Indigenous peoples and local communities, with a particular focus on Indigenous women and environmentally displaced people. We contribute to the fight against transnational environmental crimes such as the illegal exploitation of forest resources and illegal trafficking of protected species. We work to strengthen the resilience of Indigenous peoples and local communities and to raise public awareness of the need to protect forests. Finally, we implement income-generating activities for Indigenous peoples and local communities.

    When we work on organised crime, we don’t leave out the defence of people’s fundamental rights. Our area of work is the Congo Basin, with a base in Cameroon. Central Africa is home to one of the world’s largest tropical rainforests. It contains enormous resources on which millions of people depend for their livelihoods, including Indigenous peoples and local communities. The forest also provides a habitat for countless animal species and is of crucial importance for the global climate.

    Despite all the legal measures in place to protect Cameroon’s forests, forest exploitation, often carried out in partnership with private companies, gives rise to numerous abuses, resulting in serious human rights violations fuelled by well-organised criminal networks, and generally leading to the dispossession of the lands of these peoples and communities. This is where our association comes in.

    First, our work has a research component that is focused on both the legal and institutional framework to support our advocacy work at the national and international levels, and on carrying out studies and publishing articles and books, the latest of which is In Search of a Status for the Environmentally Displaced.

    Second, there is a field component in which we meet communities and organise consultation events, focus groups, surveys and observations to gather data about the difficulties people face and the needs they have.

    The third strand of the association’s work is education, through which we build the resilience of Indigenous peoples and local communities and awareness about their intrinsic rights, procedural rights, sustainable land management, the preservation of protected species and current forestry legislation. We also organise awareness campaigns to help educate communities.

    The fourth component is access to rights. We help organise communities by setting up networks of institutional and local players to facilitate access for communities whose human and land rights are constantly violated.

    The last component concerns economic recovery through the implementation of income-generating activities, particularly through community fields.

    Have you experienced any restriction or reprisal because of your work?

    We are human rights defenders working in an environment that is not always receptive to the type of work we do. We are confronted with powerful interests such as those of forestry companies that often exploit forests abusively. Our presence often makes an impression and we are subject to threats that force us to limit our scope of action to prevent the situation from degenerating and becoming too risky.

    At an administrative level, the main obstacle is the lack of a positive response or collaboration from officials. Some refuse to take part in our projects, contenting themselves with one general discussion session with us. Others refuse to make their contact information public.

    How do you connect with the global climate movement?

    APADIME collaborates with several of the world’s leading international organisations, including the International Centre of Comparative Environmental Law, an international scientific CSO based in France, which works on environmental protection through the promotion of international legal instruments. We also work with the Global Initiative against Transnational Organised Crime (GI-TOC).

    With the support and guidance of GI-TOC, we are currently working with a network of stakeholders in the Republic of the Congo and Gabon to combat organised environmental crime in the Congo Basin and protect the rights of Indigenous peoples to achieve climate justice centred on human rights.

    We are involved with international players in developing the People’s Summit for social and environmental justice, against the commodification of life and nature, and in defence of the commons. Our association is also actively involved as a speaker and observer at major international meetings, the most recent of which was the 11th Conference of the Parties to the United Nations Convention against Transnational Organised Crime (UNTOC), held in Vienna, Austria in October 2022, which produced a call for action by civil society.

    What priority issues should be addressed at COP28?

    COP28’s priority issues are the same as those we have been defending for a long time: support for Indigenous peoples and local communities to ensure their rights are protected, in particular through the funding of conservation activities and income-generating activities to raise their standard of living, and the equitable sharing of the benefits of nature as defined by the Kunming-Montreal Global Biodiversity Framework, which recognises that in addition to the urgent need to use nature sustainably, communities must benefit from what comes from their land.

    In particular, this involves examining how marginalised communities, including Indigenous peoples, can benefit from the often lucrative therapeutic and cosmetic products derived from the resources of their lands.

    Do you think that COP28 will provide sufficient space for civil society? What are your expectations regarding its outcomes?

    The participation of civil society in climate negotiations is extremely important because we are active stakeholders and, when we are able to influence the negotiations, we are a key factor in progress towards sustainable development. Our actions are complementary to political dialogue, which is why it is necessary, even compulsory, for us to take part in these negotiations.

    As usual, COP28 will officially be open to civil society as participants and observers, but the difficulties of access will lie in financing travel to and stay in the United Arab Emirates, where this global event will be held.

    But we hope that despite all these difficulties, progress will be made on the issues that are at the heart of our work, namely direct funding for communities to guarantee adaptation actions and strengthen their resilience.

  • CAMEROON: ‘Indigenous people should be at the forefront of our own movement and speak for ourselves’

    UnusaKarimuCIVICUS speaks about Indigenous peoples’ rights in Cameroon with Barrister Unusa Karimu, board member of Mbororo Social and Cultural Development Association (MBOSCUDA).

    MBOSCUDA is a civil society organisation with ECOSOC Status that advocates for the rights of Indigenous peoples in Cameroon. It aims to ensure that Indigenous peoples are integrated in the development of Cameroon by promoting their participation in decision-making processes.

    What is the current situation of Indigenous people in Cameroon?

    The situation of Indigenous people in Cameroon is not particularly good at the moment. There are people trying to get self-determination, and this has caused conflict in some parts of Cameroon. Unfortunately, the bulk of Indigenous people I work with, pastoralists, are in the English-speaking part of Cameroon, where calls for independence have led to conflict, and they have been caught in the middle of the violence.

    They are being abused. There is no respect for their territories and their basic human rights, and the government has failed to protect them. Civil Society organisations have collected data that indicate gruesome acts are being committed against Indigenous peoples during the ongoing armed conflict in the Northwest and Southwest of Cameroon. Indigenous people are being killed and they cannot defend themselves.

    Indigenous people in Cameroon still live below the poverty line. Most people in the community struggle to get employed because of limited opportunities in the labour market. Some of them end up engaging in small income-generating activities such as livestock farming and the sale of hunting products. But this is not enough to sustain their lives.

    The reason it is sometimes difficult for Indigenous people to get employed is because they struggle to get access to education. There are not enough schools, teachers and educational resources in Indigenous communities. The government has tried to implement projects to address this problem, but these have not really been effective.

    Much work still needs to be done for Indigenous peoples to gain full recognition in Cameroon. It is saddening that health services and other social facilities are not adequately provided to Indigenous people. The government needs to do a lot more to ensure that Indigenous people have access to healthcare in their communities.

    The government has tried to give visibility to Indigenous peoples in Cameroon through the International Day of the World’s Indigenous Peoples, held annually on 9 August, but if their right to life is threatened then the visibility given to them is not having much of an impact. There is a need for structural changes to guarantee sustainable development for all people in Cameroon.

    What human rights violations do Indigenous people experience in Cameroon?

    One of the biggest human rights violations that Indigenous people face in Cameroon is the lack of legal recognition of their right to their territories and their right to life, especially in the conflict-ridden English-speaking regions of the country. Land legislation in Cameroon does not recognise Indigenous peoples’ land holdings and therefore does not protect their land and resources. It is challenging for Indigenous people to register their land because the activities they tend to carry out do not fall under the requirements set out by the government when it comes to effective occupation and exploitation, which is a condition sine qua non for land registration in Cameroon. Activities such as hunting and livestock grazing do not fall under the category of productive land use required for land registration. Commercial developments in Indigenous peoples’ territories affect their livelihoods, and their land is grabbed by people who are not part of the Indigenous community.

    The implementation of the United Nations Declaration on the Rights of Indigenous peoples (UNDRIP) is supposed to provide Indigenous people with better living conditions and protection against losing their territories. However, I do not think the declaration has been well implemented in Cameroon.

    UNDRIP urges governments to recognise and protect Indigenous peoples and their rights. Their land and territories should be protected by the government, but the government violates their rights on a daily basis. We understand that the declaration does not carry any legal obligations, but it should be used as guidance on how to respect Indigenous people and value their participation in the development of the country.

    Cameroon still has land laws that were colonially inspired and do not recognise the rights of Indigenous peoples as far as territories are concerned. This might be the reason the government does not take UNDRIP into account.

    Are Indigenous people well represented in policies?

    Unfortunately, there is no binding legal framework that recognises Indigenous peoples in Cameroon. We have policies in place that serve as guidance for the recognition of Indigenous peoples but there has not been that much progress yet. The government has recently started doing things such as the appointing Indigenous people to decision-making positions. Forest dwellers are represented in decision-making. But these positions are often limited, and their people are not in high positions.

    Pastoral people have a secretary general in the Ministry of Livestock, Fisheries and Animal Industries, which is something positive, but it is very limited. It is safe to say that Indigenous people still lack political representation.

    What should the Cameroon government do to help advance the rights of Indigenous people?

    It would be good if the government met the requirements set by international legal instruments aimed at advancing and protecting the rights of Indigenous peoples. It should also revise the laws that discriminate against Indigenous people, along with its land tenure policies.

    Indigenous peoples should be considered in decision-making. Enabling Indigenous people to participate in national politics would ensure inclusive development, taking into consideration the needs of everyone in Cameroonian society. Often the government puts development strategies in place without conducting proper research and consulting Indigenous peoples, and as a result development strategies do not benefit Indigenous peoples and their way of life.

    In addition, administrative recognition of Indigenous communities would help preserve their cultural and historical heritage. When Indigenous peoples are mixed with neighbouring communities their culture becomes diluted and their history is easily neglected. Ensuring that they are not forcefully integrated with other communities would secure a future for the coming generation. The government should also promote land rights reform.

    Hopefully, with time Indigenous peoples will get economic support and their participation in the development of the country will become noticeable. I believe all of the above can be achieved if the government ratifies the International Labour Organization’s Indigenous and Tribal Peoples Convention, ILO Convention 169.

    How is your organisation working to advance Indigenous rights?

    MBOSCUDA is a community and membership-based organisation present in almost all regions of Cameroon. It was established in 1992 to promote proper living conditions for Mbororo pastoralists. We work to have the socio-cultural, political and economic rights of the Mbororo people recognised. We have consultative status with United Nations Economic and Social Council and had an observer status with the African Commission on Human and Peoples’ Rights.

    We collaborate with various ministries of the Cameroonian government. Our hope is that we can secure some of the services Indigenous people need to have a dignified life. These include, but are not limited to, civil status registration so they can get married, educational resources and healthcare facilities. We also undertake lobbying and advocacy work. To raise awareness of Indigenous peoples’ rights we participate in seminars on Indigenous peoples in Africa.

    Unfortunately, the ongoing crisis in the Anglophone regions has reduced our activities in some parts of the country. There are places we cannot currently work in because of the conflict. If we decide to go regardless, the chances are high that we will not come back. In addition, some communities that act as if they own Indigenous peoples feel threatened by our work because they know they will not be able to continue exploiting them once Indigenous people have access to information and education.

    How can Indigenous groups work together to promote their rights globally?

    Indigenous people should collaborate and form a strong global alliance. Their voices will be stronger and the possibility of them getting recognised will be higher. We should offer each other a helping hand because we are all fighting the same battle, just in different territories.

    The platforms that international organisations provide us should be used as a tool to hold our governments accountable. It is very important that we share our narratives and do not let people speak on our behalf. We know our struggles and nobody but us can elaborate on what our needs are, so we should be at the forefront of our own movement and speak for ourselves.

  • CANADA: ‘Indigenous people who are most marginalised experience significant human rights violations.’

    Melanie OmenihoCIVICUS speaks about Indigenous people’s rights in Canada with Melanie Omeniho, president of Les Femmes Michif Otipemisiwak/Women of the Metis Nation (LFMO).

    Founded in 1999 and incorporated in 2010, LFMO is a national representative civil society organisation that advocates for the rights of Indigenous peoples in Canada, and specifically for the right to equal treatment, health and wellbeing of women and gender diverse people and sexual minorities of the Metis Nation.

    What is the current situation of Indigenous people in Canada?

    In our experience at LFMO, Indigenous people who are most marginalised experience significant human rights violations. Indigenous people are trying to survive traumas and do not have the time or resources required to deal with the systemic racism that continues to violate their rights.

    For instance, we have heard numerous concerning experiences regarding difficulties to access Canada’s victim services scheme. In some provinces, policy dictates that if a person has had any prior engagement with the criminal justice system, even if decades earlier, and this remains on their record, they might not be eligible to receive victim services. This policy severely impacts on and violates the rights of Indigenous victims of crimes, including sexual assault.

    At LFMO we are keenly aware of the experience of anti-Indigenous racism. Some of us are attacked based on how we look or talk when we are going about our lives in mainstream society. We are particularly concerned about the lack of willingness to identify physical attacks on Indigenous women as hate crimes.

    We encourage change in policy and practice in all facets of the criminal justice system to identify hate crimes against Indigenous people instead of classifying them as regular assaults. To create change and hold offenders properly accountable, we need to ensure that anti-Indigenous racism is recognised as a hate crime.

    How is LMFO working to advance the rights of Indigenous peoples in Canada?

    LMFO is the national representative body for Métis women across the Métis Nation Motherland. Métis are one of the three recognised Indigenous peoples of Canada, along with First Nations and Inuit. According to the 2016 census, there are nearly 600,000 Canadians who self-identify as Métis.

    LMFO advocates for the equality of Métis women, Two-Spirit and gender diverse Métis people across the Métis Nation Homeland – our Métis Motherland. The term ‘Two-Spirit’ was coined in the 1990s to refer to Indigenous LGBTQI+ people, corresponding to an age-old concept in Indigenous communities that means someone who embodies both a masculine and feminine spirit.

    LFMO plays a significant role in enhancing the social, cultural, economic, environmental and leadership space occupied by Métis women and gender minorities. Our overarching mission is to ensure the equal treatment, health and wellbeing of all Métis people, with a focus on Métis women, young people and those who are Two-Spirit and gender diverse.

    As part of our strategic plan, we have 10 objectives: advocating for the priorities and needs of women in the Métis Nation, Canada and the world; taking care of the land and waters; guarding the traditional knowledge of Métis women; promoting social justice and equality; creating opportunities for Métis women to develop leadership skills; helping Métis people lead healthier lives and supporting healthy and vibrant communities; ensuring that the perspectives and priorities of Métis women are included in economic development initiatives, and that support is provided for their entrepreneurship; fostering culturally appropriate early learning environments and lifelong learning to improve educational outcomes for Métis children, women and all Métis learners; developing a Métis-specific research strategy to build disaggregated data; and building a strong, successful, inclusive, responsible and transparent organisation.

    We are part of a global movement of Indigenous groups around the world who are all collectively fighting and advocating to be seen, heard and recognised. The more we speak up and share our stories and fight to preserve our traditions and cultures, the more likely it is that we will achieve the recognition of our rights and the creation of policies that serve us and protect us.

    What should the government do to help advance the rights of Canadian Indigenous peoples?

    We hope that in domesticating the United Nations Declaration on the Rights of Indigenous Peoples, the government will implement policies to realise Indigenous rights and Indigenous women will be a part of those conversations. To that effect, LFMO advocates for a gender-based approach and an intersectional lens on policy development and the co-design of legislation.

  • CANADA: ‘The Pope didn’t deliver a clear apology to Indigenous people on behalf of the Catholic Church’

    Virginie LadischCIVICUS speaks with Virginie Ladisch of the International Center for Transitional Justice (ICTJ) about the recent apology of Pope Francis to Canadian Indigenous peoples and the legacy of the Truth and Reconciliation Commission of Canada.

    ICTJ is a civil society organisation (CSO) working in partnership with victims and survivors to obtain acknowledgment and redress for massive human rights violations, hold those responsible to account, reform and build democratic institutions and prevent the recurrence of violence and repression.

    What human rights violations committed against Indigenous people did the Truth and Reconciliation Commission reveal?

    The final report of the Truth and Reconciliation Commission of Canada very clearly details the human rights violations and cultural genocide that resulted from the ‘Indian residential school’ system, which was the focus of the recent apology by Pope Francis.

    The Indian residential schools and the abuses that occurred at them are among many other human rights violations suffered by Indigenous people in Canada, which include sexual and gender-based violations against Indigenous women and girls, land dispossession, violation of the right to safe drinking water, disproportionate rates of incarceration, excessive use of force against land rights protesters, discriminatory practices and lack of access to basic services, including healthcare.

    How significant is the Pope's apology?

    The Pope’s apology is a significant first step in the journey to acknowledge and repair past wrongs. In his apology, the Pope acknowledged the assimilationist intent of the residential school system and the harm it caused by systematically marginalising Indigenous people, denigrating and suppressing their languages and cultures, taking young children away from their homes, indelibly affecting their relationship with their parents and grandparents and subjecting them to physical, verbal, psychological and spiritual abuse.

    The last residential schools closed in the 1990s, so it was important for him to acknowledge the intergenerational harm caused, which persists to this day. However, several survivors noted with disappointment his omission of sexual abuse – rampant in Indian residential schools – which continues to have detrimental impacts on survivors and their families.

    While the Pope highlighted the systematic nature of harm perpetrated against Canadian Indigenous people, his apology stopped short of naming the Catholic Church’s role as part of a system intended to ‘kill the Indian in the child’. He said: ‘I am sorry. I ask forgiveness, in particular, for the ways in which many members of the church and of religious communities co-operated, not least through their indifference, in projects of cultural destruction and forced assimilation promoted by the governments of that time, which culminated in the system of residential schools’.

    The Pope’s words reflect a personal apology and an apology on behalf of individual Catholics, but not a clear apology on behalf of the Catholic Church as an institution. Since the Pope represents the Catholic Church, it is possible to interpret this personal apology as an apology on behalf of the Church. However, given the deeply embedded systemic nature of the violations committed by the Catholic Church against Indigenous people, it is necessary to clearly acknowledge that the system was at fault and that there was a concerted institutional effort to forcibly assimilate Indigenous children. This was not the work of a few misguided individuals.

    There needs to be a concerted effort to unravel the colonialist ideas that underpinned the residential school system and are at the root of persistent racism today.

    What next steps should the Catholic Church and the Canadian government take?

    ICTJ recognises apologies as an important part of a transitional justice process because of their significant moral and symbolic value. But to be meaningful, they need to be followed by real action and material reparations. The Pope acknowledged this in his apology and noted that ‘a serious investigation into the facts’ and efforts ‘to assist the survivors of the residential schools to experience healing from the traumas they suffered’ would be key to prevent such situations happening again. Ultimately, the significance of the Pope’s apology will depend on how he leads the Catholic Church in turning those words into action.

    In terms of next steps, the Catholic Church and the Government of Canada should follow the Truth and Reconciliation Commission’s 94 Calls to Action, which address the lasting harms of residential schools and call on all sectors of society to invest in new and respectful ways of moving forward together. Where more information is needed, for example around missing children and unmarked graves, the Catholic Church should open its archives and undertake a rigorous investigation.

    How is ICTJ working to advance the rights of Indigenous people?

    ICTJ works side by side with victims and survivors in their quest for justice and helps ensure they have a say in the policies that affect them. We raise awareness about their rights and support efforts to hold perpetrators accountable, uncover the truth about the violations they and their communities suffered and obtain acknowledgment and redress.

    We also partner with civil society groups, including women’s, youth and minority groups, that have a stake in building a more just, peaceful and democratic society. Together, we press forward the institutional reforms and guarantees necessary to prevent the violations from happening again.

    Over the past three decades, transitional justice processes have been recognised as an opportunity to address longstanding historical injustices against Indigenous peoples around the world. Specific processes and institutions associated with transitional justice – such as truth commissions, special prosecutorial bodies, memorialisation and reparations – may be the catalyst for political, social, institutional and cultural changes that contribute to the recognition and materialisation of Indigenous peoples’ rights, as we point out in a report we published in 2012.

    ICTJ has worked to advance the rights of Indigenous peoples in various countries, including Australia, Canada, Colombia, Guatemala, Peru and the USA. In Canada, it accompanied the Truth and Reconciliation process from before its inception in 2008 to the end of its mandate in 2015.

    Recognising the importance of involving young people in Canada’s truth and reconciliation process, ICTJ partnered with the Commission to spearhead youth engagement activities. Initiatives included a series of youth retreats in which participants developed the technical and communication skills needed to better engage their peers on Indigenous issues, and a youth-led video project that covered the history of the residential schools and young people’s knowledge – or lack of knowledge – of this history and the contemporary situation of Indigenous people in Canada.

    As expressed by a high school student from Edmonton who participated in one of ICTJ’s events, ‘We are the next generation. After 10 years, we are going to be the adults – the lawyers, the prime ministers. We have to know when we are young, and when we are older, we can make sure this doesn’t happen’.

  • CHILE: ‘Anti-rights groups attacked the Pride march to try to undermine its peaceful character’

    Ramón GómezCIVICUS discusses the struggle for LGBTQI+ rights in Chile with Ramón Gómez, human rights officer of the Movement for Homosexual Integration and Liberation (MOVILH). Founded in 1991, MOVILH is a civil society organisation that defends the rights of LGBTQI+ people.

    In June 2024, a group of hooded men attacked the Pride march in the capital, Santiago de Chile. The attackers tried to break through the security fence protecting the marchers and attacked volunteers who tried to stop them. They beat activists and participants, threw rocks and paint at floats and damaged a truck. The attack came amid a climate of growing homophobia, including calls for a boycott of the event.

    What advances and setbacks have there been for LGBTQI+ rights in Chile?

    From 1991 until 2022, when the law on equal marriage was passed, Chile experienced accelerated change in favour of LGBTQI+ rights. This was reflected in the repeal of discriminatory regulations, the adoption of 18 protective laws and the introduction of anti-discrimination public policies in education, health and labour, as well as a positive cultural shift.

    However, since 2022, both people and institutions that publicly supported LGBTQI+ rights have started being silenced, while opponents have reorganised. Hate speech has overtaken friendly speech, particularly on social media. This is partly due to the misconception that passing an equal marriage law will solve everything, and partly due to a retreat in democratic values that has brought anti-rights exponents into public office.

    The consequences are alarming. Our annual report shows that 2023 was the worst year for the promotion of LGBTQI+ rights. Discrimination cases increased by almost 53 per cent, up to 1,597, the highest number recorded, while hate speech increased by 123 per cent.

    This situation has been exacerbated by an unprecedented offensive by far-right groups that have gained power, particularly in the National Congress. Therefore, one of the main priorities for the LGBTQI+ movement is to campaign against hate speech and protect the rights that have been won.

    How serious were the incidents at the Pride march?

    At the last Pride march, a small group of no more than 10 hooded people carried out an attack with hate messages directed at marchers and activists. This attack, typical of anti-rights groups, was an unsuccessful attempt to undermine the peaceful nature that has historically characterised these marches, with the aim of portraying them as conflictual or dangerous to majority interests.

    Although the government did not react specifically to this case, the Metropolitan Presidential Delegation played a key role in ensuring the smooth progress of the march, helping to maintain its peaceful character and protecting participants along the route. This intervention was crucial in preventing the incident escalating and preserving the inclusive and festive spirit of the march.

    What are the priorities for LGBTQI+ rights, and how are organisations working to achieve them?

    In addition to campaigning against hate speech, Chile needs a reform of the anti-discrimination law to provide effective protection and the approval of a comprehensive sex education law with a human rights perspective to strengthen cultural change in schools, educate young people about diversity and protect the rights of LGBTQI+ children and young people.

    There are around 50 LGBTQI+ groups in Chile, spread throughout the country. Specialisation is a new way of working: the collectives that have emerged in the past decade focus exclusively on issues such as children and adolescents, education or health, and have a limited geographical scope of action, unlike the older movements that worked at a national level and tried to cover all areas. Regardless of the issues they address, collectives carry out communication campaigns and legislative and public policy advocacy, and form coalitions to leverage their expertise, present common demands –  such as the reform of the anti-discrimination law – and confront the anti-rights offensive.

    In addition, these groups do research on the reality of LGBTQI+ people in Chile, compile statistics on cases of discrimination and violence, provide legal and psychological counselling to victims and give talks and training workshops on sexual and gender diversity to public and private sector bodies.

    Through this combination of expertise and collaboration, LGBTQI+ groups are able to address violence and discrimination more effectively and continue to advance rights.

    How are local groups connected to the global movement and what international support do they need?

    LGBTQI+ organisations in Chile are part of various international networks. MOVILH, for example, has worked with international organisations such as ILGA and is part of several Latin American and Ibero-American networks where organisations exchange experiences and join forces. In addition, LGBTQI+ collectives collaborate bilaterally with similar groups in other countries, sharing experiences and providing mutual support.

    Globally, LGBTQI+ collectives need funding, as they are one of the vulnerable parts of society that globally receive the least resources. In the case of Chile, this need is constant, as the fact we are considered an upper-middle income country generally prevents groups receiving external funding. This has a negative impact on the struggle for equality, as the country lacks targeted state funding to address LGBTQI+ people’s needs.

  • COP26: ‘A key priority is to address vulnerability at the community level’

    Mubiru HuzaifahIn the run-up to the 26th United Nations Climate Change Conference of the Parties (COP26), which will take place in Glasgow, UK between 31 October and 12 November 2021, CIVICUS is interviewing civil society activists, leaders and experts about the environmental challenges they face in their contexts, the actions they are undertaking to tackle them and their expectations for the upcoming summit.

    CIVICUS speaks with Mubiru Huzaifah of Uganda’s Ecological Christian Organisation (ECO), a civil society organisation working for sustainable livelihoods for marginalised, under-served and vulnerable groups in Uganda. ECO’s current initiatives focus on natural resource governance, climate change resilience and adaptation, and ecosystems management and restoration.

     

    What's the key climate issue in your country that you're working on?

    The issue that most worries us is the high vulnerability levels that climate change is causing in human systems. The long-term change of climatic elements from previously accepted means is causing environmental and human systems to change. According to state of environment reports issued by the Ugandan National Environmental Management Authority, the main issues related to the changing climate include industrial pollution, widespread bush burning, the inefficient use of fuel and poorly planned transport networks, all of which result in high emission levels.

    Are there any government initiatives on climate change mitigation?

    There is a mitigation project being implemented under the Ministry of Water and Environment – Farm Income Enhancement and Forest Conservation – which gives out free seedlings to be planted to enhance the absorption capacity of the soil. There is the Sawlog Production Grant Scheme, aimed at increasing the incomes of rural people through commercial tree planting by local communities as well as medium and large-scale businesses, which at the same time helps to mitigate climate change effects through intensive reforestation. There are also several solar projects in the Mayuge, Soroti and Tororo districts, which have increased the country’s solar production, and a wetland project – supported by the Green Climate Fund – supporting wetlands conservation and addressing wetland degradation.

    Other relevant interventions include the implementation of gravity water flow schemes to enable water supply without use of energy sources; the development of highways with water drainage channels and solar lights and congestion-free road networks that will enable the smooth flow of traffic and cut down on emissions from automobiles; and the adoption of electric or emissions-free motorcycles to further reduce emissions from fossil energy sources, which the Ministry of Energy is working on alongside the private sector.

    What kind of work does ECO do on these issues?

    ECO’s work is aimed at enhancing the resilience of communities to the impacts of climate change, strengthening disaster risk reduction, enhancing good governance and management of natural resources, especially in the extractives sector, and promoting ecosystems management and restoration.

    For instance, as part of a project aimed at promoting and supporting community-conserved areas in the Lake Victoria Basin, we have provided support for legal fishing practices, promoted and provided training on sustainable farming promotion and supported good local resource governance practices. Another project is aimed at increasing transparency, social inclusion, accountability and responsiveness among those responsible for mining in the Karamoja region.

    In these and in many other projects we are working on, we always seek drive to change by putting people at risk at the centre and building on local and traditional resources and knowledge. We try to link the humanitarian and development domains by focusing on livelihoods. We work to ensure adaptive planning, trying to link local realities with global processes and integrate disciplines and approaches to encompass different risks. We partner with communities, civil society organisations, government agencies, universities and research institutes, the private sector and the media.

    How do you connect with the broader international climate movement?

    We connect with the global climate movement through the Climate Action Network-Uganda, which encompasses over 200 national CSOs. We currently chair this. This allows us to participate in COP meetings as observers.

    We also participate in the pre-COP consultative meetings organised by the Ugandan government in preparation for international climate change negotiations. In these meetings, we help assess progress in dealing with climate change and complying with our nationally determined contributions.

    We turn our lessons learned into advocacy actions that can be adapted for international climate change forums. Some local problems can feed into the national agenda, be turned into policy actions and go on to influence international policy actions.

    What hopes, if any, do you have for COP26 to make progress on climate change mitigation efforts?

    We hope that COP26 will come up with a new marketing platform for emission trading to replace the Clean Development Mechanism, which allowed countries with an emission-reduction or emission-limitation commitment under the Kyoto Protocol to implement emission-reduction projects in developing countries. We also hope it will result in the commitment of more funds to accelerate the scaling up of renewable energies.

    These international processes are relevant as long as they contribute towards the financing of climate mitigation efforts and produce novel funding strategies, such as the Green Climate Fund and the Adaptation Fund, and its pilot programme to foster innovation in adaptation practices in vulnerable countries. Coming from a developing country, I believe that it is critical to increase adaptation funding immediately, since the disruptive impacts of climate change on human systems are already apparent.

    What one change would you like to see – in the world or in your community – to help address the climate crisis?

    A key priority is to address vulnerability at the community level. Our vision is that of a community with enhanced adaptive capacity to address climate change impacts and its subsequent effects. This can be done by increasing access to working technologies and providing mitigation and adaptation funding through community structures.
