  • AFGHANISTAN: ‘Education is our basic right, it’s an Islamic right, it’s a human right’

    PenPath is an Afghan civil society organisation (CSO) dedicated to reopening closed schools, establishing new schools with communities and local authorities’ support, supporting ‘secret schools’, collecting books and setting up libraries, distributing humanitarian aid and educational materials and conducting awareness-raising campaigns in Afghanistan. 

    What is PenPath, and what kind of work does it do?

    My brother Ataullah and I founded PenPath in 2009. We work on a wide variety of topics, including human rights, girls’ education and public libraries. We seek to realise fundamental human rights. We support children’s human rights and women’s human rights.

    In the area of education, we work towards the goal of reopening closed schools. In 2009, we reopened a school in a war zone area that had been closed for almost 15 years. After we started reaching out to volunteers, we were able to campaign house to house in village after village. Over time, we were able to reopen 100 schools in the 16 provinces of Afghanistan. 

    For instance, once we went to an area which had 2,100 families and not a single school. We started encouraging people by giving them information about the importance of education. They saw how important it was to have a school in their area. PenPath eventually established 46 schools in this previously school-less area, and we also opened 40 public libraries in remote areas.

    We want to change people’s minds and show them that children’s rights, women’s rights and the right to education are all fundamental rights. We organised a book donation campaign and with the help of Afghan people we have so far collected 340,000 books. We have also distributed 1.5 million stationery material kits (pens, notebooks, schoolbags, pencils) among Afghan people. We provided education facilities for 110,000 children; and 66,000 of them were girls.

    We think of PenPath as a bridge: we are a bridge between people and education.

    What inspired you and your brother to found PenPath?

    Our father was a tribal leader, and after 25 years of work and campaigning house to house to promote education, he established a public school for 900 students. This first school was built out of tents my father got, and we all studied under the trees. In 2003, I was a child attending school in Kandahar Province, Maruf District. I was in the fourth grade and I still remember the day when armed militants came and burned it down. It was very early in the morning, and they destroyed everything, including the Afghan national flag, pictures of the president, and of course the tents, chairs, books, and all school materials we owned. They yelled out awful things to teachers and students. My father was not present when this happened, so I told him once I saw him at home that evening. Even though he was devastated, this did not stop him. The next day, he encouraged all of us to fight for our rights and rebuild the school.

    Six days after my school was burned down, militants came into my house to warn my father that as he was a supporter of girls’ education we were not welcome any longer. They gave us one week to go. We left our home and our district or else we would have been killed.

    We left for Kabul, where we saw that both girls and boys had access to education. I reflected on this and decided to start some kind of campaign. I explained my idea to my father and he agreed to give me financial support for my project, which was also dear to him because he had a history with girls’ education initiatives. This is how my brother and I founded PenPath in 2009.

     What obstacles have you faced?

    When we campaign with PenPath, we travel around the country and visit all districts and villages on our way. We talk to the local people in each area and we promote the unity of Afghan society for the cause of education. It is always difficult to start this conversation. When you first approach locals, their reaction can be very aggressive; they give us death threats and say they will kill us if we keep doing what we do. We also receive threatening phone calls from unknown numbers.

    However, I don’t personally see these threats as obstacles. We manage to have thousands of contacts with locals and tribal leaders from all religious backgrounds who support our work. Fundamentalist militants can’t control our work and they can’t make us stop.

    How did the context change as the Taliban returned to power?

    The Taliban took over Afghanistan on 15 August 2021. Two days after this, PenPath started campaigning. We travelled to 20 provinces and met with thousands of women, men, tribal leaders and people from all religious backgrounds. We encouraged them to join us and contribute to the cause of girls’ education. We told them education is our basic right, it’s an Islamic right, it’s a human right.

    When the Taliban closed girls’ schools, PenPath was the first CSO to start protests against this. We started protesting in March 2022 and held press conferences against the Taliban’s decision. 

    Right now, girls’ schools are closed from grade six to grade 12 – that is, approximately from ages 12 to 18 –, which means that secondary education is out of reach for girls. People are starting to feel hopeless because it has been seven months now and girls still can’t go back to school.

    We are campaigning to reverse this every day, protesting and holding press conferences. The Taliban told the media they would open these schools soon, so now we are waiting for this to happen. We are just waiting for the Taliban’s final decision regarding girls’ education. If the Taliban don’t keep their promise and open the schools, we won’t stay silent – we will take to the streets.

    We will protest outside the Ministry of Education until schools are reopened. The reason I stayed in Afghanistan was to open all schools and to defend this fundamental right. This is now PenPath’s responsibility.

    To what extent are people able to mobilise for girls’ education in Afghanistan?

    Mobilising in Afghanistan is not an easy task. Every day we work to change the narrative around protests. We tell the media that we love our people and our country, and that is why we are fighting. But we must accept the hardships of mobilising in Afghanistan.

    We receive threats and face any challenges that come our way. I could write books about all the challenges I’ve encountered because of my work. But I prefer not to focus on the challenges: I try to share with the media just the positive things. We want to reopen schools, and we will do whatever is necessary to achieve this. We won’t be silenced.

    How does a ‘secret school’ work?

    Secret schools function inside people’s homes. Many houses in Afghan villages are sufficiently big, with very big entrance halls. Some secret schools have grades one to six (ages 7 to 12), and others have grades six to nine (ages 12 to 16). Girls usually attend the latter since the biggest problem is that now they can’t attend high school. We also have five online programmes that are specially designed for girls who can’t attend school right now due to the political situation. The vast majority of our secret schools are located in the most remote areas or in war zones. We provide them with teachers, grade divisions and the necessary infrastructure.

    In 2016 we started with 12 secret schools. These were located in a war zone area where there were no teachers available. We moved education to the houses and family teachers helped us with this. At this time, we didn’t want to promote this initiative on the media or among the government because we were afraid for the well-being of the teachers and students who took part. If they saw we had secret girls’ schools in that area, the military would try to kill our teachers.

    Right now, we have 33 secret schools in the poorest provinces of Afghanistan. These areas had no schools 20 years ago, and we were the ones who brought education to them. There are two kinds of schools in these areas: one has only one class, and the other one has up to nine classes. Girls from poor areas used to have no access to schooling, and now they do. This is what matters to us. We give girls hope. Right now, 5,000 girls are studying every day in our secret schools.

    How could international civil society support your work?

    Funding is a big challenge for us. During the last government, I had contacts with the president and the minister of education, but I’ve never had contacts with the local Taliban. This means that no one in the current administration will help us. We used to have a team of 2,400 volunteers and worked together with the government. They had a big salary budget and helped us with donations. But the majority of those officials don’t have a job anymore, and this is a problem because we are running very low on donations.

    On the ground I can manage, because all of our activities used to be in war-zone areas, which were 50 per cent Taliban-controlled anyway. I know how to talk to religious leaders and how to navigate these difficulties. But funding is a whole different thing.

    I am very active on social media. PenPath has a website, Facebook page and Twitter account. I also use Twitter, Facebook and Instagram. If international civil society or foreign CSOs want to contribute to our projects, they can always get in touch with us on social media, by email and through WhatsApp. We currently don’t receive any kind of international funding, and all our work is volunteer work. But we do need your support to continue running secret schools, public libraries, online classes and other activities. Donations would be a big help for PenPath.

    Another key way the international community could help is by putting pressure on the Taliban government to reopen schools and by supporting education in Afghanistan. Before the Taliban took over in August last year, there were still many areas with no schools, so we need help building schools, providing scholarships, distributing books and stationery and bringing all these to remote places. We need all the help we can get if we are to provide education opportunities to every woman, girl and boy in Afghanistan.

  • AFGHANISTAN: ‘Our fight for accountability has become a thousand times harder under the Taliban’

    CIVICUS speaks with Horia Mosadiq, an Afghan women human rights defender (HRD) and founder of Safety and Risk Mitigation Organization (SRMO). SRMO aims to empower, support and protect Afghan civil society activists and organisations, including those working in remote and insecure areas, and to advocate for greater state protection and accountability for any abuses they suffer as result of their work.

    Horia has extensive experience in assisting HRDs at risk and providing human rights and safety training. She previously worked as the Afghanistan researcher for Amnesty International.

    Since the Taliban takeover in August 2021, Afghanistan has experienced a human rights and humanitarian crisis. Protests,especially by women, have been dispersed with excessive force, gunfire and beatings, leading to deaths and injuries of peaceful protesters. Journalists and HRDs have been threatened, intimidated and attacked and had their homes raided.

    Why did you establish your organisation?

    Along with two other dedicated activists, I established SRMO in 2013 with a mandate to protect HRDs and civil society in Afghanistan. We founded it because there was no mechanism inside the country to respond to growing threats against activists. I was an HRD at risk for many years and was totally reliant on international civil society organisations (CSOs) such as Freedom House, Front Line Defenders and Urgent Action Fund.

    But we wanted to set up something led and run by Afghans, by people who understood the situation on the ground and could respond to the needs of Afghan HRDs who don’t speak English and don’t have access to international platforms and organisations. The whole idea behind SRMO is to reach out and protect grassroots activists, especially those in volatile areas and without international access or funding.

    What does your research reveal about the current situation of Afghan HRDs?

    We recently published a report that contains two distinct sections. The first covers the situation in 2021 until 15 August, a time when the previous government was in control and there was an elected president in charge. A clear law enforcement system, a judiciary and other accountability mechanisms were in place. They were not anywhere near perfect or even responsive, but at least they existed.

    The second section covers the events following the Taliban takeover on 15 August 2021. The whole security situation in the country changed significantly and the republic of Afghanistan was gone. The Taliban operate on the basis of Islamic ideology and renamed the country ‘Islamic Emirates of Afghanistan’. There is no law-and-order system anymore. The whole system is run by a group of mullahs with no clear accountability. Nobody knows which laws they are implementing. There is a lack of clarity and a definite legal gap. In many instances they refer to Sharia law, although we don’t have a codification of Sharia, so it is all open to interpretation. This is the situation on the ground today.

    Following the Taliban takeover, attacks against HRDs have continued and nobody has been held accountable. Many HRDs have been killed, abducted, tortured and disappeared. Between January and March 2022 alone, SRMO documented 120 violations against activists, journalists and critics, including killings and kidnappings. Even medical doctors have been abducted by the Taliban.

    Many CSOs have had to shut down and media workers and journalists have faced numerous restrictions. We documented the case of a TV journalist who interviewed a critic of the Taliban, and right afterward he and his crew were arrested and tortured, and were only released after signing statements pledging not to reveal their treatment to the international community. Many activists who protested had their passports and IDs taken away so they couldn’t leave the country and expose the truth. Activism is still happening, but civic space is increasingly shutting down.

    Contrary to the general belief among the diplomatic community, the security situation has not improved under the Taliban. Although you may not hear about many bombings or active fighting in various parts of the country, the general security situation has deteriorated. Dozens of HRDs, journalists and others have been abducted, tortured, disappeared and detained unlawfully and without any explanation. The de facto authorities are part of an abusive system. The limited accountability mechanisms that existed under the previous regime are all gone. Now no one is accountable to anyone. Our fight for accountability has become a thousand times harder under the Taliban.

    How have you conducted your work following the Taliban takeover?

    Since August 2021, our focus shifted to reactive work to provide safety and protection to HRDs at risk and evacuate them from the country. The evacuations have since slowed down, but we also support the internal relocation of those at risk. We also provide humanitarian assistance to women HRDs, as many have lost their jobs and livelihoods. So as well as facing security threats, many have lost their means of surviving, paying for food and essentials required for their family. We have tried to support some minimal living costs where possible.

    What has happened to the activists who were evacuated?

    Those who were part of an organised effort undertaken by some countries and CSOs are being looked after while they resettle. But those who fled the country to Central Asia, Pakistan or Turkey experience an extremely bad situation as they run out of funds, their visas expire and there are no programmes for their resettlement. Many are pushed back by embassies or told they need to register with the United Nations (UN) Refugee Agency and that it can take years before they are resettled.

    Some with expired visas are even being deported back to Afghanistan. I just heard that Greece has deported 500 Afghans to Turkey, which sent them back to Afghanistan. In Central Asian countries people cannot get their expired visas renewed while in the country; they must leave to get a new one, which many HRDs are unable to do. This is making it difficult for them to survive. Many activists and journalists are facing ever-growing economic difficulties. They can’t pay for rent or food. Things are particularly difficult for those with small children. Many funders don’t provide resources for HRDs outside their country.

    What can the international community do to support HRDs in Afghanistan?

    I am disappointed with the international community. The way they have responded to the Ukraine crisis is very different from how they have responded to the situation in Afghanistan. They were open to receive millions of Ukrainian refugees, whose cases were processed within weeks. In contrast, only a few countries – including Canada, Germany and the USA – have been willing to issue visas to Afghans. This is not nearly enough, as thousands are currently stranded in neighbouring countries and in need of immediate help. If they can do it for Ukraine, why not for Afghanistan? Is it because of our skin colour or because they don’t view the Taliban as the enemy? There may be politics involved but I think there is also systematic racial discrimination. 

    More positively, the appointment of the UN Special Rapporteur on the situation of human rights in Afghanistan is an excellent step. At the moment there is a vacuum of human rights monitoring mechanisms. CSOs can only do so much and having someone working with a UN mandate and the support of the international community is key. The international community should provide the UN Special Rapporteur all the necessary financial and diplomatic support and his recommendations must be taken seriously and implemented.

    Our recent report includes a series of recommendations for the international community to put pressure on the Taliban to ensure accountability for crimes committed against HRDs and to provide financial, diplomatic and political support to Afghan HRDs at risk, including by issuing humanitarian visas and funding resettlement programmes. The international community should use its leverage to pressure the Taliban to create a safer space for HRDs and journalists in Afghanistan. This issue is currently not being addressed adequately at the international and diplomatic level.

  • BANGLADESH: ‘Civil society made a lot of efforts to stop Japan financing the Matarbari project’

    SharifJamilCIVICUS speaks about the cancellation of the Matarbari 2 coal-fired power plant project in Bangladesh with Sharif Jamil, General Secretary of Bangladesh Paribesh Andolon (BAPA), a platform that organises civil society movements against environmental degradation. Since 2009 Sharif has been involved with the Waterkeeper Alliance, a global network aimed at ensuring every community’s right to clean water. He is currently the Coordinator of Waterkeepers Bangladesh and Council Member of Waterkeeper Alliance.

    What is the significance of the cancellation of the Matarbari 2 project in Bangladesh?

    The cancellation of the Matarbari 2 coal plant project is very significant because it shows global leaders living up to their commitment to fight climate change. Last year G7 countries reached an agreement to stop building coal plants and funding coal-related projects. If Japan continued to support this coal project, it would have undermined the global effort being made to tackle climate change.

    We were happy to see a few contractors also pulling out of the project. Sumitomo Corporation, one of the biggest ones, decided to back out of the project on the basis that it contradicts their new climate policy. The Japanese-owned company decided to stop building and supporting coal plants. We believe this was a major step towards the cancellation of the project.

    People living in the area where Matarbari 1 and 2 were implemented were affected by pollution caused by the projects. If it continued, people living near the coal plant would have been affected by air pollution. The coal plant also threatened to pollute water in surrounding areas, which would have also put people in danger.

    How has civil society been involved?

    Civil society made a lot of efforts to stop Japan financing the Matarbari coal project, and hard advocacy work finally paid off. We made sure to talk to community members in surrounding areas to get their views on the project. Because we listened to their concerns about the health issues the project might cause it was easier to carry out advocacy work in the communities. Environmental civil society organisations (CSOs) were able to put pressure on key stakeholders with the help of research institutions that studied and tracked global finance and investments.

    It is encouraging to see G7 countries living up to their commitments. Japan taking a position against coal financing is a huge step towards protecting the environment in Bangladesh and the rest of world. Coal-fired power plants are the biggest contributors of carbon emissions and therefore one of the biggest obstacles to climate change mitigation efforts. As civil society we are happy to see that it is possible to hold governments and multinational corporations accountable.

    However, while it is good news to see Japan backing away from coal plant projects in Bangladesh, it is also quite frustrating to see it headed towards liquefied natural gas, which is also a fossil fuel. It would be good if Japan could help Bangladesh move towards clean and renewable energies. They have the necessary technology to do so and sharing it with us would help us overcome the climate crisis we are all going through.

    What role did your organisation play?

    As an organisation we found it important to talk to scientists to understand the scientific impacts this project would have had on our environment. We also analysed the environmental impact assessment study provided by organisations that were monitoring the project. We communicated with the plant company and the government to understand their position on the fight against climate change and environmental issues in Bangladesh. Fortunately, they were willing to listen to our concerns and even invited us to their stakeholder meetings.

    The problem we noticed with this project is that the parties involved did not consider the data provided by environmental organisations. It was understood that power plants would boost industrial activity, but our argument was that these projects had to be sustainable. Doing an environmental impact assessment was therefore key. Any project that is implemented should be carried out comprehensively, inclusively and on the basis of science so that it does not harm our environment. It was frustrating that the environmental impact assessment of Matarbari 1 did not do any modelling for harmful pollutants such as fine particles (PM 2.5) or mercury, letting the plant continue functioning subjecting it to scientific scrutiny.

    In advocating against the Matarbari project we tried to let people be part of the development activities happening around them. It was important to make them understand that every development project happening in their communities had to be sustainable and promote their wellbeing, which was not the case with Matarbari 1 and 2.

    What other actions are needed to combat climate change and environmental degradation?

    Japan is a trusted partner of Bangladesh. Bangladesh has long received Japanese investment and development collaboration. We have worked for a long time with the Japanese International Cooperation Agency, which has done a lot of good. We would like to see collaboration for development continue, but it should be of the sustainable and green kind.

    The Matarbari plant project was detrimental to our environment and its activities would have polluted both our water and air. This caused unrest and protests. We want multinational corporations and governments to consider the environmental impacts of any project they intend to introduce. They should consider the long-term effects of every project as well as the country’s energy security.

    Did you receive any support from international CSOs and activists?

    Several environmental organisations in Japan and other countries helped us raise awareness about the negative impacts of the Matarbari project. Some of these organisations conducted studies and came up with recommendations on how projects could be made green and sustainable.

    But we still need support to ensure that upcoming projects aim to promote the use of clean energy and live up to environmental standards. Our country also needs resources to help it transition to clean energies. Therefore, there is further need for collaboration with governments that can help us move in that direction.

  • BANGLADESH: ‘The legal vulnerability of LGBTQI+ people leads to harassment and discrimination’

    JMBD isa human rights organisation working against all forms of discrimination and impunity for violence against ethnic, religious, social and sexual minorities and victims of torture, extrajudicial killings, forced disappearance and organised violence, including women and children. It provides legal support to victims and advocates for justice and human rights through research, awareness-raising campaigns and collaboration with various stakeholders,including other civil society groups, government agencies and international organisations.

  • BANGLADESH: ‘This is a one-sided election in which we already know who the winner will be’

    CIVICUS speaks with Dr Mubashar Hasan about the ongoing crackdown on dissent in Bangladesh ahead of 7 January general elections.

    Mubashar is a Bangladesh-born academic and social justice activist. He is a post-doctoral researcher at the Department of Culture Studies and Oriental Languages, University of Oslo, Norway.

     

    What’s the current political climate in Bangladesh?

    The political climate in Bangladesh is tense. The election is being organised under Prime Minister Sheikh Hasina, the world’s longest-serving female head of government. The main opposition party, the Bangladesh Nationalist Party (BNP), has said it’s not going to participate in an election held under this administration, arguing that there isn’t a level playing field for parties to compete freely and fairly.

    Judicial harassment is rife. In September, the New York Times reported that 2.5 million opposition activists faced judicial cases, with each facing multiple cases and some up to 400. Journalists have found that many cases against the opposition were fabricated. The police have even reportedly filed cases against BNP activists who were long dead or living abroad.

    On 28 October 2023, the opposition organised a massive rally. To stop this becoming a full-blown people-led movement, the government aggressively repressed it. A few opposition activists retaliated and then the government blamed the violence on the opposition. At least 15 people were killed, including two police officers. More than 20,000 opposition activists have been incarcerated since late October.

    This election-related violence is largely the result of state violence. Human Rights Watch recently described the ongoing developments as an autocratic crackdown. Freedoms of expression and peaceful assembly are being restricted and forcefully violated, affecting the legitimacy of the election process. Extremely politicised state institutions are being used as an extension of the ruling party, a trend many argue could lead to the materialisation of a totalitarian state.

    Is there any space for civil society to operate in Bangladesh?

    The space for civil society in Bangladesh is closed. Civil society organisations are free to operate only as long as they don’t challenge the ruling system.

    Just as in any autocratic country, there is an increasing activism going on in the diaspora. There are many Bangladeshi activists living in Australia, as well as in Malaysia, Sweden, the USA and elsewhere. BNP leader Tarique Rahman lives in exile in London.

    People in the diaspora are using the leverage that comes with living under democratic governments to spread information about what happens in Bangladesh. Those diaspora activists argue that it is their duty to expose what is going on back home.

    There are also key investigative journalists working from exile. A site called Netra News runs out of Malmö in Sweden, and it is still quite influential in exposing serious illegal acts by the government. There are several emerging YouTube commentators and analysts who have been very courageous. They have millions of followers.

    How big a problem is disinformation in Bangladeshi politics?

    Disinformation has always been a problem. Authoritarian governments don’t like the free flow of information. They want to control information and seek to discredit independent voices, just as Trump did in the USA, trashing fact as fiction and making fiction fact. And he was the authoritarian leader of a democratic country, which Bangladesh is not.

    Partisan elements within the government of Bangladesh and ruling party members treat those who dare challenge the official narrative as enemies. As I mentioned in one of my recent articles for the Diplomat Magazine, the government is the dominant force promoting political disinformation. The main opposition party has also promoted disinformation in some instances but independent factcheckers have concluded that the volume of political disinformation promoted by the opposition is miniscule compared to the government.

    There has been recent reporting by the Financial Times focused on how the Bangladeshi ruling party is using AI-driven disinformation to disrupt the upcoming election. But this is a one-sided election in which we already know who the winner will be. In this election voters do not have real choice. Why the ruling party is promoting AI-driven disinformation is therefore a mystery.

    What are your expectations for election day and its aftermath?

    Many things will unfold in the coming days. Voter turnout will most likely be low. The government will deploy military forces nationwide, perhaps even putting them in charge of distributing ballot boxes and election materials.

    There will be some violence, probably by the opposition, followed by arrests. The opposition will persist in demanding a free and fair election and the resignation of the government. Some loss of life is sadly to be expected.

    This election is also taking place within a wider geopolitical context. China, India and Russia are strongly supportive of the Bangladeshi government, whereas the USA keeps talking about free and fair elections, which puts it on the side of Bangladeshi people.

    At this point, not much is in the hands of Bangladeshi people. Without effective external pressure towards democracy, change is unlikely. Civil society’s work will only become more challenging in Bangladesh as the government steps up its repression.

    Founded in 2015, the Quill Foundation is an Indian civil society organisation (CSO) engaged in research and advocacy. Its work focuses on the human rights issues faced by underprivileged people, especially Adivasis, Dalits, Muslims, women, sexual minorities and differently abled persons.

    Why was the use of the hijab banned in Karnataka schools? 

    The hijab ban should be seen in the wider socio-political context of India. Since the beginning of 2022, Indian Muslim women have been subjected to violence and discrimination carried out by multiple offenders. It started with an app called ‘Bulli Bai’ that placed vocal Muslim women in an online auction. This violated their privacy, as it used their photos and information without their consent.

    Shortly after that, girls wearing the hijab were not allowed to enter a couple of colleges in Karnataka state in southwest India because the administration deemed the hijab a violation of the dress code for schoolgirls. This was followed by a Karnataka government order on 5 February. While this government order did not specifically ban the hijab, it did say that such ban would not violate Article 25 of the Indian Constitution, which guarantees all citizens the right to freedom of conscience as well as freedoms to profess, practise and propagate religion. As the girls who were restricted from wearing the hijab filed petitions in the high court, the verdict decided against them and chose to impose what they should wear. Both the state government and the high court used the excuse of maintaining ‘uniformity’ in educational institutions to impose restrictions on Muslim women wearing the hijab.

    Following that order, several incidents of discrimination and violence against Muslim women were reported. They could not enter their educational institutions if they did not remove their hijab. Although the order did not include teachers, Muslim teachers were also asked to remove their hijab or burqa, a full body covering, at the gate of the campus. 

    How does the hijab ban relate to the overall status of minorities in India? 

    The hijab ban is arbitrary. it goes against India’s constitutional promise of secularism and fits into the trend of authorities using the law to criminalise minority communities. For instance, Karnataka’s anti-conversion law set barriers on converting to Islam or Christianity and made it more difficult for interfaith couples to marry. Following this law, the Christian community faced rising threats and violence as well as increased attacks on their places of worship.

    Generally speaking, minority communities are subjected to vilification because they are framed as ‘the other’. The Muslim minority is a specific target of persecution. At mass assemblies of the Hindu community, calls are often made for the genocide of the Muslim community and the mass rape of Muslim women. Calls for social and economic boycott of Muslims have been repeated frequently over the past few years. This has included taking mass oaths to boycott Muslims.

    Muslim business owners have suffered the full brunt of this incitement. In the states of Gujarat and Madhya Pradesh, some Muslim-owned shops have been set on fire by rioters or demolished by the very same authorities that should protect them. The perpetrators of such communal violence enjoy impunity and face no consequences. 

    The restriction on the use of the hijab was introduced in the context of this rising culture of intolerance. Even though the court limited the restriction to within the classroom, it has been implemented far and wide, including to suspend Muslim women teachers and other working Muslim women. 

    What are the implications of the hijab ban for women’s rights?

    The high court’s verdict, which kept the ban on the basis that the hijab is not an essential part of Islam, erased Muslim women’s free will to choose for themselves and violated not only their right to education but also their freedom of practise their religion. 

    Several studies suggest that due to systematic discrimination against the Muslim community, Muslim women in India encounter extreme hurdles in accessing education, especially higher education. In this context, the hijab ban is patriarchal and regressive in nature, because it makes decisions on behalf of Muslim women regarding what to wear and how to practise their faith.

    The decision further pushes Muslim women out of educational spaces and places them under threat in any public space. More than 400 Muslim girls have already been not allowed to appear for their exams and are facing distress, and attacks on Muslim women wearing hijabs and burqas have also increased across India. But the authorities have still not acknowledged the violence that Muslim women are going through.

    How has civil society responded to the ban?

    There have been protests on two fronts. The girls who have been directly affected by this restriction are protesting outside their college gates and holding demonstrations in other public spaces. But they are facing intimidation and threats by Hindutva vigilante groups while also being warned that they will be criminally charged for protesting. 

    In bigger cities, protests are also being organised by human rights CSOs and Muslim groups, and particularly by Muslim women. 

    Following the Karnataka high court ruling, CSOs have played an important role in raising awareness about the implications of the verdict. Several CSOs rejected the court order while also producing analysis to help the public understand its intricate legal language.

    Civil society has been able to respond in a tangible and timely manner, offering unconditional solidarity and support to the schoolgirls affected by the order and experiencing trauma resulting from violence, discrimination and harassment in the aftermath of the high court order. Some CSOs have offered mental health counselling and other services.

    Other CSOs have offered litigation support, in two forms: first, by representing individual cases of religious discrimination and providing legal support to those who missed out on exams due to the ban; and second, by petitioning on larger issues before courts of law. There have been several petitions before the Supreme Court of India to challenge the Karnataka high court order.

    In short, the civil society response has been key because of its capacity to play a full range of roles to drive change, from the micro to the macro level. An effective civil society is essential for advancing human rights in India, and the international community can play a vital role in reinforcing the work of local CSOs to amplify marginalised voices.

  • INDIA: ‘Muslim girls are being forced to choose between education and the hijab’

    Founded in 2007, BMMA is an independent, secular, rights-based civil society organisation (CSO) that advocates for the rights of women and the Muslim minority in India.

    Why have girls wearing the hijab been banned from school in Karnataka state?

    Girls in hijab were denied entry into classrooms in the name of the school uniform rules, with the authorities citing a circular that states that each student must comply with the uniform requirement in school. Both the Karnataka government and the high court played the uniform card to justify preventing Muslim women wearing the hijab from entering the college campus.

    While educational institutions undeniably have the right to set their own rules, these cannot infringe the fundamental rights granted by the Indian Constitution. According to Article 25 of our constitution, all citizens are guaranteed the right to freedom of conscience as well as freedoms to profess, practise and propagate religion.

    And under no circumstance can a dress code for schoolgirls be more important than education itself. Muslim girls have the right to be in school with or without the hijab, which is why I oppose those who promote the court’s verdict as a decision that empowers women. Although I don’t believe in the hijab, I think it is wrong to discriminate against girls wearing it. Our nation will only progress when girls have access to education regardless of their religious affiliation.

    Does the hijab row indicate the rise of anti-minorities voices in India?

    Although it may sound like an internal disciplinary matter over girls wearing the hijab, the wider context of the hijab row is one of religious polarisation and politics of hate towards Muslims. The hijab row is an integral part of the politics of religious hate in India’s polarised milieu, where Muslims are the target of the growing anti-Islam propaganda aired on TV as well as on social media platforms.

    There is a spiralling nationwide campaign against the Muslim community under the garb of religious festivities. Journalists and other monitors have found deliberate, concerted violence against life, property and businesses of India’s Muslim community carried out by hooligans claiming to celebrate religious festivals in the states of Delhi, Gujrat, Karnataka and many others. But ultimately, the Indian state must be held responsible for the terrible living conditions experienced by millions of Muslims.

    How has civil society responded to the ban?

    Civil society has extended solidarity to the affected girls and has supported them. However, civil society’s response has so far failed to impress the government and the high court, which sadly ruled to uphold the hijab ban inside classrooms in Karnataka state.

    As for opposition parties, they have been unable to run a sustained campaign to challenge the climate created by hate speech and open calls for the genocide of Muslims. This is why it’s so important for the international community to stand up and support the voices of sanity in India.

    What have pro-hijab protests achieved so far?

    Peaceful protests have been held in support of Muslim women’s right to wear the hijab in educational institutions. However, I am afraid that conservative elements of the Muslim community got involved in the protests in a way that aggravated matters, making Muslim girls and their families even more vulnerable to political onslaught.

    In my understanding, neither the hijab nor the burqa, a full body covering, is mandatory in Islam; however, patriarchal elements would like to put every Muslim girl and woman behind a burqa or hijab. The matter could have been easily resolved through dialogue between college authorities and parents. Instead, it got politicised, with different religious and political outfits jumping in the fray with their radical and antagonistic positions.

    As a result, Muslim girls found themselves in a tough position, being forced to choose between education and the hijab, which is outright unfair to them. Since many Muslim parents will not allow girls to go to school without the hijab and schools will not give them entry into class with the hijab, many girls have dropped out of their studies and have not sat their exams.

  • INDIA: ‘The government is dealing with dissent in very concerning ways’

    Sudha BharadwajCIVICUS speaks Sudha Bharadwaj, a lawyer and long-time human rights defender working for the rights of workers and Indigenous peoples in India.

    Sudha wasarrested and detained in August 2018 under the draconian Unlawful Activities Prevention Act and accused of having links with Maoist terrorist organisations. Alongside 15 other human rights defenders, she was further accused of conspiring to incite violence among the Dalit community. Despiteproof that incriminating evidence against them was planted,concerns expressed by United Nations (UN) experts about the arbitrary charges and UN calls to release political prisoners from crowded jails during the pandemic, requests for Sudha’s release, including on health grounds, were repeatedlyrejected. She was finallyreleased on bail in December 2021 after three years in detention.

    How did you get involved in human rights work?

    For the last 35 years I have been working in Chhattisgarh, an area in eastern India that is very rich in mineral resources. I began around 1986 as a trade unionist and worked with a legendary union leader, Shankar Guha Niyog, who was organising iron ore miners. Conditions were appalling. Workers were not unionised, working hours were long, wages were very paltry and even the very basic labour laws of our country were not being applied.

    I became a lawyer basically because my trade union needed one. I graduated in 2000, at the age of 40. I initially took up matters of our own union and later I shifted to work at the high court, where I realised contractual workers, farmers resisting land acquisition and Adivasi Indigenous groups resisting mining projects were forced to face very expensive corporate lawyers without any real legal assistance. They needed lawyers who understood them and who could devise legal strategies compatible with the tactics of their movements.

    I started a group of lawyers to provide legal aid to unions, farmers’ and village organisations, Adivasi communities, and civil society organisations (CSOs). Around this time, I became involved in the People’s Union for Civil Liberties (PUCL), one of the oldest human rights organisations in India. We dealt with various human rights issues, including attacks and harassment of minorities and the criminalisation of Dalits and Adivasis under false accusations of having links with armed Maoist groups, also called Naxals. We took up several cases in which security forces fired on villagers accused of being Naxalites. We were eventually able to prove that these were false accusations.

    I dealt with cases against big corporations, so I made powerful enemies. By taking up cases of Adivasis I also annoyed the government. In 2018 I was teaching a course at the national lawyer’s university in Delhi and that’s when I was arrested.

    Can you tell us about your experience in detention?

    Because the case was in Pune, I was initially sent to the women’s wing of the Yervada central jail, which is a prison for convicts. I was taken there with another activist, Shoma Sen. As soon as we were brought there, we experienced attacks on our dignity. We were asked to strip and squat. We were isolated: kept in separate cells, unable to communicate with other prisoners, led out into a yard for only half an hour a day. We were under constant surveillance.

    In the winter it was very cold. We spend most of the time reading, although we struggled to get books. Because the library was in the men’s side of the jail, only 25 books were brought at a time. We were allowed to keep only two or three with us in our cell. We also had issues with access to water and sometimes had to carry in buckets. Shoma struggled with severe arthritis. 

    Later on, the National Investigation Agency (NIA) took over our case, so we were moved to Byculla jail in Mumbai. This jail was extremely overcrowded, and we lacked any privacy. We would sleep right next to one another on coffin-sized strips of the floor which were allotted to us by the kamwali (staff) in charge of the barracks. There were also limited bathrooms to share.

    Social distancing was impossible, and during the second wave of the COVID-19 pandemic, many detainees got infected and were stuffed in a quarantine barrack. I did not become seriously sick but both Shoma and I requested medical bail due to underlying conditions. This was systematically denied.

    Due to the pandemic, we were totally cut off from the outside world and were not taken to the courts for about five or six months. Then PUCL and other groups requested the Bombay High Courts to authorise telephone calls and we were allowed to speak to our families for 10 minutes once a week. Our lawyers could talk to us by sending an email to the jail, and the jail would allow us to phone them back - for 10 minutes, twice a week. That’s how we were able to tell them about prison conditions. I also tried to help people around us who were old or sick to write petitions.

    How did you feel when you were finally granted bail, and what’s next?

    The bail order was issued on 1 December 2021. I felt extremely disappointed that other activists linked to the case were not released with me. My request for bail was accepted on technical grounds. I heard the NIA appealed to the Supreme Court to overturn my bail, but it was immediately dismissed.

    On 8 December I was taken to the court, given cash bail, and asked to produce sureties. When I came back to the jail, many detainees celebrated for me and gave me their requests. I was released the next day.

    The bail conditions have restricted me to Mumbai, which is not my city. Friends have been very helpful, but I don’t have a home or work here so I’m still trying to adjust to the situation. I would like to continue my practice on behalf of prisoners and trade unions. For now, I have to attend court hearings and check-in at the police station every two weeks.

    How have the conditions for activism in India changed while you were in jail?

    Even before I went to jail things were already challenging, but since I was released, I have seen increasing attacks against minorities, notably Muslims. There has been a rise in hate speech, which seems to be manufactured and copiously funded, especially on social media.

    The Citizenship Amendment Act (CAA), passed in December 2019, is discriminatory against minorities. There was a strong movement against the CAA law, in many places led by Muslim women, but this was shut down due to the pandemic.

    We are also seeing that many institutions that are supposed to be independent – such as the Election Commission and investigating agencies – are being manipulated by the government. There are even concerns about the independence of the National Human Rights Commission, which has failed to take a proactive role on many important issues. The undermining of these institutions will affect their roles in their future, even if the government changes.

    The government is dealing with dissent in very concerning ways. One clear example is the increasing surveillance of journalists, activists, and advocates. A lot of us involved in the case had our phones infected by Pegasus spyware. We have approached the Supreme Court-appointed Technical Committee looking into the use of Pegasus against Indian citizens and it has decided to request our phones from the NIA and undertake an inquiry.

    There are also concerns about the impacts of the Foreign Contribution (Regulation) Act (FCRA) on civil society. If you advocate for workers, Indigenous peoples or poor communities, your work is considered a political activity and you are barred from doing it. Larger CSOs with FCRA registration should be able to support smaller CSOs on the ground, but the government is depriving them of the ability of distributing funds to local grassroots groups and reaching out to real beneficiaries.

    Where do you see positive change coming from in India?

    One beacon of hope is the farmers’ movement. The opposition was against the farm bills proposed by the government, but it was unable to stop them. It was farmers themselves who stopped them, by standing their ground for almost one year in the heat, cold and rain. Thousands of criminal cases were brought against farmers, and they were smeared as terrorists. But they managed to hold their ground, build unity and push back. The key lesson here is that people must get organised.

    I think that if it hadn’t been for the pandemic, the anti-CAA law movement would have had similar results. Students are also an important force, but we are seeing them facing attacks to prevent them organising and speaking up. But they will find a way to continue their struggle.

    At a time when many internal mechanisms are failing us, international scrutiny and pressure are also key to improving the situation. There are international standards India cannot ignore. But of late, the Indian government has taken a problematic attitude towards UN bodies, including UN missions to Kashmir, and has gone as far as preventing people from speaking at or participating in international conferences. When UN Special Rapporteurs have made comments on human rights in India, the response has been dismissive and disparaging.

    The government often uses terrorism and national security as an excuse for all kinds of human rights abuses. It is important to put the spotlight on this and not let the government get away with it.

  • INDIA: ‘The hijab ban is just another tool used by right-wing politicians to remain in power’

    CIVICUS speaks about the recent ban on the hijab, a headscarf worn by Muslim women, in educational institutions in the Indian state of Karnataka with Syeda Hameed, co-founder and board member of the Muslim Women’s Forum (MWF).

    Founded in 2000, MWF is a civil society organisation (CSO) working for the empowerment, inclusion and education of Muslim women in India. Its primary goal is to provide Muslim women with a platform for expressing their aspirations and opinions on matters directly affecting their lives.

    How did the hijab row start?

    The controversy started in the town of Udupi, a small secular district of Karnataka state in southwest India, where girls wearing the hijab were not allowed to enter a college campus because the administration deemed it a violation of uniform rules. Some students protested against the ban, and protests escalated into violence.

    From this tiny part of Karnataka, the hijab row spread to other parts of the country. In response to Muslim women wearing the hijab on campuses, many Hindu students took to wearing saffron shawls, a colour seen as a Hindu symbol.

    The matter reached a Karnataka high court as some Muslim students filed petitions claiming that they have the right to wear the hijab under the guarantees provided by the Indian Constitution. But the high court’s verdict kept the ban, arguing that the hijab is not an essential part of Islam. Surprisingly, the bench in Karnataka includes one Muslim woman judge.

    What triggered the decision by Karnataka’s educational institutions?

    The decision to ban Muslim students from wearing the hijab in colleges’ premises came as a surprise. Such a ban is strange to our society. Unlike in France, where it has long been under the spotlight, the hijab had until very recently never been prohibited in India.

    Karnataka state is known for its diverse society and pluralistic culture, with the two major religious groups, Hindus and Muslims, historically coexisting, along with a wide spectrum of other religious groups.

    However, the roots of the Karnataka hijab controversy are quite deep, and are linked to growing Islamophobia. Those in power have ignited a sectarian fuse all over India in every possible way. Right now, Karnataka state also has a right-wing government, which has created fertile ground for strain in Hindu-Muslim relationships.

    To them, the hijab ban is just another tool to remain in power. It is tied to current political events, notably the upcoming December election. Right-wing politicians fabricate issues that target Muslims, who are depicted as the ‘disruptive other’, to divert people’s attention from dire economic conditions. The hijab ban did the job well, as it captured media attention. Sensational media coverage only added fuel to the fire.

    How do you view the hijab ban from a gendered perspective?

    The hijab ban is a complete violation of women’s rights to express their own identities. It should be my choice alone whether to wear the hijab or not. I am a believing and practising Muslim and I don’t wear the hijab. Muslim women of my generation usually did not wear the hijab, but younger generations of Muslim women across the globe do. I see it as a search for an identity in the face of the charged atmosphere created by Islamophobia. Indian Muslim women have worn the hijab for about a quarter of a century.

    We don’t oppose school uniforms because there is good reason for them, especially in a country such as India and all other South Asian countries, where both religious diversity and social inequality lead to differences in dress. But the use of the hijab in educational institutions had never been put to debate before the current Karnataka right-wing government suddenly considered it a violation of the school uniform rules.

    As I said, in my generation very few girls wore the hijab, and therefore my uniform was skirt and blouse, which was acceptable at the time. Later, when girls started wearing the hijab, the situation escalated from establishing that their hijab should match the school uniform colours to starting to throw them out of schools.

    What is the overall status of Indian Muslims as a minority?

    As a former member of government, I observed the status of minorities change over time. From 2004 to 2014 I was a member of a now-extinct Planning Commission that was entrusted, among other responsibilities, with bringing minorities up to mark with society in every way possible. For ten years, we devised all kinds of schemes in the areas of education, employment and health, and tried to ensure minorities made the most of them. Our main tasks were to make these plans and ensure their implementation across the country by persuading the governments of India’s states to embrace them.

    Change was slow because we did not have the power to force implementation. A key moment was when the government commissioned a report on the status of Muslims that provided a very candid conclusion by a retired Supreme Court judge. It stated that India’s 200 million Muslims, the second largest Muslim population in the world, had the lowest status on all social and economic parameters when compared to other religious groups. It should have been a wake-up call for the Indian government.

    But since then, it has only got worse. Recent so-called ‘Hindu religious gatherings’ include a call for the genocide of Muslims. Some have suggested that the saffron flag should replace India’s national flag. Many decisions have been made in violation of the constitution. This is an extremely difficult moment for Muslims in India. 

    And the hijab ban is very much part of Muslim marginalisation. Muslims are being driven to a corner and targeted by a right-wing government that demonises them to boost their support and remain in power.

    How has civil society responded to the ban controversy?

    Many CSOs have raised the issue and protested against the ban. Voices have also raised internationally, both from civil society and from influential individuals, as was the case of US congressional representative Ilhan Omar. Maybe if they became louder, these voices could drive positive change in the lives of India’s Muslims, which are becoming exceedingly difficult.

    Frankly, at times I feel it is a losing game. 

    All international attention that was paid to the ban has damaged the image of India without really making a dent on those in power, who only care about the upcoming general elections.

  • INDIA: ‘The once-cosmopolitan state of Manipur is now divided into two rival communities’

    CIVICUS speaks about ethnic violence and a humanitarian crisis in the Indian state of Manipur withMangneo Lhungdim and Sulekha Thapa, Executive Director and Deputy Director of Oasis India.

    Founded in 1994, Oasis India is a civil society organisation (CSO) working to prevent human trafficking and other forms of violence against women and children and support people so they can flourish in their community. Oasis India has also been involved inemergency relief work in Manipur.

     

    What triggered ethnic violence in Manipur state?

    Manipur and a few other northeastern states of India endured severe ethnic violence until the mid-1990s and into the early 2000s. But over the past two decades rights-based reconciliation and development efforts gained momentum, including infrastructure development initiatives that ultimately benefited local communities.

    In this new context, the conflict between the majority Meitei people living in the Imphal Valley and the Kuki-Zo tribal community from the surrounding hills, now into its eighth month, could definitely have been prevented. As retired military and police officers have claimed, public order could and should have been restored within the first month of the conflict in May 2023. The state administration, supported by central security forces, had the capacity to contain the violence and prevent further displacement and killings.

    The conflict is believed to be a collateral outcome of valley Meitei people demanding inclusion on the Scheduled Tribes list under the Constitution of India, which tribal communities interpreted as an attempt to grab their land. On 3 May 2023, the tribals of Manipur, under the aegis of All Tribal Students Union Manipur, carried out a protest march in most hill districts, including Churachandpur. Violent incidents during the Churachandpur march spiralled and spread statewide, turning into senseless killings, arson and displacement.

    It’s difficult to identify particular reasons behind this outbreak of violence since the media coverage was initially limited and subsequent reports by independent journalists gave mixed messages and focused primarily on day-to-day events. Nevertheless, the government must fully acknowledge its responsibility and admit that it bears significant blame for such escalation of a latent ethnic conflict.

    The once-cosmopolitan state of Manipur is now divided into two rival communities and there’s no prospect of the conflict ending any time soon, as there are no substantial peacebuilding efforts by the state or national government. The only hope of restoring normality in life and livelihoods in Manipur comes from collaborative efforts undertaken by local CSOs and leaders.

    What’s the current situation on the ground?

    The situation is relatively more stable now than during the initial three to four months of the conflict, but it still remains challenging. The deployment of over 50,000 central security personnel has led to increased militarisation.

    The violence affects every aspect of the lives of people of all ages.

    Agriculture is the primary occupation in the region, but a majority of farmers missed the sowing and harvest seasons due to curfew regulations and lack of resources. This has deprived them of earnings to meet the basic needs of their families and resulted in shortages of staples.

    Over 60,000 people have been forcibly displaced and currently stay in camps where CSOs are the primary providers of humanitarian aid. Road communications from Manipur’s capital city, Imphal, to affected districts are severed, which complicates the delivery of relief and affects local businesses.

    The strict curfew forced schools to close, causing children to miss several months of education and delaying the start of the new academic year. Healthcare services have also been disrupted. Even burying the dead was impossible for a long period, though some improvement has been noted over the past few days, when the remains of 64 people were taken back to their homelands.

    The emotional impact on the residents of Manipur is profound. People have lived in fear and anxiety for a long time, and many have lost family members or their homes.

    How has Indian civil society, including Oasis, worked to address the humanitarian crisis?

    Several Indian CSOs have responded to the humanitarian needs in both the hills and valley districts of Manipur. In the hill districts, the primary providers have been local churches, national aid agencies, volunteers and philanthropic organisations. Many families continue to rely on supplies and assistance provided by civil society and the neighbouring states of Assam, Mizoram and Nagaland.

    Civil society is working to improve the lives of internally displaced people sheltered in relief camps. Those in Churachandpur, for instance, receive vocational training, including tailoring and computer courses. Those who already have specific skills are provided with craft materials such as wool and weaving sets, to knit sweaters and woollen caps, while others have received bamboo wood and plastic knitting wire to make stools. This has become a source of income for many people, making a huge difference in their lives.

     

    What challenges have you faced in doing your work?

    For Oasis India and various aid agencies, the primary challenge has been delivering relief to the valley areas of Manipur, as the national highway was cut off, making it impossible to transport essential supplies without a security convoy. Food and hygiene kits were mainly sourced from neighbouring Mizoram and Nagaland, incurring high costs and taking 15 to 17 hours on a rough road to deliver supplies to tribal districts.

    Over time, Oasis started to assist people in relief camps but could only help displaced people from the Kuki-Zo tribes. Despite efforts by our senior management to overcome obstacles, there have continued to be security challenges in reaching out to the Meitei community.

    Yet another significant problem lies in mobilising resources for relief from national and international donors. The conflict’s nature as being between ethnic communities, which has been projected as having a political colour, has caused many funders to shy away.

    What should be done to resolve the conflict, and how should the international community help?

    International aid is insufficient. Since May 2023, neither the European Commission’s Civil Protection and Humanitarian Aid Operations department nor the United Nations Children's Fund have stepped in to provide humanitarian assistance to Manipur. The same is true for the Prime Minister National Relief Fund and the Prime Minister's Citizen Assistance and Relief in Emergency Situations Fund. The international community must collaborate with local CSOs that continue taking the lead in providing aid.

    For a genuine resolution to the conflict, both the Kuki-Zo and Meitei communities must come to the table, engage in dialogue and avoid any hate speech, and collaborate to establish peaceful coexistence. To facilitate this, a ceasefire should be agreed at all buffer zones. Given the loss of trust in the state government by the tribal Kuki-Zo people, an independent empowered authority could potentially broker a ceasefire between the two warring communities. There are enough sensible people and peace-loving activists in both communities who can play critical roles in bringing about reconciliation and peace.

    To put an end to the violence and prevent its repetition, perpetrators, regardless of ethnicity, should be held accountable. The Supreme Court has ordered the formation of at least 42 special investigation teams to prosecute conflict-related crimes, so at least there’s hope in this regard.

  • INDIA: ‘We have achieved a historic labour rights win for female Dalit workers’

    Jeeva MCIVICUS speaks about a recent labour rights victory in India’s garment industry with Jeeva M, General Secretary of the Tamil Nadu Textile and Common Labour Union (TTCU).

    TTCU is a women-led independent and majority Dalit trade union of textile workers that represents 11,000 female workers in Tamil Nadu, India. Jeeva, who hails from the Dalit community, has worked for more than five years in the Tamil Nadu textile industry, including at Eastman Exports. She is a founding member of TTCU and has led struggles for decent work and violence-free workplaces in the garment industry for more than a decade.

    What is the Dindigul Agreement, and how significant is it?

    The Dindigul Agreement was signed in April 2021 by TTCU and Eastman Exports, one of the largest textile producers in India, which supplies knitwear, apparel and accessories to major global clothing brands. Its aim is to end caste-based and gender-based violence and harassment (GBVH) at Eastman factories and spinning mills in Dindigul, a city in India’s Tamil Nadu state.

    This is a historic labour rights win for around 5,000 mostly female Dalit workers, who are placed at the bottom of India’s caste system.

    The Dindigul Agreement includes an enforceable brand agreement (EBA), a type of legally binding agreement in which multinational companies commit to use their supply chain relationships to support a worker-led or union-led programme at particular factories or worksites. In this case, TTCU, the Asia Floor Wage Alliance (AFWA) and Global Labour Justice-International Labour Rights Forum (GLJ-ILRF) have signed an EBA with the multinational fashion company H&M, which requires H&M to support and enforce the Dindigul Agreement. If Eastman Exports violates its commitments, H&M must take steps to penalise the company, including by reducing business, until it comes into compliance.

    This agreement is the first of its kind in India, the only EBA to cover spinning mills and the first to include explicit protections against caste-based discrimination, a problem that intensified during the pandemic.

    The Dindigul Agreement is in line with the International Labour Organization’s Convention 190 concerning the elimination of violence and harassment in the workplace. It creates structures that will empower female workers, supported by their union, to monitor and seek redress for GBVH. It also provides a new model for brands, suppliers and trade unions to cooperate to prevent and respond to GBVH in garment supply chains.

    What tipped the balance in favour of the agreement after so many years of efforts?

    Civil society has advocated for better working conditions for Dalit workers for many years, but it was not until the murder of Jeyasre Kathiravel, a Dalit woman garment worker and member of TTCU, that we succeeded in addressing the extreme problems of GBVH pervasive in this industry. The killing of Jeyasre by her supervisor in January 2021 prompted TTCU to shed light on the situation at the factory where she was killed.

    In response, TTCU, AFWA and GLJ-ILRF formed a unique partnership and launched the #JusticeforJeyasre campaign in India and other Asian countries as well as in Europe and the USA. Over 90 international unions, labour groups and women’s rights organisations joined to urge international brands and Eastman Exports to sign a binding agreement to end GBVH.

    A year-long campaign ensued, including an international vigil for Jeyasre held across 33 countries and an 11-city speaking tour across the USA to raise awareness about her case and the need to address GBVH in global supply chains. This enabled the civil society coalition to lead the negotiations that concluded with the historic agreement.

    What other challenges do Dalit workers face in India, and what needs to be done to improve their situations?

    Caste discrimination permeates every aspect of society. Due to its systemic nature, workplaces and supply chains are likely to be affected by it unless special measures to counter it are put in place.

    For instance, Dalit workers experience poorer working conditions than non-Dalits, including longer working hours, sexual harassment, lower wages, dirtier or more hazardous tasks and abusive language and gestures. We also face discrimination at the hiring stage – for instance, qualified applicants from Dalit communities are not considered for skilled jobs – and encounter discrimination in accessing services and utilities offered by the employer, such as housing, healthcare and education and training.

    With approximately 80 per cent of the bonded workforce coming from the Dalit community, strong measures need to be put in place to address bonded or forced labour and to ensure that employment in this sector is not forced.

    Important measures to advance Dalit workers’ labour rights include ensuring the freedom of association and collective bargaining, improving working conditions, paying living wages and implementing binding agreements such as the Dindigul Agreement to address caste-based discrimination and GBVH in sectors where the workforce is mostly made up of Dalit women.

    What’s next for the civil society groups involved in the Dindigul Agreement?

    Through the campaign and negotiation process, TTCU built strong forward momentum and gained respect from the factory and brands. TTCU, AFWA and GLJ-ILRF have built a powerful coalition of unions, women’s rights groups and Dalit rights advocates, among others. Now the agreements have been signed, we need to keep that momentum. We will continue to keep our allies engaged in the implementation phase and as we work to drive industry-wide change.

    We see the Dindigul Agreement as part of a regional movement against GBVH in garment supply chains. We plan to use it as a model for organising against GBVH across the industry and the region. We are already calling on more brands to join this agreement and working with them to expand it. There will surely be challenges, but we are confident we will overcome them.

  • India: Halt judicial harassment of rights groups over foreign funding

    CIVICUS, the global civil society alliance, condemns the recent case filed by the Central Bureau of Investigation (CBI) against the Centre for Promotion of Social Concern (CPSC) and its programme unit called People's Watch on allegations of 'conspiracy' and 'illegal foreign funding withdrawal' under the Foreign Contribution (Regulation) Act (FCRA), 1976.

  • India: Human rights defender Sudha Bharadwaj spends another birthday in detention

    Human rights defender and lawyer Sudha Bharadwaj will be spending her 60th birthday in detention today, more than three years after she was arrested on baseless charges under a draconian anti-terror law. Global civil society alliance CIVICUS calls on the Indian government to halt the ongoing persecution against her and release Bharadwaj immediately and unconditionally. 

    Bharadwaj has been in pre-trial detention since August 2018, when she was arrested under the draconian Unlawful Activities Prevention Act (UAPA) and accused of having links with Maoist terrorist organisations. She and 15 other human rights defenders were further accused of conspiring to incite members of the marginalised Dalit community in relation to violence which erupted in Bhima Koregaon village in the Pune district of Maharashtra in January 2018.  

    Bharadwaj was initially held under house arrest until October 2018, when she was moved to Byculla Women’s Prison in Mumbai. This is her fourth birthday in prison. 

    “Instead of celebrating her birthday with family and friends, Sudha will be alone in Byculla prison because she chose to speak up for the rights of Indigenous people and workers. Her detention highlights the systematic misuse of security laws by Prime Minister Narendra Modi’s government to clamp down on dissent and silence human rights defenders”, said Josef Benedict, CIVICUS Asia Pacific researcher. 

    Her multiple pleas for bail including for underlying health issues have been opposed by the National Investigation Agency (NIA), despite calls by the UN to decongest prisons and release political prisoners during the pandemic. There are  serious concerns about the validity of evidence against her. A report in March 2021 by a U.S. digital forensics firm has raised questions about incriminating letters presented as evidence to implicate Bharadwaj and the other activists. The letters were found on an activist’s laptop which is thought to have been hacked. 

    UN experts have expressed concerns about the terrorism charges laid against Bharadwaj and about the UAPA in general, particularly with regards to its vague definition of ‘unlawful activities’ and ‘membership of terrorist organisations’ which have been routinely used by the government to stifle dissent. 

    “The Indian government must stop using restrictive national security and counter-terrorism laws against human rights defenders and dissenters. The laws are incompatible with India’s international human rights obligations and become tools for judicial harassment” added Benedict 

    Sudha Bharadwaj is one of a group of leading human rights defenders who feature in CIVICUS’ global campaign #StandAsMyWitness. The campaign urges people to call for an end to the imprisonment and harassment of human rights defenders across the world. CIVICUS encourages people to share the defenders’ individual stories on social media using the hashtag #StandAsMyWitness. 

    India’s rating was downgraded by the CIVICUS Monitor from ‘obstructed’ to ‘repressed’ in December 2019.

The judicial harassment he is facing highlights the repressive environment for activists and critics in Indian administered Jammu and Kashmir.

  • INDONESIA: ‘We must become an example of successful societal resistance against the threat of autocratic rule’

    MuhammadIsnurCIVICUS speaks about the upcoming general election in Indonesia with Muhammad Isnur, chairperson of the Indonesian Legal Aid Foundation (YLBHI) and Secretary of the Board of theHuman Rights Working Group.

    Founded in 1970, YLBHI is a human rights civil society organisation (CSO) that provides legal aid to excluded communities throughout Indonesia and engages in research, advocacy and empowerment initiatives. Every year the organisation receives at least 3,500 legal complaints and requests for assistance.

    What is at stake in the upcoming general election?

    The upcoming election will define Indonesias trajectory amidst a trend of growing authoritarianism. The incumbent government led by President Joko Widodo, known as Jokowi, is responsible for numerous human rights violations. It has targeted poor people through evictions and arrests, weakened anti-corruption efforts and criminalised civil society.

    Jokowi has expressed support for the presidential candidacy of Prabowo Subianto, who faces allegations of crimes against humanity, including abductions and enforced disappearances of activists during mass protests in 1998 that led to the downfall of the Suharto dictatorship. He was dismissed from the military but hasn’t faced accountability and his victims haven’t received reparations, and some remain missing. His victory would be the worst possible scenario for civil society.

    Jokowi has also undermined the rule of law to pave the way for his 36-year-old son, Gibran Rakabuming, to become a vice-presidential candidate. The controversial Constitutional Court ruling issued in October 2023 to grant him an exception to the legal minimum age of 40 to run for president or vice-president was delivered by Chief Justice Anwar Usman, who happens to be Jokowi’s brother-in-law. Gibran represents the interests of the Jokowi government and corrupt and authoritarian economic elites.

    If the ruling elite succeeds in arbitrarily extending its power, there is risk of a resurgence of the kind of authoritarian and oligarchical rule we saw during dictatorship from 1966 to 1998.

    Who are the other contenders, and what are their human rights records?

    The other candidates are Ganjar Pranowo and Mahfud MD of the Indonesian Democratic Party of Struggle, which has a long history of wielding power and currently holds the highest number of ministers in the government. Mahfud has defended the Jokowi government for many years and denied the gross human rights violations committed by Indonesian security forces against Indigenous Papuans.

    We’ve also documented numerous human rights violations in Central Java during Ganjar’s tenure as governor. In Kendeng, despite a court decision favourable to the local community opposed to the construction of a cement factory, Ganjar reissued an environmental permit for the construction to proceed. In Wadas, he facilitated the implementation of a mining project aligned with Jokowi’s agenda, disregarding opposition from the local community, which also faced extraordinary repression, including arrests and beatings by the police and disruptions of internet and electricity services.

    The third pair of candidates, Anies Baswedan and Muhaimin Iskandar, in contrast, position themselves as advocates for change. Anies has a social agenda focused on protecting poor people. But they receive support from parties that are integral to the existing power structure and have also backed laws that weakened labour rights and undermined the Corruption Eradication Commission.

    What are the prospects of the election being free and fair?

    The public is concerned about Jokowi’s numerous efforts to make the election unfree and unfair. First, although he later denied it, under the pretext of COVID-19 he planned to amend the constitution to stay for a third term. He then focused on building a political dynasty. He supported his son-in-law and his son to be elected as mayors in Medan and Surakarta. Civil society reports suggest the police and army played an influential role in their victories. Concern persists as Jokowi has signalled support for the Prabowo-Gibran pair and ordered his officials to back his son’s campaign, even though they are required to remain neutral.

    There are also significant concerns about potential fraud, which have prompted civil society to intensify efforts to establish an election monitoring system and set up monitoring mechanisms at polling stations. Civil society remains vigilant, scrutinising any statements, policies or threats that could undermine the integrity of the election.

    Civil society is joining forces to prevent the election of Prabowo. Online activists have created the Four Fingers Movement to urge voters to choose a different pair than Prabowo-Gibran.

    Surveys currently indicate that Prabowo could receive about 40 per cent of the vote. To force a runoff, it’s essential to prevent fraud and secure turnout. If nobody takes over half of the vote on 14 February, civil society and the public may unite around an alternative candidate to counter Prabowo in the runoff. But there are concerns about a potentially low turnout. The number of people choosing not to vote was already high in the previous election.

    What should be done to counter democratic decline in Indonesia?

    Democracy in Indonesia is being eroded by a government that disregards constitutional principles and the rule of law and instead uses laws as tools of power to suit its interests. Jokowi has reinstated the army and police in various public roles and issued presidential decrees and enacted policies to undermine other political parties and eliminate the opposition.

    A key symptom of democratic decline is repression of government critics, including journalists, activists, academics and others advocating for human rights. A revealing example is the case against activists Haris Azhar and Fatia Maulidiyanti, who faced criminal defamation charges for exposing state corruption and human rights violations in the Papua region. Human rights are being violated across Indonesia as communities are evicted under the pretext of investment or national development projects, and people who denounce this are systematically criminalised.

    But there are other issues that should be tackled to foster democracy in Indonesia. Indonesian political parties lack a clear ideological orientation and don’t represent public interests. Their position depends on their leadership and decisions are often made by a few. There is no internal democracy in political parties. The high costs of campaigning lead parties to rely on support from wealthy investors and businesspeople, undermining transparency and enabling corruption.

    To foster change, we should work toward democratising parties, making them more transparent and accountable. Efforts should be made to involve the public in the legislative process. Laws are sometimes passed within a week without any consultation with civil society. Referendums and other mechanisms should be explored to enhance public participation.

    The upcoming election has additional significance in the face of a global surge in authoritarianism. We must avoid following the path of the Philippines, where the son and daughter of two authoritarian dynasties succeeded in getting elected. We must unite in the face of authoritarianism and become an example of successful societal resistance against the threat of autocratic rule.

  • MALDIVES: ‘We have come a long way, but more needs to be done to further open up civic space’
    SaafathCIVICUS speaks about the situation of women’s rights in Maldives with Safaath Ahmed Zahir, founder and president of Women & Democracy (W&D). 
     
    Founded in 2016, W&D is a civil society organisation (CSO) that promotes women’s economic and political participation and good democratic governance in the Maldives through research, advocacy and awareness-raising activities. 
     
    What led you to become an activist and found a women’s rights CSO?
     Growing up in Maldives, a small island developing nation, the disparities between men and women became evident to me. I came from a majority-women family and witnessed the personal upheavals that my mother endured and how much my family battled for my education. Returning home after studying abroad was an eye-opener for me. In interviewing for a job, I experienced first-hand the deep-rooted patriarchal culture and the double standards women face on a daily basis. So I decided to put my education to good use: to push for women’s rights and empowerment in my country.

    I first played a role in creating Women on Boards, a CSO promoting gender diversity in the workplace. This inspired me to try to contribute further to building the organisational infrastructure and community to support women’s economic and political participation in Maldives. The organisation I founded, W&D, is now one of the most prominent in Maldives, with over 300 members, 200 of them aged between 18 and 29.

    What are the main women’s rights challenges in Maldives?

    Maldives ranked 106 out of 144 nations in the World Economic Forum’s 2017 Global Gender Gap Report. Women are marginalised in the political sphere due to institutional barriers, discriminatory cultural practices and social norms. Despite being roughly half of the population, having a 98 per cent literacy rate and actively participating in political parties, in 2009 only 6.5 of members of parliament were women. The proportion fell to 5.9 per cent in 2013, and again to 4.6 per cent in 2019. Currently, only four out of 87 parliamentarians are women, and few women hold senior public sector roles.

    With the passing of the Decentralisation Act, which allocates 33 per cent of local council seats to women, there has been some progress in local governance. The Maldives’ women development committees are an important platform for women to enter into politics and to participate in the decision-making process at local and national levels. But many barriers still limit their fulfilment of their mandate. They should be empowered to achieve true decentralisation.

    Women continue to take on the burden of childcare and domestic chores, which makes it difficult for women to engage in economic activities on a par with men. Female labour force participation in Maldives is higher than in other South Asian countries, but women tend to be clustered in low-growth sectors and in lower-paying positions, and they earn less than men. While tourism is the lifeblood of our economy, women make up only seven per cent of the tourism labour force.

    Women’s entrepreneurship is generally underdeveloped, and women’s economic contribution tends to be rendered invisible, particularly in major sectors such as tourism, fisheries, construction and wholesale and retail trading. Gendered economic inequalities were exacerbated under the pandemic, reversing what little progress had been made over previous years.

    Gender-based violence also remains an entrenched problem. One in three women aged between 15 and 49 have experienced physical or sexual violence at some point in their lives. There is a great need for more and better infrastructure to support survivors.

    In sum, a clear female disadvantage persists. Regulatory institutions must be strengthened to solidify existing gender equality gains and mitigate gender inequalities.

    How is civil society in general, and W&D in particular, working to address these challenges?

    Women’s rights CSOs have been working to address these challenges for several years, through capacity development workshops, advocacy campaigns, movement-building and creating opportunities for women and girls.

    Six years on from its founding, W&D has become a leading CSO working to protect the rights and improve the lives of women. We particularly advocate for women’s safety, economic and political leadership and for inclusive democratic governance.

    Since 2018, we have conducted an annual capacity development programme to advance women’s leadership and political empowerment in partnership with the International Republican Institute. In three years, more than 680 women aspiring to public office and political leadership have taken part in our training activities. In the 2021 elections for local councils and women’s development committees, 83 women who successfully completed our training were elected.

    During the pandemic, we launched a rapid response programme for vulnerable women and girls. In response to the dramatic increase in reports of domestic abuse, we established a domestic violence and mental wellness helpline to help women seek the assistance of the relevant authorities, undertake safety planning and connect them with wellbeing resources. We provided survivors with psychosocial counselling and referred the most urgent cases to emergency shelters or other safe spaces. With a grant from the Queen’s Commonwealth Trust (QCT) we were able to assist 130 women.

    Also with QCT support, we worked to improve access to menstrual materials for vulnerable women and girls. Approximately 10,500 sanitary materials were distributed as part of our rapid response programme. We have just received additional support to continue our rapid response programme. We expect to assist at least 240 more women and girls within the next eight months.

    Additionally, in partnership with the Commonwealth Foundation we have hosted multi-stakeholder discussions and consultations with vulnerable populations, relevant government bodies and CSOs to offer policy reforms to address the needs of the most vulnerable.

    This year we implemented a project to help strengthen the capacity of CSOs and community-based organisations working towards women’s empowerment and social development in Maldives. We brought together more than 160 people from various organisations.

    How has civil society in Maldives joined the recent global mobilisation wave against gender-based violence?

    Over the past seven years there have been many street mobilisations, mainly condemning rape and demanding justice for sexual crimes against women and girls and children in Maldives. Protection gaps in rape laws and barriers to accessing justice have perpetuated the prevalence of sexual violence and the lack of justice for survivors. The dire state of women’s safety in Maldives was highlighted by the 2016 Demographic Health Survey conducted by the Ministry of Health, which showed that one in every four women in relationships had faced physical or sexual violence from an intimate partner in their lifetime. In recent years, the Maldivian community has become more outspoken on the issue, particularly amidst the #MeToo movement, where a lot of Maldivian women came forward with their experiences.

    Throughout 2020 and 2021, there were multiple street mobilisations spurred by cases of sexual violence and injustice. In early 2020, following a case of sexual abuse of a two-year-old girl by her relatives, outraged citizens protested against rape and urged the government to protect children from predators. The authorities again came under criticism in mid-2020 after a foreign woman was sexually assaulted and the suspects were released from custody, with reports soon following that one of them was in a position of influence. People gathered outside parliament to protest against rape and impunity.

    Following the exacerbating effects of the pandemic on violence and abuse against women and girls, protesters rallied again in 2021 The government has taken steps to address these problems. It ratified the First Amendment to the Sexual Offences Act to improve the definition of rape and strengthen investigations, including by removing burdensome evidence requirements. In 2021, it also criminalised marital rape, marking a significant milestone for the women’s rights movement. But there is still a lot of progress to be made in combating the violence and abuse faced by women and children.

    How has the space for civil society action evolved over the past few years?

    As a relatively new democracy, the Maldives has taken significant steps towards ensuring civic space freedoms, but there is still a lot of room for improvement.

    Following the November 2018 elections, Maldives has experienced legislative reforms and a relative opening up of civic space. A commission was established to probe unresolved disappearances. Maldives drastically improved its position in the World Press Freedom Index, moving from 142 to 87 out of 180 countries. This was made possible by reforms such as the repeal of the 2016 defamation law.

    While Maldives has come a long way since its first democratic election back in 2008, more needs to be done to further open up civic space. Over the years, human rights defenders have been targeted and subjected to verbal attacks, including hate speech and death threats, while women activists have faced online vilification and threats due to their work for women’s rights.

    CSOs are also under pressure from extremists and hate groups, whose influence in limiting the social and cultural lives and roles of women has persisted. There have been instances of religious scholars advocating for girl child marriage and female genital mutilation, and attempts to suppress women advocates who speak out against these grave violations of women’s rights. Women human rights defenders are specifically targeted and face additional and gender-specific challenges, including threats of sexual violence and rape.

    What kind of international support does the Maldives’ women’s rights movement need?

    We need the continued support of international partners and collaborators to maintain and advance our work to empower women. As our movement is mainly composed of CSOs, we rely on the generosity of international organisations that identify with our mission to be able to continue to run the projects that are making a difference in Maldives.

    We also need continued opportunities for dialogue and collaboration with the international community. The exchange of ideas and information among countries and cultures is inspiring and empowering for women and girls in Maldives, particularly in the areas of business and politics.

    International support for Maldivian civic space also plays a significant role in furthering women’s empowerment. This is largely achieved by developing the skill sets of CSOs through workshops and programmes run by our international partners and collaborators.

    Vocal support from the international community for the Maldives women’s rights movement is also crucial. While we have faced obstacles, CSOs in Maldives have persevered in promoting women’s rights and we will continue to do so alongside our international partners and supporters.

  • NEPAL: ‘The TikTok ban signals efforts to control the digital space in the name of national sovereignty’

    GandakiPradeshCIVICUS speaks about the recentTikTok ban in Nepal with Anisha, provincial coordinator for Gandaki Pradesh at Body and Data.

    Founded in 2017,Body and Data is a civil society organisation promoting an accessible, safe and just digital space for all people in Nepal. Anisha, known by her digital name Aneekarma, oversees a project focused on online expression by women and LGBTQI+ people and leads Body and Data’s digital rights initiative in Nepal’s Gandaki province. 

    Why did the Nepali government ban TikTok?

    The government has cited multiple reasons for banning TikTok. It cited concerns about a rise in cybercrime, the disruption of social harmony – mainly due to the circulation of ‘vulgar’ content that ‘damages societal values’ – and TikTok’s perceived promotion of a ‘begging culture’, as content creators use it to seek money or gifts from their audience during live sessions. They also invoked the fact that the platform is being banned in some global north countries, although those bans normally apply only to government phones.

    Ultimately, it all boils down to an attempt to restrict freedom of expression. TikTok has grown to be a significant platform. It serves a diverse audience including housewives, older people, small business owners and entrepreneurs. Recently, people began using TikTok to voice opinions and exercise free speech against the authorities, provoking anger and fear among political leaders who have stepped up surveillance.

    How will this ban impact on digital rights?

    Nepal is a democratic country where freedom of speech and expression are fundamental, and the ban on TikTok has raised concerns about these rights being compromised. These concerns have been exacerbated by the government’s plans to introduce a separate bill aimed at tightening control over social media.

    The enforcement of the TikTok ban infringes on the basic rights of freedom of expression and access to information. The platform was used not just for entertainment and for small enterprises to promote their products and services but also as a channel to share diverse opinions, engage in creative expression and amplify the voices of excluded communities, particularly women.

    Bans on popular social media platforms add complexity to the ongoing international debate regarding digital rights. There are growing concerns surrounding the intersection of technology, free expression and governance in the digital age. The TikTok ban sparks discussions on the delicate balance between government regulation and individual liberties.

    What potential privacy or security concerns arise from users shifting to other platforms?

    Because of TikTok being banned, users have started to migrate to alternative platforms, which raises further privacy and security concerns. It is paramount that digital rights are safeguarded during this transition.

    User education and awareness campaigns on privacy and security best practices are needed to enhance digital literacy. Users must be confident that their personal information is well protected. Transparent data practices, including clear information on data collection and usage, are vital for building user trust and enabling informed decision-making.

    The influx of new users to alternative platforms may also introduce potential cybersecurity threats. Platforms should continuously invest in security measures such as encryption protocols, regular audits and prompt vulnerability fixes.     Governments face the complex challenge of regulating social media platforms to combat misinformation and disinformation while also safeguarding their citizens’ rights to free expression and privacy. Sophisticated strategies are required to achieve a balance between national security imperatives and global digital rights.

    Just as TikTok has established its own guidelines regarding harmful content, governments can collaborate with technology companies to define clear and transparent standards for social media conduct that do not compromise people’s right to express their opinions, but rather that counteract misinformation. It is crucial to implement robust fact-checking mechanisms and foster media literacy to empower users to distinguish between reliable and deceptive information.

    International collaboration to standardise regulations is key to preventing the infringement of digital rights across borders. The adoption of privacy-enhancing technologies, such as end-to-end encryption, preserves individual privacy while facilitating uninhibited self-expression.   • PAKISTAN: ‘It doesn’t matter who casts the vote as much as who counts the vote’

    MuhammadMudassarCIVICUS speaks about Pakistan’s upcoming election with Muhammad Mudassar, Chief Executive Officer at the Society for Human Rights and Prisoners’ Aid (SHARP-Pakistan).

    Founded in 1999, SHARP is a human rights civil society organisation working for the rights and wellbeing of vulnerable groups, including refugees and internally displaced people, and working on issues related to people trafficking and smuggling of migrants, including through advocacy at the national and international levels, capacity development, community services and emergency response.

    What’s the political climate in Pakistan ahead of the election?

    Post-COVID-19, like many global south countries Pakistan grapples with security concerns, political instability and economic challenges that affect both its citizens and government. This means that uncertainty loomed over the upcoming election, but the situation is much clearer now and the country is all set to vote for the new parliament. It would be unconstitutional to extend the mandate of the existing caretaker government. The Chief Justice of Pakistan has confirmed that it is set in stone that the general election should be held on time.

    To what extent are conditions conducive to a free and fair election?

    As had always been the case, there’s controversy around the election, which many observers feel lacks conditions for fair competition. While some political parties are free to conduct their activities, others claim to face restrictions in submitting nomination papers and campaigning, and their members are subjected to arrests.

    Over the past 75 years, no prime minister of Pakistan has completed a full five-year term, and they have often ended up in jail. This trend started with Zulficar Ali Bhutto, deposed during martial law in 1977, followed by his daughter Benazir Bhutto, who was dismissed twice. A similar fate befell recent former prime ministers Nawaz Sharif and Imran Khan.

    Nawaz Sharif’s Pakistan Muslim League (PML-N) has had ample space for campaigning, even though Sharif, a three-time former prime minister, was ousted for alleged corruption in 2017 and sentenced to 10 years in prison. In October 2023, he returned to Pakistan from exile in the UK, where he had travelled on bail for medical treatment in 2018. Sharif’s corruption conviction and his lifetime ban from politics were overturned by the Supreme Court in early January. Now most political commentators are predicting that the PML-N will win the election.

    In comparison, Imran Khan’s Pakistan Tehreek-e-Insaf (PTI) party is complaining that it has been all but barred from participating in the election. The Electoral Commission of Pakistan disqualified Khan due to one conviction out of around 200 cases against him and barred the party from using its famous cricket bat symbol on ballot papers. Khan has also recently received 10 and 14-year sentences  on charges of leaking state secrets and corruption. Nomination papers of most national and provincial PTI leaders were rejected by District Returning Officers but appellate tribunals of higher judiciary subsequently accepted most and allowed them to context elections.

    Further, there’s no democracy within political parties due to nepotism and dynastic leadership. Most political parties function as family dynasties, which drives independent leaders away. It has rarely been about people’s choices. It doesn’t matter who casts the vote as much as who counts the vote.

    How have civic space conditions changed over the past years?

    The media and civil society are divided and, human rights activists comment, there is an atmosphere of discontent that somewhat hinders the freedom of speech. Further, unemployment and other pressing issues continue to prompt many people to leave Pakistan.

    Still, at SHARP-Pakistan we remain hopeful and keep analysing problems to try to offer solutions. As part of Pakistani civil society, we aspire to forge connections, work alongside and learn from international partners to be able to better promote human rights and democracy at home. We need free and fair elections so that results truly reflect the will of the people.

    How are you and other civil society groups engaging with the election?

    The role of civil society in the election takes the form of support for the institutional processes of a democratic vote well as the more substantive development of a democratic electorate. Civil society is also playing its due role in reducing election-related conflict dynamics and promoting a peaceful electoral environment.
