ARGENTINA: ‘Milei’s victory expresses the rejection of the previous governments’
CIVICUS speaks with Yanina Welp, researcher at the Albert Hirschman Centre on Democracy, about the results of Argentina’s runoff presidential election, won by a far-right outsider.
How do you explain the victory of Javier Milei, an outsider with no party structure?
Milei’s victory, like that of any other candidate, cannot be explained by a single reason. There are at least three main explanations for his victory.
First, there’s the economic situation. On top of a high level of poverty – 40 per cent and growing – Argentina has very high inflation, and the economy hasn’t grown for many years. And the same goes for formal employment. There are a lot of informal workers and many people experience high levels of uncertainty.
Second is the inability of the political class to respond to these demands. Most recently, those in power have acted arrogantly. Insecurity, corruption scandals and the passivity of the authorities in the face of all these have increased. Milei’s leadership came to embody people’s rejection of the situation. Many people voted for him because he expresses well the rejection of recent administrations, and not necessarily because they approve of or adhere to the policies he has proposed to implement.
Third, there’s the role of political leadership, and specifically of the incumbent, for doing nothing in the face of this threat and even encouraging Milei’s candidacy with the aim of dividing the opposition’s vote and therefore having a better chance at winning. This was done first by Peronists, in the run-up to the first round, and by former president Mauricio Macri ahead of the runoff, which put his Together for Change coalition in crisis.
Do you think the electorate has leaned to the right?
Unlike almost all the other candidates, who only had vague and general proposals, Milei ran on a strongly ideological platform, which he kept putting forward throughout the campaign.
However, when analysing people’s attitudes, there are contradictions, first and foremost because there is no universal notion of what is supposed to be ‘right-wing’ or ‘left-wing’. For instance, polls show growing concern about rising insecurity, and it would be very elitist to think that having this concern makes you right-wing. The rise in crime shows that it is a real concern.
It is true that in this election campaign positive perceptions of the private sector have increased compared to perceptions of the public administration, possibly as a result of Milei’s discourse but also because the image of the state has deteriorated considerably under recent administrations. In this sense, it could be said that voters have indeed moved towards the right. But Milei’s victory with almost 56 per cent of the vote shouldn’t lead to the conclusion that more than half of the electorate have ideologically leaned rightwards, or even embraced the radical right, because many voted for him because he embodies the reaction to the status quo rather than because of his ideological proposals.
During the campaign it was argued that democracy was at stake. Is Argentina’s democracy in danger?
Democracy is not in imminent danger, as was the case with military coups, which wiped democracy away overnight. There are signs of democratic erosion – but these have been there for years. There has been both progress and setbacks, including attempts to co-opt the judiciary, the misuse of state resources and clientelistic practices.
Generally speaking, Argentina’s democratic institutions work. Despite the opposition’s complaints about the electoral system, the elections took place normally and the results were out very quickly.
However, we have seen a huge setback in terms of public debate. Intolerance and verbal violence have increased. Supporters of different parties can hardly talk to each other. There is a lot of aggression on social media. These are all medium-intensity warning signs that, if not addressed, will only pave the way for more violence and authoritarianism.
How will Argentina’s political scene change following this election?
Since 2003, with Néstor Kirchner’s election to the presidency, a system of two broad coalitions formed, which since 2007, under Cristina Fernández de Kirchner, has been maintained by the introduction of open, simultaneous and compulsory primary elections. These served to avoid party fragmentation but had the negative effect of eroding programmatic or ideological differences. The two coalitions that formed as a result included their own right and left wings, blurring the ideological debate and replacing it with a divide between Peronism and anti-Peronism. This ended up encouraging affective polarisation with very watertight alignments where it is increasingly difficult to find common ground.
The fact that the presidential elections were won by a party that until a couple of years ago did not exist will force the two big coalitions of recent decades, the Peronist ruling party and the opposition Together for Change, to profoundly reconfigure themselves.
Within Peronism, former president and current vice-president Cristina Kirchner was the big loser of this election. In recent times she has been absent from the political scene, leaving Peronism without clear leadership. Peronism has strong roots in trade unions and social organisations that are highly dependent on the state. These organisations have incentives to negotiate, should the new government open up that space. However, Milei’s initial discourse has pointed in a completely different direction, insisting that he will take shock measures.
What are the main challenges the new government will face?
The new government should tackle three major challenges. The first is to stabilise the economy by stopping inflation and putting the exchange rate in order. The second is to introduce reforms to increase productivity and solve the crisis in formal employment. And the third is governance. Argentina has very strong social organisations, which has both positive and negative aspects, but in any case, it is a strongly organised society that is very predisposed to conflict.
These three challenges must be tackled in a coordinated and consistent way, which is quite difficult.
Do you think Milei’s government will be able to tackle them?
I have serious doubts that the new government will be able to meet these challenges, not only in the area of stabilisation and structural reforms, but also and above all in the area of governance. Many of the proposed measures, such as adopting the US dollar as the currency, could be found unconstitutional. Other measures require legislative majorities that the new government won’t have. Its only prospect of obtaining substantial legislative support was through Together for Change, but the division of the opposition coalition leaves Milei without even a congressional quorum.
Milei has not one provincial governorship and almost no mayorships. However, Argentina’s sub-national powerholders have always been accommodating and pragmatic. Still, some key measures would go directly against the interests of the provinces, such as the elimination of co-participation, the system through which the federal state distributes public resources from national taxes to the provinces. And then there is the potential confrontation with the province of Buenos Aires.
Milei could try to rule by decree, but this would cause an instant crisis, and in case of an impeachment trial the vice-president, Victoria Villarruel, would take over. This would not ensure any positive change but would rather imply some additional negative elements.
Milei was elected with a very large majority, so he has great popular legitimacy. But this majority could be inflated, as is often the case in runoffs, and is compounded by the volatility and impatience of a large part of Argentina’s electorate. If he succeeds in implementing his ultra-liberal programme, a global rarity, the social costs will be extremely high. And if he fails to do so, people’s disenchantment with politics could increase and their support for democracy could be called into question.

AUSTRIA: ‘A new civil society coalition is emerging to defend democracy against extremism’
CIVICUS speaks about the growth of the far right in Austria withGabriela Greilinger, PhD Student at the University of Georgia, USA and co-founder and director Quo Vademus,a grassroots think tank publishing analysis by young writers and encouraging young people to engage with politics and current affairs.
What are the main far-right groups in Austria, and how concerning is their recent growth?
The Austrian Freedom Party (FPÖ) is the main far-right political party, but there are other groups outside the party system that are also ideologically far right and are considered very close to the FPÖ, such as Identitarian Movement Austria. Freiheitliche Jugend (Freedom Party Youth of Austria), the youth wing of the FPÖ, also maintains close links to the Identitarian Movement. There are also right-wing extremist fraternities, such as Olympia, which are similarly closely connected to the FPÖ.
The FPÖ’s recent rise in the polls is not really a novelty but rather a recurrence. Since its founding after the Second World War, it has been included as a coalition partner in government several times and has risen and fallen in popularity over the years. It plummeted in the polls following the 2019 Ibiza scandal – in which FPÖ politicians were filmed appearing to offer business contracts in return for support – and other corruption allegations, and the breakup of the far-right coalition government led by Sebastian Kurz, which included the right-wing conservative, Christian-democratic Austrian People’s Party (ÖVP) along with the FPÖ. After that, the Austrian Freedom Party went through several leadership changes.
Several factors jointly account for the FPÖ’s most recent surge in the polls. First came the COVID-19 pandemic, during which it positioned itself as a strong opposition to the public health measures put in place by the ÖVP-Greens coalition government, including mandatory testing and vaccinations. It openly supported anti-lockdown demonstrations, bringing together people from both right and left.
Then, in 2021, corruption allegations around then-ÖVP chancellor Kurz emerged, which played into the hands of the FPÖ, helping it regain its popularity. This was followed by Russia’s full-scale invasion of Ukraine in 2022, which led to an energy crisis and soaring prices in Austria, a country traditionally highly dependent on Russian gas.
As a result, inflation surged further and exacerbated economic anxieties, which have remained largely unaddressed by the current government. All of this has helped the FPÖ regain its popularity, so much so that in November 2022 it surpassed the Social Democrats in the polls and has polled around 30 per cent since. Forecasts predict that it will come in first in this year’s elections and, if so, it would for the first time in history be able to appoint the chancellor.
What public concerns is the FPÖ tapping into?
Immigration is certainly one of the main issues the FPÖ keeps coming back to, but not the only one. The FPÖ also engages in ‘culture war’ politics, taking on issues such as gender-inclusive language and LGBTQI+ rights.
Over the past couple of years, in the context of rising inflation following the pandemic and during the war in Ukraine, it has also increasingly tapped into people’s financial anxieties.
Overall, though, it doesn’t present any viable solutions to people’s concerns but rather attacks and smears political opponents, trying to present itself as the clean alternative to what it calls the ‘system parties’ – a term formerly used by Nazis. Social media, specifically Facebook, is one of the main platforms it uses to spread their messages.
How have Austrian civil society and public opinion reacted to this rise of the far right?
The far right has long been mainstreamed and normalised in Austria, among other reasons because of its repeated inclusion in government. That means its rise, while concerning, is not necessarily surprising or shocking to most people. We’ve seen it happen before. Still, time and again there have been protests against the far right – in 2017, for instance, people mobilised against the inclusion of the FPÖ in the right-wing Kurz government.
However, civil society and its leaders have again become more outspoken in recent weeks, after the German investigative outlet Correctiv reported on a secretive meeting known as the Lehnitzsee Conference that took place last November in Germany, in which right-wing extremists, businesspeople and even some members of the mainstream conservative Christian Democratic Union discussed plans to expel millions of people deemed not sufficiently ‘assimilated’ to the majority society. A notorious Austrian extremist, Martin Sellner, took part in the event, implicating the Austrian extreme-right scene.
This far-right meeting triggered large-scale anti-far-right demonstrations in Germany, which inspired Austrians to organise protests in Vienna and other cities across the country. Although the protests were fewer and smaller in size than Germany’s, many people mobilised.
We have also seen the emergence of a new civil society coalition to defend democracy against extremism. In response to the revelations about the Lehnitzsee Conference, several civil society organisations formed the Coalition for Human Rights and Democracy (Bündnis für Menschenrechte und Demokratie) to ‘create a firewall’ against right-wing extremism. It then also organised a demonstration in defence of democracy in the city of Graz.
How has the government reacted to the rise of the far right?
As of today, we’ve seen little reaction or attempts by the government to curtail the far right. It’s been rather the opposite: the ÖVP has long adopted the messages of the far right on immigration and largely appropriated the FPÖ’s depiction of immigrants. And although the current chancellor, Karl Nehammer, had said he would not enter a coalition that includes FPÖ leader Herbert Kickl, a hardliner, he has not completely ruled it out after this year’s election.
As it stands, the FPÖ is set to win the election and a relaunch of another ÖVP-FPÖ coalition seems to be the most likely option. All in all, I see the government making very little effort to avert the far-right danger. If anything, the ÖVP is trying to take the wind out of the FPÖ’s sails by co-opting its agenda and programme. This is not weakening the far right but rather mainstreaming its policy points and making it part of the ‘normal’ public debate – which it shouldn’t be.
What forms of international support does Austrian civil society need to sustain its efforts?
I believe that there could and should be more international cooperation between civil society organisations that are addressing right-wing extremism and racism. Further, more positive media coverage is needed of civil society efforts to mobilise in defence of democracy to divert the focus from the far right. While it is true that the far right has once again made significant advances, the media continues to focus disproportionately on far-right successes, potential future successes, positions and discourse, simply giving it too much airtime. In contrast, there is much less focus on the forces standing up for democracy and civil society’s efforts to respond to extremism.
At the end of the day, as the slogan used in the German protests goes, ‘Wir sind mehr’ (We are more). We are the majority, even if at times a silent one – and not the far-right supporters and sympathisers.

CHILE: ‘For the first time the extremes are inside the parliament and there are unacceptable undemocratic voices’
CIVICUS speaks with Alberto Precht, executive director of Chile Transparente, about Chile’s presidential elections and their persistent pattern of low electoral turnout. Founded 23 years ago, Chile Transparente is a civil society organisation (CSO) that promotes transparency in public and private institutions and the fight against corruption.
What have been the peculiarities of this electoral process?
There have been three recent votes in Chile: first, the national plebiscite held in October 2020, in which citizens were asked whether they wanted a new constitution and, if so, which body should be in charge of drafting it; then the elections of representatives to the constitutional convention in May 2021; and now, with the constitutional convention in place, the presidential elections, with the first round held on 21 November and the second round scheduled for 19 December.
These electoral processes have been quite peculiar because each of them has produced quite different results as measured on the left-right ideological axis. On the one hand, a progressive constitutional convention was elected, including a significant hardcore left-wing component. On the other, both in the primary elections and in the first round of the presidential election, a hardcore right-wing candidate, José Antonio Kast, won first place, followed by Gabriel Boric, a progressive candidate running in coalition with the Communist Party.
The political environment is quite polarised, but what is most striking is that between 50 per cent and 60 per cent of Chileans do not show up to vote. This makes the election results very uncertain. Moreover, whoever wins will do so with 13 or 14 per cent of all eligible voters. It is not surprising that there are usually wide currents of anti-government opinion, since the government never represents a majority.
Why do so few people vote?
It is paradoxical, because in the current context one would have expected a higher turnout. The 2021 election for the constitutional convention was the most important election since 1988, and turnout did not reach 50 per cent. The only vote that exceeded that threshold was the 2020 plebiscite, with a 51 per cent turnout, but that was different because it was a ‘yes’ or ‘no’ vote. This low turnout was striking, because although no one expected a 80 or 90 per cent turnout, as was the case in the historic 1988 plebiscite that said ‘no’ to the Pinochet dictatorship, turnout was expected to be closer to 60 per cent.
It is very likely that we will see even lower participation in the second round, even though there are two very clear and distinct options, which would hopefully motivate more people to vote.
In Chile there is a structural problem of low participation. In part, this has to do with the fact that voting is voluntary, but it also has to do with the fact that the political offer is not very attractive. Although the offer has changed a lot and the latest reform in the system used to elect parliamentarians has allowed for greater pluralism, this has not been enough to motivate people to vote. The latest elections have been a rollercoaster and therefore very hard to analyse; the only certainty we have is that at least 50 per cent of Chileans do not feel represented in the electoral system.
How could people be motivated to vote?
Some legal reforms are already being introduced to that effect. The national plebiscite that will take place in 2022, where people will say whether they agree with the new constitution, is going to be a mandatory vote. Additionally, the vote is going to be organised in a georeferenced way, so that people will be able to vote at a polling place within walking distance of their residence.
This is not a minor detail: in Chile, voting places are not assigned according to place of residence, so people, especially low-income people, must take a lot of public transport to get to the polls. Even though it doesn’t cost them money, because it’s free, they have to invest the whole day in going to vote, which many can’t do. These changes will increase participation rates, but it will be very difficult for Chile to reach 80 per cent participation in the short term.
The big questions that no one has been able to answer are who the people who don’t vote are and what they think. Between the constituent convention elections and the presidential election there seems to have been a turnover of voters. Younger voters showed up to vote in the constitutional convention elections, while older voters tended to participate more in the presidential election.
What role does Chile Transparente play in the electoral process?
Chile Transparente has a system of complaints and protection for victims and witnesses of corruption that has been receiving complaints of misuse of electoral funds. Today we are stuck with a very important controversy involving the candidate who came third in the first round of the presidential elections, Franco Parisi. He is a neo-populist candidate whose campaign has been funded in quite opaque ways.
We also work to motivate participation and have participated in observations of local electoral processes that had to be repeated. We receive the support of the European Union for a programme called Transparent Convention, which publicises the functioning of the constitutional convention, highlighting certain issues that might seem relatively opaque and that need to be brought to the public’s attention.
We are one of the few organisations in the country that are active in transparency and anti-corruption issues and we play a very important role alongside investigative journalists.
How are these elections influenced by the protest movement?
The election for the constitutional convention fed off the strength of the 2019 protests; in fact, at one point in the Constitutional Convention came to reflect the people who were protesting. But by the time of the presidential elections, held one year later, only the hangover from the protests remained, and the results were rather a reflection of the people who had suffered the effects and were against the protests.
We need to understand that the mobilisation process has not been purely romantic, but has been accompanied by a lot of violence. Between the pandemic and the protest violence, there are people who have not been able to reopen their businesses, who cannot go to work in peace, who have lost everything. At the same time, we obviously have a debt in terms of human rights violations.
These tensions were expressed at the polls, and we will surely have a heart-stopping second round, in which the competitors are a candidate who represents a hardcore right wing, quite different from the traditional right that has governed in recent years, and a candidate who has formed a coalition with the Communist Party, until now marginal in a political game that has rather gravitated towards the political centre.
What has happened to the established Chilean party system?
There is undoubtedly a weariness with the democracy of the last 30 years, regardless of all the progress the country has made. There are large sectors that believe the centrist consensus that characterised the transition to a so-called ‘democracy of agreements’, consisting of doing what was considered to be within the realm of the possible, does not provide solutions. This has led not only to a social outburst, but also to a conservative reaction. It is a textbook situation: every revolution is followed by a counter-revolution.
On top of this there is a problem of migration management, which has caused a huge electoral shift throughout the country, especially in the north. Chile used to vote for the left and now it voted for two candidates – one from the extreme right and a populist candidate – who proposed harsher measures against migration, such as the construction of border ditches or mass expulsion: nothing could be further from a culture of human rights.
At the same time, the left has lacked any self-criticism. It has not understood how important it is to respond to people’s concerns about insecurity and to attend to the victims of violence. When there is an outbreak of violence, violence victims will vote for those who offer them order. As is well known, in Chile there has long been a major conflict with the Indigenous Mapuche people. There is also conflict with non-Mapuche sectors, often linked to organised crime, who have taken violent action. In those areas, where one would expect a vote for the left, the complete opposite has happened. In certain localities where violence has become endemic, the conservative candidate has received up to 60 or 70 per cent of votes.
What would be the implications for civil society depending on which candidate wins in the second round?
A part of the more traditional press seeks to give the impression that if Boric wins, it will be the advent of communism, while another part claims that if Kast wins, he will take us back to the times of Pinochet. However, thanks to social media and new technologies, alternative media outlets have flourished in recent years. There are more pluralistic television channels and channels with quite diverse editorial lines, which have more nuanced views.
I believe that both alternatives entail risks, because both candidates include within their coalitions people or parties that seek to limit the space for civil society, that adhere to a narrative that the press is financed by international powers, that Chile Transparente serves certain mega-powers, and promote conspiracy theories. Let’s remember that the Communist Party candidate who lost the primary elections against Boric proposed an intervention in the media. For his part, Kast has the support of hardcore Pinochetist elements.
However, in the second round, the two candidates have moved towards the centre to capture the votes they need to win. The groups that followed former President Michelle Bachelet, who initially opposed Boric, are now working with him. On the other side of the spectrum, in order to attract segments of the liberal right, Kast also has had to moderate his discourse.
Perhaps hope lies in parliament acting as a regulator of the two extremes. It is a diverse parliament where no party will have a majority, so whoever gets to govern will have to do so in negotiation with parliament. At the same time, the constituent process, which is still underway, can produce a constitution of unity that would set the conditions for the new president to govern.
The problem is that for the first time the extremes are inside parliament and there are some voices that are unacceptable from a democratic point of view. For example, two deputies elected by the extreme right recently mocked an elected candidate who is transgender. Some not very encouraging positions on human rights have also been expressed by the left. For example, the Chilean Communist Party has just recognised Daniel Ortega as the legitimate president of Nicaragua and continues to recognise Nicolás Maduro in Venezuela.

CHILE: ‘The proposed constitution reflects the country’s division rather than being an instrument for its union’
CIVICUS speaks with Patricia Reyes, director of Fundación Multitudes, about the process to develop a new constitution in Chile since a previous draft was rejected in a referendum in September 2022.
Fundación Multitudes is a civil society organisation dedicated to generating spaces and building capacity for civil society to participate effectively in decision-making processes.
Why does Chile need a new constitution?
The constitution-making process in which Chile has been immersed since 2022 was a response to a longstanding social and political crisis that erupted in October 2019. Faced with the eruption of social demands for greater protection, equity and guarantees of basic social rights such as education, health and social security, which in some cases were expressed with unusual violence, all political sectors agreed to initiate a constitution-making process.
Initially, an inclusive process unfolded that produced a draft constitution that incorporated adequate standards of rights protection for a democratic and social state. But the proposal failed to win the support of the more conservative parts of society and was rejected in a referendum, largely because of mistakes made in the process. These were mainly due to the political inexperience of the members of the constituent commission, who were mostly independents with no links to political parties. They overlooked the need to reach broad agreements encompassing all parts of society, and particularly traditional political players. Other factors were the incorporation of some drastic changes in political institutions and the inability to communicate the benefits of the new constitutional text adequately to the public as a whole.
After the proposal was rejected, the social demands that had triggered the process were still there, and the existing constitution continued to be as ineffective in resolving them as it was when the social outburst occurred. To solve our problems of democratic coexistence, we need a new social pact that can unite us around a shared institutional project. That is why the constitution-making process was resumed, this time in a more traditional format, which has produced a new draft that will again have to be submitted to a popular vote.
How different is the new draft from the one that emerged from the 2021 Constitutional Convention?
The new draft is a lot more similar to the current constitution. It introduces more modest changes. Compared to the previous one, I think it rolls back some rights that had already been won, particularly for historically excluded groups such as women. Nor does it introduce recognition of other vulnerable population groups , such as Indigenous peoples and children and adolescents. But it does share with the previous draft the reaffirmation of freedom of enterprise and the concept of a subsidiary state.
The two processes have been quite different because in the first case the constituent body included many citizens elected by popular vote and independent of political parties, while the second involved a Council of Experts appointed by the two chambers of Congress and a Constitutional Council elected by popular vote but made up mostly of members proposed by political parties ranging from the centre to the far right.
However, there is one thing that the proposals resulting from both processes share: both have been considered partisan in nature, viewed as aligned with the interests of a specific political camp. They reflect the division of Chile rather than being an instrument for its union.
What changes would the new draft make to the existing constitution?
Overall, the text reproduces the current institutional framework, except for the fact that it reduces the number of members of parliament. It also enshrines the same rights as the current constitution. It shares many of its strengths but also suffers from many of the same weaknesses.
The draft contains several articles that have caused controversy because of the regressive way in which they could be interpreted. For example, in the area of reproductive rights, constitutional provisions could mean that the rule that currently allows abortion in cases of rape, danger to the life of the mother and non-viability of the foetus could be declared unconstitutional.
The incorporation of a special anti-corruption body could enter into conflicts of competence with the current Office of the Comptroller General of the Republic. Additionally, some populist tools would be introduced to allow the immediate expulsion of undocumented migrants, along with some tax exemptions – a matter that generally does not belong in a constitutional text – and a number of highly sensitive provisions, such as the possibility of allowing terminally ill convicts to serve their sentences at home, which could benefit people convicted of crimes against humanity committed during the period of dictatorship.
On the plus side, a Victims’ Ombudsman’s Office would be established and progress would be made on decentralisation, granting greater powers to local governments.
What’s the position of different groups towards the referendum to be held on the latest draft?
Most right-wing parties approve of the project, while those on the left reject it and those in the centre have a great diversity of opinions, with some campaigning for approval and others for rejection.
But the last word will be up to voters, who are going through what has been defined as a moment of constitutional exhaustion. Because of the lengthy and controversial process and the lack of cross-cutting agreements, there is a lot of apathy and indecision, as well as conflicting positions. Right now polls show a majority of people would reject the new constitution, but the vote is on 17 December, so there is still a long way to go, and there are many people who have not yet decided how they will vote.

CRI is a civil society organisation that focuses on the connections between climate change and human rights, putting pressure on governments and corporations to take action to end abuses. Along with many other organisations, it played a key behind-the-scenes role in the final approval of the CSDDD.
The CSDDD aims to protect human rights and the environment while tackling climate change. It empowers European courts to hold large companies accountable for practices such as child or forced labour in their supply chains and production, and requires companies to align their business strategies with the Paris Agreement climate goals. It also seeks to improve access to justice and provide remedies for victims, ensuring companies are held accountable for their actions or failures to act.
What’s the CSDDD and what difference should it make?
The CSDDD is potentially the most important piece of environmental and climate change legislation in the world. The European Union (EU) is the world’s largest economic bloc, bigger than the USA and China, and when it legislates or issues regulations, it has the power to set global standards. For example, when the EU required Apple to stop changing iPhone chargers every few years, Apple eventuallychanged its global policy to comply with the EU standard and avoid heavy fines.
The strength of the CSDDD is that it requires companies to adopt and implement climate transition plans in line with theParis Agreement. A key global problem is that companies often claim to be Paris Agreement-compliant but continue business as usual. This directive imposes legally binding human rights and environmental due diligence obligations on large companies, requiring them to identify, mitigate and remediate the environmental and human rights harms they cause in their operations and supply chains. This is a major step forward.
In addition, the CSDDD establishes financial liability for violations, creating a strong incentive for compliance. Under some conditions, civil society organisations (CSOs) and trade unions will be able to bring claims and hold companies to account. This underlines the crucial role of civil society, as governments often fail to enforce laws, even those they have passed themselves.
A notable weakness of the directive, however, is its limited scope. It only applies to large companies with over a thousand employees and an annual turnover of more than €450 million (approx. US$480 million). This was meant to exclude small and medium-sized enterprises that say they don’t have the capacity to meet the requirements. As a result, an estimated 65 per cent of companies that could be covered are not.
Nevertheless, the directive still covers around 50 to 60 per cent of all business activity. Over time, we expect the size of companies covered to be reduced, extending the directive’s reach.
We hope the CSDDD will lead to better environmental and climate standards worldwide. This directive will require large companies doing business with the EU to meet basic environmental standards in their supply chains and production. If companies must meet these standards to do business with the EU, we expect these internal standards to become global standards, influencing their operations wherever they do business.
What role did civil society play in the adoption of the directive?
Civil society played a crucial role. The directive wouldn’t have been adopted without the persistent efforts of many CSOs to put pressure on states.
It took many years to get to this point. When the directive began to unravel because of theobjections of the German Free Democratic Party (FDP) and the support of climate sceptic governments such asItaly’s, civil society stepped in. We worked with the Belgian EU presidency, Green parties and supportive states to keep the directive on track and get it adopted.
Civil society also engaged with large companies that were in favour of the directive, encouraging them to intervene. These companies recognised that while the directive might impose short-term costs, it would ultimately benefit them by raising global standards. They wanted to ensure a level playing field by holding companies from countries with lower standards, such as China and Vietnam, to the same high standards they’d have to comply with. If this works it will be a welcome change from the typical corporate race to the bottom.
Civil society rescued and advanced this critical piece of legislation by successfully linking supportive companies and governments.
What concessions were made to get the directive adopted?
For legislation to be adopted in the EU, it must first be approved by the European Commission and then by the European Parliament. The final step is approval by the European Council of Ministers, an intergovernmental body that under its complicated rules in this case only needed a qualified majority of its 27 members.
The Council had given its provisional approval, but at the final stage the FDP withdrew its support. This is a small economically neoliberal party that is a minor part of theGermancoalition government but may have thought it could use its stance to gain an electoral advantage. Without telling the main coalition parties it apparently contacted parties in other member states and urged them to withdraw their support. Enough did so to raise doubts about whether the required qualified majority could still be achieved. So the CSDDD was temporarily withdrawn to avoid defeat. With the help of other European CSOs and the Belgian presidency, we worked to reassemble a group large enough to achieve the qualified majority.
Concessions made to secure this majority included raising the employee and turnover thresholds that companies had to meet to be covered by the directive. This helped overcome the objections of those concerned about potential impacts on small and medium-sized enterprises.
While the final text wasn’t exactly what we’d hoped for, it was still a significant victory. For the first time, it sets out basic principles and standards covering virtually all major multinational companies involved in global trade. Almost every global trading company you can think of will be covered by the CSDDD.
We expect these companies to put pressure on the EU to amend the law to include those not currently covered by the CSDDD, creating a business consensus to extend its reach so companies won’t be able to compete with lower prices simply because they aren’t held to the same standards.
Overall, it’s not enough of what’s needed, but it’s a big step in the right direction.
What are the next steps?
The provisions of the CSDDD will be implemented gradually, giving companies time to adjust their operations.
We’ll have to wait and see what happens with thenew European Parliament and how supportive it is of climate policy. Although the Greens lost many seats, there’s still a majority of political parties that recognise the seriousness of climate change. The key question is whether they believe it requires urgent action and whether they will move quickly to implement it.
We’ll continue to campaign for this directive alongside partner CSOs. We’ll engage in discussions with the Commission and members of parliament to explore ways to strengthen this legislation over time. However, it’s likely to be several years before the EU considers amending and improving this directive. In the meantime, our primary focus will be on ensuring companies comply with the requirements of the new law.
How else is CRI working to hold corporations accountable?
We’ve been working on Mexico’s avocado industry, which is responsible for deforestation, water theft from local communities and intimidation and violence against Indigenous communities and civil society activists. Given that 80 per cent of avocados grown in Mexico are exported to the USA, we felt a responsibility to address this issue.
Thanks to the cooperation of many local organisations and activists who remained anonymous for security reasons, we published ourreport last November. We also approached Mexican and US companies with our findings and pressed the Mexican and US governments to create a mandatory deforestation-free certification process for the sale of avocados. We spoke to federal agencies in both countries. We worked with journalists at the New York Times, which published a key full-pagestory, and with members of the US Senate, who sent a key letter to the US government. We held webinars with civil society in Mexico. In February, as a result of our pressure, both governmentsannounced a ban on the sale of avocados grown in illegally deforested areas. Indigenous communities had been complaining about this for years, and we were finally able to make their voices heard.
Solidarity was essential because we faced very powerful interests, including big companies with huge investments and drug cartels laundering money through the avocado industry. But we were still able to reach an agreement to end these harmful practices.

CROATIA: ‘The longer this government remains in power, the weaker democracy and the rule of law become’
CIVICUS speaks about ongoing anti-government protests in Croatia with Oriana Ivković Novokmet, Executive Director of Gong.
Gong is a think-do tank whose work focuses on promoting democratic processes and institutions and developing a democratic political culture in Croatia.
What triggered recent protests?
On 17 February, thousands of people took the streets of the capital, Zagreb, todemand early parliamentary elections. Organised by 11 left and liberal opposition parties, this massive anti-government demonstration was triggered by the appointment of former judge Ivan Turudić as the new state attorney amid media reports linking him to corruption. The opposition fears this appointment will further deteriorate the already compromised reputation of the Croatian judiciary.
According to a report by one of the most influential Croatian newspapers, Jutarnji list, between 2016 and 2020,Turudić, then the president of the Zagreb County Court, exchanged messages with the then state secretary of the ministry of justice, accused in another corruption case. The messages clearly showed they had a romantic relationship. Opposition members argue that Turudić lied to the Parliamentary Committee for the Judiciary when questioned about the meetings they had, claiming their relationship was superficial.
Additionally, President Zoran Milanović accused Turudić of meeting as president of the Zagreb County Court with Zdravko Mamić, a football manager sentenced for tax evasion and embezzlement who is currently a fugitive in Bosnia and Herzegovina. Mamić allegedly met with Turudić while a suspect and later when he was under investigation, as noted by the Security Intelligence Agency.
In a context of increasing frustration with the government of the Croatian Democratic Union (HDZ) party, which is plagued with corruption accusations, the February protests helped the opposition gain momentum. It subsequently announced plans to stage further protests in several major cities on 23 March.
What’s the state of democracy and civic freedoms in Croatia?
Turudić’s appointment was yet another example of Prime Minister Andrej Plenković’s habit of capturing independent institutions, which he’s done since reaching office. The longer the HDZ and Plenković remain in power, the weaker the rule of law and liberal democracy become. Plenković vowed to reform the HDZ but he has failed to change his party and also reversed progress made in upholding the rule of law in Croatia.
Under Plenković, Croatia is drifting away from the principles it adopted on joining the European Union. During his two terms, institutions such as the Commission for the Prevention of Conflicts of Interest have been significantly weakened. The Commissioner for Information was appointed as a fig leaf so the justice minister could hide the real authors of theLaw on Constituencies, which redrew the boundaries of electoral districts to suit the ruling party. This key electoral law was crafted by the HDZ without involving experts, civil society or the opposition. Arbitrary district boundaries were traced on the basis of an unreliable voter registry. This move has undermined public trust in elections and could also result in an even lower voter turnout.
Are protesters able to voice their demands freely?
The government has imposed restrictions on protest rights, including by closing St Mark’s Square, home to key government institutions. Full access to the square is now restricted to government and parliamentary staff, and the area where people are allowed to protest is demarcated with fences. Recent demonstrations like the one on 17 February, however, haveseen an expansion of the available space for protesters.
Plenković reacted to these protests by accusing the opposition of being pro-Russian, despite the fact that its only reference to Russia was to mourn Alexei Navalny’s death. On its official Facebook page, the HDZ insulted the opposition and people who supported the protest by labelling them ‘backward leftists’, ‘rampant angry revolutionaries’, ‘Russophiles’, ‘Putinophiles’ and ‘destructive and anti-patriots’. Many members of the government also endorsed this hostile narrative. In this crucial electoral year, Gong’sanalysis revealed the use of numerous bots – automated programs that mimic human activity – supporting insults against the opposition on Facebook and attempting to manipulate citizens.
Plenković has tried to silence the media and their sources by adding provisions to the Criminal Code to criminalise leaking of information during the non-public phase of criminal proceedings. The bill however triggered protests by journalists and in response the government amended it to clarify that leaks deemed to be ‘in the public interest’ wouldn’t be criminalised. What is or is not in the public interest will however be determined by judges and Turudić.
What’s at stake in the 2024 elections?
President Milanović shocked Croatia when he announced he would run in parliamentary elections, scheduled for 17 April, as the Social Democratic Party’s (SDP) prime ministerial candidate, entering the ring against Plenković. The Constitutional Court says Milanović can only run for prime minister if he resigns as head of state first. Milanović called them gangsters and continued the campaign with the slogan ‘The rivers of justice are coming’. The SDP’s support grew strongly in the polls, but it now has a furious rhetorical populist at its head, openly saying he will not respect the Constitutional Court.
Campaigns will likely be plagued by offensive speech, contributing to the erosion of democratic values and the integrity of the electoral process. The HDZ is still by far the strongest party, but people are increasingly dissatisfied with the direction of the government and the constant corruption scandals. With Milanović’s entry into the race, the election result has become uncertain.
What are the main challenges for civil society?
Croatian civil society organisations (CSOs) operate in a context marked by a backsliding in liberal democracy, with attacks on activists, the media and independent experts, and challenges to the rule of law. Civic space has significantly contracted, and CSOs face administrative burdens, financial constraints, overwork and underpayment. As a result, many organisations are retreating from the public sphere, decreasing their engagement and doubting if they should continue to question thosein power.
Moreover, changes in 2020 to theCouncil for Civil Society Development reduced the participation of CSOs in decision-making processes, undermining the legitimacy of the body and leading to the government outvoting CSOs and completely dominating law-drafting working groups. We have warned the public and the European Commission (EC) about token CSOs being used to shape anti-corruption laws. Instead of consulting widely with civil society, the government includes these CSOs that have been established to support its agenda rather than promote the public interest.
In this challenging environment, Gong is set on remaining an active democratic watchdog,using a range of strategies to achieve social impact and foster positive change. These include analysis, research, proposing democratic innovations, advocacy, education, networking and collaboration with diverse stakeholders, including the academic community, civil society, media, politicians, government institutions and society in general.
A recent successful advocacy effort involved the EC unveiling new guidelines for the participation of its members in elections. This initiative was prompted by Gong’sreport on EC President Ursula Von Der Leyen’s involvement in a pre-election campaign video for the HDZ. Gong raised this issue with both the EC and the European Ombudsman during Croatia’s 2020 parliamentary election.
For doing this work, we are constantly targeted with defamation campaigns by politicians, particularly those in power. This raises concerns for our safety and must immediately stop.

ECUADOR: ‘Democracy has allowed room for organised crime and narco-politics to grow’
CIVICUS speaks with Mauricio Alarcón Salvador, executive director of Fundación Ciudadanía y Desarrollo (Citizenship and Development Foundation, FCD), about the elections that will be held in Ecuador on 20 August, the eruption of political violence and organised crime and the implications for civil society and the future of the country.
FCD is an Ecuadorian civil society organisation (CSO) that promotes and defends the rule of law, democratic principles and individual freedoms and encourages citizen participation, social control, transparency, open government and public innovation.
Why is Ecuador facing general elections only two years after the inauguration of a new president?
We will have new elections because the current president resorted to the mechanism known as ‘mutual death’, established in the constitution since 2008. This allows the president to dissolve the National Assembly on various grounds. It is known colloquially as ‘mutual death’ because ‘killing’ the legislature also causes the ‘death’ of the executive. In May this year, President Guillermo Lasso dissolved the National Assembly because, in his opinion, it had caused a serious political crisis, in the context of an impeachment trial against him based on accusations of corruption in his close entourage. The use of this mechanism allows the president to continue governing briefly without Congress but requires both legislative and presidential elections to be called within a short period of time to elect those who will complete the ongoing term. That is why the National Electoral Council called for presidential and legislative elections to be held on 20 August. Those elected in this vote will stay in power for approximately 18 months, the length of the current term remaining, which will end in May 2025.
How has civic space evolved under this government, and what are the prospects for the future?
For the little more than two years that this government has been in office, the situation of civic space has not changed much from the previous period. While it is true that the Organic Law on Communications was reformed to provide greater guarantees for freedom of expression and press freedom, the hostile environment against the media and journalists remains unchanged. The main aggressor may no longer be the president, but the notion persists that some people have the right to silence others just because they think differently. The climate of censorship and self-censorship hasn’t changed.
Nor have the regulatory conditions under which CSOs operate. Although the authorities no longer persecute or intimidate them, the regulations that enable them to do so remain in place. No progress has been made towards the adoption of an NGO law fully guaranteeing freedom of association.
Finally, as regards freedom of peaceful assembly, protests in June 2022 highlighted the weak character of the procedures available to authorities for guaranteeing it. There is still much work to be done in this regard and the challenge ahead is enormous.
CIVICUS, an organisation of which we are members, has been key in making the situation of civic space in Ecuador and its evolution visible in recent years.
Are the conditions for clean and transparent elections in place?
At FCD we believe that general conditions exist for a clean and transparent electoral process. The National Electoral Council that is in charge of this process is the same that organised the presidential vote in 2021 and local elections a few months ago. These were processes that, generally speaking, have been commended by electoral observation missions. There are some pending issues to be resolved, mainly regarding the financing of politics, but in terms of the organisation of the process we are confident that everything will go well.
As civil society, we would have liked to collaborate much more in supporting these elections, but this process came about unexpectedly and the organisations that usually take part have not been in a position to implement all our initiatives. Nevertheless, national election observation will be carried out and we have conducted campaigns to promote informed voting: we have published background information about the candidates and their government plans, and we have even monitored, albeit in a limited way, issues related to political financing. The challenge is enormous, but we are confident that we are doing our part to strengthen an extraordinary electoral process that we never saw coming.
What are the key campaign issues?
What we’ve seen these past few weeks is an apathetic campaign, very weak on proposals. Candidates seem to be fully aware that what is being elected is a transitional government that will last a few months, and they are not giving it due importance. Little has been said about fundamental rights and freedoms in a context where security is the main focus of public attention. This is of great concern to us, because in the face of the critical situation of insecurity at the national level, people demand quick solutions regardless of whether their implementation violates rights and freedoms. Regarding security, for example, several candidates have referred to the use of force outside of what is established by basic rights and international standards in force in Ecuador and the region.
Unfortunately, it is difficult for a situation as serious as the one Ecuador is going through to be resolved in such a short period of time as the one that will be afforded to the future president. The main concerns of Ecuadorians are centred on insecurity, the economic crisis and corruption. It is hoped that the new government will act on these issues by listening to people and putting an end to the arrogance that has characterised the outgoing government. Although time is short, the transitional government should establish basic lines of action, either for continuity through the next period or so that whoever comes to power in 2025 will have a basis for doing so.
How does the assassination of Fernando Villavicencio change the political scenario?
Political violence is nothing new in Ecuador: in recent elections there have been candidates who experienced threats and attacks, which in some cases have cost them their lives.
However, this is the first instance in a long time that a presidential candidate has been the victim of an assassination. The conditions under which the attack on Fernando Villavicencio occurred are revealing. He was a candidate with a risk assessment of over 95 per cent, who had police protection and had been denouncing constant threats against him.
This affects not only the electoral landscape but also Ecuador’s democracy itself, which has allowed room for organised crime and narco-politics to grow. If the proper institutions act in a timely manner and not only prevent events like this from happening again, but also manage to put an end to the prevailing impunity, we will end up strengthening a weak democracy that has been crying out for help. For this to happen, there is much work ahead, focused on coordinating efforts between public institutions, civil society, the private sector and political actors in ways that put the country ahead of any particular interest.
What international support does Ecuadorian civil society need to continue doing its work?
After what has happened in recent years, the starting point would be to ensure that international cooperation does not abandon Ecuadorian civil society. Cooperation institutions must also understand that although it is more profitable – at least in terms of communication – to save the environment, protect species or support community development, it is key to maintain support for organisations and initiatives working for democracy and civic space, because no other initiative would be viable without these.
The international community must keep its eyes on Ecuador and look for local allies to fight back against the democratic setbacks we are experiencing. A joint effort is needed to strengthen civil society as a fundamental pillar of democracy.

ECUADOR: ‘The election provided a temporary escape valve, but instability is not over’
CIVICUS discusses the results of the 15 October runoff vote in Ecuador’s presidential election with Humberto Salazar, executive director of Fundación Esquel.
Esquel is a civil society organisation that seeks to contribute to sustainable human development, the improvement of the quality of life of the most excluded parts of the population and the construction of a democratic, responsible and supportive society in Ecuador.
How did violence as a result of organised crime affect the election?
The electoral process was deeply affected by violence. This was not limited to the death of presidential candidate Fernando Villavicencio. In the context of these and the previous local elections, elected representatives to local governments were also assassinated. The most notorious case was that of Agustín Intriago, mayor of the city of Manta. A candidate for the National Assembly was also assassinated, and many other candidates for different positions received threats. The list of fatal victims of violence expands if we include the seven suspects captured for the Villavicencio assassination who were killed in the prisons where they were being held.
In this context, voting preferences were surely affected. From the shadows, groups representing local and transnational mafias sent intimidating messages through violent acts that influenced people’s votes. This was very evident in the first round, when following Villavicencio’s assassination, most voters opted for candidates who until then had had no chance of reaching the runoff. This was the case with Jan Topic and Daniel Noboa, the president-elect. Both saw their numbers rebound after the assassination.
Was violence a campaign issue in the runoff?
The influence of violence on the elections went beyond being a campaign issue strategically chosen by the candidates. For voters, security became a central issue on the agenda, even surpassing in priority other key issues such as unemployment and poverty.
It is not that unemployment and poverty lost relevance, but rather that the three issues became an integrated trio of aspirations that is at the basis of current demands. The electorate is looking for quick and effective, but not isolated, answers. Security, unemployment and poverty are all elements of the same equation that citizens demand from the political system.
Although the candidates’ proposals on the issue were very general, there is a consensus in political circles that security is a key issue in Ecuador’s current situation. Consequently, in the coming days the president-elect will have to develop his security proposals in greater detail. At the polls, voters didn’t evaluate whether the proposals of either candidate on the issue were the best, nor did they have the tools to do so, but now they hope that, regardless of the policies chosen, the result of their implementation will be greater peace.
Do you see the result as indicating a rightward turn by the electorate, or do you think the vote wasn’t ideologically motivated?
The analysis of electoral preferences is not a game of addition and subtraction in which one side, in this case the right, wins, while the other side loses. Nor are we dealing with a naïve or uninformed electorate that has been tricked by a renewed right-wing alternative and has leaned towards right-wing values, principles and narratives as a result.
In the current circumstances, the vote is far from ideological. Other considerations weigh in the assessment of available options. In this case, the search for novelty prevailed, allowing for the victory of an ‘outsider’. In Ecuador, outsiders have a long track record of success.
While the winning candidate represents the right in terms of his values and models, discursively he presents himself as a renovator, much more pragmatic than ideological. This blurring of ideological content is not a unique feature of this particular candidate, but expresses a deeper process of transformation of representation in a context in which rhetoric has been emptied of content as a result of practices blatantly contradicting discourse.
People voted overwhelmingly for a candidate who managed to inspire their trust, whose traits set him apart from the polarised competition proposed by more ideological candidates. They looked for someone who offered alternatives not only to address security issues but also to tackle issues of economic recovery and welfare.
The result was also influenced by the expectations of specific audiences such as young people, who make up a major part of the electoral roll. This part of the electorate sought options for the future detached from the conflicts between those who are ultimately responsible for the crisis in which we are now immersed. In this sense, right-wing and left-wing ideological narratives were equally punished, as evidenced by the fact that all traditional parties lagged behind in the election results.
Why did defeated candidate Luisa González lose, despite having a stronger party structure?
A key factor in Luisa González’s defeat in the runoff was the weight of the figure of former president Rafael Correa as the symbol and leader of the Citizen Revolution movement. This leadership, which offers the movement a captive electorate of around 25 per cent, also creates a ceiling that, in a polarised competition between Correism and anti-Correism, does not allow the candidate to surpass the 50 per cent required to win in the runoff. The same polarisation strategy that gave Correa’s government the strength to push its agendas has reduced her chances of attracting an electorate that is not part of the party’s hardcore vote.
The revanchist narratives of Correism, expressed in the motto ‘neither forgive nor forget’, also undermined González’s support. The appeal to a return to the past reaffirmed the party’s base, but prevented it winning the votes of a broader electorate that distrusts the authoritarian tendencies of Correism and feared that the triumph of his candidate would translate into restrictions on civic space, particularly on freedom of association.
What are civil society’s expectations of the new administration?
While the president-elect does not have a history of resistance to civil society participation, during the campaign he was not particularly open to receiving proposals from and meeting with civil society groups. This creates uncertainty about how broad and effective spaces for civil society participation in public policy design and implementation will be. In principle, there are no clear threats to civic space, but there is uncertainty regarding the new government’s position on the promotion and strengthening of civil society.
It is worth noting that the two second-round competitors had a conservative bias beyond their ideological leanings to the right or left. Hence the uncertainty as to how the new president will respond to social demands from the gender equality agendas of feminist groups and the LGBTQI+ community, the demands of the Indigenous movement regarding plurinationality and interculturality, and the concerns of the human rights movement regarding the search for policies to tackle crime that do not sacrifice rights.
What is certain is that there is a huge number of problems that the new government will have to address. To sustain its initiatives beyond the one and a half years of his term in office, the new president will need to make a broad call for action and produce a basic agenda endorsed by national multi-stakeholder agreements. Policies on security, labour – with an emphasis on youth employment under a model of intergenerational inclusion – and combating chronic child malnutrition will be indispensable. The so-called Democracy Code, the 2009 law that establishes the electoral system, the management of elections and the requirements for the functioning and financing of political parties and movements, must also be reformed.
Do you think this election put an end to political instability?
The instability is not over, but the election provided a temporary and short-lived escape valve for the tensions of the multi-dimensional crisis affecting Ecuador. The government’s grace period, however, will be very limited: it will have to produce measures in the short term that show it’s on the way to resolving major problems.
Two things could work against it: the slowness of the bureaucratic apparatus to develop transformative projects and the power struggle that could block its initiatives in the National Assembly. The relationship between the executive and legislative branches will be key. If the executive once again finds itself blocked by a multitude of special interests demanding perks to enable the approval of its initiatives, the crisis will again deepen.

ECUADOR: ‘The new government must dialogue and seek political agreements that are public, not under the table’
CIVICUS discusses the results of the 15 October runoff vote in Ecuador’s presidential election with Ruth Hidalgo, executive director of Participación Ciudadana (Citizen Participation).
Participación Ciudadana is a non-partisan and pluralist civil society organisation (CSO) that works to strengthen democracy in Ecuador.
How did organised crime violence affect the electoral process?
The electoral process that just ended has been marked by political violence: a presidential candidate, a mayor and a prefect were assassinated. There has also been a climate of violence on the streets due to the actions of drug gangs, who extort protection money known as ‘vaccines’ from the public and uses it to finance organised crime groups.
This made the issue of security one of the central topics in the debate between the second round candidates, and one that has generated the highest expectations.
The two candidates’ proposals, however, were broadly similar, although with some differences in tone and characteristics of their own. Both aimed to strengthen the presence of the armed forces as co-executors alongside the police of anti-crime policies.
How do you interpret the triumph of a centre-right alternative?
This was not necessarily an ideological vote. The weakness of political parties in Ecuador means that ideology is losing strength. For some time now, the country has been debating not between right and left but between Correism and anti-Correism: it is the controversial legacy of former president Rafael Correa, in power for a decade between 2007 and 2017, which continues to polarise Ecuadorian society.
The winning candidate, business leader Daniel Noboa, represents at least by his origins a centre-right option. But if he has won, it is because he has managed to capture the votes of a young electorate that is not on either side of the polarisation and has rather opted for a new vision, a young candidate with no political baggage who offers a form of politics that, unlike that of his predecessors, is not confrontational.
What factors worked against the candidacy of Luisa González?
Correa’s candidate, Luisa González, was hurt by the constant presence of Correa during most of the campaign, which ended up overshadowing her candidacy. Although in the end she tried to distance herself from that influence, she did not manage to position herself as a renewed Correist option, which is what she should have conveyed in order to have a chance of winning. She remained stuck to the worn-out and questioned political image of the former president.
I believe that the element of Correa’s legacy that leads to the greatest rejection is his confrontational and threatening way of dealing with those he views as political enemies. This seems to be eliciting more and more discontent and disapproval. While the amount of support González received was not small, this set a ceiling for her that she was unable to break through. This was precisely the reason her opponent was able to prevail.
How has the space for civil society evolved in recent years, and what can be expected under the new government?
Civil society, in my opinion, has recovered its presence and freedom of action after Correa’s time in power, during which it was restricted and in some cases persecuted. Let’s not forget that an important environmental CSO, which confronted the government because of its extractivist policies, was arbitrarily shut down and then legislation was passed to regulate the registration, operations and closure of CSOs at the government’s discretion, with the aim of removing those that bothered the government. Many civil society activists and journalists were criminalised for their work.
The expectation of civil society under the new government is the same as always: to have an enabling environment that allows it to carry out its activities freely. We expect a government that protects and promotes freedom of association.
What should be the priorities of the new president?
It’s worth remembering that these were early elections called to elect President Guillermo Lasso’s successor after he used the ‘cross-death’ mechanism, dissolving congress to prevent it impeaching him, but simultaneously cutting his mandate short. This means Noboa will only serve as president for the rest of Lasso’s term: a mere 18 months, too little time for the many challenges he will face.
The new president takes over a country plagued by insecurity and violence, with a high fiscal deficit, almost zero growth, very high unemployment rates and on top of that, one that is once again experiencing the El Niño climate phenomenon, with warming water currents that produce extreme weather events and record temperatures. These are all issues he will have to prioritise, with public policies aimed at mitigating the most important problems in the areas of the economy, climate change and public security. To do so, he will need to build a strong team and create spaces for dialogue and reconciliation. He will need to demonstrate openness to civil society and seek political agreements that are public, not under the table.
Every election presents an opportunity. As always in a country with so many needs, expectations are high. The main task ahead for the new government is to strengthen Ecuador’s democracy, which will demand an enormous amount of work.

GEORGIA: ‘The foreign agents law poses a threat to the vibrancy and autonomy of civil society’
CIVICUS speaks with Nino Samkharadze, policy analyst at the Georgian Institute of Politics, about thecontroversial ‘foreign agents’ law just passed in Georgia.
The Georgian Institute of Politics is a Tbilisi-based non-profit, non-partisan research and analysis organisation dedicated to fortifying the foundations of democratic institutions and effective governance in Georgia.
What’s the purpose of Georgia’s law on foreign agents?
According to the government, the Law on Transparency of Foreign Influence, which has just been passed by parliament, aims to increase the transparency of civil society’s operations by requiring civil society organisations (CSOs) to disclose their sources of funding and provide details about the nature of their activities.
In its transition from the post-Soviet era, Georgia faces economic and political challenges. Its evolving democracy is characterised by weak institutions and it’s heavily dependent on support from international sources, including financial grants from the European Union (EU), European states and the USA. The introduction of this law may have been a response to concerns about foreign influence, but it has sparked debate in Georgian society. It poses a threat to the independence and security of CSOs. Its vague language and broad room for interpretation provide the government with opportunities to influence and control civil society, potentially stifling dissenting voices and undermining the positive contributions of CSOs to democratic governance.
Why did the government reintroduce the bill after failing to pass it last year?
The process began with the introduction of a first version of the bill in February 2023. It wasn’t proposed directly by the ruling Georgian Dream party but by People’s Power, a splinter political group closely linked to Georgian Dream and espousing even more radical anti-western narratives. But it was met with considerable domestic and international opposition. Protests erupted in Tbilisi, Georgia’s capital, and criticism came from European institutions and the US government. In response, Georgian Dream announced it would vote against the bill, which ultimately led to its rejection by parliament. Following this failure, Georgian Dream underwent a period of reflection and intensified its propaganda. It softened the bill’s language and tone to make it appear less radical and reintroduced it in April 2024. Soon after, on 14 May, it was passed by parliament.
Georgian Dream came to power in 2012 and is now in an unprecedented third term in office. Since it began its third term in 2020, it has increasingly shown anti-democratic tendencies. With a general election scheduled for October 2024, it’s under increasing pressure as polls indicate a decline in public support. If it doesn’t maintain its majority, it will have to seek cooperation from opposition parties. In this context, the government may see the passage of this law as a way to defuse opposition and strengthen its grip on power.
How do you think the law would affect civil society?
The impacts of the law on civil society are expected to be significant and multifaceted, affecting various dimensions of its functioning and autonomy.
CSOs are likely to be negatively labelled as serving the interests of foreign powers, undermining public confidence in their activities and missions. This labelling could easily lead to stigmatisation and marginalisation, reducing the effectiveness of advocacy efforts and diminishing their influence in the public sphere.
The law’s provisions for extensive monitoring also pose a threat to the autonomy of CSOs and the privacy of their staff. The government’s ability to access and publish personal data, including correspondence and communications, could hamper CSOs’ ability to operate freely and investigate cases of corruption and human rights abuses.
Further, the ambiguity of the law leaves room for interpretation and potential abuse by the government. Similar to the situation in Russia, where laws targeting ‘foreign agents’ have been used to restrict civil society activities, the vague language of the law could allow for further restrictions on CSOs and their ability to operate independently.
The law may also lead to a withdrawal of funding from international foundations and donors. Given the increased risks and restrictions on civil society activities, donors may be reluctant to continue supporting organisations in Georgia, further limiting the resources available for democracy and state-building efforts.
Overall, the draft law poses a threat to the vibrancy and autonomy of Georgian civil society. It undermines the essential role CSOs play in promoting democratic values, defending human rights and holding the government to account. It could have far-reaching consequences for Georgia’s democratic development and its relationship with the international community.
How has civil society reacted?
Georgian civil society has vehemently opposed the bill, seeing it as a dangerous step towards authoritarianism. This law poses a threat to critical voices and raises fears of further concentration of power in the hands of the ruling elite, as has happened in Belarus and Russia.
No wonder the bill is also often referred to as the ‘Russian law’ – it’s seen as a precursor to outcomes similar to those seen in Russia. It’s feared that dissenting voices will be marginalised or silenced under this law, mirroring the situation in Russia where government critics often face persecution or exile. Given the consolidation of the ruling party and the erosion of democratic principles in Russia, there are concerns in Georgia that the ruling party is also seeking to consolidate power and stifle dissent. Despite some differences between both legal texts, the broader implications for democracy and civil liberties are deeply worrying.
Georgian society, known for its pro-European and pro-democracy stance, has taken to the streets to protest against this threat. International partners, including the EU and the USA, have also criticised the law and stressed the importance of upholding democratic values.
How has the government responded to the protests?
The government’s response to the mass protests has been one of dismissal, demonisation and repression.
The government has tried to discredit the protesters, particularly younger people, by suggesting they are uninformed about the law and are being manipulated. However, this is contradicted by the fact that many of the protesters, many of whom are students, are well educated and have a clear understanding of the issues at stake.
The government has also resorted to tactics of repression and intimidation, with reports of regular arrests, beatings and pressure on people associated with the protests. Civil servants, including teachers and academics, have been threatened with the loss of their jobs if they are found to be involved in the protests. This has a chilling effect and discourages dissent.
CSOs have been targeted with demonisation campaigns that portray them as enemies of the country. While there has been no immediate closure or direct pressure on these organisations, the hostile rhetoric and stigmatisation contribute to an environment of fear and intimidation.
This authoritarian approach reflects a concerted effort to stifle dissent and maintain control, even at the expense of democratic principles and human rights. It threatens to further undermine confidence in institutions and exacerbate social and political tensions.
How can the international community best support Georgian civil society?
The international community can play a crucial role in supporting Georgian civil society at this difficult time.
High-level visits and engagement by representatives of the EU and the USA are essential. We hope they’ll lead to tangible measures to hold accountable those members of Georgian Dream who supported this law. This could include the introduction of targeted sanctions against people responsible for undermining democratic principles. In addition, the EU should use Georgia’s official status as a candidate for EU membership to impose conditions of adherence to democratic norms and respect for human rights. Sanctions or other forms of pressure could be imposed if these principles are violated.
It’s also crucial that the EU and the USA continue to demonstrate their unwavering support for Georgia and its pro-European aspirations. Financial assistance and political support are essential to strengthen civil society and maintain momentum in the struggle for democracy. Without this support, civil society risks being further marginalised and weakened by the government.
A combination of diplomatic pressure, conditionality and unwavering support from the international community is needed to support Georgian civil society in its struggle for democracy and human rights.

GERMANY: ‘The rise of the far right will make things more difficult, but the EU will remain functional – for now’
CIVICUS speaks with Andreas Müller, Executive Director of Democracy International, about the European Parliament elections and his expectations for the results in Germany.
Democracy International is a German civil society organisation working to strengthen civic participation and direct democracy. Its goals are to give people a direct say in political decision-making and to make governments more accountable.
What’s at stake in the European Parliament elections?
In 2024, more people around the world will participate in elections than ever before, setting the political course for years to come. At the same time, we are experiencing the biggest global crisis of security and democracy in decades. The number of democracies worldwide has reached a new low since 1985 and authoritarian regimes are on the rise. The human rights situation in many countries is appalling. Russia’s war of aggression against Ukraine and China’s threats against Taiwan also threaten global peace and security.
In this context, the 2024 European Parliamentelections are of particular importance. The European Union (EU) is facing immense challenges as a peace project. The security challenge of Russia’s war on Ukraine influences the thematic focus of the elections. The rise of nationalist, right-wing parties in many European countries and accusations that the EU is too bureaucratic, undemocratic and out of touch with people are putting the EU under great pressure.
Right-wing nationalist parties are exploiting these challenges by offering populist, seemingly simple solutions to these complex crises and fuelling the narrative that the EU is the cause of these problems. Debates aboutrising inflation and economic insecurity, globalisation, immigration and asylum policy are deliberately confused through disinformation in all channels, leading to uncertainty about the EU’s ability to act. As a result, right-wing parties that are critical and hostile of the EU are likely to secure close to a quarter of European Parliament seats.
This is paradoxical, given that these challenges can only be met with a functioning EU. Strong, progressive legislation is needed to address climate, security and democracy crises. However, the expected rise of right-wing, nationalist parties is likely to lead to more blockages and delays, threatening the functioning of European democracy and the rule of law.
The main task of all democratic parties in the European Parliament in the next legislative period will be to counter this development. Large civil society alliances and parties are urging people to vote against this trend. Following the reversal of the negative trend in voter turnout in 2019, efforts are being made to achieve at least 50 per cent turnout across the EU.
What are the likely outcomes in Germany?
In Germany, voter turnout has risen from a low of just 43 per cent in 2004 to 61.4 per cent in 2019, back to 1994 levels. This trend is expected to continue, particularly given that, for the first time, people between 16 and 18 will be able to vote, and two-thirds of them have said they intend to do so.
However, higher turnout alone will not prevent the rise of right-wing parties. Predictions are that the right-wing Alternative for Germany (AfD) could come second or third in Germany. Only the conservative Christian Democratic Union and the Christian Social Union in Bavaria are far ahead in the polls. The governing parties of thetraffic-light coalition – the Social Democratic Party, the Greens and the Free Democratic Party – are expected to lose votes compared to the previous European Parliament election in 2019.
Still, there is reason for hope: since the beginning of the year, the AfD has lost significant support in the polls. While it received 23 per cent in January 2024, it is now getting only 15 per cent. The reasons for this include a series ofscandals involving the party’s top candidate and other officials, which led to the party’sexclusion from the right-wing Identity and Democracy group in the European Parliament.
Overall, the democratic centre in Germany remains clearly in the majority in this EU election, albeit with a loss of votes compared to the AfD.
What are the main issues likely to influence the outcome?
The main issues in this election are Germany’s role in relation to Russia’s war of aggression in Ukraine and the question of arms supplies. The threat to security and peace is at the centre of most political debates. The second most important issue is social and economic security, often discussed in connection with immigration and asylum policy, a theme particularly fuelled by the AfD. These two issues regularly alternate in first and second place in the polls. Climate and environmental issues have lost prominence compared to 2019.
The expected increase in voter turnout suggests a growing interest among German voters. Overall, voters’ understanding of global issues and crises and of the role of the EU has increased. However, domestic issues and opinions on national government policies remain the decisive factors accounting for voting decisions. In Germany, the outcome of the EU election is a mood indicator for national politics. Specific European issues tend to play a subordinate role.
Are there significant differences between young and older voters, and between men and women?
Like German society as a whole, the younger generation is not homogeneous. However, young people tend to be more supportive of the EU than older generations. Around 78 per cent of young people support the continuation of the European project, compared with 65 per cent of older people. But, according to the latest polls, young people are not expected to vote in higher numbers than older people.
Young voters differ from older ones on several issues. While both age groups share concerns about peace and security and the impact of Russian aggression, young people are more likely to be concerned about human and civil rights and climate change. On social and economic issues, young people are particularly concerned about affordable housing, equal opportunities and protection against poverty in old age. Migration and asylum issues are less important to them.
When it comes to gender, there is a noticeable gap in voting decisions. In Germany, women generally vote more left-progressive, while men tend to vote more conservative. This trend has intensified in recent years. The gender gap is most significant among young people. According topolls, 18 per cent of young men intend to vote for the AfD, compared to eight per cent of young women.
What would be the consequences of the rise of the far right in the European Parliament?
A rise of right-wing, nationalist parties in the European Parliament means the legislative body would have to deal with obstructionism and anti-EU behaviour. However, all polls predict a continued strong democratic majority for the political centre. So while the growth of the right wing will make political work more difficult and uncomfortable, the EU will remain functional, at least for the time being. Whether mainstream parties can counter the nationalist narrative remains to be seen. It will be crucial to tackle the security crises of coming years and ensure social and economic security.
For Germany, the election is a bellwether for upcoming national elections, particularly next year’s parliamentary election. The AfD’s decline in the polls is also noticeable at the national and state levels, although less so than in the EU elections, and the reasons for this are mainly attributable to the AfD itself. At the moment, all democratic parties have ruled out cooperation with the AfD, so the risk of right-wing populists entering government remains low.
Examples fromHungary,Italy andthe Netherlands show this is a European trend that’s been going on for a long time. All these examples have already had consequences for the rule of law, democratic freedoms, human rights and overall societal interaction.
Germany is not immune to this, and the pressure from right-wing populist and nationalist parties and opinions is very real here as well. Political discourse is increasingly shifting towards the right. If the AfD keeps gaining ground, it will get worse.

GLOBAL: ‘With a wealth tax on the biggest fortunes, extreme poverty can be eradicated’
CIVICUS speaks about climate change, global inequality and the need for redistribution with Adrien Fabre, a France-based climate economistand founder of Global Redistribution Advocates (GRA).
GRA is a civil society organisation (CSO) that promotes public debate about three global redistribution policies that enjoy wide public opinion support worldwide – a global wealth tax, a global climate plan and a global climate assembly – and advocates towards political parties in several countries to incorporate these into their agendas and programmes.
What inspired you to become a climate economist and found GRA?
I started my PhD in economics with the goal of understanding humanity’s problems and proposing solutions. I always wanted to give voice to every human, so I naturally specialised in running surveys. Then, in the context of the Yellow Vests protests that began in 2018, I surveyed French people about their attitudes towards climate policies. This sparked interest at the Organisation for Economic Co-operation and Development (OECD), which called on me to conduct a similar survey in other countries. I seized the opportunity to ask people questions they had never been asked before, such as whether they supported a global tax on millionaires to finance low-income countries. I was amazed by the levels of support: more than 70 per cent in every country!
I ran complementary surveys in Europe and the USA. I tried asking questions differently and tested policies in which the respondents would lose money, but the results were the same: people in western countries were willing to lose a few dozen euros per month to end climate change and global poverty. Furthermore, the support is sincere: you can read this scientific article or my Twitter thread for details.
Now, if there is such strong support for global redistribution, why doesn’t anyone propose it or defend it in public debate? To advocate for global redistributive policies to transfer resources or power from high to low-income countries I launched GRA in April 2023.
What are your proposals?
We have three main proposals to promote wealth redistribution, environmental sustainability and global cooperation to address pressing global challenges. The first is a global wealth tax on individual wealth exceeding US$5 million, with half of the tax proceeds distributed to lower-income countries.
This tax would spare 99.9 per cent of the world’s population, who have wealth below US$5 million. And if the tax were just two per cent, it would collect one per cent of the world’s GDP, which is more than the GDP of all low-income countries, home to 700 million people, combined. Our proposed tax schedule is moderate: two per cent for fortunes above US$5 million, six per cent for those above US$100 million and 10 per cent for those above US$1 billion. A tax of two per cent is far lower than the interests, rents and dividends such a fortune generates.
Our second proposal is a global climate plan aimed at combatting climate change through a worldwide carbon emissions cap, implemented by a system of global emissions trading, and financing a global basic income.
This plan would enter into force as soon as signatory countries cover 60 per cent of global carbon emissions. Participating countries would enforce a cap on carbon emissions, decreasing each year and down to net zero emissions after three decades, in line with the temperature target. Each year, emissions permits would be auctioned to firms that extract fossil fuels or import them from non-participating countries, making polluters pay. To cover the cost of emissions permits, firms would increase fossil fuel prices, which would in turn encourage individuals and businesses to change their equipment or adjust their habits, eventually reducing carbon emissions. The revenues from carbon pricing would fund a global basic income estimated at US$50 per month for each person over 15.
This plan would bring a massive redistribution from countries with a carbon footprint higher than the global average – like OECD countries – to those with a lower-than-average carbon footprint, including most of Africa, South and Southeast Asia and Latin America. It includes mechanisms to encourage participation by all countries, such as a tariff on goods imported from non-participating countries in proportion to their carbon content, a provision allowing middle-income countries such as China to opt out from the mutualisation of revenues to guarantee that it would not lose from the plan while ensuring that it decarbonises with the same carbon price, and a provision facilitating the participation of subnational entities like California or the state of New York even if the federal level does not participate.
The wealth tax and the climate plan would each redistribute one per cent of the world’s GDP from high to low-income countries every year. Extreme poverty can be eradicated. The average income in a country like the Democratic Republic of the Congo would double following the transfers.
Our third proposition is that of a global climate assembly, comprised of representatives elected through proportional representation in participating nations, tasked with drafting a comprehensive treaty to address climate change globally. Before even the beginning of that experiment in democratic governance at the global scale, the assembly would bring a radical change, as the election campaign would foster a global public debate on climate justice.

Who are you targeting these proposals at, and how are you working to get the message across?
We are targeting our campaigns at policymakers, scholars, civil society and lay people. Many scholars have endorsed our proposals. GRA is a member of civil society networks in each of our policy domains, and we are hoping that key CSOs will endorse our proposals. We have already met with cabinet members of various governments, including Brazil, Colombia, France, Germany and South Africa, as well as many European Union (EU) politicians. And we are sending dozens of emails every day to get more meetings. Once we get a book on our climate plan and the scientific article finished and published, we will reach out to the public. We will publish an open letter in widely read newspapers, calling on world leaders to discuss global redistributive policies at the United Nations (UN), the G20 and climate summits.
Hopefully, we will get media attention and the movement will grow. It will help if well-known personalities, including celebrities, endorse our proposals. But it will take a social movement to make change happen, perhaps a global demonstration. Our hope is that a large coalition of political parties, CSOs and labour unions throughout the world endorse some common policies towards a sustainable and fair future – ours, or similar ones. This will likely strengthen the parties of the coalition and help them win elections. Our research shows that progressive candidates would gain votes if they endorsed global redistributive policies.
What are the prospects of these proposals being implemented in the near future?
Our proposals are getting more and more endorsements every day. The African Union just called for a global carbon price and will defend this idea in international negotiations.
But our proposal that receives the largest support is the global wealth tax. The next European Parliament elections will be held in June 2024, and left-wing parties will campaign on a European wealth tax. We have proposed that one-third of this European wealth tax would be allocated to lower-income countries outside Europe, and there are good chances that some parties will take this forward. A petition in favour of a wealth tax has recently been signed by 130 members of the European Parliament, and politicians from all parties on the left and centre endorse our proposal. However, a majority in the European Parliament would not suffice, as this proposal would require unanimity at the Council of the EU, that is, the approval of each EU government.
However, three things can help. First, Brazil will chair the G20 in 2024, and we hope that President Lula, along with other leaders, will put pressure on global north states for global redistribution. Second, it would help if US President Joe Biden included wealth taxes on the agenda of his re-election campaign. Third, the campaign for the 2024 European Parliament elections could create momentum for some countries to move forward, even if the EU does not.
I am optimistic that wealth taxes will be implemented – perhaps not in 2024, but within the next decade. However, I fear negotiations might end up being overseen by the OECD, resulting in a disappointing agreement, as happened on international corporate taxation. Negotiations on international taxation must be hosted by the UN, not the OECD. And regarding the content of the negotiations, we should be vigilant of three elements: the exemption threshold, which should not exceed US$5 million; the tax rates, which should be progressive and not too low; and the distribution of revenues, a substantial part of which must go to low-income countries.

What are your hopes and expectations regarding the upcoming COP28 climate summit?
COPs sometimes bring good surprises. Last year, high-income countries finally accepted the principle of a fund to compensate vulnerable countries for the loss and damage from climate change, after 30 years of demands from the developing world.
But I don’t expect any good news this year, as the upcoming COP28 in Dubai is chaired by the CEO of the United Arab Emirates’ state oil company. More generally, I do not expect much from COPs because its decisions are made by consensus, so countries like Saudi Arabia can block any meaningful proposal. This is what led to the current system of nationally determined contributions: while all countries supposedly share the common goal of limiting global warming to ‘well below 2°C’, there are no binding commitments, no harmonised policies, no agreement on burden-sharing, and the sum of countries’ voluntary pledges is inconsistent with the common goal.
To break the deadlock, states with ambitious climate goals should start negotiations in parallel with the UN framework. I think the EU and China should start bilateral negotiations. If they put forward something like the global climate plan that we propose, countries that would benefit from it would surely accept it, and more than 60 per cent of global emissions would be covered. This would put enormous pressure on other countries to join, and particularly other OECD countries such as the USA.

GUATEMALA: ‘Our democracy is at risk in the hands of political-criminal networks’
CIVICUS speaks with Evelyn Recinos Contreras about Guatemala’s general elections – where a candidate promising reform has surprisingly made the second round of the presidential race – and the prospects for democratic change and opening up civic space.
Evelyn is a former investigator for the International Commission against Impunity in Guatemala (CICIG) and former advisor to the Attorney General of Guatemala. She is currently living in exile because of her human rights activism.
What is the state of civic space in Guatemala?
Civic space in Guatemala is under serious threat. To understand this better, one must understand that, as a consequence of armed conflict, the social fabric is broken. There is hardly any grassroots citizen engagement to speak of. The sectors that for decades served as an engine of social change, such as teachers, trade unionists and high school and public university students, have been irreparably affected by the violence.
Of these, probably the only grassroots sector that remains organised is Indigenous Mayan peoples, who fight for the defence of their territory and natural resources. In addition, in urban areas, civil society human rights and pro-democracy organisations have organised their work around strengthening democratic institutions, with much emphasis on the issue of justice.
It is precisely these sectors that are once again being hit by authoritarianism and state violence. In the interior of the country, thousands of community leaders are being criminalised and entire communities are subject to arrest warrants and threatened with criminal prosecution. A similar situation is experienced in urban areas, where the justice system has been captured by political-criminal networks that use state platforms to fund their criminal endeavours and intimidate justice operators, human rights defenders and activists who fight for human rights and the strengthening of civic space and democracy.
Networks of corruption and impunity affect the democratic space, as evidenced by the fact that people such as Thelma Cabrera of the People’s Liberation Movement were prevented from registering as candidates and participating in the elections.
What are the causes of Guatemala’s democratic erosion?
Democracy in Guatemala is being eroded by political-criminal networks that have taken over institutions and use them for their own benefit rather than the wellbeing of the public and the strengthening of democracy. But it has been a gradual and almost imperceptible process. Several key institutions have been weakened, such as the National Civil Police, which is in charge of two main tasks: crime prevention and the maintenance of citizen security, and collaboration in criminal investigations. For years, civil society worked with police commanders to build an institution at the service of democratic security, so that its work would serve to produce a civic space in which citizens could enjoy their fundamental rights and live a dignified life free of violence. But since 2017 we have seen the institution weakened, with commanders being dismissed and resources being misused.
Similar problems can be found in the judiciary. High courts have not followed their normal process of renewal: they have not held elections for new magistrates. In addition, the last two elections they held were denounced and investigated for acts of corruption. The Public Prosecutor’s Office has also been weakened by a policy of criminal prosecution and criminalisation of justice operators, which has also meant the sidelining of investigation of crimes against life, violence against women and property crimes, which hit citizens hard. Rates of violence and insecurity in Guatemala are almost as high as in countries undergoing internal armed conflicts.
Do you think that the anti-corruption struggle has failed in Guatemala?
It is very difficult to provide an absolute answer to the question of the success or failure of the fight against corruption in Guatemala. I think the cases that were brought to trial were supported by evidence and due process was respected. In that sense they were successful. But this was only part of the fight against corruption, because the law provides a limited platform. The damage to society had already been done and resources had already been lost.
The fight against corruption is only truly successful when there is a level of social involvement that leads to scrutiny of public officials and a sustained demand of accountability. Sadly, we are not there yet.
For those who have been involved in the fight against corruption, the negative consequences have been obvious. Prosecutors, judges, human rights defenders, activists and community leaders are being persecuted on unfounded charges and pushed towards exile. This sends a strong message of fear to Guatemalan society. But I am convinced that the struggle does not end here. We deserve a country where we can all live in freedom and dignity. The Mayan people have been resisting for more than 500 years, so I think they are our best example to follow.
Do you think a positive change could come out of this election?
I believe there is hope. People have shown they are tired of the same murky forces that for years have embodied voracious economic interests that exploit peoples and territories and are characterised by discrimination, double standards and structural violence.
The fact that one of the contenders in the runoff is the Semilla party, born out of the anti-corruption protests of 2015 and bringing together many people who have never participated in political parties before, is evidence of a desire for change. People rejected the usual political actors who represent archaic economic interests and embody authoritarian and corrupt forms of politics.
For change to really materialise, we need the international community to turn its eyes to Guatemala. The risk to our democracy at the hands of political-criminal networks must not go unnoticed. We need the international community to draw attention to and speak out about the situation in our country, because the violation of the human rights of Guatemalans affects our shared humanity.

GUATEMALA: ‘These elections are key because they give us a chance to take a different path’
CIVICUS speaks with Jordán Rodas Andrade about Guatemala’s general elections – where a candidate promising reform has surprisingly made the second round of the presidential race – and the prospects for democratic change and opening up civic space.
Jordán Rodas is a lawyer specialising in constitutional guarantees and fundamental rights, transparency and anti-corruption. In addition to being a university professor, in 2015 he was elected vice-president of the Guatemalan Bar Association and between 2017 and 2022 he was Guatemala’s Human Rights Ombudsman. In exercising this role he was repeatedly criminalised and threatened, as a result of which he had to go into exile.
How have civic space conditions changed in Guatemala in recent years?
In recent years there has been a very worrying deterioration of civic space in Guatemala, which has worsened under the current president, Alejandro Giammattei. His predecessor, Jimmy Morales, a comedian-turned-president, left very bad practices in place, but these reached extreme levels under Giammattei.
In recent years, many human rights defenders, land rights defenders, journalists and justice defenders have had to leave our country, forced by a hostile climate of persecution and criminalisation. This closure of spaces and the absence of an independent press have produced fertile ground for the advance of an authoritarian regime. These elections are key because they give us Guatemalans a chance to take a different path for the good of our country.
What drove you into exile?
In my five years as prosecutor, I was criminalised with 18 pretrial proceedings, all of which were rejected. It is exhausting to have to constantly defend yourself against such a succession of spurious accusations. Then I had eight requests for removal from office by members of congress, in addition to a crippling financial suffocation.
Above all, I have witnessed the weakening of justice. Many had to take the difficult decision to leave the country to save their lives, their freedom or their integrity. Among them are Juan Francisco Sandoval, former head of the Special Prosecutor’s Office against Impunity (FECI), Erika Aifán, an independent judge, Judge Miguel Ángel Gálvez and many others who in one way or another touched the heartstrings of political and economic power.
It is no coincidence that behind the persecution of justice operators and journalists is often the Foundation Against Terrorism, directed by business leader Ricardo Méndez Ruiz, who has been accused by the US government of acts of corruption and acts against democratic institutions. This organisation was a plaintiff in the criminal proceedings against Virginia Laparra, former FECI prosecutor in Quetzaltenango, who has been in prison for more than a year and who should never have been detained for denouncing cases of corruption of a judge. Whistleblowing is not a crime anywhere in the world.
The same organisation criminally prosecuted José Rubén Zamora, the founder of newspaper elPeriódico, one of the government’s main critics who for years has denounced corruption. Zamora was recently sentenced to six years in prison for several alleged crimes, including money laundering. This sent a very serious message against press freedom. The independent press has had to self-censor and yet it continues to fight this battle.
I was still in Guatemala when Zamora was captured, and so I decided to distance myself. I left in August but returned in December, by land, to participate in the assembly of the People’s Liberation Movement (MLP), which proclaimed Thelma Cabrera, an Indigenous Maya Mam woman, as its presidential candidate and myself as its vice-presidential candidate. Four years ago, the MLP came in fourth place, but in a context of social malaise in the face of corruption and thanks to its opening up to mestizo people – people of mixed European and Indigenous heritage – I thought it had a good chance of entering the second-round race.
But my successor in the prosecutor’s office filed a spurious complaint against me, as a result of which our presidential ticket was blocked. I was systematically refused information about the content of the complaint. In other words, this was used to take us out of the race. Since then, I have continued the struggle from exile. This may not be what you want, but it is what you have to do.
Under what conditions would you decide to return to Guatemala permanently?
I was just talking about this last week following a work meeting with the Guatemalan state mediated by the Inter-American Commission on Human Rights (IACHR). I have been the beneficiary of a precautionary measure from the IACHR since 2017. These measures establish that the state has the obligation to ensure and guarantee a person’s life, integrity, security and liberty, and in my case the state of Guatemala has not complied with it. In order to return, I would need as the minimum that the state does not persecute or criminalise me.
There are currently two accusations against me, one filed by the Human Rights Ombudsman’s Office and another by the Comptroller General’s Office. I have no official knowledge of what the accusations are because I don’t have access to the documents; I have requested them through access to information requests. But it seems to me they are related to the fact that in my declaration of assets I said that I had handed over on 20 August, which is when my constitutionally established term ended, but I left the country on 18 August, leaving the deputy attorney general in charge, as the law dictates. In other words, there was no falsehood or crime. This case is under reserve, and I have asked the state, as a sign of goodwill, not to extend this reserve but to hand over a copy of the complaint so I can defend myself, and to guarantee my life and safety, and that of my family in Guatemala.
Has the fight against corruption in Guatemala failed?
The fight against corruption has not failed, but it has stalled as a result of a well-thought-out strategy of a corrupt alliance of political officials and private sector actors.
However, today more than ever I hope that we will learn the painful but positive lessons from the International Commission against Impunity in Guatemala (CICIG), which I believe has more lights than shadows. I hope that from that learning we can, sooner rather than later, take up the fight against corruption again.
International support will continue to be indispensable because our justice system is very porous, permeated by organised crime and lacking institutionality. Three of the nine magistrates of the Supreme Court of Justice and several other judges and judicial officials are on the US State Department’s Engel List of people who have committed acts of corruption or have participated in actions to undermine democracy in their countries. Members of the Supreme Electoral Tribunal have been accused of falsifying their doctoral degrees to get elected and the Human Rights Ombudsman was Giammattei’s human rights officer in the prison system at the time he launched ‘Operation Peacock’, a police operation that resulted in a massacre and eventually cost Giammattei 10 months in prison, but also launched its presidential bid. Hence the trust that exists between these two officials.
But it is clear that people are tired of all this and they showed it at the ballot box on 25 June, when they said no to a return to the past and yes to a proposal that sends a message of hope for the fight against corruption. This was clearly put by the candidate who represents this hope, Bernardo Arévalo, who made it to the second round against all odds.
Do you consider these elections to have been free and competitive?
The presidential election was not free and competitive, because a fair election requires not only that there be no fraud on voting day, but also that a series of elements are present throughout the process, from the moment the elections are called. The election was called on 20 January, and on 27 January the state closed the door on us and prevented our participation. Not only did this violate our right to stand for election, but it also restricted citizens’ right to have a full range of options.
In reaction to this exclusion, Thelma Cabrera called for a null vote, and numbers don’t lie. The null vote actually won, with 17 per cent, a higher share than that received by the candidate who came first, Sandra Torres, who got around 15 per cent. People are clearly fed up.
The unfairness of the competition also manifested itself in the official party’s handling of public resources and the government’s extremely close relationship with some Supreme Electoral Tribunal magistrates.
But the fact that Bernardo Arévalo managed to enter the second round is, alongside the mass of null votes, blank votes and abstentions, a sign of enormous rejection of the system. I have high expectations for the second round, in which I hope that the Guatemalan people will participate massively and take advantage of this opportunity to choose a better future.
What would Guatemala’s new government need to do to put the country back on the road to democracy?
Above all, the anti-corruption message must be accompanied by real action. Revenge against justice operators must stop, the rule of law must be restored and the freedom of the independent press must be guaranteed.
The new president should form a cabinet inclusive of progressive sectors. He should convene political parties, social forces and Indigenous peoples’ movements to jointly make a proposal that ensures public policies benefit those most in need.
The new government should totally dissociate itself from the malpractices of the past and be very careful about power’s temptations. Its responsibility to those who have placed their trust in it must prevail. There will be temptations along the way, so it is essential that it place its bets on people who are ethical, capable and consistent with the values projected in the electoral campaign, as people voted for them because they recognised them first and foremost as an honest party. Bernardo is surely the most interested in honouring the legacy of his father, former president Juan José Arévalo. His government could become a third government of the revolution, taking up and improving on the great achievements of that democratic springtime that took place between 1944 and 1955.

INDIA: ‘Anti-Muslim hate speech sustains polarisation that benefits the ruling party’
CIVICUS speaks about India’s ongoing elections with Aakar Patel,board chair of Amnesty International India.
Amnesty International is a global movement of over 10 million people committed to creating a future where human rights are enjoyed by everyone. Amnesty International India was forced to halt its operations on 30 September 2020 as part of the Indian government’s crackdown on civil society.
How has the election developed so far, and what roles is civil society playing in it?
This is our lengthiest election yet, spanning from 19 April to 1 June. We expect to know the results on 4 June. This is an anomaly considering the advancements in technology that should have made the process faster. Previous elections have been completed in under three weeks, and even in the 1950s, when balloting was physical and counting manual, the process was swifter. One explanation for this election’s extended duration is that Prime Minister Narendra Modi, the focal point of the ruling Bharatiya Janata Party (BJP), needs time to campaign across all 28 states. The Election Commission, purportedly impartial, has been very accommodating to his needs.
This campaign has been notably acrimonious, with Modi exploiting religion to polarise voters. Anti-Muslim hate speech sustains polarisation, and this benefits the BJP disproportionately because it leverages religious identity unlike any other party. This polarisation effect is compounded by the BJP’s implementation of divisive policies, such as the criminalisation of marriages between Hindus and Muslims. Such measures are reshaping segments of society and are likely to have enduring impacts on our social fabric.
Modi also propagates baseless insinuations and accusations against the opposition, often left unchecked by the media. Political parties, particularly the BJP, adeptly harness digital tools for maximum impact, unbound by any ethical considerations.
Civil society in India faces significant challenges that have intensified under the BJP and Modi. Despite this, many groups have actively countered the communal and divisive rhetoric as effectively as possible, and have engaged with voters to provide information on relevant issues.
What are the major issues for voters?
So far, voter turnout has been lower than expected, and this seems to be the result of lack of enthusiasm. The BJP is placing its bets on polarisation rather than putting forward substantive proposals to tackle voters’ material concerns. These move briefly onto the centre stage when the opposition is able to thrust them under the spotlight. And still, major media outlets, predominantly owned by corporate entities and seemingly tethered to the government, tend to sidestep pressing issues like unemployment, inflation and violence in Manipur state.
Regional issues hold significant importance, particularly in the southern states where the BJP’s political influence is not as entrenched as in the north and west. The simultaneous holding of legislative assembly elections in Andhra Pradesh alongside the national election will undoubtedly influence dynamics. In Karnataka, where the Indian National Congress party secured victory last year, its performance in delivering on its promises will likely shape its electoral fortunes this time around.
What are the chances of the united opposition coalition winning?
The opposition has a chance, although it appears to be a slim one, for several reasons.
The first is that the election is neither free nor fair due to the fact that many opposition leaders are currently in jail, even though they haven’t been convicted. They have been arrested just so that they cannot campaign. Opposition bank accounts have been frozen by Modi for the same reason.
There is also the fact that the BJP is also the wealthiest party by far and has a highly efficient and experienced ground campaigns team.
However, I would say that Modi’s performance over the last decade is a major concern for many voters and will likely impact negatively on his support among those still undecided.
Coalitions have always been good in our part of the world because they impose a sense of moderation and prevent bouts of insanity. Ranged against the might of the BJP, the largest political party in the world, there is no option for non-BJP and non-communal parties but to ally.

INDIA: ‘Civil society efforts will be crucial to the quality of the elections’
CIVICUS speaks with Anjali Bhardwaj, founding member of the Society for Citizen Vigilance Initiatives (Satark Nagrik Sangathan, SNS), about recent electoral reforms and civil society efforts to ensure the quality of India’s upcoming election.
Established in 2003, SNS is a civil society organisation (CSO) working to promote government transparency and accountability and foster active citizen participation.
What recent changes have been made to rules on campaign financing?
On 15 February, the Supreme Court ruled the electoral bond system currently used to finance election campaigns unconstitutional. This is a positive change, with a potential to bring transparency to campaign financing.
Introduced in 2018, the electoral bond scheme allowed people and organisations to buy designated bank bonds ranging from 1,000 to 10 million rupees (approx. US$12 to US$120,000) to donate to political campaigns in a completely anonymous way. When it introduced this system, the ruling Bhartiya Janata Party (BJP) presented it as a measure to combat corruption and increase transparency in political financing.
Before the bond system was introduced, political parties could receive funds in cash or through the banking system, but large corporate donations were often made in cash. All cash donations below 20,000 rupees (approx. US$240) were anonymous under the Income Tax Act. So to hoodwink the system, parties often reported large cash donations as multiple donations of amounts smaller than 20,000 rupees.
The electoral bond scheme was presented as a measure to increase transparency but the anonymity it ensured had the opposite effects. The opacity it enabled allowed single donors to provide unlimited funding. It hasn’t allowed people, CSOs, opposition political parties or even the Election Commission of India to track the flow of money in politics. It has compromised the public’s right to information, as voters are unable to discern the extent or sources of funding political parties receive. This limited people’s democratic right to make informed voting decisions.
What was the reasoning behind the Supreme Court’s decision?
The Supreme Court first addressed this issue as early as 2019, acknowledging the bond system’s potential harm to democracy but allowing it to continue while it analysed the substance of the case. But even back then, it emphasised the deepened information imbalance created by a system that allowed the ruling party to access information about donors and donations through the government-controlled bank while leaving opposition parties and the public in the dark.
In its recent ruling, the Supreme Court stressed that electoral bonds infringe article 19 of the constitution because without the right to information in electoral matters, the rights to free speech and expression guaranteed by article 19 cannot be fully realised.
Voters in India predominantly support parties, rather than individual candidates. When large corporations contribute generous funds to political parties, there is the presumption that they do so in the expectation of receiving favours in return once parties become part of governments. When favours are returned, policy is guided not by promises made to voters or by people’s needs but by the interests of funders. This is why funding transparency is crucial for informed voting. Without this information, voters cannot know what to expect when parties access government.
Electoral bonds exacerbated corruption through anonymous funding that gave free rein to large corporations to influence policy. They also made the playing field even more uneven, as the BJP consistently received a substantial share of electoral bonds.
The Supreme Court judgment declared the scheme and associated amendments unconstitutional, emphasising the importance of the right to information. The court prohibited further transactions and mandated disclosure of past transactions, marking a significant move towards restoring transparency and fairness in India’s electoral process.
How has civic space evolved under Prime Minister Narendra Modi?
Regrettably, since the beginning of the Modi government in 2014 we have seen a significant contraction of civic space, due to systematic attacks on the crucial right to dissent, a cornerstone of any democracy.
The essence of democracy lies in people’s right to question those in power. But in India, this right has been under attack in three primary ways.
First, those who express dissent, criticise government policies or challenge legislation are labelled as anti-national. The governments files legal cases against them, leveraging draconian laws, terror-related legislation and money laundering statutes to silence them.
Second, the government has deliberately weakened the laws that empower citizens. The Indian Right to Information Act, lauded as one of the world’s most progressive, has been amended twice in the last five years. Regressive amendments have severely affected people’s right to access information and question the authorities. Similarly regressive amendments to other laws, such as the Representation of People Act and the Income Tax Act, along with the electoral bonds, have further curtailed people’s right to access vital information to hold the authorities to account.
The government has also undermined the independence of institutions responsible for upholding fundamental rights, including the right to free expression and protest. This has eroded the constitutional protection people should enjoy when expressing dissent. Protesting and questioning the government have therefore become increasingly difficult.
The cumulative effect of these developments has dealt a severe blow to civic space in India.
Are there enough guarantees for a free and fair election?
India has needed electoral reform long before the current administration. For decades civil society has advocated for changes to strengthen the electoral process. While India takes pride in conducting relatively free and fair elections, concerns over the quality of elections have increased over time.
Civil society has repeatedly expressed alarm over issues including the influence of money over elections, the security and reliability of electronic voting machines and manipulation of the voter roll.
Regarding the undue influence of money over elections and consequently over policymaking, electoral bonds have long been a matter of major concern. Civil society has also expressed apprehension about glitches in and tampering with electronic voting systems, prompting debate and ongoing legal challenges in the Supreme Court. Alarms were also sounded by recent elections that saw arbitrary deletions and additions to voter lists.
Civil society continues to bring attention to these issues, urging authorities to find solutions. The resolution of these challenges is essential for India to genuinely claim it conducts free and fair elections.
Who are the major contenders in the 2024 election, and what are the main issues the winner will need to tackle?
India has numerous political parties that actively participate in elections. The BJP and its allies have successfully formed a government twice and are currently strong contenders to secure a third term in office. The opposition landscape includes the Indian National Congress, historically prevalent prior to the BJP’s rise. But there are many other national and regional parties that contribute to the diversity of the political spectrum.
As a developing country, India, faces multifaceted challenges. Among the most significant are deep-seated socio-economic inequality and high incidence of poverty, with a small number of families holding a substantial portion of the country’s wealth and a substantial percentage of the population living below the poverty line. There is much need for policies to uplift those on the margins of society and reforms to the structures that perpetuate inequality.
Equally crucial is the protection of civic freedoms, particularly for those who criticise the government, including through peaceful protests. Those who express dissent and demand accountability must be protected rather than criminalised.
The next government should prioritise these issues, addressing inequalities and working to create an environment where citizens can freely express themselves and participate fully in the democratic process.

PANAMA: ‘We’ll have to stay vigilant and resist any attempt to curtail rights and freedoms’
CIVICUS discusses the results of Panama’srecent presidential election with Olga de Obaldía, executive director of the Foundation for the Development of Civic Freedom.
The Foundation for the Development of Civic Freedom is a civil society organisation working to defend fundamental freedoms, empower citizens for democratic participation and strengthen democracy by promoting transparency and the struggle against corruption.
Who is José Raúl Mulino, and why did he win the election?
Mulino won the election in large part due to the popularity and charisma of former President Ricardo Martinelli, and also in part due to the peculiarities of the Panamanian electoral system.
Martinelli campaigned despite being disqualified from running for or holding public office after being convicted of money laundering in a major corruption scheme involving overpriced road construction. He initially tried to register his wife as his running mate, presumably in order to give her his place if his legal troubles made it impossible for him to run. But he abandoned the plan because the constitution forbids the president appointing close relatives.
Instead of his wife, he appointed Mulino, his security minister between 2009 and 2014. Martinelli’s conviction became final in February: he was sentenced to more than 10 years in prison and, in order to avoid prison, he sought asylum in the Nicaraguan embassy. The Electoral Court allowed Mulino to take Martinelli’s place. This decision was appealed on the grounds of unconstitutionality, but two days before the election the Supreme Court upheld the Electoral Court’s decision.
Convicted or not, Martinelli maintained his enormous popularity and, from his embassy confinement, launched a media campaign based on the slogan ‘Mulino is me’, an attempt to transfer his core electoral support, estimated at between 30 and 35 per cent, to Mulino.
Since Panama elects its president by a simple majority of votes, without a runoff, and there were eight candidates, Mulino won with 34 per cent of the vote.
This electoral system should be revised to ensure the popular will is respected. However, it’s worth noting that Panamanians were civic-minded and accepted the result peacefully even though most had voted against the president-elect.
What were Mulino’s campaign promises?
Among other things, Mulino promised to ‘put money in people’s pockets’ and build infrastructure, notably a train linking the city of David, in the far east of the country, with Panama City. This was justified on the grounds that it would improve transport between the interior and capital and stimulate economic development in remote and neglected regions.
Another recurring theme in Mulino’s campaign was the need to put an end to what was characterised as ‘judicial persecution’. Martinelli’s party contains many people indicted for corruption during his administration. Several of them have been elected to the Central American Parliament, which grants them immunity from prosecution under a treaty that equates their privileges with those of national deputies.
During the election campaign, the possibility of ‘closing’ the Darién Gap, the border with Colombia, was also mentioned as a way of stemming the flow of migrants through the jungle. However, the feasibility and impact of this measure are unclear. Previous bans aimed at stopping migration have only encouraged clandestine approaches and exacerbated humanitarian problems. The situation in the Darién is complex and need far-reaching solutions.
These promises were clearly popular with some parts of the public, but their feasibility and potential consequences should be carefully considered.
Finally, another promise was to ‘help’ former President Martinelli. It is not yet clear what form this help will take. The president-elect has said his government will follow the rule of law, and his first major test will be to resolve the ex-president’s impasse in the Nicaraguan embassy, from where he continues to try to influence national politics.
What should the new government do to address the country’s key social and economic challenges?
The new government will have to make critical decisions in a context of deep economic crisis. One of them is to save the social security system.
Panama is one of the most unequal countries in the world. Informal labour has reached 55 per cent, with 20,000 jobs not recovered since the pandemic. The social security system is on the verge of bankruptcy: it covers 80 per cent of people, but only 30 per cent pay contributions. The pension system now lacks the funds to meet its future obligations and could collapse.
Economic problems are compounded by falling investment. Public debt has risen to US$49 billion, with no clear investment in infrastructure or job creation. The state is due to make its first major debt payment in three months, but does not appear to have sufficient funds to meet it.
The president-elect has announced he will seek to form a government of national unity. It is unclear what form this will take, but it’s clear that given the scale of the problems, a coalition government or some form of cross-sectoral cooperation is the only way forward. According to the president-elect’s statements, business would be his natural ally in finding solutions.
Under what conditions does civil society operate in Panama, and can changes be expected under the new government?
As elections approached, our small civil society faced a recurring phenomenon: an exodus towards partisan political activity. While some civil society organisations like ours are professionalised – with a board, administrative staff, a budget and defined structures – most rely on volunteers. Traditionally, a reverse exodus from non-winning political parties towards civil society organisations happens after elections.
In addition, few organisations focus their work on advocacy for civil and political rights and freedoms and democratic governance. Most focus on poverty alleviation or the provision of social services such as health and education. In these roles, they tend to be partners with the state in the implementation of official programmes. In recent years, however, we have witnessed an increase in activism and the formation of new identity-based groups demanding equal rights, while new youth groups have arisen at the national level as a political and social force largely responsible for the success of national mobilisations against open-pit mining in October and November 2023.
In the 2024 electoral campaign, while civil society participation remained limited, since there are few organisations dedicated to promoting civic values or fundamental freedoms, we saw several non-partisan initiatives to enable informed voting, and several organisations, including us, joined together in this effort.
We don’t know what will happen under the new government, but we are concerned about the Martinelli administration’s record of restricting civic space through intimidation of critical organisations and the judicial harassment of activists and journalists. It is unclear what trajectory the Mulino government will follow, but we’ll have to stay vigilant and resist any attempt to curtail fundamental rights and freedoms or restrict civic space.

PARAGUAY: ‘Very tough years are ahead for civil society that promotes human rights’
CIVICUS discusses Paraguay’s recent general election with Marta Ferrara, executive director of Seeds for Democracy (Semillas para la Democracia).
Founded in 2006, Seeds for Democracy is a civil society organisation (CSO) whose main objective is to contribute to the improvement of the quality of democracy in Paraguay by promoting citizen participation, social equity and accountable governance.
What are Paraguay’s main challenges, and to what extent could the results of the recent election contribute to solving them?
Paraguay’s main problems are fundamentally economic, stemming from deep inequality. In recent years, Paraguay has had very good macroeconomic indicators, with high growth, but has remained very unequal, with high unemployment, large numbers of people in informal work and lack of access to health, education and opportunities. It is a country run by immensely wealthy cattle-ranching and agro-exporting elites who rule for their own benefit and to the detriment of a terribly unequal society. I believe this is the central characteristic of Paraguayan society and economy. It is a deep, structural problem, and this election has done nothing to solve it. The same people as always have won: the same sectors that have kept the country in this situation for more than 70 years.
At stake in this election was the possibility of alternation in power. However, that would not necessarily have meant radical change, because the presidential candidate of Concertación, the opposition coalition, was also a conservative, albeit from the Liberal Party. His running mate was a woman, but he still represented a conservative sector of society. These were not disruptive candidacies representing a real change in the way politics is conducted, in the way power is exercised, in terms of public policies or representing different social sectors.
How do you explain the comfortable win for the Colorado Party, despite the incumbent president’s very low approval rating?
The results can be explained to a large extent by the effects, which we already anticipated, of the system of unblocked lists with preferential voting in the context of a divided opposition.
A couple of years ago there was an electoral reform that replaced the closed and blocked party lists with unblocked lists with preferential voting. In these, the voter can select a candidate within the list of their choice, in order to vote for both a party and a candidate; then, according to the number of votes obtained by each candidate and their list, seats are distributed by the D’Hont system.
This system was introduced in the last municipal elections and we already knew that it would have some negative effects. A big problem with unblocked lists is that generally the candidate with the most money is the one who gets ahead. They also cause strong competition of all against all within parties.
In addition, the old system was replaced by electronic ballot boxes without sufficient training, meaning that people were not well prepared to use the new system. This allowed the spread of so-called ‘assisted voting’, which is illegal, and which basically consists of having people at polling stations interfering with voting with the excuse of helping voters use the electronic system.
All this benefited the Colorado Party, which has been at the helm of the state for a long time and is therefore the one with the most resources, and which has sufficient internal diversity to be able to provide replacement options for those who are dissatisfied with their government they lead.
There were, however, some small improvements in women’s representation. For the first time two women have been elected governors and there are more women than before in both houses of Congress.
But with the opposition divided, the Colorado Party won by the widest margin in Paraguay’s democratic history. In addition to winning the presidency, it won control of both houses of Congress and 15 of 17 governorships.
The other defining feature of this election was the emergence of a third opposition political grouping with a populist-authoritarian and messianic style. Led by Paraguayo Cubas, it represents so-called ‘angry voters’, those dissatisfied with traditional parties and the way politics has been conducted for decades. This candidacy did not take votes away from the government but from the opposition, and unexpectedly came in a close third place, with more than 20 per cent.
What is the basis for the allegations of fraud voiced by protesters?
The followers of Paraguayo Cubas, joined by people from practically all sectors of the opposition, many of them young people disaffected with politics, have taken to the streets en masse across the country to denounce fraud, despite the fact that their candidate got a very good vote, which they did not expect. The fact that an anti-establishment group is mobilising protests on a scale not seen in a long time represents a major challenge for the future of democracy in Paraguay.
This was a relatively peaceful election in which there was virtually no violence. What there was plenty of was disinformation, hate speech and social media attacks throughout the campaign. These aggressions strongly affected CSOs, including our own, Seeds for Democracy, and came mostly from the ruling party and the party and supporters of Paraguayo Cubas, although Concertación also launched similar attacks against its political opponents.
What role did civil society play during the election?
Civil society played a relatively important role, despite the restrictions it has faced. The Electoral Court initially did not authorise civil society election observation and instead issued a rather restrictive regulation. It finally accepted that the Sakã Consortium, a civil society coalition, would carry out observation and a parallel count, but with very many restrictions.
Seeds for Democracy has been actively involved in denouncing the problems of political financing, an issue we have succeeded in placing on the agenda. The other major problem in Paraguay, along with enormous inequality, is corruption. Lack of control over money in politics has brought groups linked to organised crime to power, both in Congress and in governors’ offices.
We will soon be working on political finance control. In Paraguay, campaign spending is controlled after elections. A month later, when the parties submit their statements, we begin to monitor them through the Electoral Court’s Citizen Observatory of Political Financing, cross-checking data on public contracts with the sworn statements published on public agencies’ websites. Paraguay’s freedom of information legislation is quite good and enables us to do this work.
How do you see the future of democracy in Paraguay?
In the medium to long term I see a very difficult situation. There are many things to be resolved in order to improve the quality of democracy. The emerging political group is violent, anti-rights, fundamentalist and messianic. Its inspiration is the popular authoritarian president of El Salvador, Nayib Bukele, and his way of ruling, so I think we are in for some very tough years ahead.
The section of the Colorado Party that won the election is one whose leaders attack civil society. They are anti-rights: they define themselves as ‘pro-life’, they are against equal marriage and sexual and reproductive rights and they attack all issues related to gender rights. That’s why I think civil society is in for a very tough few years. The various segments of civil society, especially those working on rights issues, are going to have to make big efforts to join together and undertake collective action.
At the moment, some organisations have some funding from international cooperation sources, and we hope that this support will increase and strengthen so that we can work together to face all these challenges. It will be a constant struggle, all the more difficult because we have already seen attacks against freedom of expression and press freedom.
I do not expect much in the coming months. For the time being, we must stay vigilant to understand which way things are going. But what is certain is that very tough years are ahead for CSOs that promote human rights.

PORTUGAL: ‘The rise of the populist right only further weakens trust in the political system’
CIVICUS speaks about early elections taking place in Portugal on 10 March with Ana Carmo from Akto, a Portuguese civil society organisation that promotes human rights and democratic values through advocacy, campaigning and education.
What are the main issues the new government will have to deal with, and how are candidates proposing to address them?
The most pressing issues that should be addressed by the new government and have been central to election debates are housing, health, pensions, education, immigration and the climate crisis. There are several other issues that are also on the agenda and should be addressed, including some related to the police and the justice system.
These are issues that allow for very different answers depending on where you are on the ideological spectrum. The more left-wing parties propose measures that require greater state intervention and public investment, while those towards the right present proposals that benefit the private sector and investors, and require less state intervention, arguing this will lead to economic growth and subsequently greater wellbeing.
Portuguese politics tend to revolve around two parties, the Socialist Party (PS) and the Social Democratic Party (PSD), both close to the centre. In this campaign, Pedro Nuno Santos, head of the PS ticket, has put forward proposals that are further to the left than usual for the PS, while Luís Montenegro, who leads the ticket of the Democratic Alliance (AD), a coalition led by the PSD, has followed his party’s usual ideological line.
What’s more, the PS is wearing out, perhaps due to its eight consecutive years in power, while the PSD, instead of preparing to succeed it, is also getting weaker. Instead, more radical right-wing parties are growing, notably Chega, identified as a ‘catch-all’ party, ideologically amorphous, populist and opportunistic, which adapts its discourse to whatever allows it to win the most votes.
A climate of discontent, frustration and perhaps revolt has led more and more people to vote for Chega as a form of protest. However, the growth of a party like Chega only further weakens trust in the political system.
Have disinformation or hate speech been a problem during the campaign?
There have been problems with disinformation, particularly spread by Chega, whose discourse is not based on facts. That’s why we often hear false statements or fallacious ideas coming from its leader and members of parliament. Chega has been running an anti-immigration campaign that appears to have instigated hate speech and expressions of xenophobia within society. On 3 February, a far-right march against the ‘Islamisation of Europe‘ took place in Lisbon’s Martim Moniz neighbourhood, an area known for its multicultural diversity. The march was banned by Lisbon City Council and the courts for its content and the danger it posed to citizens. Nevertheless, people still took to the streets.
Some media and the other political parties are making an effort to challenge fallacies about immigration, emphasising that the truth is that Portugal is a country of emigrants. They also highlight positive facts about immigrants, such as their great contribution to Portuguese social security, which allows pensions to be paid. It is a very strong argument in favour of immigration.
During its campaign, Chega also made the absurd and impactful proposal to ‘end support for gender equality’. This statement once again needed a deconstruction and fact-checking effort by the media and forced the other political parties to take a stand.
With the increasing spread of ‘fake news’, Portuguese media have set up fact-checking programmes to help counter the trend and maintain journalistic rigour. However, disinformation campaigns are more difficult to combat on social media, where Chega has succeeded in meddling. Because of this, polls point to a significant percentage of young people potentially voting for this populist party that jeopardises our fundamental rights.
To encourage debate about ideas, Portuguese media joined forces to organise political debates between the leaders of all parties represented in parliament, as they did in 2015. In the version implemented this year, candidates debate each other for around 25 minutes and these debates are broadcast and commented on in various news channels. This allows civil society to be better informed about their choices and people have shown interest, because debates have received top ratings.
What do you think the result of the elections could be?
Since the resignation of Prime Minister António Costa in November 2023 due to a corruption investigation that implicated him in influence peddling, corruption and malfeasance in energy projects, the political landscape has become increasingly unpredictable.
First, as he was elected PS leader, Nuno Santos was viewed as Costa’s unequivocal successor as prime minister, due to his charisma as well as the fact that his party had an absolute majority. Montenegro, in comparison, is not a charismatic leader and has had a career of setbacks. The PSD has been losing strength to more radical and populist parties such as Chega and Liberal Initiative, which is not seen so much as a populist party and still has space on the spectrum of the political right. The PSD doesn’t want to ally itself with Chega, and Liberal Initiative rejected a coalition with the PSD, causing it to ally with the CDS-Popular Party and the Monarchist Party.
By entering a coalition with two parties without parliamentary seats, the PSD resurrected a 1979 solution in an attempt to confront the PS’s absolute majority. But even so, it didn’t initially gain the ground it wanted.
The left has also lost relevance: the Left Bloc currently has five parliamentary seats, the Portuguese Communist Party has six and Livre has one.
In the presence of a left that some commentators describe as ‘asleep’, a one-party centre bloc and a right without an assertive leader, Chega is the only party flourishing.
In late 2023, opinion polls pointed to a new PS majority, but since the formation of the AD coalition, some polls suggest a potential AD victory. At the moment, there is great uncertainty and the large number of undecided voters will potentially decide the country’s direction. Every time there is a new electoral debate, new trends emerge. In the last debates he took part in, Nuno Santos called for a ‘useful vote’ in fear of a victory for AD and the right.
What are your expectations for the post-election period?
Depending on which party wins, the majority it gets, the coalitions that are formed and the number of seats that the opposing parties manage to obtain, there are various possible scenarios.
These legislative elections could lead to Portugal joining the trend we’ve been seeing across Europe with far-right and populist parties entering government, or they could lead to Portugal standing out with a more socialist and left-wing government. And even these two scenarios are reductive, because the outcome will also depend on the composition of the parliamentary opposition, which is so important for the proper functioning of our democracy.

PORTUGAL: ‘These elections have reminded us that democracies are fragile and imperfect’
CIVICUS speaks about the results of Portugal’s 10 Marchelectionwith Ana Carmo ofAkto, a Portuguese civil society organisation that promotes human rightsand democratic values through advocacy,campaigning and education.
What were the key election campaign themes and the main parties’ proposals?
Parties’ campaigns for the 10 March election focused on issues such as housing, health, economic growth, education, social protection – particularly pensions – and the fight against corruption. During debates, other issues were also addressed, such as negotiations with the police – who held some protests and covertly threatened to boycott the election, the formation of coalitions, an issue that arose based on polling data, and the country’s governability.
This election campaign was very atypical and perhaps because of this, equal attention was given to all parties with parliamentary representation, something unusual in Portugal, where competition has been mostly bipartisan, between the Socialist Party (PS) and the Social Democratic Party (PSD). Discussion of political coalitions forced us to think about politics in ideological terms, with major contenders placed on the left, right and far right.
The contest for the prime minister position was between Pedro Nuno Santos of the PS and Luís Montenegro of the PSD as part of the Democratic Alliance (AD) coalition. Nuno Santos’ main proposals placed him as the continuation of the incumbent government with a focus on strengthening public investment on all of the campaign’s focus areas. His strategies to deal with the key issues included negotiation, strengthening institutions and greater public investment in public policy. Luís Montenegro, in comparison, centred his campaign on strengthening and stimulating the private sector, establishing public-private partnerships and reducing personal income tax and corporate income tax rates to encourage investment.
It’s important to note that the campaign saw little discussion of proposals or in-depth analysis of political programmes. The pitch-style debates didn’t take us beyond the headlines, creating some confusion as it was hard to tell the political programmes of the different parties apart. Following the debates, the over-abundance of commentary on all TV channels, each with its own bias, also contributed to the confusion of ideas. Even so, and contrary to what was expected due to the presence of a populist party, the debates and the other parties’ campaigns managed to maintain a good level of cordiality and political seriousness.
What led to the AD and PS winning almost the same number of seats?
The wear and tear of the PS government became very apparent during the campaign. Despite Nuno Santos’ great effort to disassociate from former Prime Minister António Costa and present himself as the party’s new face, many people were unhappy and didn’t trust the PS.
According to polls, the number of undecided voters increased as election day approached. The media’s excessive and sensationalised coverage may have contributed to this. With so many people undecided, confused and saturated, an expression of a desire for change was to be expected.
However, it’s important to remember thattwo years ago the PS won an absolute majority in an election that came about because the Left Bloc rejected the state budget. But it subsequently failed to satisfy people’s major needs, and for the second time its government fell, leading to elections. Nuno Santos’ political ability and perceptions of him, the other parties’ campaigns, leaning mainly towards the right, the influence of mainstream and social media and the European and international context all contributed to a paradigm shift. The fact that, as a result, the PS went from 120 parliamentary seats to around 76 has far-reaching implications.
What are the consequences of this tie?
As a result of the technical tie between the AD and PS, the climate of uncertainty that dominated the campaign continues. If parties are faithful and uncompromising with their positions and their word, it’s very likely that there will be another election in November because the state budget won’t get approved. If this happens, another highly likely scenario is that the far-right Chega party will continue to gain ground and further strengthen its position in parliament.
So this is a critical moment and a window of opportunity for Portuguese democracy to prove its strength – or weakness. Will political parties be able to engage in dialogue for the sake of political stability? What will their approach be to dealing with a populist party that has become a solid third political force? Will the centre bloc be maintained?
If these elections have reminded us of anything, it is that democracies are fragile and imperfect. We’ll see what capacity we have to adapt to democracy’s new contours.
How worrying do you find Chega’s performance?
Chega’s performance has been similar to that of its counterparts in other countries: Donald Trump’s Republican Party, Jair Bolsonaro’s Liberal Party, Viktor Orbán’s Fidesz, Marine Le Pen’s National Rally and Matteo Salvini’s Northern League. Its growth is not surprising – it’s even predictable. This is a party that feeds on fear, disinformation and revolt, and follows thegrowth of similar parties across Europe. Its tactics are no different from those used by other far-right parties.
Chega attracts historical revanchists, xenophobes and racists, the angry and the disaffected. The Algarve region, a district won by Chega, is an example of a region that resents the way it’s been treated by successive governments. This is a region that’s very much affected by seasonal changes and experiences constant failures in dam management, leading to water shortages. Its feeling of being abandoned may explain the election result.
The growth of a populist party is always worrying, as history can attest. It’s all the more concerning given that Portuguese democracy is still young. Just as we celebrate the 50th anniversary of the 25 April Carnation Revolution when our democracy was born, we are faced with narratives and behaviours that go against the principles of our democracy and our rights and freedoms. The growth of a far-right party is particularly concerning when it comes to the most excluded people: women, the lower and lower-middle classes and young people. That’s why the majority of its voters are male.
How did civil society engage with the elections and how has it reacted to the results?
Despite the high percentage of undecided voters, abstention appeared to decrease. Abstention has always been a concern, hovering around 40 per cent, but historic figures are not accurate due to the unusual number of non-habitual residents and newly registered voters. In these parliamentary elections, abstention was around 34 per cent, but turnout wasn’t up significantly from previous years.
Until the new government takes office, it’s difficult to gauge civil society’s reaction to the election results. There is indeed great concern about the growth of the far right, but if these were protest votes, to what extent can we deduce that voters are satisfied with the result? There is a desire for change, but we don’t know if the desired change will materialise.
When will a new government be formed, and what role might Chega play in it?
It’s not certain there will be a coalition government. Montenegro repeated several times during and after the campaign that he will not enter into a coalition with Chega, and for the PS it doesn’t pay to form a coalition with left-wing parties, as the number of right-wing MPs remains higher or the same. Chega has said on a number of occasions that it would never enter into a coalition, but we are talking about a party that says everything and its opposite, and after the elections it has been pushing for a coalition with AD and says it’s willing to govern together.
Chega’s role will depend more on how the other parties deal with its existence than on its own actions. The other parties have created a firewall around Chega, which has ended up strengthening its presence, and they have shown there’s no desire for this party to be part of a political solution. The PS is focused on being the leader of the opposition. Whether it succeeds in doing so and how effectively will determine the Portuguese political scene.
Would a government that includes the far right pose a real danger to fundamental rights and freedoms?
It depends on how it is included and with what intentions. If AD coalesced with Chega and adopted its ideological line, there would be a real risk.
It’s not desirable for there to be a reactionary force with racist, xenophobic, sexist and revanchist discourse in parliament, but there are ways to mitigate this. Portugal lived through 41 years of dictatorship and has been a democracy for 50 years. It is because of the nature of our past dictatorship experience that our constitution forbids fascist parties and recalls the overthrow of the fascist regime in its preamble.
Portuguese political history shows that there has been more progress in guaranteeing fundamental rights and freedoms with left-wing socialist governments in power than with right-wing social democratic governments.
When we consider the speeches and proposals of the far right, fundamental rights and freedoms are called into question. However, as a democratic country, there is room for a party like this to exist, just as there are many other parties in opposition that are fiercely in favour of extending these fundamental rights and freedoms. It is up to democracy to demonstrate that it defends these rights and freedoms.
