• Afganistán: Solicitud para instar a los talibanes a que respeten los derechos humanos y faciliten el proceso de los afganos que huyen a Australia

  Las abajo firmantes, organizaciones de la sociedad civil de diferentes regiones del mundo, nos dirigimos a usted en relación con la actual crisis en Afganistán que se produjo a raíz de la caída del gobierno del presidente Ashraf Ghani. Le escribimos debido a la urgencia que requiere la comunidad internacional en apoyo a las personas defensoras de los derechos humanos, a los representantes de la sociedad civil y a los periodistas que están tratando de huir de Afganistán para escapar de las acciones potencialmente violentas de los talibanes. Existe una enorme preocupación de que los logros en derechos humanos alcanzados en los últimos 20 años en Afganistán se vean rápidamente erosionados en las próximas semanas. 

  Como usted ya sabe, las personas defensoras de los derechos humanos, especialmente las que defienden los derechos de las mujeres, de los periodistas y de aquellos asociados con grupos de la sociedad civil han sido objeto de ataques violentos, amenazas e intimidación por parte de los talibanes. En los últimos años, CIVICUS y otras organizaciones de derechos humanos han documentado estos ataques, así como también el estado de total impunidad del que gozan los autores. El Comité de Defensores de Derechos Humanos de Afganistán recientemente ha  informado que solamente entre septiembre de 2020 y mayo de 2021, 17 defensores de los derechos humanos fueron asesinados.

  Más de 200 personas defensoras de derechos humanos y representantes de los medios de comunicación informaron que habían recibido graves amenazas. En vista de las actuales condiciones de conflicto e inestabilidad política estas amenazas se han acrecentado. 

  Los talibanes tienen un historial de violación de los derechos humanos y de atacar a los civiles con impunidad. Las mujeres y los niños han soportado la peor parte de estos ataques y a muchos se les ha impedido trabajar y se les ha dificultado el acceso a la educación y a la asistencia sanitaria. La  declaración del Sr. António Guterres, secretario general de Naciones Unidas, del 16 de agosto de 2021 instando a la comunidad internacional a hablar al unísono para defender los derechos humanos en Afganistán es un paso en la dirección correcta. También tomamos nota de las preocupación expresada por el Alto Comisionado para los Derechos Humanos sobre los primeros indicios de que los talibanes están imponiendo severas restricciones a los derechos humanos en las zonas que están bajo su control, las cuales están especialmente dirigidas a las mujeres.

  Tal como se esperaba, muchos defensores de los derechos humanos están intentando abandonar el país. Hemos recibido informes de que a algunos se les impide subir a los aviones, ya que las misiones extranjeras han dado prioridad a la evacuación de sus propios ciudadanos y personal. Otros han tenido que ocultarse y temen por sus vidas; otros están esperando que les suceda lo inevitable. Las mujeres que han hecho campaña durante años por la igualdad de derechos y la participación equitativa en espacios públicos incluyendo el proceso de paz han sufrido represalias. 

  Tomamos nota de los informes que indican que por lo menos 3000 refugiados afganos podrán trasladarse a Australia en los próximos diez meses y que a los afganos titulares de visas que se encuentran actualmente en Australia no se les requerirá que regresen a Afganistán mientras exista riesgo para su seguridad. Sin embargo, es necesario hacer mucho más. La comunidad internacional tiene la responsabilidad de proteger los derechos de los afganos, en virtud del derecho internacional de los derechos humanos y del derecho humanitario, y una manera de hacerlo es proporcionarles salvoconductos a aquellos que corren peligro si permanecen en Afganistán.

  Honorable Primer Ministro, instamos a su gobierno a mantener conversaciones urgentes con los ministerios australianos pertinentes para desarrollar un Plan de Acción Nacional para guiar la respuesta de Australia a la crisis afgana. 

  Le pedimos que dé prioridad a las siguientes acciones en el plan de acción; 

  • Pedir públicamente a los talibanes que respeten los derechos humanos, incluidos los derechos de las niñas y las mujeres y las libertades fundamentales, conforme al derecho y las normas internacionales de derechos humanos.
  • Dar prioridad a la concesión de salvoconductos y documentos de viaje a los afganos que corren un mayor riesgo de ser perseguidos por los talibanes a causa de su trabajo anterior o de su situación en el pasado, así como a sus familiares directos.
  • Instar a las embajadas y misiones australianas de todo el mundo a que reduzcan los requisitos de viaje para las personas defensoras de los derechos humanos y las representantes de la sociedad civil de Afganistán que deseen viajar a Australia.
  • Crear en Australia un entorno favorable para que todos los afganos que huyen de su país se recuperen de las presiones psicosociales que soportaron en Afganistán y de la ansiedad que puedan experimentar al establecerse en un nuevo país. 
  • Prometer un nuevo apoyo a los grupos de la sociedad civil, dentro y fuera de Afganistán, que ayuden al reasentamiento de los refugiados y que por otra parte promuevan las necesidades humanitarias y de derechos humanos.
  • Apoyar la creación de un mecanismo para la investigación y rendición de cuentas que sea independiente y con perspectiva de género en la Sesión Especial del Consejo de Derechos Humanos de las Naciones Unidas sobre Afganistán que está prevista para el 24 de agosto de 2021.
