  • LEBANON: ‘Abuses against women are the direct product of the gender imbalances of a patriarchal society’

    Ghida AnaniCIVICUS speaks about the impacts of the COVID-19 pandemic on Iraqi women and girls and civil society’s role in combatting gender inequalities in Lebanon with Ghida Anani, founder and director of ABAAD – Resource Centre for Gender Equality.

    ABAAD is a women-led civil society organisation (CSO) that strives for gender equality as a key condition for sustainable social and economic development in the Middle East and North Africa. Its work is organised around three pillars: providing direct services, building capacity and developing resources, and advocating for policy reform.

    How has COVID-19 impacted on women and girls in Lebanon?

    Even before the pandemic, women and girls in Lebanon suffered from a vicious cycle of gender-based violence (GBV) and discrimination that deprived them of the opportunity to participate meaningfully in social, economic and political life.

    Most of the abuses and discriminatory acts experienced by women and girls in Lebanon are the direct product of imbalances between women and men in the patriarchal Lebanese society, which are codified into law. Domestic violence is a longstanding problem due to deeply engrained gender social norms that permeate the entire societal system, policies and legislation. So far the government has failed to recognise and therefore address the problem and has not allocated dedicated resources to tackle GBV.

    COVID-19 lockdowns and the ensuing economic downturn did nothing but exacerbate already existing GBV risks both at home and in public spaces. Self-isolation, misuse of power, heightened tensions, financial uncertainties and the disruption of life-saving services were key factors that worsened the situation.

    During the pandemic, ABAAD noticed an increase in the severity of the violence women were subjected to at home. Some women reached out to tell us they were struggling with mental health issues and suicidal thoughts. At least two women said they had received death threats from family members after showing flu-like symptoms consistent with COVID-19 infection.

    How has civil society in general, and ABAAD in particular, responded to this situation?

    Since the initial stages of the outbreak, we put together a response to ensure the continuity of life-saving services. We prioritised the best interests of rights-holders by putting them at the centre of the response.

    We had to suspend some in-person activities, such as outreach, community events and awareness and training sessions. But on the positive side, our focus on maintaining life-saving services helped us develop new internal case management guidelines for crisis counselling and emergency support services by phone, along with face-to-face services for high-risk cases.

    We also provided community-based awareness sessions on COVID-19 and psychosocial support sessions via conference calls and WhatsApp groups. Our helpline continued to function 24/7, including for services provided by ABAAD’s Emergency Temporary Safe Shelters across the country and its Men Centre. Moreover, as the three safe shelters operated by ABAAD were at full capacity, we worked to create additional capacity by renting new spaces. 

    We led several campaigns, such as #LockdownNotLockup and #TheRealTest, to fight the stigma surrounding COVID-19, show solidarity with women and let them know that they were not alone. We also worked closely with relevant ministries, United Nations (UN) agencies and CSOs to advocate for enhanced-quality coordinated response at a national level. In partnership with the Lebanese Ministry of Social Affairs, we recently launched a series of workshops about national mechanisms to report GBV and special units dedicated to supporting survivors.

    On International Women’s Day, we held digital activism activities and sessions for women and girls through ABAAD’s Women and Girls Safe Spaces. There are 23 such centres across Lebanon, providing a safe, non-stigmatising environment for women and girl survivors of GBV and their children to receive comprehensive and holistic care services.

    How is civil society working to bring women’s rights concerns into the policy agenda?

    Civil society is working hard to bring gender equality to the top of the policy agenda. As Lebanon approaches its first parliamentary election following the popular uprising of late 2019, Lebanon’s Feminist Civil Society Platform, a group of 52 feminist CSOs and activists first convened by UN Women in the aftermath of the 2020 Beirut explosion, has launched a series of demands for candidates running for parliament to commit to achieving gender equality goals.

    Our statement to future members of parliament details the laws that need to be reconsidered from a gendered perspective, including various laws to criminalise sexual violence in the Lebanese Penal Code. This is a demand that CSOs have long advocated for.

  • LEBANON: ‘Civil society has taken the lead in advocating for social change, human rights and political reforms’

    CIVICUS speaks about deteriorating civic space conditions amid political and security instability in Lebanon with Fadel Fakih, Executive Director of the Lebanese Center for Human Rights (CLDH).

    Founded in 1997, CLDH is a civil society organisation (CSO) working to enforce human rights for all, denounce human rights violators and fight impunity by providing legal and rehabilitation services.

    What’s been the impact of the ongoing political paralysis?

    Since April 2023, Lebanon’s parliament has repeatedly postponed municipal elections under the pretext of lack of funding and technical and logistical obstacles. This has impeded local democratic processes critical for addressing community needs, allocating resources and delivering essential services. The prolonged delay in holding elections has diminished people’s ability to raise concerns, hold local authorities accountable and participate in decisions directly affecting their lives.

    Parliament has also been unable to designate a president since the incumbent’s mandate expired in October 2022. It has tried and failed to elect a new president 12 times already. This political deadlock has significantly impacted on national governance and decision-making processes.

    A fully functional presidency is essential to guide Lebanon through its multifaceted crises and ensure the effective operation of government institutions. The absence of a president has obstructed the formation of a new government that would have to enact reforms and address urgent political, economic and security concerns. This has exacerbated public frustration and deepened a pervasive sense of uncertainty.

    What’s the current security and human rights situation in southern Lebanon?

    Since 8 October 2023, villages in South Lebanon have endured daily Israeli bombardments and exchanges of fire. As a result, at least 14 civilians have been killed, including women, children and older people. The press has also been deliberately targeted, resulting in the death of Reuters journalist Issam Abdallah on 13 October. According to the Lebanese Ministry of Public Health, as of 14 November the death toll stood at 77 people, with 328 wounded.

    The deteriorating security situation prompted the closure of 52 schools and forced many people to evacuate their homes, pushing the number of internally displaced people in Lebanon to over 46,000.

    Moreover, the Israeli army has deployed artillery shells containing white phosphorus, in violation of international humanitarian law. This has caused extensive damage to private properties, public infrastructure and agricultural land. Israeli shelling in southern Lebanon has also sparked fires that destroyed approximately 40,000 olive trees and scorched hundreds of square kilometres of land, dealing a severe blow to one of Lebanon’s primary agricultural crops.

    What are the conditions for civil society in Lebanon?

    In recent years Lebanese civil society has grappled with significant challenges. In the absence of basic government action, CSOs have taken the lead in advocating for social change, human rights and political reforms. Over the past year, civil society has tried to maintain momentum for change despite escalating problems, including the vacuum in the presidency, arbitrary deportations of Syrian refugees, targeted attacks on LGBTQI+ people and external security threats.

    But civil society efforts have been hindered by limited resources and a context of economic crisis, political instability, widespread corruption and a challenging humanitarian situation. Moreover, a smear campaign that powerful politicians launched in 2019 has caused a surge in hate speech and the targeting of civil society as a whole.

    Additionally, during 2023 we have experienced significant backsliding on freedom of expression, as media outlets and journalists have been increasingly targeted through legal actions, arrests, harassment and intimidation. Journalists critical of political figures or parties face reprisal, as influential groups abuse their power to try to suppress media coverage that contradicts their interests. For example, several journalists were recently summoned to the Cybercrimes Bureau in retaliation for their online publications. In October, CLDH faced direct threats from former military personnel for advocating for accountability in the case of a murdered Syrian national.

    Reporting on sensitive issues such as sectarian conflicts, government policies, corruption and security challenges often draws excessive attention from authorities who seek to control the narrative and conceal information that could destabilise the status quo. They also intend to use a draft media law currently under parliamentary discussion to further restrict freedom of expression.

    How does CLDH work to advance human rights, and what challenges do you face?

    CLDH advances human rights through a comprehensive approach that includes advocacy, research, public mobilisation, pro bono legal services for vulnerable groups regardless of nationality or migratory status, rehabilitation services for victims of torture and enforced disappearance and capacity development for key stakeholders in the human rights field. Through a project funded by the United Nations Democracy Fund, we are working to empower victims of human rights violations to become civic activists engaged in public awareness campaigns and policy reforms.

    Given the multifaceted nature of our work, we frequently encounter challenges such as limited funding and resources, security risks associated with handling sensitive cases, legal restrictions, widespread misinformation and apathy, and difficulties in accessing vulnerable groups. Other obstacles arise from the economic crisis, deteriorating conditions in Lebanese prisons and financial hardships faced by excluded groups.

    What forms of international support does Lebanese civil society receive, and what further support do you need?

    Lebanese CSOs receive international support in the form of financial assistance and grants, which are particularly crucial during crises when resources are scarce. Support also comes in the form of capacity development programmes and technical assistance aimed at increasing impact. International partnerships and networks also help amplify the voices of Lebanese civil society and strengthen our calls for policy changes.

    Further assistance is needed to ensure the financial sustainability of local CSOs and their resilience to external shocks, enabling consistent operation in difficult circumstances. Donors must align their support with local needs and priorities to address context-specific challenges.

  • LEBANON: ‘Increased popular awareness is irreversible, it will remain despite any setbacks’

    CIVICUS speaks with Ziad Abdel Samad, Executive Director of the Arab NGO Network for Development (ANND), and Zahra Bazzi, ANND ProgrammesManager, about the protests that began in Lebanon in October 2019, the changes achieved and the challenges encountered.ANND is a regional network that brings together nine national networks (encompassing 250 organisations) and 23 civil society organisations (CSOs) in 12 countries. It was established in 1997 and since 2000 has had its headquarters in Beirut, Lebanon. It promotes the role of civil society and the values of democracy, human rights and sustainable development in the region, and advocates for socio-economic reforms aimed at sustainable development and gender justice, with a rights-based approach.

    What triggered the protests that began in October 2019?

    The protests were motivated by the direct repercussions of the economic and monetary crisis on the Lebanese population, but had deep roots in a structurally flawed economic system and wicked political practices and corruption embraced by successive governments for decades. The few months before the eruption of the revolution saw a looming economic crisis with an increase in government debt and questionable monetary and financial engineering coupled with a decrease in GDP growth, as well as a rise in unemployment, reaching approximately 16 per cent among the general population, and more than 45 per cent among young people, along with growing poverty and increases in the prices of essential commodities. One week before the protests, direct signs of a financial crisis had started to show, including strikes at petrol stations and the inability of the government to access new credit to import wheat and other basic goods, in addition to the eruption of roughly 100 nationwide wildfires and forest fires that destroyed massive green areas and some houses.

    Following the late adoption of the 2019 budget in July, the negotiations over the 2020 budget were being finalised in October with a clear aim of increasing state revenue at any cost and reducing the enormous deficit of 11 per cent to escape the crisis. The cabinet meeting held on 17 October suggested a new set of austerity measures, including additional indirect taxation, without envisioning the anger of the Lebanese people and the massive protests that would spread through the country that same day.

    Protesters have shared a clear vision with clear demands of the political and economic systems they want to achieve: the resignation of the government – which happened on 29 October 2019; the formation of a new government comprising people independent from the ruling parties – indeed a new government was formed on 22 January 2020, although it does it not conform to the key demands of the revolution; and the holding of democratic parliamentary elections based on a new democratic electoral law. In addition, there were demands to pass laws on the independence of the judiciary, take action to recover assets and other socio-economic demands.

    How did the government react to the protests?

    Since the first days of the uprisings, political parties and various elements of the regime felt threatened by the imminent change protesters were calling for, which would jeopardise the power they have held for decades. They reacted to this by using excessive force, teargas, rubber bullets, arbitrary detention and arrests, especially after December 2019.

    Since the beginning of the protests, several human rights violations were committed against protesters. On 23 November, five young people – including two minors – were arrested and detained by the security forces for taking down a banner belonging to a political party. On the same day, supporters of the Amal and Hezbollah movements violently clashed with peaceful protesters in Beirut and other regions to denounce the closure of roads. Violence increased, a fact that was firmly condemned by United Nations’ experts and special rapporteurs, who called on the Lebanese government to respect the right to the freedom of expression and protect protesters.

    The postponement of parliamentary consultations from 9 to 16 December, and then again to 19 December, was accompanied by increasing violence and clashes among protesters, supporters of political leaders and the security forces and army. The most violent clashes were recorded between 10 and 16 December: on 10 December, protesters toured in their cars outside the houses of the previous ministers of public works and transportation, denouncing the poor infrastructure that had caused enormous floods on main roads and highways, locking citizens for hours in their cars. Protesters were attacked ferociously by men in uniforms of the Internal Security Forces, but who were affiliated with some political parties. Cars were vandalised, and protesters and journalists were dragged out and beaten indiscriminately.

    On the nights of 14 and 15 December, security forces clashed with supporters of political parties who provoked and attacked them in different ways. Security forces also arbitrarily attacked protesters gathered in Beirut, and fired teargas and rubber bullets at them, in retaliation against the acts of some. These two days of violence ended with the arrest of 23 people, some of whom showed signs of torture after their release. More than 76 protesters reported experiencing some form of attack, either by security officials or as a result of the rubber bullets fired against them. More severely, a few reported being dragged inside the parliament building and beaten by the security forces inside. A few reported the theft of money, legal documentation, or phones.

    Violence continued until the night of 16 December, with supporters of political parties attacking the people gathered in squares in Beirut and in the south, and burning down tents and cars. This came in response to a video, probably intentionally spread on social media, of a young man from Tripoli cursing the Shia faith.

    Clashes between protesters and security forces and riot police were especially intense during the attacks protesters made against banks, and during protests and attempts to remove the massive walls and blocks unlawfully put in front of parliament, and more recently in front of the Government Palace.

    Following the arbitrary arrest of protesters, on 15 January 2020 hundreds gathered outside the detention facility to call for their release, and were subjected to excessive force by the riot police, including the indiscriminate firing of teargas. Journalists and TV reporters were directly attacked by riot police. Footage was leaked showing the security forces beating detainees while transporting them to a detention facility. Some released detainees shared stories of torture and abuse inside detention facilities.

    Recent statistics released by the Lawyers’ Committee to Defend Protesters in Lebanon show that between 17 October 2019 and 31 January 2020, around 906 protesters were arrested and detained, including 49 minors and 17 women. Roughly 546 protesters were subjected to violence at the protests or in detention facilities.

    When and how did the protests become a ‘revolution’?

    The protests are widespread across the country. They are decentralised and remain non-sectarian. As Lebanese people overcame their religious and political divergences and joined forces in an attempt to achieve real change, they made the biggest post-war civil movement in Lebanon. This change had been long-awaited, particularly by civil society, which has tried to promote partnerships and engage in policy-making at various levels for years, despite the lack of serious and effective channels for doing so. Although the term ‘revolution’ has been contested by many, protesters and activists, among others, have insisted on calling the process a revolution, particularly after the increased violence and the death of two martyrs, Hussein Al-Attar and Alaa Abou Fakher.

    Although key demands have not changed since the beginning of the protests, more demands were added as the process evolved, especially relating to the socio-economic and financial situation. More importantly, demands started off and remained socio-economic, but were always directly linked to political change.

    What role have CSOs played during the process?

    CSOs have played an important role in the revolution, which has benefited from their accumulated knowledge, communication skills and organisational capacities. Most of those organisations participated in the protests since day one, but their role went beyond protesting. CSOs are leading in coordinating the protests and organising daily discussions at various squares in Beirut and other regions. These meetings address politics, law, socio-economic policies and human rights. They address people’s concerns and ensure the availability of solutions and alternatives. Participation in discussions has steadily increased and has involved a variety of sectors of society, including young people, women, the private sector, academics, and students. However, protest camps have faced challenges following the destruction and burning of their tents in Beirut and across other areas.

    It seems that women and young people are playing increasingly prominent roles in protest movements worldwide. Has this been the case in Lebanon?

    While women in Lebanon have been at the forefront of every important political moment in our country, they have been particularly active during the revolution. Slogans and demands related to women’s rights have been very clear and evident, including the right to pass their citizenship to their families, a civil personal status law and protection from violence, Women have organised in groups, or participated individually, to form human shields at the forefront of protests to prevent violence, lead the marches and host discussions on women’s issues.

    Feminist and women’s marches were held outside Beirut, in north and south Lebanon particularly. These were bold actions that were not very common prior to the revolution. Feminists were also able to engage critically with the slogans of the revolution and to place their discourse on the table. They were able to draw attention to many patriarchal connotations in slogans, even in the national anthem. In addition to being active alongside men, and sometimes alone, closing roads and occupying squares and public facilities, women cooked meals and offered them to protesters and sitters to support them, and initiated cleaning and recycling campaigns on a regular basis. More importantly, on many occasions, they formed a shield on the front rows between protesters and security forces to minimise the clashes.

    The revolution also witnessed very active participation by young people and youth groups. These formed the backbone of the protests, as for years young people have been eager to take part in decision-making and political life. In Lebanon, people below the age of 21 are not eligible to vote in parliamentary and municipal elections, and yet they found a space in this revolution to participate and make their voices heard. As such, young voices and concerns were loud during the protests. Young people were particularly concerned with unemployment, immigration, and the brain drain and suggested bold demands, including calling for the downfall of the regime and all its political leaders without exception and the establishment of a secular system promoting social justice and gender equality.

    The revolution has been an opportunity to revive the student movement in Lebanon. Despite all the efforts made prior to the revolution to form a nationwide student movement, in the absence of a national student union the student movement was fragmented and weak. However, after 17 October, student clubs in private universities such as the American University of Beirut, Notre-Dame University and Université Saint-Joseph participated heavily in the protests in and off-campus, forming marches from universities to the main protest squares, and even setting up their own tents in downtown Beirut. Other private universities such as the Lebanese American University and the Lebanese International University held protests on and around campus. The Lebanese University (LU), Lebanon’s national university, saw the biggest student protests. The LU Student Coalition was particularly active in the revolution, from setting up a tent for protesters in Riad Al-Solh square, in downtown Beirut, to hosting various discussions, joining efforts with other student clubs and leftist groups.

    Younger school students also had a role in the revolution. Along with university student groups, they took a big part in civil disobedience actions and general strikes. Students closed their schools and universities and protested in front of the Ministry of Education and other public administration offices for many days. As 6 November marked Students’ Day, students all across Lebanon were revolting for a better future. A banner raised by one of the students says it all: “On this day I won’t be learning history, I will be writing it.”

    What have protests achieved so far, and what remains to be done?

    Within 100 days, the revolution has had an impact on the authorities and also at a popular level.

    First, it overthrew the so-called presidential settlement – an agreement among regional and internal forces and other actors – that led Michel Aoun to become president and produced a parliament based on an unconstitutional electoral law. This led to the rise of a new political majority and the formation of a coalition government including seven major political parties. This came at a high price, including the conciliation of regional and local powers, frequent disruption of the work of parliament and government, and very intense pressures especially on the political and security levels.

    Second, it overthrew the government, that is, the executive power. This was the settlement’s weakest component, as the prime minister was the weakest among power holders such as Hezbollah, the Amal Movement, and the Free Patriotic Movement.

    Third, the revolution interrupted two parliamentary sessions and blocked the adoption of equivocal draft laws listed on the agenda. Mobilised citizens had never been able to cancel a parliamentary session before.

    Fourth, it caused disruption within the ruling coalition and among the authorities, as seen in the resignation of the government and the confusion that prevailed in the process of forming a new government, especially when two candidates for the role of prime minister had to be let go for failing to meet the minimum requirements demanded by the revolution, along with other reasons. During this lengthy process, acute differences and contradictions were revealed between allied parties, despite the fact that they belonged to the same block.

    Above all, the revolution has increased popular awareness, which has been reflected in thousands of initiatives and discussions. Decentralised protests have taken place across all cities and villages from the far south to the far north and east, and have included all social and age groups. This diverse and inclusive revolution has contributed to breaking the rigid sectarian and regional political discourse, disrupting traditional loyalties and breaking down barriers between social groups and regions. Some people think that this positive shift cannot be considered complete, but there is indeed a consensus that it is a very important and irreversible change, which will remain despite any setbacks. We must be confident that significant progress has been made regarding popular awareness and the ability of social movements to carry out direct political action in the streets.

    The revolution has achieved certain gains during the first round and is preparing for the next round, in which new laws and policies need to be adopted as soon as possible to overcome the ongoing financial and economic crises and set a base for a new and fairer economic paradigm.

    How connected is Lebanese civil society with its counterparts around the world, and what support does it need from international civil society in order to continue its struggle?

    Lebanese civil society is very rich and diverse, and it is connected to its counterparts around the world through different channels. It is indeed very active on the advocacy front and takes part in numerous international advocacy platforms.

    In these critical times, the country is going through, civil society is avoiding seeking any support from foreign counterparts, in order to refute all conspiracy theories and accusations that politicians and their affiliates have made against protesters and the revolution. In order to lessen all the claims fabricated against our genuine and national revolution, Lebanese civil society is very reluctant to receive any support that could amount to or be interpreted as intervention by any foreign actor. However, it would welcome solidarity actions and statements, especially those that denounce human rights violations committed against protesters.

  • LEBANON: ‘The main culprits of the current crisis are bank owners and their greed for profit’

    Alaa KhorchidCIVICUS speaks about Lebanon’s ongoing financial crisis and the situation of depositors who are unable to access their savings with Alaa Khorchid, head of Depositors’ Outcry Association. 

    Depositors’ Outcry Association is a citizens’ group that formed in 2019 to support depositors’ attempts to withdraw their savings from Lebanese banks after their accounts were frozen in response to the financial crisis.

    Who is to blame for the situation Lebanese depositors are currently in?

    Lebanese depositors are desperate because their savings have been frozen, so they cannot withdraw them from banks. The way they are being mistreated is outrageous. If a depositor simply complains loudly, bank staff call the police on them. Even if they have a million dollars in the bank, depositors are unable to get medical treatment or pay for their kids’ university fees. Banks are only allowing them to withdraw US$140 a month, and are told if they have an issue with that limit, they can go ahead and file a lawsuit.

    The main culprits of the current crisis are bank owners, whose greed for profit got us to this point. What they did was a scam. They sent representatives abroad to convince Lebanese expatriates and foreigners to invest their money in Lebanese banks even though they knew we were heading into a crisis, while they smuggled their own money to France, the USA or the Gulf countries, where their investments amount to billions.

    Also responsible are state authorities, starting with Riad Salameh, governor of the Banque du Liban (BdL), Lebanon’s central bank. He should have regulated banks and held them accountable three years ago, but he didn’t.

    The government is responsible for not applying the laws on banks owners. They should have forced them to return depositors’ money out of their own pockets, but instead allowed them to smuggle their money abroad.

    The courts also have their share of responsibility, as they have thousands of cases pending, years after they’ve been filed. When cases filed by depositors in Lebanon reach a certain point they are shelved, while in France and the UK depositors managed to win their cases and get their money back.

    How have people organised to get their money back?

    People got together to fight collectively through organisations such asDepositors’ Outcry Association, which formed in 2019. Asan association, we have filed lawsuits against the BdL governor as well as the Association of Banks in Lebanon (ABL) and one bank, the Société Générale de Banque au Liban (SGBL), that smuggled US$1.2 billion out of the country. All these lawsuits have been pending for years because most of the judiciary has been bribed by the banks. 

    We also support depositors by mediating between them and the banks. For example, we have a list of cancer patients that we shared with the banks to try and convince them to release some of their funds to enable people to pay for treatment. Some banks, but not all, have responded positively.

    Some depositors have gone the banks to get their money by whatever means. One of them was Sali Hafiz, whom we supported. Hafiz asked for our help; a lawyer and members of the association went inside the bank with her and over 100 members were outside the bank to cheer for her and ensure her safety. We also helped a retired serviceman in Chtoura retrieve some of his savings from the bank. The association’s lawyer follows up with depositors, and when a depositor enters a bank to try to get some of their money back, we spread the word among our supporters so people gather outside in support and make it harder for others to enter the bank or for security to kick them out.

    It is worth noting that not all the organisations out there are supporting depositors. There are several organisations funded by ABL or SGBL, which obviously always side with the banks. The same applies to local media, which continues to accept money from the banks in the form of advertising. Depositors have had their accounts blocked for three years on the grounds that there is no money to give them back, but the banks still find money to pay for advertising.

    What needs to change so the situation can be resolved?

    We don’t have a functioning governance system. Banks have retained people’s savings for three years and the BdL has allowed this to continue, while the judiciary has protected the banks by withholding thousands of cases without reaching a conclusion. Many judges have a financial incentive to behave this way: they got bank loans worth millions of US dollars, which they are now repaying in Lebanese lira at a ridiculous exchange rate – they will end up paying 10 per cent of the original amount. This is a real scandal.

    The first change needed is to replace the BdL governor. He is the one behind the financial policies issued in 2017 and 2018. He brought cash in from correspondent banks and loaned it to the state without any guarantees. He spent US$100 billion without ever being held accountable. He considers himself above the law: he faces multiple lawsuits but he simply refuses to show up in court. 

    What are the implications of the recently passed Banking Secrecy Law?

    Parliament passed an amended Banking Secrecy Law that will lift secrecy on the bank accounts belonging to public officials and major bankers. We find the new law acceptable, although we hoped it would apply retroactively. As we told the head of the Parliament’s Finance and Budget Committee, we want to clarify what happened to the funds the political and financial elite transferred abroad after 17 October 2019, estimated at between US$13 and 15 billion. We want to understand who smuggled them and where to. But the new law won’t solve all the issues as there is no trust in the banking system.

    Another bill, the Capital Control Law, is set to be discussed in parliament, but there is still no final draft to comment on. Unfortunately, it is a bit too late to discuss capital controls, once capital has been massively smuggled abroad. Capital controls should have come a week, even a month into the crisis, but not after three years. Banks have smuggled the funds of the elite abroad because there were no legal impediments. The latest update we heard regarding the capital control law is that there will be no separate capital control law and it will be part of a larger recovery roadmap consisting of many changes in addition to capital control. We consider the potential recovery roadmap as a death sentence to depositors.

    What do you think about the conditions imposed by the International Monetary Fund (IMF) for approving a US$3 billion loan?

    According to the government, one of the IMF’s main conditions is to write off US$70 billion of depositors’ funds. If that is what the IMF wants in exchange for giving the state a US$3 billion loan, then of course we are against it. The IMF can’t ask the state and BdL to write off as much funds to ensure they get repaid for their loan. Some members of parliament promised us they would refuse to pass any legislation to that effect.

    But a reform requested by the IMF that is most important to us, and which ABL rejects, is the restructuring of banks. We hope that banks will be restructured and a timeline for repaying depositors will be released.

    At the beginning of the crisis, BdL had US$34 billion. Today, it has US$8 billion. Those billions are gone due to governance failures. If the same policies remain in place, nothing will work, regardless of whether the IMF gives the state a loan of US$3 or 10 billion. The first step to get out of this crisis should be to guarantee deposits, because the crisis wasn’t the depositors’ fault.

    In the past 15 years banks made over US$35 billion in profit, which was transferred abroad. We demand a forensic audit of each bank to find out which had profits, and how much. There are 40 banks in Lebanon. Why are they being treated as one? We should examine each separately.

  • LEBANON: ‘The political youth movement was a major pillar of the opposition to the ruling class’

    MarwanIssaCIVICUS speaks about the recent general election in Lebanon with Marwan Issa, research assistant with the Asfari Institute for Civil Society and Citizenship at the American University of Beirut.

    The Asfari Institute seeks to bridge academia and civil society activism. It does so through knowledge production, convenings and the creation of safe spaces for learning, dialogue and exchange. Located at the heart of the American University in Beirut, it functions as a regional hub for civil society working for diversity, inclusion, equality, accountability and sustainability.

    What was the political and economic context of Lebanon’s 15 May general election?

    The election was held while Lebanon faced one of its worst economic crises in recent history. People were experiencing severe hardship due to lack of essential items, including medicines. On election day, the currency exchange rate skyrocketed, with the US dollar going from 1,515 to around 30,000 Lebanese pounds. Not surprisingly, the majority held deep-seated anger against traditional ruling parties. This led many voters, and especially those in the diaspora, to elect new independent opposition parties and candidates.

    However, the intensity of the crisis also led many people to despair and crippled their desire or motivation for action. As a result, the revolutionary feelings stirred by the protests of 17 October 2019 largely died down, and many people felt their vote would not make any difference, which explains the low turnout.

    But this did not mean that people were not searching for alternatives: in fact, a solution-focused, rational debate has also emerged that is clearly different from the tribal methods of traditional political parties, which instrumentalise sectarianism, clientelism and fearmongering. New opposition groups have developed that criticise the traditional division between those who blame all the country’s problems on the presence of Hezbollah as an armed militia, and those who believe the presence of resistance against a potential threat from Israel is necessary. Both are viewed as serving the interests of the current political elite.

    In the face of this, the new opposition offers an alternative discourse focused on both sovereignty and economic justice. This debate about alternative economic and social solutions is very promising for the years ahead.

    How did youth-led groups engage with the election process?

    There are plenty of youth-led political groups in Lebanon, but the main one is Mada, the Network of Secular Clubs. The first secular clubs were formed in universities as an alternative to the domination of ruling class parties on campus and started to take part in university student council elections. Over the past few years, these secular clubs won more than two-thirds of the seats in student council elections, breaking the hegemony of traditional political parties. As a result, they have paved the way for a new type of discourse on and outside campuses. Now the Network has 21 clubs throughout the country – not just in universities but also in unions and regions – and continues to have a clear youth-led political discourse.

    In preparation for the election, Mada engaged in negotiations with other groups to form coalitions. In Beirut, Mada members were active in the creation of Beirut Tuqawem (Beirut Resists), a grassroots participatory campaign that included individuals and groups from various progressive circles. Those volunteering in these campaigns were mostly university students working alongside other Mada members who were a bit older – but still young, around 25 on average.

    Mada members were also active in launching campaigns in other parts of Lebanon, including al Janoub Youwajeh (The South Confronts), Jil al Teghyir (The Generation of Change), and the 17 October Coalition.

    So-called apolitical young people – young people not active in any political group – also mostly leaned towards voting for new independent opposition groups. They also encouraged those around them to do the same, which boosted the opposition movement. Had the voting age been 18 instead of 21, we could confidently say that the elections would have brought many more new faces to parliament.

    How free and fair was the election?

    The electoral process was plagued with violations that made the competition unfair. For instance, although there are strict caps on campaign spending, ruling class candidates violated the law and poured millions of dollars into their campaigns. This huge financial advantage allowed them to reach vast audiences, while opposition campaigns had much more limited resources.

    Bribery and clientelism were also rampant. In addition, smear campaigns and direct threats on opposition candidates were widely noticed. One of them, Ali Khalife, received direct threats following a smear campaign by pro-Hezbollah electronic armies. A few days before the election there were attacks by Tashnag party supporters on opposition groups in Metn and the beating of volunteers.

    On election day many violations were recorded, but they were highly dependent on the context. In the southern region, for example, violations included brawls, fights, and politically affiliated electoral assistants going inside voting booths alongside voters. In areas controlled by armed or powerful parties, such as Hezbollah and the Amal movement in the south, many people did not dare turn up to vote.

    How do you assess the election results?

    All the above combined, plus the fact that the ruling class also very carefully crafted the electoral law to suit its sectarian and partisan quota system, made for a tilted playing field. Under the circumstances, the results were promising and can be built upon.

    The election resulted in around 12 or 13 new opposition faces in parliament, plus a couple more who could be counted as part of the opposition but were in parliament already. The presence of 15 opposition, mostly new, legislators is great news. They have clear views regarding both the presence of an armed militia and the responsibility of banks and bank owners in the economic crisis. For instance, newly elected member of parliament Ibrahim Mneimneh, of Beirut Tuqawem, who got the most preferential votes among all new opposition candidates, has a progressive economic and social discourse and took a clear stand on issues related to security and arms.

    In contrast, candidates traditionally linked with the Syrian regime lost their seats, including Assaad Herdan in the south, Weeam Wahhab and Talal Erslan in Mount Lebanon, and Elie Ferzli in Bekaa. This was a huge victory against people who were puppets in the hands of the Syrian regime during the period in which Syria maintained a military presence in Lebanon, between the 1990s and 2005.

    Following the election, pro-change political forces must continue pushing for change in and outside parliament, supporting the newly elected members of parliament and holding them accountable for the implementation of their programme.

    What kind of international support does Lebanese civil society need?

    Youth-led groups have been at a significant financial disadvantage, and I believe they are the ones that need the most support. It only makes sense that the new generation be supported since waves of emigration keep rising as students and young people more generally lose hope in Lebanon. Financial support, however, should be conditional on the credibility of the opposition group receiving it; it must be directed towards groups with a proven commitment to democracy, social justice, and non-sectarian values.

    International organisations, embassies, and other entities could also express their support by including the perspectives of opposition groups in designing policies and humanitarian aid mechanisms because Lebanon’s ruling class has proven highly skilled at transforming aid into clientelism and perpetuating the cycle of violence and poverty for political gain.

  • LEBANON: ‘The world seems to be starting to forget Syrian refugees’

    Founded in 1968, Anera is a US-registered civil society organisation (CSO) dedicated to helping refugees and others hurt by conflicts in Jordan, Lebanon and Palestine (West Bank and Gaza). Working with partners on the ground, it mobilises resources for immediate emergency relief and for sustainable, long-term health, education and economic development.

    What is the situation of Syrian refugees in Lebanon?

    The human rights situation of Syrian refugees is getting worse by the minute. Freedom to work is almost non-existent. Right from the start Syrians were officially not allowed to work in most sectors, so they typically rely on informal jobs in services, agriculture or construction, where they get no insurance or benefits and are exposed to all kinds of labour abuses.

    While the situation for Syrian refugees in Lebanon has always been difficult, COVID-19 and the subsequent lockdown hit them very hard economically. As well as affecting host communities, the pandemic impacted on Syrian refugees with extra severity. Because Lebanese labour laws relegate refugees to the informal economy, they are dependent on gig work and daily jobs, usually in the service sectors. So they were particularly affected by the shutdown of the entertainment and food industries. 

    Because of school closures due to COVID-19 as well as ongoing teachers’ strikes to demand unpaid salaries, Syrian refugees have no place to study. Their freedom of movement has also been affected: everywhere in Lebanon there are notices warning that Syrians are only allowed to move around at certain hours. It’s starting to feel like full-blown segregation.

    It should be noted that Lebanon is already extremely segregated politically and religiously and has an extremely toxic and traumatic relationship with Syria. The presence of a large, mostly Sunni Muslim, Syrian community only adds to the political tension, to the point that violent clashes could erupt any time.

    With Lebanon’s ongoingeconomic crisis, the situation is hard for everyone, both locals and refugees. But on top of struggling economically, refugees are also facing growing xenophobia. Because Lebanese communities are struggling to put food on their tables, the narrative of refugees being a burden on society is becoming increasingly popular. When the Lebanese currency and politics were more stable, someone on an average salary could feed a whole middle-class family, but now they can barely get some petrol for their car. The idea that Syrian refugees are taking everything from Lebanese people is widespread, and reactions are becoming increasingly hostile and violent. When people see international funding going towards Syrian refugees, they get enraged.

    Many people think refugees are taking away potential aid that should go to Lebanese people. So on top of the livelihood challenges, refugees also face stigma, negativity and hostility, all of which affects their psyches. This isn’t happening just in Lebanon.Turkey is another example of this. The scenario is the same throughout the region: Syrian refugees are being blamed for everything.

    International factors such as fluctuations of the US dollar, political turmoil everywhere and the war in Ukraine are also affecting funding for Syrian refugees. So when it is most needed, funding is going to decrease. We have recently received a message that part of the assistance for Syrian refugees will be cancelled.

    Which are the most vulnerable groups of refugees, and why?

    Syrian women are for sure the most vulnerable among Syrian refugees, for several reasons. Their access to sexual and reproductive health centres, and to education, is truly low. There’s a general lack of knowledge and awareness of these issues and early marriage is frequent. In refugee camps such as those in Bekaa, Syrian women and girls are often exposed to gender-based and sexual violence. Those living in tent settlements know their chances of reporting sexual harassment and being heard are very, very low. Being a Syrian female refugee in Lebanon means dealing with toxicity and violence at all levels. 

    Children and young people are next in terms of their vulnerability. We are talking about early marriage, child labour and no prospects of accessing education or future employment opportunities. They have no access to proper medical attention either. If they get into an accident, they will wait in line for hours to be seen by a doctor. The most dangerous thing, however, is their lack of prospects. 

    What is Lebanon’s status regarding international refugee law?

    Lebanon hasn’t even signed the1951 Refugee Convention and is violating refugees’ rights by pushing them to ‘willingly’ go back to Syria. Lebanon should be bound by international law to protect these refugees, not to return them to unsafe territory.

    Unlike Turkey, the tents and places where Syrian refugees mostly live in Lebanon are privately owned. These private owners are Lebanese people profiting from refugees, who they make pay rent. They must pay electricity to have one bulb they can switch on and off inside the tents. They must be the only refugees on the planet who have to pay rent for the space they occupy!

    These rights violations are enabled by the fact that Lebanon has not signed the Refugee Convention. Syrian refugees are not officially considered refugees, which deprives them of their basic rights as refugees. This grey area is very dangerous.

    Refugees themselves aren’t aware of the laws that could protect them. They come from a country where they were never encouraged to inform themselves about and claim their basic human rights – which was one of the reasons they left. Upon arrival in Lebanon, they aren’t informed about their basic rights, so they are mostly unaware of them. And even if they knew what their rights are under international law, they have no guarantee these rights are going to be protected in Lebanon because nothing binds the Lebanese state to that law. 

    How does Anera promote the human rights of refugees?

    Anera is a humanitarian and development organisation. We are not a rights-based organisation, but we contribute to the protection of the basic human rights of refugees. Our role is to fill in the gaps left by the government to help refugees access education, work and healthcare, among other rights. 

    We work across several sectors, from livelihoods to food security. We try to create synergies between them to address several needs at once. We work with refugee families in both the north and south of Lebanon through agriculture support. We provide them with tools and technical education to grow and sell their produce. As for food security, we have programme in partnership with the United Nations Office for the Coordination of Humanitarian Affairs in Lebanon that provides hundreds of families with regular food parcels and cash assistance so they can purchase what they need. 

    One of our biggest programmes distributes free medicine. Each year we help mobilise medical supply shipments worth millions of dollars from international partners around the world and distribute them to refugee centres.

    We work to prevent child marriage through a cash transfer programme, using cash assistance as an incentive for families to keep their girls in school. And throughout our operations, we make sure all our partners abide by all humanitarian guidelines and standards when it comes to child protection and protection from sexual exploitation and abuse. Towards that end, we offer training and constantly do monitoring work. While we don’t directly provide safe spaces for victims and survivors, we work closely with other CSOs and grassroots groups that do so.

    It is worth mentioning that we always take the community aspect into consideration so as to balance things. For instance, our food programme also distributes food to the Lebanese population. 

    What challenges do you face?

    Thepolitical situation in Lebanon is very challenging. The fact that the government often has a hostile attitude towards Syrian refugees and is trying to return them to unsafe territories is a big obstacle. Government corruption also has a negative impact on our work with refugee communities, as it affects us on an organisational and funding level. 

    We also face challenges coming from the refugee communities where we work. An example of conflict happened recently in the context of a project on child marriage that we implemented due to the increase in child marriages among Syrian refugees in Lebanon. Because of the economic crisis, more families are encouraged to marry off their daughters at a younger age. Our project faced pushback by the refugees themselves. It seems that toxic coping mechanisms such as child marriage are easier for them in the short term.

    What support do organisations working with Syrian refugees need from the international community?

    Everyone in Lebanon is vulnerable right now: Syrian refugees, Palestinian refugees and Lebanese people. The situation of Syrian refugees is stagnant right now, but everything else is worsening. 

    What’s needed is more advocacy and more funding for all communities to balance the help provided and avoid conflict. We need to calm things down and bring stability. We could also use some technical support at a government level when it comes to refugee management.

    The narrative around Syrian refugees needs to change so they are not viewed as a burden but as human beings in need of help.

    The question all Syrian refugees ask themselves is what’s next. If the situation in Syria doesn’t get better and Syrians are forced to leave Lebanon, they will try to get to Europe, or anywhere else offering some kind of opportunity. We need more global engagement to determine what will happen next. Collective work is vital.

    The world seems to be starting to forget these refugees. The topic trended on social media for a while at the beginning but then attention was captured by floods in Nigeria, war in Ukraine andrepression in Iran. No one is talking about Syrian refugees anymore.

    So much is going on in the planet. There are so many crises erupting all at once. But the fact that new crises are happening doesn’t mean the situation of Syrian refugees has improved and the issue disappeared.

    The international community must remember Syrian refugees and the Syrian crisis. Human rights defenders must advocate for the rights of Syrian refugees – because if they don’t, who will?

  • LEBANON: ‘This crisis should be handled with a feminist vision’

    CIVICUS speaks to Lina Abou Habib, a feminist activist based in Beirut, Lebanon, about the civil society response to the emergency caused by the explosion on 4 August 2020. Lina teaches Global Feminisms at the American University of Beirut, where she is affiliated with the Asfari Institute, and chairs the Collective for Research and Training on Development-Action, a regional feminist organisation working in the Middle East and North Africa. She also serves on the board of Gender at Work and as a strategic Middle East and North Africa advisor for the Global Fund for Women.

    Would you tell us about the moment of the explosion?

    The Beirut explosion happened on 4 August 2020, at around 18:10 Beirut time. I was at home and I had known for an hour that there was a huge fire at the Beirut port. When the fire started getting bigger the sky was blackened by fumes. I was looking out, and the first thing I felt was a very scary earthquake-like feeling, after which it took a split second for a huge explosion to happen. Glass shattered all around me. It took me a couple of minutes to understand what had just happened. The first thing everyone was call our family and close friends just to make sure that they were okay. Everybody was in a state of disbelief. The explosion was so powerful that each one of us felt like it had happened right next to us.

    What was civil society’s immediate response?

    It is important to note that alongside the civil society response there was also an individual response. Individuals took to the streets in an attempt to help others. Nobody trusted that the state would help in any way. The state was responsible for what had happened. People took the responsibility for helping each other, which meant addressing immediate problems such as clearing rubble from the streets and talking to people to find out what they needed, including shelter and food. About 300,000 people had become homeless and lost everything in a split second. There was an extraordinary reaction by ordinary people to help: people with brooms and shovels started clearing rubble and distributing food and water. Anger turned into solidarity.

    This was an amazingly empowering moment that still continues. As we speak, there are volunteers and civil society organisations (CSOs) who are basically holding the fort and not only engaging in immediate relief but also providing all sorts of support to distressed populations.

    However, these acts of solidarity and care have also been criticised. The main criticism has been that such acts are unhelpful because they relieve the state from fulfilling its obligations and performing its duties. I understand this critique, but I don’t agree with it. To me, the acts of solidarity performed by civil society and ordinary people were our main success stories: stories of power and resistance that we should talk about. We need to highlight the immediate response provided individually by people who themselves had been hurt or had lost a lot. Migrant worker communities, who live in dire conditions of exploitation, racism and abuse, went out there to clear the rubble and help others. I don’t think we should ignore the significance of these acts of solidarity.

    Lebanon was already undergoing deep economic crisis, which was further exacerbated by the COVID-19 pandemic and the explosion. Which groups were impacted upon the most?

    The worst effects were felt by those who were already in the most vulnerable situations. A clear example of multiple forms of discrimination overlapping and reinforcing one another is the situation of female migrant workers in Lebanon. This is not new; this situation is decades old. First, migrant women work in the private sphere, which makes them even more invisible and vulnerable. Second, there are absolutely no rules that need to be followed to hire them, so they are basically at the mercy of their employers. They are kept in quasi-slavery conditions based on so-called ‘sponsorship contracts’. The air that they breathe is dependent on the will of their employers and they are completely bound to them. In sum, this is a population of women from poor countries of the global south who work as domestic workers and caregivers, positions that make them incredibly vulnerable to abuse. There are no laws that protect them and that has always been the case. Therefore, they are the ones left behind when there is a security issue or a political crisis.

    Three consecutive events have affected their situation. The first is the revolution that started on 17 October 2019, an incredibly important moment that was the culmination of years of activism, including by women migrant workers, who were supported, nurtured and mentored by young Lebanese feminists. As a result, in the midst of the revolution there were migrant workers who revolted against the sponsorship system, which deprives them of their humanity and exposes them to working conditions that amount to slavery, and demanded dignified work and a dignified life.

    And then there were the economic breakdown and the COVID-19 pandemic, both of which hit as the protests were still ongoing. As a result of the economic crunch, some people choose to not pay their migrant and domestic workers’ salaries, or even worst, simply disposed of them on the streets during the pandemic.

    And then the Beirut port explosion happened, which again affected migrant workers in particular. It was a succession of crises that hit migrant workers first and foremost, and particularly women, because they were already in precarious conditions in which they were abused, their labour taken for granted and then thrown away on the streets, forgotten by their embassies and ignored by the Lebanese government. 

    As an activist and a feminist, how do you view the government response to the explosion?

    There hasn’t been any responsible government response. I would not even call what we have a government, but rather a regime. It is a corrupt dictatorship, an authoritarian regime that continues to pretend to be democratic and even progressive. The regime says it embodies reforms, but it never follows through. For instance, 10 days into the revolution, in October 2019, the president addressed the nation and promised an egalitarian civil family law, which feminist activists have been demanding for decades. This came as a surprise, but it turned out that it wasn’t serious, as nothing has been done about it. The authorities just say whatever they think people want to hear, and they seem to be convinced that the public is too ignorant to notice.

    So we need to position the response to the explosion against the background of the recent uprising. The government’s response to the revolution has been to not acknowledge the problems that people were pointing at: that it had emptied the public coffers, that it continued to exercise nepotism and corruption and, worst of all, that it was dismantling public institutions. The only government response has been to close the space for civil society and attack the freedoms of association and expression and the right to protest. I’ve lived in this country for most of my life, including through the civil war, and I think there hasn’t been a crackdown on freedoms of the magnitude we are seeing right now under this regime. We have never witnessed people being summoned by the police or general security because of something they said or posted on social media. This is exactly what the regime is doing and continues to do. The president is acting as if there was a lèse-majesté law and is not accepting any criticism; people who criticise him are paying with their freedom. It is the first time we hear about activists being detained for this reason.

    In short, the regime hasn’t done anything significant in response to the explosion. Sending the army to distribute food aid packets is in no way significant. They are even refusing to give food aid items to non-Lebanese people who were affected. This exposes the various layers of corruption, bigotry and mismanagement that are at interplay here.

    Following the explosion, people took to the streets again to protest. Do you think protests have made an impact?

    On the Saturday following the explosion there were people protesting on the streets. I was there and I was scared because of the deployment of violence by the security forces.

    In the face of so many calamities, the only reason why people are not massively on the streets is because of the COVID-19 pandemic. This has been a gift for the regime. It has imposed curfews, broke up the tents set up by the revolutionaries at Martyrs’ Square and arrested and detained people, all under the guise of wanting to protect people from the virus. But of course, nobody is duped. The levels of contagion are increasing rather than decreasing. It doesn’t help that the regime is so corrupt that we basically don’t have any functioning health services.

    The constraints created by the pandemic and the fears for one’s health are seriously limiting people’s actions against the regime, but I don’t think this is going to stop the revolution. People have had enough. People have lost everything. And when you push people’s backs to the wall, there is nowhere else to go but forward. The regime will continue to use brutal force, it will continue to lie and mismanage funds and resources, but this is becoming totally unacceptable to an increasingly larger proportion of the population.

    I believe that street mobilisation has been successful on several levels. One can disagree and point out that the regime is still in power, and this may be true; it will take a long time for it to fall. But one immediate success of the protests is that they shattered a taboo. There was a kind of halo or sanctity around certain leaders who were believed to be untouchable. Now it's obvious that they don’t enjoy that protection any longer. Although the regime is not ready to concede, they are just buying themselves some time.

    The way I see it, a major gain has been the leadership role played by feminist groups in shaping the country that we want, the rights and entitlements we are claiming and the form of government that we want. Alongside 40 feminist organisations we have released a charter of demands. We put our heads together and have stated what humanitarian reconstruction needs to look like from a feminist perspective and are using this as an advocacy tool for the international community. The way we are intervening indicates that this crisis should be handled with a feminist vision.

    Additionally, for the first time the LGBTQI+ community has been part and parcel in shaping the reform process, the transition process and again shaping the country we want, regarding both the form of state and human relations. And the voice of the migrant community has been amplified as well. To me, these gains are irreversible.

    What support does civil society in Beirut and Lebanon need from the international community?

    There are a number of things that need to be done. First, we need tangible forms of solidarity in terms of communications to amplify our voice. Second, we need to lobby the international community on behalf of the Lebanese feminist movement so that the Lebanese regime is held accountable for every cent it receives. To give an example, we received about 1,700 kilograms of tea from Sri Lanka, and the tea has disappeared; it appears that the president distributed it among the presidential guards. We need influence and pressure from the international community to hold this regime accountable. Third, we need to bring these voices to the attention of international mainstream media.

    I want to emphasise the point that international aid should not be without conditions, as the ruling regime lacks transparency and accountability. Of course it is not up to civil society to rebuild, or to reconstruct the infrastructure. But if any cent has to go to the regime, then it must be given with conditionalities of transparency, accountability and due diligence. Civil society must be empowered to play a watchdog role. This means that CSOs must have the voice and the tools for monitoring. Otherwise nothing is going to change. International aid will vanish; it will only help the regime prolong its rule while the city remains in ruins.

  • LEBANON: ‘This election has brought to the forefront new voices speaking about rights’

    Lina Abou HabibCIVICUS speaks about the recent general elections in Lebanon with Lina Abou Habib, director of the Asfari Institute for Civil Society and Citizenship at the American University of Beirut.

    The Asfari Institute seeks to bridge academia and civil society activism. It does so through knowledge production, convenings and the creation of safe spaces for learning, dialogue and exchange. Located at the heart of the American University in Beirut, it functions as a regional hub for civil society working for diversity, inclusion, equality, accountability and sustainability.

    What change resulted from the 15 May general election?

    Despite taking place in an extremely complicated, uncertain and turbulent political and economic context, the process resulted in the election of many new independent candidates coming from civil society and calling for change. These new voices have political agendas that are very different from those of traditional ruling parties: they call for a new, more accountable governance system and for women’s rights, among other issues. These agendas include road maps for overcoming the ongoing deep economic crisis. And most importantly, they focus on how to stop the political race to the bottom that’s been happening in Lebanon.

    Most of the independent candidates who were elected are linked to the 17 October protests, the uprisings that took place in 2019, when people clearly said that they had enough of the political elite that had become – and continues to be – outrageously corrupt. The 17 October Revolution was a unique moment because protesters had such diverse, inclusive and feminist voices – feminist demands became an integral part of the political demands of the revolution. For instance, sexual harassment became a political issue because the voices of the LGBTQI+ community and migrant women domestic workers were also represented. No demand was compromised or put aside.

    By that time, it became clear to us what system of governance we aspired to. It must be based on equality, inclusion, diversity and respect for human rights. The revolution also gained momentum because the same thing was happening in Chile and other countries where people were rising up. Hence, I do not exaggerate when I say that the feminist voices of the 17 October Revolution inspired political participation in the 2022 election.

    It is important to note, however, that some independent members of the new parliament do not share the agenda of the 17 October Revolution and have quite regressive rhetoric. For instance, newly elected member of parliament Cynthia Zarazir called for the death of Syrian refugees on social media. Having people like her in parliament represents a new challenge. Aside from that, I would say that this election has brought to the forefront new voices speaking about rights and pointing the way forward out of the current crisis.

    How did the feminist movement work collectively in preparation for the election?

    There was rallying behind feminist candidates such as Zoya Jureidini Rouhana, who pushes for an compulsory egalitarian family law, a top priority for Lebanon’s feminist movement. Rouhana is the founder of KAFA (‘enough’) Violence and Exploitation, a feminist civil society organisation that was behind several legal reforms in Lebanon. Moreover, it champions political discourse on gender-based violence. Her electoral campaign was in line with that. It is a rare moment when you have a feminist candidate running on a feminist agenda in a general election – and this was partly possible thanks to the voices that became heard in October 2019. The political movement took shape and gained more feminist voices during those uprisings.

    Feminists mobilising around the elections forced candidates to state their position on gender equality, including the rights of the queer community. In return, independent candidates who sided with gender equality were attacked by the regime and conservative forces. One way for government officials and supporters to disparage and attack somebody is to say they are going to endanger the family. This is very unfortunate, but at the same time, it is fantastic that this important conversation is taking place in the public sphere and these issues are being discussed as part of the overall social and political dialogue.

    In sum, the inclusive and intersectional feminist movement of Lebanon has succeeded in elevating feminist discourse to the public and political arena. But there is still a long way to go: the new parliament includes only two additional female members compared to the previous one, as only eight women were elected, out of 115 candidates nominated by traditional parties, opposition groups, and civil society. These results are still lacking in terms of reaching a critical mass to exercise feminist influence in parliament.

    What’s next for the civil society movement following the election?

    The real battle is just about to begin. The election showed that change is possible, but it is still not enough. The next step for us is to figure out how we will hold independent members of parliament accountable. They must be accountable because they won as a result of our collective movement.

    We will still be facing a corrupt and oppressive regime and serious issues such as illegal arms and a heavily militarised society, economic downfall, destroyed livelihoods, broken public institutions and irresponsible and unaccountable policymaking. As such, civil society in its diversity, and especially the intersectional feminist movement, should remain vigilant.

    The conversation we started must continue, and we need our international allies to help keep it going, and certainly not be complicit with the regime. We have a collective responsibility to monitor human rights violations, talk to feminist activists and help amplify the voices of Lebanon’s intersectional young feminists.

  • Open appeal to UN Member States to ensure the adoption of a resolution creating an investigative mechanism on Afghanistan at the 48th session of the UN Human Rights Council

    We, the undersigned organisations, write to urge UN Member States to ensure the adoption of a robust resolution to establish a Fact-Finding Mission or similar independent investigative mechanism on Afghanistan as a matter of priority at the upcoming 48th regular session of the UN Human Rights Council (HRC).

    We express our profound regret at the failure of the recent HRC special session on Afghanistan to deliver a credible response to the escalating human rights crisis gripping the country. The adopted resolution falls far short of the consistent calls of the Afghanistan Independent Human Rights Commission (AIHRC), the UN High Commissioner for Human Rights, Special Procedures and civil society organisations, and does not live up to the mandate of the HRC to effectively address situations of violations of human rights, including gross and systematic violations. 

    A Fact-Finding Mission, or similar independent investigative mechanism, with a gender-responsive and multi-year mandate and resources to monitor and regularly report on, and to collect evidence of, human rights violations and abuses committed across the country by all parties is a critical component of the broader international response urgently needed to address the escalating human rights and humanitarian crisis in Afghanistan. Such a mechanism is crucial to ensure UN member states are fully informed of the situation on the ground as they take important decisions on how to respond to the crisis, how to help protect the rights and lives of the people of Afghanistan, and how to prevent further crimes. It is crucial to support the brave activists and human rights defenders, particularly women human rights defenders, who have continued their work at significant personal risk and have requested support and solidarity from the international community. It is also crucial as a means of taking one small step to addressing the accountability gap that fuels grave violations and abuses across the country, and to complement and support international and national work on accountability for crimes under international law. 

    The urgent need for such a mechanism could not have been made clearer throughout the negotiations, and at the opening of the special session. The AIHRC, the High Commissioner for Human Rights, the Special Procedures, the Ambassador of Afghanistan to the United Nations in Geneva, and a broad constellation of national, regional and international civil society organisations, have all made this call clearly and consistently. The High Commissioner for Human Rights stressed that while her Office was ready and willing to update the HRC regularly on the situation, it was critical for the HRC to take “bold and vigorous action, commensurate with the gravity of this crisis, by establishing a dedicated mechanism to closely monitor the evolving human rights situation in Afghanistan, including – in particular – the Taliban's implementation of its promises, with a focus on prevention.” To ignore these consistent appeals, and sit idly by and wait for further crimes to occur to take meaningful action, is an abdication of responsibility by the HRC. The people of Afghanistan are entitled to much better than this. 

    At the special session, UN Special Procedures recalled that the last 18 months “have been the deadliest civilian casualties recorded in Afghanistan in late history” and also reminded the Council of the fifth report of the UN Secretary General on Children and Armed Conflict in Afghanistan (S/2021/662 16 July 2021) documenting “that child casualties for the first half of 2021 constituted the highest number of children killed and maimed for this period ever recorded by the UN in Afghanistan, a situation compounded in the last few weeks.”   

    At this crucial moment for the people of Afghanistan, we are convinced that an independent investigative mechanism is the only credible means to address the human rights crisis in the country, advance accountability and deter further abuses. Although some states proposed the creation of a Special Rapporteur as a compromise during the special session, this would not be an adequate or appropriate response to a crisis of this magnitude for a number of reasons, including the lack of resources, limited capacity, and correspondingly narrower scope of such a mandate. We note that the special session resolution itself “stresses the need for transparent and prompt investigation into reports of all violations and abuses of human rights and violations of international humanitarian law, committed by all parties to the conflict, and to hold those responsible to account.” Clearly, the only credible way to give effect to this commitment is to create such a “transparent and prompt investigation.”

    We urge all UN Member States, to take urgent action to correct the HRC’s course, by ensuring a robust independent investigative mechanism is put in place when it meets for its 48th regular session in September. As noted by the Chairperson of the AIHRC in her opening address to the HRC, “Afghan activists on the ground, my colleagues on the ground, who face direct threats to their lives and the lives of their families, demand better, while they have everything to lose by putting this ask forward […] Many I speak to in Afghanistan already fear that they may not have a tomorrow. In our worst moment, we call on you to do better.”

    What is the current state of civic space in Palestine?

    Palestinians do not have their rights and freedoms recognised. Civic space is so narrow that anything we say regarding Israeli settler colonialism can cause us to go to prison. Administrative detention is frequently used: even though it is illegal according to international law, we have seen a number of people go to prison without any trial. Because of this, we have to be extremely careful about the kind of content we put up on our social media accounts, as it can be used against us in court.

    These restrictions also affect Palestinians living abroad. The majority find it difficult to return to their home country due to the restrictions.

    Recently Israel classified six organisations that advocate for children’s rights, women’s rights and Palestinian prisoners’ rights as terrorist organisations. As a result, their funding was cut and their staff members were sent to prison under administrative detention. People are being sent to prison without charges and remain there for years.

    Is there a shift towards digital activism in Palestine?

    People in Palestine have been using social media since its inception. However, Israel has tried to prevent Palestinians sharing their stories: on Facebook and Instagram, for instance, they censor anything related to Palestine. When we post sensitive images of people being beaten or shot, our social media accounts can get suspended for months and we risk going to jail. Even international human rights organisations have been censored for releasing videos of Israelis attacking Palestinians.

    But this has not stopped us showing the world our reality. The work I do includes making videos of the situations Palestinians face on a daily basis and sharing them on social media. With this I hope to raise awareness of what we are dealing with and show people we need urgent help.

    Palestinians have had to find innovative ways to inform the world about events happening in our country. For instance, to share information on social media about the situation without it being removed, we have changed the way we write ‘Palestine’: we write it as either ‘Pale Stine’ or ‘Pale@stine’ or ‘Isr@el’. It is still a challenge because when it comes to Palestine or Israeli violations international media are biased, but we have been able to reach a larger audience and keep them informed about our issues.

    Civil society also raises awareness about the terminology used – for example, so that people understand that what is happening between Israel and Palestine is not a war. It is our position that it is not just an occupation but also qualifies as colonialism. Indigenous people are being removed from their land to make way for Europeans to settle. Israel has claimed this is a religious war, which is not at all the case: people in Palestine face torture regardless of their religion. This is why as part of our advocacy work we share accurate information about the situation in our country.

    When trying to investigate the war crimes Israel has committed in Palestine, the United Nations has had difficulty accessing information and even entering the country. International human rights organisations face the same problem. So we try to contribute to their work by providing information about what is happening in Palestine.

    What kind of support do you need from the international community?

    The only thing that Palestinians need right now is peace. What has happened to us through the 74 years of Israeli occupation has been brutal. We have seen on many websites, including CIVICUS’s, that the prevailing narrative is in line with the one promoted by the United Nations and other international organisations, which is the one approved by Israel and the USA; that is totally wrong.

    We lived in Palestine before 1948. In the 19th century Jews started migrating to Palestine as refugees, and Palestinians hosted them. The British occupied Palestine in the early 1920s and until the late 1930s and early 1940s, during which time they helped non-Palestinian Jews to migrate to Palestine in mass numbers.

    Colonial powers of the global north have normalised murder and devastation in the global south. Those colonial regimes continue to strengthen their relations with Israel and in return they enhance their security and military capabilities. In Africa they are taking over natural resources, namely gas and oil, at bargain prices; this is in fact the reason why they deliberately never bring up African human rights issues in earnest.

  • PALESTINE: ‘The counter-terrorism law is used to restrict political work in Palestine & shrink civic space in Israel’

    CIVICUS speaks withEinat Fogel-Levin, International Advocacy Coordinator for the Human Rights Defenders Fund (HRDF), about growing restrictions on Palestinian civil society. HRDF is an Israeli civil society organisation (CSO) working to protect Palestinian and Israeli human rights defenders (HRDs) by providing legal aid and defence to those facing various forms of legal persecution and fending off attacks on their bodies, persons and work.

  • PALESTINE: ‘They label us antisemites or terrorists to silence us and paralyse our human rights work’

    NadimNashifCIVICUS speaks about civil society’s online activism against repression and oppression in Palestine with Nadim Nashif, executive director and co-founder of 7amleh: The Arab Center for the Advancement of Social Media.

    7amleh is a civil society organisation that advocates for Palestinian digital rights. With the aim of creating a safe, fair and free digital space for Palestinians, it researches digital rights, provides training to Palestinian activists and organisations and leads local and international advocacy campaigns.

    What is the focus of 7amleh’s work?

    We focus on digital rights and digital activism. Palestinian people have been living under occupation for the past seven decades. This kind of occupation obviously involves lots of violence, repression and oppression.

    As technology progressed and the internet became part of our lives, the same power relations were replicated in the online world. Palestinians live under siege from the Israeli government. This siege is not only physical; it has also migrated to the virtual world.

    There are frequent attempts to prevent Palestinians from exercising their freedom of expression online. This is done by pressuring companies to exclude Palestinians. For instance, many social media platforms are biased in their policy toward Palestinian content and many digital payment platforms don’t allow Palestinians to use them under various excuses due to Israel’s pressure. PayPal, for instance, is available to Israelis but not Palestinians. Palestinians’ freedom of expression is also limited because they can be arrested for what they post on social media. There’s an evident practice of discrimination against Palestinians.

    Our organisation is recording all these cases of restriction and documenting them to fight for the rights and freedoms of Palestinians.

    How have Palestinians worked around these restrictions to make themselves heard?

    The Palestinian identity is under attack. For instance, the Israeli army doesn’t let the Palestinian flag be raised. But Palestinians have tried to find creative ways to express their identity. For example, to represent their flag while not raising an actual flag, they have chosen to display the flag’s colours. These are the colours that can be found in watermelons, so they will instead draw a watermelon.

    Social media platforms use the available technology, their algorithms and search engines, to cooperate with the Israeli authorities by monitoring speech and deleting content when certain keywords come up. For example, Palestinian political movements are considered by Israel and the USA to be terrorist organisations, so their names are banned from social media. But digital activists are finding ways to write them that trick artificial intelligence, such as by adding full stops between letters. This is how they can still express themselves and find ways not to be banned entirely online. Those are some tactics Palestinians are using to refuse to play by the rules of those who want to limit them and tell them how to think, write and express their national identity.

    Digital activism is key. When you experience human rights violations on a daily basis, the camera becomes a tool of resistance. For many Palestinians, it is the only defence from soldiers and violent settlers attacking them constantly. In many cases, home evictions were prevented because they were livestreamed. That’s why the Israeli government initiated legislation to criminalise photography and video-making.

    Online global solidarity is also key, as shown by the 2021 case of the Sheikh Jarrah neighbourhood in East Jerusalem, in which online solidarity movements applied pressure to prevent house evictions. As a result, the Israeli government’s plan didn’t succeed.

    How have the authorities reacted to this activism?

    They have constantly tried to silence the Palestinian narrative and raise the Israeli one, by criminalising Palestinian activists and sending them to jail. There are cases in which you don’t even understand why someone is in jail.

    I remember the case of a young teenager from Jerusalem who posted on Facebook some phrases about Palestinians needing to go to Al-Aqsa Mosque to defend it from Israeli settlers. He spent one and a half years in jail because of this, which was not a call to violence at all. He just said, ‘Hey, this is our holy place, we need to protect it’. You can be sent to jail for saying something about protecting a place! This example is just one of many.

    The Israeli government is pushing many laws and regulations to be able to do this. One of them is the so-called ‘Facebook law’ it is trying to pass. Officially, it’s meant to help deal with harmful content. But it aims to grant Israeli courts the power to demand the removal of user-generated content on social media platforms that can be perceived as inflammatory or as harming the security of the state, people or the public. It is so vague that anything the Israeli authorities don’t like will be sent to the courts, without those affected being able to defend themselves. Using ‘secret evidence’, Israel can order companies to take down content they consider to be illegal. This would obviously be used exclusively against Palestinians.

    Many tactics of online repression are already being used, including lots of online brigading – coordinated actions by groups constantly reporting social media content to the Cyber Unit. Palestinians are under surveillance 24/7, especially on social media. Accounts are continually under surveillance and reported to social media companies. These companies are taking down almost 90 per cent of what the Israeli government asks them to.

    How can international civil society and the international community best support Palestinian civil society?

    I think they must take a firm stand when human rights violations happen. There’s an ongoing attempt to silence Palestinian civil society by labelling us as antisemites or terrorists. These accusations have profound effects: they aim to paralyse Palestinian civil society and prevent it recording human rights violations and atrocities – war crimes – committed against Palestinians.

    Internationally recognised Palestinian human rights organisations have been on the ground for more than four decades and have recorded everything. They clearly have nothing to do with terrorism or antisemitism – all they care about is human rights and democratic values. But many governments around the world fail to reject the accusations against them. Why?

    Any outstanding personality or activist standing up for Palestinians faces a smear campaign. We are trying to develop tools that help us deal with this, but it’s not simple. Palestine is not the only place where this is happening. We’ve seen shrinking civic space and civil society activists and organisations stigmatised as terrorists or terrorist supporters in many other countries in the global south, with many countries of the global north cooperating and supporting the regimes that oppress them.

    No human being would accept having their freedoms taken away without fighting back, as Palestinians do; it’s a natural human reaction. We hope allies and friends from global rights movements, political movements and civil society organisations will stand up for us and raise their voices on our behalf.

  • Request for support to free imprisoned HRD Dr Abduljalil AlSingace

    We, the undersigned human rights organisations, are writing to raise urgent concerns about Bahraini human rights defender Dr Abduljalil AlSingace, who has been on hunger strike since 8 July 2021, to protest the confiscation of his academic research on Bahraini culture. He turns 60 on 15 January 2022. He has been in prison for over a decade in violation of his freedom of expression and assembly rights.

  • SYRIA: ‘The pandemic added another layer to women’s diminished access to healthcare’

    CIVICUS speaks about the upcoming International Women’s Day and Syrian civil society’s role in eliminating gender inequality with Maria Al Abdeh, executive director of Women Now for Development (WND), a Syrian civil society organisation (CSO) aimed at fostering a democratic, free and just society in which women can play meaningful roles and reach their full potential.

    What impact has the COVID-19 pandemic had on women and girls in Syria?

    The pandemic has definitely had a disproportionate impact on Syrian women and girls. Champa Patel and I analyse these impacts in a recent paper, ‘COVID-19 and Women in Syria‘. Under the pandemic, women’s health issues were taken less seriously, especially those related to sexual and reproductive health, such as pregnancy. Women lost access to hospitals – access that was already diminished by war and displacement. The pandemic added another layer to women’s diminished access to healthcare services and facilities.

    We have also seen a huge psychosocial burden on the Syrian women we interviewed. Women spoke about the panic their children experienced when schools closed. In children’s minds, school closings are linked to bombings and displacement, so when schools closed yet again it triggered traumatic memories. Mothers had to calm their children and explain there were no bombs but there was now a new danger, the pandemic. Displaced women also reported on the traumatic impact of displacement on their mental health.

    Additionally, most interviewees told us that they were giving more tasks to girls than boys. But we found something interesting: during the first months of the pandemic, when fear was at its highest, Syrian girls were quite creative in finding ways to support their community, such as by organising activities for children in camps.

    Other women reported that it was challenging to keep their families healthy, which according to established gender roles is a woman’s job as a caregiver. The pandemic clearly took a toll on everyone, but as is also the case with violence and conflict, it had intersectional effects that made it worse for women.

    The pandemic worsened an economic situation that was already fragile. Eighty per cent of Syrians are below the poverty line and 60 per cent of households are led by women. As a result of the pandemic, an additional economic burden was placed on women’s shoulders. For the sake of their husbands and children, women are the last ones to eat, which has huge health consequences. Even those who do not live in camps usually have no way of storing food, so they can only afford food when the breadwinner brings money in every day.

    While the conflict in Syria may have already altered women’s roles in both family and society, the pandemic has reinforced an unjust gender divide.

    How has civil society, and WND more specifically, worked to support Syrian women during the pandemic?

    Civil society has supported women in many ways, from raising awareness to providing humanitarian aid and psychosocial support. Most of this support, however, was provided during the first year of the pandemic. As time passed, the pandemic itself stopped being a priority for Syrians, who instead focused on its economic impacts. Despite the growing death toll of the pandemic inside Syria, priorities changed.

    As for WND, our main areas of work are protection, empowerment, participation, research and advocacy. The research we conducted during the first months of the pandemic informed our programmes, which we modified to match the needs of Syrian women in the new context. As a result, we supported more small businesses led by women.

    We also reinforced our psychosocial support programme and we shifted our empowerment programmes online – which we had done before in response to bombings, but only for shorter periods. By shifting online, we were able to reach further. On the negative side, we lost personal contact with women, and could not reach the most vulnerable ones, who have no access to technology.

    What are the main women’s rights issues in Syria? What would need to happen for them to be effectively tackled?

    This is quite a difficult question. Rights, freedom and dignity are a very basic need for all Syrians, both women and men. But for women, there is a huge list of unfulfilled rights.

    The war has deepened inequalities and reinforced patterns of violence. Gendered impacts need to be taken into account in any discussion around accountability, justice or peace. This is why, as women and feminists, we are calling for transformative gender justice, which means addressing the root causes of harm and crimes to prevent their recurrence.

    Take for example enforced disappearances. This is huge issue in Syria, where more than 100,000 men and women – but mostly men - have forcibly disappeared. In addition to loss and psychological pain, many women have had to deal with an unjust law that deprives them of custody of their children or access to their husband’s property. Many women whose husbands had gone missing told us that education was their biggest need, as they had to take care of the whole family by themselves and were not well prepared.

    Another example is the condition of female detainees. Some have been killed by their families after getting out of detention centres because they were viewed as ‘dishonoured’ for being raped. Instead of being considered victims, they were treated as sinners. 

    But our basic rights won’t be realised as long as the Syrian regime remains in power. The pandemic was just another indicator that the Syrian regime doesn’t care about its people, who were left on their own, without even basic medical care.

    For gender inequality to be tackled effectively, the war needs to end and criminals mustn’t be allowed to take over the country. We need the kind of peace that brings democracy and accountability. Unfortunately, crimes and human rights abuses are currently being committed not only by the Syrian regime, but by other parties in the conflict as well.

    So-called ‘honour crimes’ against women are on the rise because the violence and impunity of war have started to take root in society. The Syrian authorities couldn’t care less about tackling these violations. The gender impact of war is not even considered and women’s perspectives are not taken seriously at any level. That’s why WND works so hard to highlight the impact of conflict and displacement on women as well as their perspectives through a feminist lens, and insists on the importance of including women at all levels of decision-making. 

    The International Women’s Day (IWD) theme for 2022 is #BreakTheBias. How are you organising around it in the communities you work with?

    For this year, WND has decided to celebrate our success following years of war and the pandemic. This IWD, our organisation’s focus will be on shedding light on acts of solidarity by Syrian women’s CSOs, as a feminist approach to empower women, claim space and fight violence.

    On 11 March we will hold an online seminar, ‘The Power to Change: Women and Feminist Organisations as Transformative Actors in Syria’, which will revolve around the findings of a report recently published by WND, Global Fund for Women and Impact.

  • SYRIA: ‘We spread the culture of human rights in a country with one of the world’s worst human rights records’

    FadelAbdulGhany.pngCIVICUS speaks about Syria’s ongoing civil war and human rights crisis and its prospects for democratic change with Fadel Abdul Ghany, founder and Executive Director of the Syrian Network for Human Rights (SNHR).

    Founded in 2011, SNHR is a human rights civil society organisation (CSO) that works to monitor and document human rights violations, protect victims’ rights and hold perpetrators accountable, promoting the conditions for transitional justice and democratic change.

    What is the current security situation in Syria?

    We have a team of approximately 22 people in Syria that daily monitors and documents human rights violations, including extrajudicial killings, arbitrary arrests, enforced disappearances, torture and forced displacement. We have published daily reports on the civilian death toll for a decade. In September 2023, 55 civilians, including 12 children, were killed. Ninety-seven were killed in August, 55 in July and 42 in June. In the first half of 2023, 501 civilians lost their lives due to the ongoing conflict. Our monthly reports also cover arbitrary arrests, with 223 cases reported in August and 204 in September.

    We document crimes committed by all armed groups involved in the conflict, categorising them by perpetrator. From March 2011 to June 2023, a total of 230,465 civilian deaths were reported, with over 87 per cent attributed to Syrian regime forces and Iranian militias, three per cent to Russian forces and two per cent to ISIS. Based on our reporting and news of grave and pervasive violations no territory in Syria can be considered safe or secure.

    What are the working conditions for your colleagues in Syria?

    We consider ourselves on the frontline because we document violations on the ground and identify perpetrators. Our team operates discreetly in Syria, either from the office or from their homes using fantasy names. We safeguard their identities for security reasons. Their safety is more important than any documentation.

    Our team faces intense pressure, and if arbitrarily arrested, they risk severe torture by the regime led by Bashar al-Assad or other parties. We do our best to protect and provide security education to our staff. Our IT infrastructure is highly secure, and we’ve implemented measures to thwart cyber-attacks, which have included Russian attempts to hack our website.

    What’s the situation for Syrian refugees?

    Many Syrians aren’t safe in other countries either. In Lebanon and Turkey, refugees face the risk of forced return to Syria in violation of international law, specifically the 1951 Refugee Convention. Conditions are dire, with Syrians often blamed for economic hardship in host countries, even though Lebanon and Turkey receive substantial funding from the European Union and other donors to welcome refugees.

    The feeling of insecurity and lack of proper protection in neighbouring countries, which host over 70 per cent of refugees, drive Syrians towards-called ‘death boats’ to seek safety elsewhere in Europe. The international community should better distribute the responsibility of welcoming refugees, because the current allocation isn’t fair.

    What should the international community do to address Syria’s dire human rights and humanitarian situation?

    The international community must intensify efforts to achieve a political transition and end Syria’s 13-year-long conflict, which is taking a lot of lives and causing immense suffering, with widespread torture and forced displacement of half the Syrian population. Any prospect of political transition has been absent due to insufficient international pressure on all parties in the conflict, and particularly on the Assad regime, leaving the Syrian people and the conflict largely neglected.

    The international community must actively support efforts to fight impunity. The Assad regime has got away with numerous war crimes and crimes against humanity. There should be a collective effort to bring justice. If accountability is to be achieved, it also requires a political transition leading to the establishment of independent local courts.

    Chinese and Russian veto power at the United Nations Security Council obstructs the referral of war crimes to the International Criminal Court. With limited universal jurisdiction, only 27 sentences have been issued in Germany and other countries against Syrian war criminals, mostly from non-state terrorist groups such as Al-Nusra or ISIS.

    True accountability requires dismantling the Assad regime, the Syrian National Army, the Syrian Democratic Forces, the Islamist organisation of Hay’at Tahrir al-Sham and other non-elected entities ruling Syria through fear.

    Aid should be directed to people affected by the recent earthquake and those displaced in northwest and northeast Syria. Continuous assistance is also vital for Middle Eastern states hosting most Syrian refugees. Such comprehensive support on a large scale is essential for advancing the Syrian movement toward democracy.

    How is Syrian civil society working for a transition to democracy?

    Syrian civil society continues to protest to demand respect for human rights, investigates rights violations and expose perpetrators based on the principle of equality and promote human rights through education. We work hard to spread the culture of human rights in a country with one of the world’s worst human rights records and to get rid of a decades-long dictatorship.

    SNHR publishes reports and statements urging a halt to violations and providing recommendations to other states. We conduct in-depth bilateral meetings with various foreign ministries, including those of France, Germany, the Netherlands, the UK and the USA, and convene other high-level meetings. We actively participate in and organise advocacy events. The most recent, held on 21 September, focused on human rights violations and avenues for accountability and was co-hosted by the USA and co-sponsored by France, Germany, Qatar and the UK.

    I believe the international community should also provide substantial financial and logistical support to active Syrian CSOs that have played a significant role in the Syrian civil war and have, to some extent, replaced the state.

    What has triggered recent protests across Syria?

    Since early August, many regime-controlled areas of Syria have witnessed peaceful civil demonstrations. People took to the streets because they felt even more hopeless following Assad’s interview with Sky News Arabia on 9 August. He didn’t apologise nor did he express any willingness to change the way he’s ruling the country. Instead, he said that if he could go back to 2011, he would kill even more people than he did.

    There are ongoing protests in areas of northern Syria that aren’t controlled by the regime. Protesters seek to hold the Syrian regime responsible for the worsening economic, social and political conditions. Their calls echo those of the 2011 Arab Spring: they demand an end to family rule and a transition to democracy, freedom of speech, the release of illegally detained people and accountability for perpetrators. Their major message is that Assad must go.

    We have monitored and documented multiple vicious methods used by the regime’s security forces to suppress protests, including arrest, torture, enforced disappearances and prosecution of hundreds of protesters. The regime uses its media outlets to slander protesters or anyone criticising it as traitors or collaborators working with foreign entities. The Syrian regime has also attempted to stage counter-demonstrations with loyalists chanting pro-regime slogans and threatening anyone opposing the regime.

  • The Council must address arbitrary detention of human rights defenders

    Statement at the 48th Session of the UN Human Rights Council

    Thank you, Madame President.

    No one should be arbitrarily detained simply for peacefully protecting equality, freedom and justice for all. But worldwide, people are in prison for standing up for their rights and for the rights of their communities.

    Teresita Naul is a human rights defender who dedicated her life to protecting the poorest and the most marginalised. She is detained in the Philippines under spurious charges. Teresita’s case is illustrative of how the Philippines has repeatedly criminalised the work of human rights defenders.

    Sudha Bharadwaj is a human rights lawyer, and one of many human rights defenders charged and detained in India under the Unlawful Activities Prevention Act. This is a clear example of a case in which the use of vague and overly broad national security and anti-terrorism provisions has given authorities wide discretion to criminalise peaceful activities, a tactic highlighted by the Working Group on Arbitrary Detention.

    María Esperanza Sánchez García is human rights defender detained in Nicaragua, where false charges have been used as a strategy to criminalise activists and defenders to deny them status of political prisoner, and arbitrary detention used as a tactic to dismantle the political opposition.

    Abdulhadi Al-Khawaja, Co-Founder of the Gulf Centre for Human Rights, has spent a decade arbitrarily detained in Bahrain. This year he turned 60 in prison, separated from family and friends.

    Human rights defenders are critical to the functioning of the Council’s mandate. We call on the Council to ensure that States who routinely practice arbitrary detention of human rights defenders are held to account and to ensure that human rights defenders are protected and can continue their vital work.

  • TURKEY: ‘Civilian refugees should not be used as political bargaining chips’

    Bassam AlahmadCIVICUS speaks with Bassam Alahmad, co-founder and executive director of Syrians for Truth and Justice (STJ), about the Turkish plan to return one million refugees to Syria.

    STJ is a civil society organisation (CSO) dedicated to documenting human rights violations to contribute to the prospects for justice, as well as training human rights activists and building capacity in areas including digital security and civic engagement.

    Why is the Turkish government making plans to return a million Syrian refugees to Syria?

    We do not know the exact reason behind the plan to return a million Syrians to Turkish-administered regions of Syria. But there are several possible reasons we can think of. First, Turkey will hold general elections next year, and every time elections approach, the ruling Justice and Development Party will try to draw attention outside Turkey in any way possible – by attacking other nations, creating problems with neighbouring countries or groups of people – to hide domestic failures.

    Second, the decision may be part of a wider strategy by the Turkish government concerning its engagement with northeast and northwest Syria, which aims to decrease the presence of Kurds and other populations who it doesn’t view as ‘Turkey’s allies’ – people that Turkey does not like having at its borders. To achieve this, Turkey will make claims that these populations are ‘terrorists’.

    The decision announced to return a million Syrians from Turkey back to Syria therefore hits two birds with one stone. It would allow the Turkish government to show its domestic opposition that it is tackling the ‘problem’ while also using Syrians against Syrians in the northeast and northwest parts of Syria.

    To sum up, there is no specific reason we know of, but we can assume that demographic engineering in northeast and northwest Syria and Turkey’s domestic politics are all at play.

    How has this announcement impacted on Syrian refugees in Turkey?

    This policy has really affected Syrian refugees in Turkey. Every single day there is at least one case of assault against a Syrian person – sometimes more. Incidents of racism and cases of deportation and violence at the border, and even of murder, have been verified. Hundreds of organisations and media outlets have verified racist attacks against Syrians.

    Why are these attacks happening? Because the Turkish government is telling people that it has already spent too much on Syrians, and Turkish citizens are resenting it. The Turkish government is also telling people that it has freed areas in Syria from terrorists and they are now safe for return, so Turkish citizens are increasingly putting pressure on Syrian refugees to leave. Turkish public opinion turning against Syrians makes them vulnerable to racism and deportation.

    The discourse that Turkish president Recep Tayyip Erdoğan is disseminating is affecting Syrian refugees very negatively. And the problem is that it is not true. The United Nations, the Independent International Commission of Inquiry on the Syrian Arab Republic, Amnesty International and many others have all said that Syria is not safe.

    How do you assess Turkey’s immigration policy?

    Many countries and organisations say that Turkey should be thanked for its treatment of Syrian refugees; however, Turkey’s 2016 agreement with the European Union was a really bad one, because as a result Syrian refugees were trapped or detained in Turkey so that the Turkish government could receive money for hosting them.

    Syrian refugees and asylum seekers have been used as political game pieces ever since. Following this agreement, in which Europeans agreed to pay money to Turkey to keep Syrians from advancing through Greece and further into Europe, there have been multiple instances of disagreements between Europe and Turkey leading to threats against refugees.

    This is not good. You can’t keep using civilian refugees as political bargaining chips, using them against Turkey, or against the Kurds in northeast and northwest Syria, or against the Americans in northeast Syria. But the 2016 agreement gave the Turkey government leverage to use refugees as a political card, and they have used it. And by the way, Turkey is not the only country using refugees this way, and Syrian refugees are not the only refugees who have been used. Afghan, Iraqi and other refugees have had similar experiences, but this is especially true for Syrian refugees.

    Do you think the attitude of the Turkish government points to a broader European pattern?

    Of course, the Turkish refugee policy has a lot in common with refugee policies around the world. I do not want to say that all European governments treat refugees the same way as the Turkish government, but occasionally there are similarities.

    In particular, we all saw how European governments treated Ukrainian refugees – this was good. But they don’t treat Syrian refugees the same way. European countries gave Turkey money to keep Syrian refugees in Turkey, while they opened their doors to Ukrainian refugees.

    We do not want to paint all the Turkish and European politicians and policies with the same brush, but there are patterns of racist refugee policies and racist attacks against refugees that are important to recognise.

    How has Syrian civil society responded to the announcement by the Turkish government?

    Unfortunately, the civil society response has not been unified. Many Syrian CSOs that do not have employees or offices in Turkey have published reports about this plan; however, Syrian CSOs in Turkey have not been able to speak out, for a number of reasons. In some cases, organisations are politically aligned with Turkey and welcome these policies. But many others want to speak out against these policies – the racism, the deportations, the military actions against Syrians within Syria – but they are unable to for security reasons.

    In other words, some people don’t want to speak up because they are essentially in agreement with Turkish policies, while others would want to but cannot because it is dangerous, as they are in Turkey, where speaking out may result in deportation or arrest. There are also some Turkish organisations that address these issues, but many do not have the interests of Syrian refugees in mind.

    It is key for Turkish organisations to speak out and insist that Syria is not safe for refugees to return. There has been limited discussion about Turkey’s rights violations against Syrians, and this should not be the case. Both domestic and international civil society should speak out against violations occurring in Turkey and committed by Turkey.

  • UAE: ‘Many leaders remain silent in the face of systematic human rights abuses’

    Kristina StockwoodCIVICUS speaks with Kristina Stockwood of the Gulf Centre for Human Rights (GCHR) about the current state of civic space in the United Arab Emirates (UAE) and the government’s efforts to improve its international reputation by holding theExpo 2020 event in Dubai.

    GCHR is a civil society organisation (CSO) that provides support and protection to human rights defenders in order to promote human rights, including the rights to the freedoms of association, peaceful assembly and expression.

    What is the current state of civic freedoms in the UAE?

    A dominant thread throughout GCHR’s coverage of the UAE is the stark difference between the progressive and forward-thinking image the UAE projects on the international stage and its despicable treatment of human rights defenders (HRDs) and others in civil society. Every single HRD active in the UAE has been imprisoned or driven into exile in violation of their right to the freedom of expression. The UAE cracks downs systematically on critical and independent voices who advocate for human rights in the country, both online and offline.

    As GCHR shows in a recent report, the UAE authorities rely on torture to consolidate this oppressive climate. Key emerging patterns are the use of enforced disappearances following arbitrary arrest, detention to perpetrate torture with impunity, the punishment and further torture of those who dare to speak out about their conditions of detention, and the complicity of companies and the international community in the systematic perpetration of torture in the UAE. 

    The UAE also continues to persecute HRDs in exile. In 2021, the UAE cabinet issued ministerial resolution 83, which added 38 people – including several HRDs and a researcher – and 13 entities to the government’s terror list. Also in 2021, it was revealed that one of the targets of surveillance under the Pegasus Project was Alaa Al-Siddiq, an Emirati activist and the executive director of ALQST for Human Rights, who was killed in a traffic accident in the UK in June 2021, where she had relocated to flee persecution.

    Al-Siddiq’s father is one of the UAE94 – a group of prominent HRDs, judges, academics and students convicted and imprisoned following a trial that lacked the most basic international standards of fair trial and due process. They are due for release after 10 years in prison in 2022, but human rights groups fear that high-profile prisoners won’t recover their freedom, as the UAE uses so-called ‘Munasaha (rehabilitation) centres’ to keep prisoners locked up past the end of their sentences.

    How is GCHR working to expose these human rights violations?

    Exposing these human rights violations has been at the heart of GCHR’s work. We monitor the situation on the ground, produce reports, advocate internationally and campaign for the release of HRDs.

    In January 2022, together with Human Rights Watch, we issued an urgent appeal to help Ahmed Mansoor, who is on GCHR’s Advisory Board. Mansoor was detained in March 2017 and for years has been held incommunicado, isolated from other prisoners, denied even a bed and mattress. After he wrote a prison letter that was published by regional media in July 2021, in which he detailed his flagrantly unfair trial and mistreatment in detention, the authorities retaliated against him by moving him to a smaller and more isolated cell, denying him access to critical medical care and confiscating his reading glasses.

    In January 2022, along with several other CSOs led by MENA Rights Group we issued a joint appeal protesting against the UAE’s new Law on Combating Rumours and Cybercrime, which restricts civic space and free speech and criminalises acts that are protected under international law. We called on the UAE to immediately repeal or amend the law.

    How is the UAE using Expo 2020 to divert attention and improve its international reputation?

    Throughout the Expo, which started in October 2021 and ends on 31 March 2022, the UAE has made an effort to whitewash its image, projecting a country of tolerance that even promotes women’s rights. To that effect, a women’s pavilion was included at the Expo and Forbes held a big event for women.

    The Women’s Pavilion at the Expo is designed to ‘reaffirm Expo’s commitment to gender equality and women’s empowerment’. But women in the UAE have no rights and no power, and have been imprisoned for their online activities. The head of the Expo himself is a prominent perpetrator of violence against women. In 2020, a British woman who was organising the Hay Festival in the UAE, Caitlin May McNamara, was assaulted by Sheikh Nahyan bin Mubarak Al Nahyan, commissioner-general of the Expo and Minister of Tolerance and Coexistence, after being lured to this residence on the false pretences that they would talk about the situation of Ahmed Mansoor.

    Needless to say, not a single UAE HRD was invited to the Expo, an event whose organisers claim has the purpose of creating ‘a better tomorrow’ because that is what happens ‘when the world comes together’, as its slogan goes.

    To what extent has the exposure of violations of the rights Expo 2020’s migrant workers challenged the UAE’s public relations machine?

    The work of human rights groups to expose violations of the human rights of migrant workers building venues has been key regarding large events in the Gulf countries, such as the Dubai Expo and the World Cup 2022, which will be held in Qatar.

    Migrant workers in the Gulf are subjected to massive human rights violations through the notorious kafala (sponsorship) system that strips them of their basic rights. Under this system, they have no right to move, travel or change work. They have little access to healthcare and no right to union representation or to form organisations. They are also denied the right to citizenship, even if they spend their whole lives working in these countries.

    However, the plight of migrant workers has received more attention in Qatar than in the UAE, as the UAE uses its large PR machine to gloss over human rights violations.

    The COVID-19 pandemic complicated things, as many low-wage migrant workers remained acutely vulnerable to infection. To make things worse, in late March 2020, the Ministry of Human Resources and Emiratisation issued an arbitrary and discriminatory decree allowing private companies to amend the contracts of migrant workers, put them on unpaid leave or force them to accept permanent or temporary salary reductions due to the spread of COVID-19. In April 2020, a letter sent by a coalition of 16 CSOs and trade unions called on the authorities to provide migrant workers with adequate protection during the COVID-19 pandemic.

    How is civil society taking advantage of global media attention around Expo 2020 to advocate for human rights?

    In October 2021, GCHR and over two dozen partners, including two Emirati CSOs which operate in exile – the International Campaign for Freedom in the UAE (ICFUAE) and the Emirates Detainees Advocacy Centre – organised the online Alternative Human Rights Expo to counter the narrative of tolerance promoted by Emirati authorities. The three themes of the Dubai Expo are mobility, sustainability and opportunity – none of which is freely available to HRDs in the region. We argued that ‘coming together to hear diverse voices’ and ‘create a better world’ is not something attainable in a place where people are locked up for speaking their minds.

    At the Alternative Human Rights Expo’s main event, held online on 14 October 2021, over 25 human rights groups paid tribute to human rights defenders from the UAE and called for their release during the Dubai Expo. The event, hosted by GCHR’s Women HRDs Programme Manager, Weaam Yousef, and prominent activist Iyad El-Baghdadi, featured HRDs, poets, artists, musicians, writers and filmmakers from a dozen countries in the Middle East and North Africa and beyond. The aim of the event was to highlight the work of creative talents from the region, as well as that of imprisoned activists, whose work was read during the event. These included Ahmed Mansoor in the UAE as well as Abdulhadi Al-Khawaja in Bahrain, Alaa Abd El-Fattah and Sanaa Seif in Egypt and Golrokh Ebrahimi Iraee in Iran. Of those, Sanaa Seif was freed in December. Over 900 people participated or watched the event.

    As part of that campaign, GCHR and 80 international CSOs delivered a letter to the UAE embassies in Geneva and London calling for activists imprisoned in the UAE to be freed, and for justice for women who have been abused in prison or at the hands of Emirati authorities. The letter, which highlights the case of Ahmed Mansoor, was delivered on Ahmed’s 52nd birthday. Those present at the embassy also filmed a birthday video for him.

    Additionally, on 8 March 2022, International Women’s Day, GCHR co-sponsored an event with the European Centre for Democracy & Human Rights, ICFUAE and ALQST titled ‘Women’s Solidarity in Human Rights Activism: Storytelling from the Arab Peninsula’, where Emirati HRD Jenan Al-Marzooqi spoke of the persecution of herself and her family that forced her to flee the country. Other prominent WHRDs from Saudi Arabia, Oman and Yemen also told their stories.

    On 8 March, GCHR also published a press release in the context of our campaign calling on governments in the region, including the UAE, to ‘take serious measures to end the use of sexual and gender-based violence, curb online harassment of women, stop the use of surveillance to persecute women HRDs, stop reprisals against them and their families, and remove travel bans among other restrictions’.

    ICFUAE and GCHR also created a petition calling on the UAE government to release Emirati HRDs who are arbitrarily detained and serving lengthy sentences simply for their human rights activities. We will deliver the signatures to the UAE authorities at the end of the Expo, and this will be a powerful message that Emirati defenders matter to people around the world.

    What should international civil society do to help bring these issues into the global agenda?

    Many CSOs have reported on the human rights violations happening in the UAE, yet many global leaders remain silent, at least in public, sometimes suggesting that they raise human rights violations behind the scenes. This includes government allies of the UAE and companies that hold events in the UAE. 

    Following successful civil society advocacy, in September 2021 the European Parliament adopted a wide-ranging resolution calling for the immediate and unconditional release of Ahmed Mansoor and others in the same situation, including Mohammed Al-Roken and Nasser bin Ghaith, and all other HRDs, political activists and peaceful dissidents, and urging all European Union member states to suspend the sale and export of surveillance technology to the UAE.

    On 15 March, 27 CSOs led by the Bahrain Institute for Rights and Democracy wrote a joint letter to Formula 1 (F1) CEO Stefano Domenicali to raise human rights concerns ahead of the Bahrain Grand Prix, held on 20 March. They praised F1’s cancellation of its race in Russia but condemned the company for creating a ‘clear double standard’ over the participation of three race venues – Bahrain, Saudi Arabia and the UAE – in the war in Yemen. They called on F1 to use its platform to secure redress for victims whose abuse was connected to their races and review their policy on racing in Gulf states considering their participation in the war in Yemen, among other recommendations.

    It is important for international civil society to continue to raise concerns about the UAE’s human rights record, both inside the country and in relation to the war in Yemen.

  • YEMEN: ‘We are caught in limbo, neither at war nor at peace, with state institutions nearly collapsed’

    RadhyaAlmutawakelCIVICUS speaks about Yemen’s ongoing conflict and humanitarian crisis withRadhya Almutawakel, co-founder and chairperson of Mwatana for Human Rights (Mwatana).

    Founded in 2007, Mwatana is a Yemeni civil society organisation (CSO) that advocates for humanrights, documentsviolations, creates awareness and provides legal support to victims.

    What’s the current situation in Yemen, and what are the prospects of the conflict being resolved in the near future?

    First, it’s crucial to note that the conflict in Yemen goes beyond a mere civil war, as it spans three distinct dimensions: local, regional and international. It started in 2014 when the Ansar Allah (Houthi) armed group seized control of Sana’a, the capital, and escalated with the intervention of a Saudi-led coalition in 2015. The ongoing conflict has been marked by relentless intensity and violations of international humanitarian law such as aggressive actions targeting civilians and critical infrastructure, resulting in what is now recognised as the world’s most severe humanitarian crisis.

    Since the ceasefire agreement in April 2022, direct military operations have ceased, providing temporary relief for civilians. While movement between specific Yemeni governorates and cities has improved, the country is caught in a state of limbo, neither at war nor at peace, grappling with the near-total collapse of state institutions. A significant proportion of public sector workers hasn’t been paid their salaries since 2016. Various armed groups control extensive territories, exacerbating the severe economic crisis and food insecurity. These are the primary challenges in Yemen’s humanitarian crisis.

    Despite the ceasefire, numerous human rights violations continue to be perpetrated by various parties to the conflict. Since late 2022, Oman has mediated the ongoing negotiations between the Houthi group and Saudi Arabia. Throughout 2023, reciprocal visits between both parties have taken place in Sana’a and the Saudi capital Riyadh with recent reports suggesting progress in negotiations that may lead to the resolution of this decade-long conflict.

    How has the war impacted on civilians?

    Throughout the years-long war, civilians in Yemen have faced two types of profound impacts. First, as direct victims. Thousands of civilians have been killed and many more have been injured. Civilian infrastructure has been destroyed, including schools, hospitals, bridges, historical and archaeological sites, farms, water and food sources and civil service structures.

    People have also been indirect victims: as the economy collapsed, hundreds of thousands lost their sources of income. Parties to the war enforced widespread starvation, landmines were planted, thousands of children were recruited to fight and public freedoms gained over decades of pre-war struggle, including women’s rights, have regressed. Minorities have faced persecution, and the conflict has had extensive economic, social and political ramifications.

    What role has Yemeni civil society, including Mwatana, played since the beginning of the conflict?

    Yemeni CSOs have been crucial partners of international institutions in implementing humanitarian response plans across different regions during years of conflict. Their programmes and interventions have addressed the needs of many vulnerable groups, bridging gaps deepened by the war.

    Both local and international civil society have successfully reshaped the global narrative of the war, shifting the focus from the perspectives of conflict parties to amplifying the voices of victims and shedding light on the humanitarian and human rights tragedy. They’ve actively advocated for the establishment of an international mechanism to investigate violations committed by all parties to the war. Human rights organisations have monitored and documented violations and advocated for criminal accountability.

    Mwatana for Human Rights monitors and documents human rights violations in Yemen through extensive field investigative research aimed at gathering precise information, evidence and testimonies to establish the facts and the identities of victims and perpetrators. We also provide legal support to victims of arbitrary detention, enforced disappearances and torture.

    We are currently documenting the plight of refugees and internally displaced people and the violations they’ve endured from various conflict parties. The challenges faced by hundreds of thousands of refugees in temporary shelters underline the critical need for peace efforts to prioritise the safe return of forcibly displaced people to their homes and communities.

    Mwatana’s mission extends to raising awareness and fostering a culture supportive of human rights through positive engagement with the public on social media platforms. We are actively involved in constructive dialogue with influential stakeholders to address the human rights challenges in Yemen through local and international advocacy mechanisms.

    How is Mwatana working to hold perpetrators accountable?

    We have a specialised unit dedicated to seeking justice, reparations and accountability for victims of rights violations. The judicial system has structural, technical and integrity challenges, including corruption and inability to ensure fair trials. As a result, civilian victims have endured widespread impunity.

    Even though Yemen isn’t a party to the Rome Statute and therefore falls outside the jurisdiction of the International Criminal Court (ICC), Mwatana has been gathering evidence to ensure justice for all victims and accountability for all violators.

    First, we conduct comprehensive research and organise workshops and meetings with legal experts, academic institutions and experienced entities to explore available avenues for holding perpetrators accountable, including through international and United Nations (UN) mechanisms and the limited investigative procedures initiated by the conflict parties.

    Second, we collaborate with the international community to enhance accountability within international legal frameworks. Along with the European Center for Constitutional and Human Rights (ECCHR) and other partners, Mwatana submitted a file to the ICC. Further, in collaboration with the ECCHR and the Italian Network for Peace and Disarmament, we filed a complaint with the Italian Prosecutor and the European Court of Human Rights. Additionally, in coordination with Amnesty International, the ECCHR and Sherpa, we submitted a file to the French prosecutor. We also filed a legal intervention in the administrative case brought by the Campaign Against Arms Trade before the British judiciary. There are ongoing efforts to build cases in other countries.

    Third, we’ve actively engaged with UN mechanisms through the submission of shadow reports on Yemen and Saudi Arabia to the UN Human Rights Council Universal Periodic Review process and UN treaty bodies, namely the UN Committee on Economic, Social and Cultural Rights and the Committee Against Torture. We also provide written and oral briefings to various UN Special Rapporteurs and special procedures mandate holders.

    Finally, we undertake a range of actions to directly pressure violating parties and relevant bodies. We conduct workshops and discussions on accountability, reparations and truth-telling, drawing upon experiences from other countries. We have released a report on reparation mechanisms, and we plan to issue another in 2024 on viable criminal accountability options. These aim to establish informed foundations for future transitional justice in Yemen.

    What should the international community do to address the crisis and support Yemeni civil society?

    The international community’s response to the Yemen crisis has been weak and restricted due to conflicting interests with the involved parties, ranging from economic concerns and political alliances to arms trade deals. As a result, the conflict and numerous rights violations persist without any robust international action being taken. To address this, the international community must intensify efforts for a human-rights-secure settlement, enhancing the role of civil society and upholding the rule of law, justice and mechanisms for a transition to democracy.

    This requires the allocation of larger resources for civil society programmes and expansion of CSOs’ activities to extend their sphere of influence. Increased financial support is also needed to build capacity and ensure the continuity of CSO operations. It’s crucial that substantial resources are invested to support the work of local civil society in the upcoming period so that we are able to contribute to peace efforts effectively.

    Beyond financial aid, it’s important to endorse the work of Yemeni CSOs on the ground. The international community should exert pressure on all conflict parties to remove any impediments that hinder the efforts of CSOs, such as annual work permit barriers. Standing by civil society while it’s facing retaliation, defamation and smear campaigns for its work and stances is an essential part of expressing international solidarity.
