ERITREA: ‘When the government reacts to our work, we know what we do is making an impact’
CIVICUS speaks with about civil society work in Eritrea’s context of closed civic space with Helen Kidan, chairperson of the Eritrean Movement for Democracy and Human Rights (EMDHR).
Founded in 2003 and based in South Africa, EMDHR is a civil society organisation (CSO) that raises awareness about the lack of civil and democratic freedoms and promotes the rule of law, human rights and democracy in Eritrea.
What’s the situation for civil society in Eritrea?
Eritrea has never truly implemented its 1997 Constitution and until Eritrea it is run by the rule of law, human rights abuses will continue with no recourse to justice. This includes completely closed civil society space, with no semblance of rights of association, assembly and expression.
Since Proclamation No. 145 of 2005 went into effect nearly two decades ago, there has been no independent civil society in Eritrea. According to this law, the only way CSOs can implement programmes is in partnership with government agencies, which restrict the areas, themes and focus of the projects that can be implemented. There are obviously very few CSOs present and active in Eritrea.
The only way to start creating any space for independent CSOs in Eritrea would be to have Proclamation 145/2005 revoked.
What is EMDHR doing to try to improve the situation?
EMDHR advocates against the ongoing human rights abuses in Eritrea as well as for the rights of Eritrean refugees in the diaspora. Our mission is to promote and defend human right values as established in international legal instruments and advance democratic change, rule of law and constitutionalism in Eritrea, with the ultimate aim of building a society in which people exercise their basic rights and live in peace, dignity and prosperity.
We provide training, sustain networks and produce and disseminate information to create awareness of the situation of Eritreans. We have made several presentations at the United Nations (UN) Human Rights Council in Geneva, and in July 2022 we made a presentation at the UN in New York.
We are currently working with African CSOs to bring the ongoing crisis in Eritrea to the African level and get support for Eritrean refugees. We have also commissioned a report on the state of Eritrean CSOs that makes recommendations to the international community.
In early September 2023 we co-organised the Africa Civil Society Organisations Summit held in Arusha, Tanzania. Through a joint project with Africa Monitors, Eritrean Satellite Television and Eritrean Diaspora for East Africa, a CSO based in Kenya, we have provided training to Eritrean human rights activists, including on digital activism, and created a space for Eritrean CSOs and activists to be able to work together.
In 2019 we provided in-person training in a workshop held in Uganda. In 2017 we co-organised a conference in Brussels on the ongoing Eritrean refugee crisis, with which we tried to elicit a reaction from members of the European Parliament, commissioners and CSOs from across Europe. And in 2015 we campaigned and got asylum for Eritrean footballers in Botswana.
What’s it like to be a diaspora activist? How do you connect with activists within Eritrea?
It’s extremely frustrating because it makes our work less effective. Connecting with people inside Eritrea is very hard as internet penetration in Eritrea is only two per cent. The government basically controls all media: all independent media ceased to exist in 2001. This is why most information is brought to us by people who have recently left the country. But while the work is challenging, it is still possible to get information. And when the government reacts to our work, we know what we do is making an impact.
A lot of funders provide funds to African organisations only when they operate in their home country. The fact that we are not able to operate inside Eritrea means we also suffer financially and hence a lot of Eritrean CSOs are forced to sustain themselves on the basis of voluntary work.
Additionally, the work remains emotionally and psychologically draining, as many Eritrean activists in the diaspora are threatened with harm to family members still living in Eritrea for speaking out against the regime back home.
As Eritrean human rights defenders, even if you are operating outside the country, the government will always discredit your work. All those that don’t agree with them are seen as traitors. The government uses social media as a means of trolling and tries to attack websites and other social media channels.
What sparked recent protests by Eritrean refugees in Israel, and how has the Israeli government responded?
Those protests appeared to have been organised by a new group called Brigade N’Hamedu, which is trying to overthrow the regime. Their members hold demonstrations across the world, and they particularly attack the festivals that the regime holds abroad, which they view as a means of raising funds for the regime and spreading its propaganda. They are tired of government interference and intimidate Eritreans who have left their country but still support the Eritrean government. They want all Eritreans who claim asylum but express support for the Eritrean government to have their asylum revoked.
This is a movement of young Eritreans but a lot of veterans and older members of the community support them, as they see them as the most plausible means of removing the regime. Although they have succeeded in mobilising Eritreans, however, there seems to be no clear strategy and this could be a stumbling block. They are very unlikely to succeed.
In response to these protests, and using their unprecedented violence as an excuse, Israeli Prime Minister Benjamin Netanyahu said that he wants all Eritreans removed from Israel. The predicament of Eritreans in Israel was already dire, but this has now opened the doors for the far-right government in Israel to deport all Eritreans. However, the UN, Israeli human rights groups and other human rights groups outside Israel are asking that genuine refugees whose lives are at risk not be deported to Eritrea.

Eritrea: a real challenge to the UN system and the international community
Statement at the 52nd Session of the UN Human Rights Council
Enhanced Interactive Dialogue on human rights situation in Eritrea

Thank you, Mr President,
Despite being elected to the UN Human Rights Council for the period 2022-2024, Eritrea poses a real challenge to the UN system and the international community. Its continued failure to fully cooperate with the Special Rapporteur’s mandate and implement the recommendations of human rights bodies calls the credibility and integrity of the entire UN human rights system into question.
We remain deeply concerned by reports of unlawful and arbitrary killings, forced disappearances, torture and arbitrary detentions perpetrated by the Eritrean government, indefinite military service, lack of freedom of expression, opinion, association, religious belief, and movement.
Over 20 journalists and politicians remain in detention since their arrests more than 20 years ago, they are the longest detained persons in the world. Eritrea’s involvement in the Tigrayan conflict significantly resulted in abhorrent human rights abuses which included the recruitment of child soldiers and the kidnapping and forced conscription of Eritreans to fight in the conflict.
We call on the Eritrean government to release all detained journalists, civil society activists and illegally detained Eritreans from prison.
Special Rapporteur, what should the Council do to ensure steps are taken towards meeting the five benchmarks for progress recently enshrined in the Human Rights Council’s resolution 50/2?

Interactive Dialogue on the Report of the UN Special Rapporteur on the Situation of Human Rights in Eritrea

CIVICUS and the Eritrean Movement for Democracy and Human Rights welcome the Special Rapporteur’s report and engagement with the mandate.
Eritrea’s government remains one of the world’s most repressive. It has no independent civil society organisations or media outlets, imposing severe restrictions on freedom of expression and opinion, peaceful assembly, association and religion or belief. Eritrean forces have been implicated in violations in Ethiopia’s Tigray region.
Both the High Commissioner and Special Rapporteur report a lack of progress, and still the government remains unwilling to address grave human rights violations and abuses. This is particularly concerning given that Eritrea is a Member of this Council.
Human rights violations continue unabated including arrests and incommunicado detention and enforced disappearances. The indefinite national service continues and involves torture and forced labour. In late 2020, Eritrean forces indiscriminately attacked civilians in Axum in the Tigray region, killing and injuring many, and destroyed property including healthcare facilities.
We urge the Council to adopt a resolution renewing the mandate of the Special Rapporteur, and to mandate reporting on the role played by Eritrean forces in Ethiopia’s Tigray region since November 2020. We ask the Special Rapporteur: in the continued absence of cooperation by Eritrea, what other avenues for international pressure could be leveraged to engender progress?

Eritrea: renew vital mandate of UN Special Rapporteur

Excellencies,
In 2020, the UN Human Rights Council maintained its scrutiny of Eritrea’s human rights situation. Since no progress could be reported in the country, the Council considered that monitoring of and reporting on the situation was still needed.
As Eritrea completes its first term as a Member of the Council (2019-2021), its Government shows no willingness to address the grave human rights violations and abuses UN bodies and mechanisms have highlighted or to engage in a serious dialogue with the international community, including on the basis of the “benchmarks for progress” identified by the Special Rapporteur in 2019. Furthermore, Eritrean forces are credibly accused of being responsible for grave violations in Ethiopia’s Tigray region, some of which may amount to crimes under international law, since the beginning of the conflict in November 2020.
Scrutiny of Eritrea remains vital. At the 47th session of the Council (21 June-15 July 2021), we urge your delegation to support the adoption of a resolution extending the mandate of the Special Rapporteur on the human rights situation in the country for a further year. In addition to ensuring that Eritrea’s domestic situation remains subject to monitoring and public reporting, the resolution should include a request on the High Commissioner for Human Rights to report on the role played and possible violations committed by Eritrean forces in Ethiopia’s Tigray region since November 2020.
While welcoming the adoption of resolutions 41/1 and 44/1 under the Council’s agenda item 2, many non-governmental organisations cautioned that any shifts in the Council’s approach should reflect corresponding changes in the human rights situation on the ground.
Regrettably, the concerns expressed in a joint civil society letter published last year remain valid. Key human rights issues in Eritrea include:
- Widespread impunity for past and ongoing human rights violations. Arbitrary arrests and incommunicado detention continue unabated, as do violations of the rights to a fair trial, access to justice and due process, enforced disappearances, and lack of information on disappeared persons. For instance, the fate and whereabouts of Ciham Ali Ahmed, an Eritrean-American citizen who in 2012 was thrown into indefinite detention aged 15 for attempting to flee the country because her father, a government official, defected, remain unknown.
- Conscription into the country’s abusive national service system. Secondary school students, some still children, continue to be conscripted in their thousands each year, including amidst the pandemic. Indefinite national service, involving torture, sexual violence against women and girls, and forced labour, continues. Thousands remain in open-ended conscription, despite the 2018 peace accord with Ethiopia. Those who joined the national service in 1994 have not been demobilised, and they are still conscripts 27 years later.
- Restrictions on the media and media workers. A free and independent press continues to be absent from the country and 16 journalists remain in detention without trial, many since 2001.
- Severe restrictions on civic space. These restrictions result in Eritrean citizens being largely unable to exercise their rights to freedom of opinion and expression, peaceful assembly, association, and religion or belief.
On 24 February 2021, in his first address to the Council, the Special Rapporteur on Eritrea, Dr. Mohamed Abdelsalam Babiker, indicated that he had seen “no concrete evidence of progress or actual improvement in the human rights situation in the country.” He added that “Eritrea has not yet put in place an institutional and legal framework to uphold minimum human rights standards in a democratic society. The country lacks rule of law, a constitution and an independent judiciary to enforce the protection of and respect for human rights […].”
On 26 October 2020, his predecessor, Ms. Daniela Kravetz, highlighted that two years after the peace agreement with Ethiopia and the lifting of UN sanctions, she could only note that severe restrictions on civil liberties remained in place and lament a “lack of meaningful and substantive improvement” in relation to the benchmarks for progress she identified.
On 26 February 2021, High Commissioner Michele Bachelet stressed that she “remained concerned by the lack of tangible progress” in the country and was “disturbed by reported abductions and forcible returns of Eritrean refugees living in Tigray – some reportedly at the hands of Eritrean forces.”
Since November 2020, these and other independent experts and UN actors have expressed deep concern over the involvement of Eritrean forces in the conflict affecting Ethiopia’s Tigray region. The violations reported include violations of Eritrean refugees’ rights, including possible killings, abductions, and forced return to Eritrea, as well as atrocity crimes against civilians.
In early 2021, Amnesty International reported that on 28-29 November 2020, Eritrean troops fighting in Tigray systematically killed hundreds of unarmed civilians in the city of Axum, opening fire in the streets and conducting house-to-house raids in a massacre that may amount to a crime against humanity. Human Rights Watch also reported on how Eritrean and Ethiopian forces indiscriminately shelled Axum, killing and wounding civilians, shot civilians, and pillaged and destroyed property, before the Eritrean forces fatally shot and summarily executed several hundred residents, mostly men and boys, over a 24-hour period.
UN actors, including the Secretary-General, Mr. António Guterres, and the Head of the Office for the Coordination of Humanitarian Affairs (OCHA), Mr. Mark Lowcock, called on Eritrean troops to leave Tigray. Mr. Lowcock added that “countless well-corroborated reports suggest [Eritrean forces’] culpability for atrocities.” The High Commissioner for Refugees, Mr. Filippo Grandi, also publicly expressed concern about the safety of Eritrean refugees in Tigray, considering in particular the infiltration of armed actors in refugee camps.
In 2018, the Council invited the Special Rapporteur to “assess and report on the situation of human rights and the engagement and cooperation of the Government of Eritrea with the Human Rights Council and its mechanisms, as well as with the Office of the High Commissioner [OHCHR], and, where feasible, to develop benchmarks for progress in improving the situation of human rights and a time-bound plan of action for their implementation.”
As a Council member, Eritrea has an obligation to “uphold the highest standards in the promotion and protection of human rights” and to “fully cooperate with the Council.” However, the Eritrean Government refuses to cooperate with the Special Rapporteur, and continues to reject findings of ongoing grave violations and calls for reform.
The Council should ensure adequate follow-up by allowing the Special Rapporteur to pursue his work and OHCHR to deepen its engagement with the Eritrean Government. It should also urge Eritrea to meet its membership obligations before the end of its term (31 December 2021) and to engage with the UN human rights system constructively. At the recent 46th session, Eritrea announced its intention to again seek Council membership for a further three-year term. The Council should not reward non-cooperation, but rather maintain scrutiny of Eritrea and hold it to its membership obligations to engage in good faith with Council-appointed mechanisms and take concrete, measurable steps to address the grave human rights concerns repeatedly identified by successive Special Rapporteurs and the High Commissioner herself.
At its upcoming 47th session, the Council should adopt a resolution:
- Extending the mandate of the Special Rapporteur on Eritrea for one year;
- Urging Eritrea to cooperate fully with the Special Rapporteur by granting him access to the country, in accordance with its obligations as a Council Member;
- Calling on Eritrea to develop an implementation plan to meet the benchmarks for progress, in consultation with the Special Rapporteur and OHCHR;
- Requesting the High Commissioner to present an oral update on the human rights situation in Eritrea at the Council’s 49th session;
- Requesting the Special Rapporteur to present an oral update at the Council’s 49th session in an interactive dialogue, and to present a report on the implementation of the mandate at the Council’s 50th session and to the General Assembly at its 77th session; and
- Requesting the High Commissioner to present an oral report on the role played and possible violations committed by Eritrean forces in Ethiopia’s Tigray region since November 2020, at the Council’s 48th session.

ETHIOPIA: ‘Civil society can play a key role in overcoming divisions’
CIVICUS speaks to Yared Hailemariam, Executive Director of theAssociation for Human Rights in Ethiopia, about recent political reforms in Ethiopia, the opening opportunities for civil society and the prospects for further change.
Can you tell us about your background and how the political reforms introduced in Ethiopia since 2018 by Prime Minister Abiy Ahmed have impacted on you?
I used to work for the Ethiopian Human Rights Council (EHRCO), a civil society organisation (CSO) established in 1991 by people concerned about the human rights situation in Ethiopia at that time. This was just after the removal of the military junta and its replacement by the current ruling coalition, the Ethiopian People’s Revolutionary Front (EPRDF). I joined EHRCO as an investigator in 1998, and then came the notorious 2005 elections, which the government rigged and which were followed by violence. There were mass killings in the capital, Addis Ababa, in June 2005, and then my colleagues and I were targeted by security forces and detained several times. One time we were detained for a couple of weeks. After we were released there were more clashes between government security forces and opposition members and supporters. Just before the second round of massacres in November 2005 I left the country to attend a conference in Uganda, and while I was there I found myself in the wanted list, so after that I was in exile.
I returned home in January 2018 for the first time after 13 years in exile. Currently I’m leading the Europe-based Association for Human Rights in Ethiopia, which is an organisation that was working to fill the gap, because Ethiopian civil society was under threat and not able to do any advocacy activities outside the country. They were not able to conduct any research or reach the international community. So some of my colleagues who left the country and I established this association in 2013. We conducted undercover research in Ethiopia, but mostly we have focused on advocacy. I was working mostly at the United Nations (UN) Human Rights Council, the African Commission on Human and Peoples’ Rights and with European institutions. We were doing advocacy together with CIVICUS, the Committee to Protect Journalists, DefendDefenders, Front Line Defenders, Human Rights Watch and other partner organisations. But now we are allowed to go back home.
What are the main differences the political reforms have made for Ethiopian civil society?
In the last 10 years, civic space in Ethiopia was in a very horrible condition but now, following these reforms, it’s seen a really huge change. Civic space has opened widely.
The previous law was very restrictive. It targeted civil society working on rights-based issues, but now CSOs are encouraged. The Civil Society Proclamation, a very draconian piece of legislation, has been reformed, and the process was very open and civil society was respected in it. The new draft accommodated all our concerns. The previous law established an agency that monitored the activities of civil society that was very authoritarian and limited the work of civil society, but that institution has also been reformed. In the new agency there’s a presence of civil society and independent representatives, as well as people from the government. I visited the agency. They are very friendly, very open and work really closely with civil society.
Just a year and a half ago, international human rights organisations were not able to organise any meeting or training activity, or even visit Ethiopia. I’ve now been able to conduct capacity development workshops in Addis Ababa. So, the impression I have is one of huge progress that is very satisfactory for local civil society.
The opening of civic space in Ethiopia can be also a good example for other countries that had followed the bad practices of Ethiopia.
How has civil society responded to the changes?
There is now a lot of activity, including training and workshops, and it’s open to international human rights organisations. They are providing capacity development training and financial and technical support to local civil society, which is also receiving support from donors, embassies and the international community. These opportunities are new. Local civil society can now recover and rehabilitate from its past limitations, and reach the international community, because people can also now travel.
What are the major challenges that remain for civil society?
Because of the impact of the previous laws and because CSOs were labelled as enemies of the state they were restricted in their development, and now they have challenge of getting back to attracting skilled professionals. CSOs have opportunities but they don’t have the capacity to explore and exploit all the opportunities that come to their door. That’s the big challenge. I interviewed some CSOs that don’t know how to prepare a proposal to attract donors and don’t know how to do advocacy. I met some donors who told me that they want to provide support to local civil society but there is shortage of skilled people who can prepare proposals and report back to them at the level they require. Now an election is coming in 2020 and many CSOs want to engage with this process, but even prominent CSOs have told me that they don’t know how to approach donors and how to submit good proposals to get grants.
So there is a huge gap now, and that’s the area where we are trying to support local CSOs to develop skills. There is a need for people from outside. What I’m saying to the international community is that it’s not enough to go there and do training; if they send one or two experts for some months these experts could help strengthen and offer support for some prominent CSOs.
Given that the reforms are emanating from the prime minister, what are the risks that could hinder further reforms?
There are potential dangers. Reform is still at the top level. The prime minister promised to reform the country through a democratic transition and to open up the political space. You can feel that there is a change in the country and there is some political willingness at the top level, but at the same time the regime has huge and very complex bureaucratic structures.
Most government structures, offices and institutions are full of political appointees from parties in the ruling coalition. That makes it really difficult to reform organisations. Even when the central government in Addis Ababa says something or a new law or regulation is adopted, it may not go very deep. Reforms may not go deep through to the bottom of bureaucracy, to the structures. People are starting to complain in public media that the government is saying the right things, reforming the law, appointing new faces to high-ranking positions, but the suffering still continues at the lower level. So, that’s one challenge, and there is still no clear roadmap that shows how the central administration can improve this mess
People who were appointed because of their political affiliation rather than their talents now feel under threat. They fear they may be moved or replaced. So in some regions we have seen that some movements are trying to shift the direction of reform. Some people linked to the old regime are still in control of their regions and are trying to instigate conflicts. They have money and weapons, so they can manipulate regions to instigate ethnic conflicts.
The EPRDF is a coalition of four major parties that are now not united like they were before and are publicly disagreeing. There are tensions between the Amhara and Tigray regional governments, and recently a conflict erupted in the border area between the Amhara and Oromia regions. In the past, these groups acted together because they were fully dominated by the Tigray People’s Liberation Front and the other parties were used as a tool. But now, each of the regional governments considers themselves as effectively a sovereign state so there is competition. Each regional state is recruiting and training militias, such that each region has thousands of fully armed forces.
There is a fear that the administration in Addis Ababa has failed to control these dynamics of conflicts and tension within the ruling coalition that might affect the unity of the country. We don’t know in which direction it will lead us, but there are clear tensions. There is tension between the ruling party members and the different coalition parties, there is ethnic tension, and in each region there are extremist elements, groups that spread hate speech and advocate the removal of other targeted ethnic groups from their region. Ruling parties are also competing and fighting with the extremist groups in their regions. Because of this, the Addis Ababa administration is failing to reinforce the rule of law.
In some regions, the instability is such that there are huge and serious debates about the dangers of holding the election. Some parties are requesting that the election be postponed for at least six months because of extreme elements, and the fear that people will be targeted and attacked and wouldn’t be moved from region to region to mobilise their supporters or open offices. Some parties are restricted from moving and are now only able to work in Addis Ababa, and maybe a few more cities where they are given full security. So, many parties have requested a delay. But on the other side, extreme and ethnic-based parties are requesting that the government conducts the election on its planned dates. They have already declared that if the election day changes, even by one day, they will call for a protest, and that might create more problems. So now the Addis Ababa administration faces a dilemma. If the election is conducted on its time, I’m sure that ethnic nationalist extremist parties that are instigating violence will win seats in parliament. These upcoming days, weeks and months will be a very difficult time for Ethiopia.
What role is hate speech playing in stoking ethnic conflict?
People are living together and still sharing values. In Addis Ababa you didn’t feel it. People are living their normal lives and going about business as usual. It is the elites and their activists who are using social media to spread hate speech instigating ethnic tension, violence and targeting of certain groups of people. They have followers, and when they call some kind of violent action you immediately see that there is a group on the ground that’s ready to act and attack people.
In the last year and a half almost three million people were forced into internal displacement. Ethiopia is now in the 10 highest countries in the world for internal displacement. This has happened in the last year and a half because of ethnic conflicts. Hate speech is spreading easily and very quickly through phones and social media, especially Facebook. Some of the calls for ethnic conflicts are coming from outside Ethiopia, including Europe and the USA.
Now the government is drafting a new law to regulate hate speech, but it’s really hard to tackle.
How can further political reform be encouraged?
We all, especially human rights activists and researchers, including from the international community, need to encourage this reform in many ways. We need to support the strengthening of national human rights institutions, including the Ethiopian Human Rights Commission, and strengthen the capacity of local civil society.
Civil society could play a key role in overcoming divisions, given that political parties and some media are ethnically based. Because civil society is neutral, the international community should focus on strengthening its capacity to play a key role in shaping the behaviour of new generations, who are vulnerable to being used by political elites. Civil society could give broad-based civic education to nurture good citizens who understand their responsibilities.
In short, we need to focus on how to strengthen the capacity of civil society to support the positive achievements and political reforms going on in Ethiopia.
What are the most urgent support needs of civil society?
There are many ways to support local civil society, and not only by providing money. As I said earlier, there is now the possibility to receive funding, but people still need skills to apply for and use these grants. So, in addition to financial support, local civil society needs skill training in various aspects, including in advocacy, research methodologies, monitoring and documenting human rights, and they also need to network, and not only at the national level. They need support to connect themselves to the outside world, to the UN Human Rights Council and other international and regional mechanisms. Local civil society is not able to use these processes well, and some don’t know how to engage with these international mechanisms at all. So, they need the guidance and support of the international community.

ETHIOPIA: ‘For civil society, 2019 has been a new beginning’
In 2019, theNobel Peace Prize was awarded to the Prime Minister of Ethiopia, Abiy Ahmed Ali, “for his efforts to achieve peace and international cooperation, and in particular for his decisive initiative to resolve the border conflict with neighbouring Eritrea.” CIVICUS speaks with Bilen Asrat, Executive Director of the Ethiopian Civil Society Organizations Forum (ECSF), about the prospects for democracy in Ethiopia. Established in 2013, the ECSF is a non-partisan, independent and inclusive civil society body comprising various civil society groups, networks and consortiums operating at the federal and regional levels, focusing on the common concerns and challenges faced by civil society in Ethiopia.
What has been the progress towards democracy in Ethiopia in 2019? Has the space for civil society improved?
During 2019, there have been a lot of changes in the state of democracy and human rights, which has been reflected in a wider space for independent civil society and opposition political parties. Prime Minister Abiy Ahmed was appointed in April 2018 after his predecessor resigned as a result of anti-government protests. Although he was a member of the Ethiopian People’s Revolutionary Democratic Front, the party in power since 1991, Prime Minister Ahmed pledged to reform the authoritarian regime, and repressive terrorism and media laws were repealed. Imprisoned journalists were released and the environment for the media improved. The new government also released political prisoners and legalised opposition parties, some of which had been labelled terrorist organisations and banned. In July 2019, a well-known human rights lawyer was appointed as the head of the Ethiopian Human Rights Commission. Once political change became apparent, a lot of politicians that had been living in exile came back to Ethiopia.
The positive change that started in 2018 has continued. For Ethiopian civil society, 2019 has been a new beginning. In February 2019, the draconian 2009 Charities and Societies Proclamation was amended. This law imposed a lot of restrictions on civil society, especially when working for human rights, democracy and good governance. The new law changed the classification of civil society organisations (CSOs) and only distinguishes between local and international CSOs. It lifted restrictions on funding for CSOs and allowed for the re-entry of international organisations into Ethiopia. The old law stated that organisations receiving more than 10 per cent of their funding from international donors were to be considered foreign international organisations, and could therefore not undertake any human rights-related work in the country.
The scope of action for CSOs has now widened because unlike the old law, the new proclamation does not provide an exhaustive list of the permitted activities of CSOs, so it does not set a limit to the activities that civil society can engage in, except for those that are against criminal law. This is more consistent with the right to the freedom of association, which means that anyone can form an association to pursue any legitimate objectives, without restriction.
Do limitations apply to CSOs promoting LGBTQI+ rights?
The scope of legitimate civil society activities does not include the promotion of LGBTQI+ rights, because this is considered to be against ‘public morals’. Homosexuality is illegal in Ethiopia; it is a crime under the Criminal Code and it is punished with imprisonment. It is also not accepted by the majority of the population, so there is not much of a perspective that the law will change in that regard.
In other words, restrictions do not apply anymore to CSO activities in the areas of human rights and democracy, but the establishment of CSOs to promote the rights of LGBTQI+ people is still not allowed, because they would be promoting an activity that is considered a crime by our Criminal Code.
Was civil society consulted in the process of developing a new law?
Yes, we were consulted. Before the new law was passed, there were several consultations across Ethiopia’s nine regions, and over 1,000 CSOs were engaged in the process. In fact, the initial document for the draft law was produced by civil society itself. We submitted it to the former prime minister and various governmental offices, pointing out the challenges posed by the previous proclamation and recommending specific changes, and eventually it was our recommendations that were turned into law – including for instance the right to appeal against the decisions of the regulatory agency in front of a court of law.
We only have one objection to the new proclamation: we think that the agency that has the mandate to regulate civil society should be accountable to the legislative body, and not to the executive. We expressed this during the consultations, and when the Office of the Attorney General finalised the draft and submitted it to the Council of Ministers, we raised our concerns to parliament. But the government didn’t accept our recommendation and decided to keep the regulatory agency under the executive branch.
How did civil society receive the news that the Prime Minister had been awarded the Nobel Peace Prize?
I think the news was well received. Prime Minister Ahmed got many congratulatory messages from civil society and communities, as the peace processes started to have visible effects both in Ethiopia and in Eritrea. Ethiopian military forces stationed abroad were brought back to the country, laws started changing and hellish prisons where horrible human rights abuses took place were shut down.
I think the Nobel Peace Prize is fulfilling two purposes. First, it is an acknowledgment of the Prime Minister’s contribution to ending the 20-year conflict between the two countries and an encouragement to continue along the peacebuilding path.
Second, the award is an expression of support for the Prime Minister’s project to build a democratic nation, opening up political competition, allowing for the growth of an opposition and a multiparty system, promoting an active civil society, and striving for greater equality. Prime Minister Ahmed has brought women on board: he appointed a cabinet that was 50 per cent female and for the first time a woman was appointed as president of the Supreme Federal Court.
What do you think are the main challenges ahead?
The main challenge is that communities have been unable to exercise their rights and their power for too long, and when all these spaces suddenly open up there is a danger that they will be put at the service of power struggles. Political competition in Ethiopia takes place mostly along ethnic lines, as political parties tend to represent specific ethnic groups, so groups are still competing with each other. Democratisation is moving forward in a context in which conflict persists. There are some states that are still under a state of emergency, experiencing internet blackouts and ethnic clashes. The social situation is also delicate because of the high unemployment and poor economic performance.
What role can society play in overcoming those challenges?
Civil society has a great role to play in bringing democracy to Ethiopia, especially in terms of building peace by establishing dialogue and reaching some form of consensus among religious leaders and local communities. If a certain degree of peace is not achieved internally, democratic elections become impossible. So the first task for civil society to undertake is internal peacebuilding.
Most CSOs are developing these kinds of activities. They are starting to engage, but it’s taking time, because we are still in trauma due to our past experiences. Until very recently civil society was not allowed to work on peacebuilding or reconciliation, and it was a very dangerous thing to do. Over time, most of the experienced people with the right skills for the tasks ahead migrated to the private sector or left the country. This opening is a new phenomenon and to be up to the task we need to reassess the situation, revise our strategic plans, gain new skills and produce training materials.
We are building up our own resilience while trying to engage in these very necessary activities. This is where our allies in international civil society could help us. Ethiopian civil society needs support for capacity building and training, developing advocacy tools and learning about best practices and replicable successful experiences. International organisations could also help us to bring different stakeholders to the discussion and reach a consensus about the democratisation process and the required human rights protections. National elections will be held in August 2020, so we only have a few months to work to ensure elections are a peaceful democratic process.
Would you say the upcoming election will be a key test for the democratisation process?
Yes, because we have not yet had a free and competitive election. Prime Minister Ahmed was appointed by the parliamentary body that resulted from the 2015 election, which was tightly controlled by the ruling party and marred by coercion and intimidation.
In August 2019, parliament – whose current members are all from the ruling coalition – passed a new election law, and opposition parties complained that some of the changes made things more difficult for them and threatened to boycott the election. So the process is by no means without obstacles, and it will be a test for all of us, including for civil society, which needs to work to keep the authorities accountable to the community and make sure that the democratisation process succeeds.
But first and foremost, the election will be a test for the government and the ruling party to keep their promise that if they lose, they will relinquish power. Even before we get to that point, it is already testing their willingness to open up the media space and make sure that fair conditions for competition are met.
Progress is being made in that regard. The Electoral Board now has a new structure and is chaired by a former opposition party leader, a woman, who had been imprisoned and exiled for her political ideology and came back after reforms were initiated.
How hopeful you are about the future?
I believe the best is yet to come. But as civil society, we have a lot of work to do to make it happen. We need to work hard to build a democratic, transparent and accountable system in Ethiopia. We need to keep watching and make sure the government remains committed to protecting democracy and human rights. We need to watch closely and make sure it includes women’s issues in their agendas. We expect these elections to be the most democratic and peaceful that we have ever had, with more female candidates than ever before, and we expect the losing and winning candidates to shake hands and accept the people’s will.
I also think this change has happened because of the sacrifices many people have made. Many people have died for this to happen. Now it’s time to use only our hearts, not weapons, to achieve change. We will not be able to do all of this by ourselves, so we need solidarity and support from regional and international organisations. An authoritarian regime could be held together in isolation, but democracy will need a lot of help to grow and survive.

ETHIOPIA: ‘The June 2021 election is between democratic life and death’
CIVICUS speaks to Mesud Gebeyehu about the political conflict in the Tigray Region of Ethiopia and the highly contested upcoming Ethiopian national election, scheduled to take place in June 2021 amidst an ongoing pandemic and a continuing state of emergency. Ethiopia: Stop violence against protesters and lift internet restrictions
(Johannesburg 2 July 2020) CIVICUS calls on the authorities in Ethiopia to stop using violence to disperse ongoing protests and to lift internet restrictions that have been imposed across the country.
At least 80 people have been killed since protesters started demonstrating against the brutal assassination of prominent musician Hachalu Hundessa on 29 June 2020. Hachalu, whose songs reflected the challenges of the Oromia people during anti-government protests from 2014 to 2018, was killed by unidentified gunmen in Addis Ababa.
“The Ethiopian authorities have a long history of using brutal force to quell protests, and the ongoing repression of protesters has once again opened divisions and provoked violence among the different ethnic groups. The shutting down of the internet and arrest of prominent political figures bring back memories of the human rights violations perpetrated by previous governments. The authorities should lift restrictions on the internet and implement UN guidelines on managing protests to avoid a further escalation of violence,” said Paul Mulindwa, Advocacy and Campaigns Officer, CIVICUS.
Background
More than 80 people have been killed as protesters condemn the killing of popular musician Hachalu Hundessa. The Ethiopian government has failed to provide assurances that those responsible have been identified and will be brought to justice. The number of deaths may be higher as internet restrictions imposed by the authorities in cities affected by the violence make it impossible to obtain credible information on the extent of the unrest. Prominent political figures, including former political prisoner and journalist Eskinder Nega, have also been arrested. CIVICUS is concerned that the government’s violent response may intensify this volatile situation.

European States and US must take measures to protect Egyptian human rights defenders, both home and abroad
The undersigned civil society organisations express their outrage at the latest death threats targeting the Director of Cairo Institute for Human Rights Studies (CIHRS), Bahey el-Din Hassan, as a result of his human rights work on Egypt in Europe and the US. On 21 March 2018, in reaction to a memo sent by seven Egyptian independent human rights groups, including CIHRS, to the UN Secretary-General regarding the presidential elections in Egypt, a TV show host called on the Egyptian authorities to “deal with him [Bahey el-Din Hassan] the same way the Russian spy was dealt with,”[1] in reference to the nerve agent attack on Serjei Skripal in the United Kingdom.
Given the gravity of these threats against Bahey el-Din Hassan, the undersigned organisations call on the European States and the United States to:
1. take all necessary measures to protect Egyptian human rights defenders (HRDs), both home and abroad, and
2. to urge the Egyptian authorities to carry out immediate, thorough and impartial investigations on these threats. HRDs should be able to engage with regional and international human rights systems without fear for their lives. Support for HRDs is a stated priority of EU, Swiss, Norwegian and US foreign policies, and lies at the heart of the 1998 UN Declaration on HRDs.
CIHRS is an indispensable and internationally recognised organisation, which has been a champion of human rights across the Middle East and North Africa for over 20 years.
These events not only constitute the latest example of the harassment that Mr Hassan has faced in the last years, which forced him into exile in 2014 following the election of President el-Sisi, but also represent an extremely worrying pattern of reprisals against HRDs in Egypt and many other parts of the world.
While pro-democracy activists in Egypt are being jailed for expressing their views on social media, these repeated and serious incitements on television calling to inflict physical harm against Bahey el-Din Hassan as well as other HRDs have not been adequately addressed by the Egyptian authorities. Amidst an unprecedented crackdown on human rights and civil society, together with a soon-to-be implemented draconian NGO law, the Egyptian authorities appear determined to silence HRDs by any means, including instructing security services and State-sponsored media to intimidate them in Egypt and abroad.
Egyptian NGOs already witnessed this kind of harassment during a human rights workshop in Rome in May 2017, when two persons pretending to be Egyptian journalists intimidated and took pictures of the Egyptian participants. Subsequently, a smear campaign was launched in Egypt where Moustafa Bakry, a political figure closely associated to President Abdel Fattah el-Sisi and a member of the pro-Sisi parliamentary bloc, stated on his TV show that the Egyptian security agencies should “kidnap” Egyptian human rights defenders, including Bahey el-Din Hassan, from Europe and bring them back to Egypt “in coffins”,[2] reminding them that this had been done in the past.

Bahey el-Din Hassan is a journalist, he has published articles in The New York Times and The Washington Post. He is a leading initiator of the human rights movement in Egypt and the Arab region, director and co-founder of CIHRS, and a member of the boards and advisory committees of several international human rights organisations, including the Euro Mediterranean Foundation of Support to Human Rights Defenders (EMHRF), Human Rights Watch (HRW) Middle East and North Africa Division, and the International Center for Transitional Justice (ICTJ). Hassan is also one of the founding members of EMHRF and EuroMed Rights.

CIVICUS and our CSO partners in South Sudan thank the Commission on Human Rights in South Sudan for their comprehensive report. We welcome this crucial scrutiny, currently the only way in which human rights in South Sudan can be examined.
While we welcome the formation of the Unity Government provided for in the Revitalised Peace Agreement, we are seriously concerned that key areas of this agreement have stalled, particularly around governance and security sector reform, posing severe threats to the peace process. The country continues to face major governance, security, and humanitarian issues. Violence continues in regions across the country, destabilising safety and livelihoods.
The human rights situation in South Sudan remains dire and continues to worsen. Civic space is closed, with restrictions on freedom of speech, expression, peaceful assembly, and association. Independent and critical voices are targeted with arbitrary arrest and detention, sexual violence, torture and other cruel, inhuman or degrading treatment. With pervasive surveillance of journalists, activists, and human rights defenders by security operatives, these amount to attempts to deliberately and systematically terrorise such voices into ceasing their work.
We urge the Council to ensure the continuation of the mandate of the UN Commission on South Sudan and extend the Commission’s mandate further and in full. We call on the government of South Sudan to fully implement Revitalised Peace Agreement.

Freedom Day: more needs to be done to stop killings of LGBTQI+ people in South Africa

It has been almost thirty years since Freedom Day was first introduced in South Africa but still the fundamental freedoms of many people are being curtailed - particularly the rights and freedoms of people within the LGBTQI+ community. On Freedom Day, global civil society alliance CIVICUS would like to draw attention to these brutal murders by calling on the South African government to guarantee the safety and protection of all LGBTQI+ members in the country, as enshrined in the constitution.
There has been a recent spate of violent attacks against LGBTQI+ people and at least 6 known murders in the last few months. Gay man Lonwabo Jack was sexually assaulted and stabbed on his 22nd birthday in mid-April. A few weeks before this attack, 34-year old Sphamandla Khoza was brutally stabbed to death in his hometown of Ntuzuma, KwaZulu-Natal, while 40-year-old Andile “Lulu” Ntuthela was butchered and dumped in a shallow grave in Uitenhage, the Eastern Cape.
South Africa has been lauded as a champion for LGBTQI+ rights in the continent because of its progressive legal framework that recognises same sex marriage and full equality for everybody. However, in reality the situation of LGBTQI+ rights has been deteriorating, with LGBTQI+ rights campaigners and individuals living and operating in a hostile environment characterised by hate speech, death threats and killings.
On Freedom Day, to make freedom and equality a reality for the LGBTQI+ community across the country, CIVICUS is calling on the South African government to:
- Guarantee the safety and protection of all LGBTQI+ members in the country as enshrined in the constitution;
- Conduct independent investigations into all cases of those killed and bring the perpetrators to justice;
- Fast track the implementation of the Hate Speech and Hate Crimes Bill;
- Invest in gender sensitisation workshops for rural communities to foster harmony and understanding of the LGBTQI+ community;
- Appoint an LGBTQI+ rights expert to monitor the situation of LGBTQI+ rights defenders in South Africa, and ensure an enabling environment for LGBTQI+ rights organisations and human rights defenders to operate.

Fundamental civic rights have deteriorated across Africa in 2020 - CIVICUS report finds

Gabon government goes after civil society and opposition members for failed military coup, raising concerns

Global civil society groups are concerned at indications by the government of Gabon that it intends to investigate local civil society organisations and members of the political opposition for their involvement in the recent military coup attempt.
A small group of Gabon army soldiers seized control of the country’s national broadcasting station in the capital, Libreville, on January 7 and announced a political takeover and the setting up of a National Restoration Council to oust President Ali Bongo. The coup was thwarted after security forces stormed the building, killing two of the soldiers involved in the operation. Eight plotters have been arrested. A day after the failed coup, the government shut down the internet nationwide and suspended broadcasting services.
There are concerns that the Gabonese authorities might use the failed coup as a pretext to clampdown on fundamental rights to freedom of assembly, expression and association and tighten its grip on the media.
Amid heightened political tensions, global civil society alliance, CIVICUS, has expressed serious concern at comments by government spokesperson Guy-Bertrand Mapangou that certain opposition parties and civil society would be investigated for supporting the coup.
“We urge Gabon not to target individual human rights defenders or civil society but to instead increase the space for fundamental rights to be enjoyed by all Gabonese,” said Teldah Mawarire of CIVICUS.
“What Gabon needs is democratic reform and the respect of the rule of law – virtues which have been absent from the country for half a century,” Mawarire said.
The Internet shutdown has also sparked concern, as a violation of the freedom of citizens to express themselves freely and to impart and receive information without hinderance. CIVICUS has urged the Gabonese government to ensure that fundamental freedoms are respected, in the wake of the coup attempt.
President of Gabon, Ali Bongo has been away receiving medical attention in Morocco since last October. He succeeded his father Omar Bongo in 2009 in a contested election in which the opposition alleged electoral fraud. The Bongo family has ruled Gabon for 51 years. There has been an increase in restrictions on fundamental freedoms since a contested 2016 elections characterized by a media blackout, the killing of protesters, widespread arrests and intimidation and harassment of journalists.
Last November, the authorities suspended the newspaper L’Aube for three months for publishing an article about the president’s health. The publication’s editor was banned from practicing journalism for six months. The same month, in a move widely criticized by civil society as being unconstitutional, the Constitutional Court amended the constitution to accommodate the absence of President Ali Bongo. Gabonese Civil society groups argued that the mandate of the Constitutional Court was limited to interpreting the constitution and not to change it.
The CIVICUS Monitor, an online platform that tracks threats to civil society in all countries, has rated civic space – the space for civil society – in Gabon as “Repressed”. This means that civil society organisations there operates under serious restrictions, which impede their ability to speak out on or protest any issue of concern to them.
Following the attempted coup, the African Union (AU) commendably and swiftly condemned the action and urged a return to the rule of law. However, the AU has been encouraged to apply the same urgency to address the longstanding repression of fundamental rights by the Gabonese state.
